Why does the last name change?

The surname is part of the status of a citizen, which is an indispensable and obligatory attribute. People carry out all legally significant actions, sealing them with their last name and first name (except for cases of using a pseudonym, which are established by law). A surname is given to a person at birth. However, this part of individuality is not immutable; the surname can be changed in accordance with the procedure established by law. The law provides for 3 possible reasons for this.

  1. When changing marital status . When starting a family or divorcing a marriage, one or both spouses have the right to change their surname, and take any of the two surnames they want, or a double one consisting of both surnames. You cannot take a double surname if at least one of them already has a compound surname. Divorce provides grounds for returning the previous surnames or keeping the current ones.
  2. For a child when changing the parent's surname . If one of the parents of a child under 14 years of age changes his last name for some reason, or a parent with a different last name enters the child’s life through adoption, the guardianship authorities, at the request of the parents, may decide to transfer the child to a new last name. If both parents change their surname at once, the child will be changed without asking his wishes. If the father’s name changes by law, then the baby’s middle name will be changed without fail, without the right to choose (Part 3, Article 62 of the Federal Law “On AGS”).
  3. At the request of the citizen . Any Russian citizen who has reached the age of 14, who has or is receiving a passport for the first time, can change his last name by expressing his desire and justifying the reason. The registry office at the place of birth, having received such an application, will consider which acts will have to be amended, and if these changes do not violate the law, permission to change personal data will be given.

For foreigners

It’s hard to believe, but in modern Russia, foreign citizens can also enjoy free medical care. This is a fairly common occurrence.

In order for a foreigner to reissue a document for free medical care, it is necessary to present the previously specified papers. Their list varies depending on life circumstances.

We are changing SNILS - but what are we actually changing?

SNILS is just an eleven-digit code indicating a personal account in the Pension Fund, assigned to a citizen upon his first application for registration. Therefore, any replacement means issuing a new plastic card, an insurance certificate for compulsory pension insurance, also called SSOPS. Personal data may change on it, but not the number, which is an identification number in the Pension Fund of Russia system.

IMPORTANT! Due to the fact that the number is single and assigned for life, it is better to have it written down or copied on additional media in order to use it in cases where you need to restore or replace the SSOPS card, which takes time.

Policy characteristics

What is a compulsory medical insurance policy? This is a document that can be presented in different ways - with a plastic card or a small bluish sheet. It allows you to receive free medical care throughout the Russian Federation. For example, undergo medical examination at local clinics.

  • date of birth of the citizen;

Why change SNILS when changing your last name?

In connection with changing your last name, you need to clarify the information in the Pension Fund database. If an employee received a new last name, but is listed in the Pension Fund under the old one, that is, did not change his SSOPS, then payments transferred from salary to his future pension may be “stuck”, as they will not find their addressee.

Procedure for changing SNILS

This is a fairly simple and quick procedure, for which you will need:

  • old SSOPS card or statement of its loss (the card must be destroyed);
  • a passport containing the new surname;
  • the document on the basis of which it was changed (marriage certificate, decision of the registry office).

These documents must be presented to the Pension Fund (any branch) or to your employer.

Next, an application for exchange of the insurance certificate is written - a special form is filled out in the ADV-2 form. You need to fill out the following items correctly:

  • SNILS number;
  • old full name;
  • changes in personal data (if only the last name has changed, then the first and middle names do not need to be re-entered);
  • gender of the SNILS owner;
  • registration address by place of residence;
  • actual place of residence;
  • details of the new identity card (passport with a new last name);
  • date and handwritten signature of the SNILS owner.

If your employer changes SNILS, he will need to draw up an inventory of documents in the ADV-6-1 form.

NOTE! If an employee is absent (on a long business trip, on vacation, on sick leave), and SNILS needs to be replaced urgently, the employer can initiate this procedure himself using a notarized power of attorney.

You can independently obtain a ready-made SSOPS card with new data from the Pension Fund upon presentation of a new passport or from your employer by signing a special statement.

Deadlines

Some important documents, such as those that prove identity, require immediate replacement. The first to be reissued is the civil passport, and a month is allotted for this. The owner of the insurance is not limited in time and can renew it at any time.

In practice, medical institutions do not refuse to provide medical services due to a discrepancy between the last name in the passport and the insurance contract. However, there is no point in delaying the replacement. How long does it take to change health insurance?

The rules of compulsory health insurance stipulate that the maximum period for obtaining insurance cannot exceed the validity period of the temporary certificate. It turns out that you can receive insurance with new data no later than 30 days from the date of submission of the application.

Replacing SNILS for a child

If the surname was changed for a child under 14 years old, there is no need to perform any actions with SNILS, because the number will not change, and he will be issued a SSOPS card at 14 years old. By that time, he will have his own passport with his current surname, for which the insurance certificate will be issued.

A 14-year-old teenager has the right to change SNILS independently, because he already has his own identity card. The procedure for this will be exactly the same as for adults.

Manufacturing and receiving

In order to obtain a compulsory health insurance policy, you should contact the office of the company where the documents for its replacement were provided. When applying, you must submit a temporary certificate issued as health insurance, as well as present a document that can confirm your identity. The SNILS system itself is aimed at reducing bureaucratic errors and delays. Therefore, the issuance and replacement procedure is simplified and accelerated as much as possible. Unfortunately, there are some nuances that ordinary citizens have to deal with today. What to do in such cases?

  1. The employer refuses to replace SNILS . Despite the fact that it is the direct responsibility of the employer to provide employees with SNILS, in practice, HR department employees do not want to take on additional work and send the employee to the Pension Fund to independently obtain SNILS or replace it. If this happens, you can complain about negligent personnel officers to the appropriate branch of the Pension Fund (this is also permissible by telephone). Of course, this will somewhat aggravate the relationship with the employer, but that’s another story.
  2. They are sent to the Pension Fund at the place of registration . The pension fund branch can be selected according to the place of actual residence, and not just registration, because the data accounting system in which SNILS is registered is the same for all of Russia (Part 2 of Article 7 of the Law “On Accounting in the Compulsory Pension Insurance System”). An exception is made for individual entrepreneurs - they must contact the branch of the Pension Fund of the Russian Federation to which they belong based on registration as policyholders.
  3. Employment is denied due to incorrect data in SNILS . An employer does not have the right to refuse to register an employee for work if he does not have a SNILS or it contains incorrect passport data. Yes, SNILS will need to be changed, and the employer himself is obliged to do this within a month after employment.
  4. A replacement for SNILS cannot be issued through the government services website . Unfortunately, this procedure has not yet been activated on the government services portal, despite the fact that almost half of all citizens’ requests to the Pension Fund are related to the registration or replacement of SNILS.

How to change compulsory medical insurance company

Replacement of the insurer is carried out through a personal application or with the involvement of an authorized representative. The role of the latter is often played by the employer, but trustees are also not uncommon. The list of persons who can replace the compulsory medical insurance policy is given in Art. 16 Federal Law No. 326. When collaborating with a trusted person, you will need to draw up a power of attorney, which will confirm the fact of registration of the insured person in a specific health insurance company. The law does not establish a clear form for such a document; notarization of the power of attorney is also not required.
