Where and how to obtain a cadastral passport of a land plot?

To become the full owner of real estate, you must go through the state registration procedure. State cadastral registration is carried out by entering detailed information about real estate into the State Cadastre. If you want to sell an apartment, draw up an exchange agreement, or use it as collateral when obtaining a loan from a bank, you cannot do without the following documents:

  • A drawn up agreement that records the transfer of ownership;
  • Passport;
  • Cadastral passport;
  • Technical certificate.

Other documents may be required depending on the case. A cadastral passport for an apartment is a unitary document of state standard, created on the basis of the actual properties and characteristics of a real estate property. In brief form, the document contains the following information:

  • A unique identifier number assigned by the Cadastral Chamber;
  • Address of the apartment;
  • Date of registration of the apartment with the local state cadastre;
  • What kind of property is this?
  • Characteristics and properties of the apartment (living area, floor plan, availability of communications, is there a balcony, common and living space);
  • Information about the owner of the apartment;
  • Graphic information about the layout.

Receiving a cadastral passport is another proof for the owner that he really has the full right to own and dispose of real estate at his own discretion. Due to the presence of the received cadastral number in the cadastral passport, this once again proves that the registration procedure has been completed in Rosreestr, as well as the fact that such an object exists and has the properties and characteristics specified in the cadastral passport. Let us remind you that the date of state registration is the date of entering data into the Unified State Register. Without this stage, even if there are purchase and sale agreements or receipts, the owner is not the full owner of the apartment, he cannot sell it, receive a cadastral passport, use it as collateral, and cannot obtain registration at his place of residence. Many people do not know what a cadastral passport for an apartment is and why it is needed. In this case, a consultation at the Star-Service Cadastre and Registration Center will help you, where you can receive qualified assistance in completing real estate transactions.

Obtaining a cadastral passport - why and who needs it?

Currently, the State Cadastral Registration of Real Estate bodies are undergoing active reform. According to the new procedure for registering property rights, a cadastral passport is a mandatory document; without it, no real estate transaction can be carried out. This is a government strategy necessary to fill the Unified State Register. This database stores information about all registered real estate properties in the Russian Federation, including garages, plots, dachas, private houses, industrial facilities, as well as properties with shared participation.

To obtain a cadastral passport for an apartment, you should apply to the Cadastral Chamber, a multifunctional center or the Star-Service Cadastre and Registration Center. Also, as part of the reform of the state registrar, an information platform was launched in the form of the Rosreestr website, through which you can also provide all the necessary documents and issue a passport.

What should the statement look like?

The cadastral extract of a plot of land covers 6 sections.

The first three contain material identical to pages KP1, KP2 and KP3.

On KV4 there is graphic material about the land plot with the definition of specific data on angles and turns.

On page KV5 there is a descriptive part specifying the boundaries of the territory, as well as the numbers of adjacent plots.

KV6 includes information about turning points with coordinates and special marks.

Who can get it?

Despite many myths and misconceptions, a cadastral passport can be obtained by any citizen of the Russian Federation who has reached the age of majority and has submitted the appropriate application to the cadastral chamber, the MFC, or contacted the Star-Service Cadastre and Registration Center. This procedure confuses many, but freedom of access to information has solved a lot of problems. Firstly, a potential buyer can see in advance what the cadastral passport for the apartment contains. This reduces risks and allows you to verify all entered information. Secondly, only the owner of the property can make any changes to this document.

Registration procedure:

  1. The first step in obtaining a cadastral passport for an apartment is a written application to any of the above registrars. The procedure and speed of registration does not depend on where the application was written, with the exception of contacting the Star-Service Cadastre and Registration Center, through which you can order a cadastral passport via the Internet in just a few days (instead of the 14 days provided for by the Law). The applicant must provide a passport and pay the state fee. If you want to receive a new cadastral passport after redevelopment or to enter new data into the document, you may need to call a surveyor (BTI employee). If the cadastral passport was lost for some reason, the registration authorities must also be notified about this.
  2. The required package of documents is individual for each specific case and is announced by employees of the Cadastral Chamber or the FMC. In most cases, if third parties want to receive a passport for an apartment that interests them, just a passport of a citizen of the Russian Federation is enough. If information is entered after redevelopment, permission from the SES, a court order, or permission from the BTI may be required. The procedure for commissioning apartments in new buildings and obtaining a cadastral passport for them is also different. In these cases, it is necessary to provide title documents, as well as commissioning acts, a transfer deed or a purchase and sale agreement with the developer.
  3. In some cases, after redevelopment and the need to make changes to the cadastral plan of the apartment, it is also necessary to provide a technical passport (these are different documents and they contain different information).
  4. It is necessary to provide the original receipt of payment of the state fee for receiving the service by the Cadastral Chamber (200 rubles). The fee is paid at any bank cash desk; non-cash transfers are allowed; you can contact the cash desk directly at the Cadastral Chamber.
  5. An important point is the stage of checking all documents. Initially, an employee of the Cadastral Chamber will check whether all documents have been submitted according to the protocol, and their correctness of execution is checked over the next 5 days, which, according to the Law, are allocated for the issuance of a cadastral passport. Looking ahead, it is worth clarifying that quite often the norm established by law of 5 working days is delayed. Therefore, it is better to contact lawyers who will check the correctness of the documents before submitting them to the Cadastral Chamber.

After you have handed over all the documents to the employee, you must receive a receipt stating that the documents have been transferred in full to the state registrar. Check the list carefully, as this will be your only evidence if the document is lost. To obtain a ready-made cadastral passport, you must take a receipt and a passport of a citizen of the Russian Federation. Employees usually agree on a preliminary date for document execution, but it may change.

Also, registration of a cadastral passport can take place through a principal. In this case, the procedure does not differ from the established procedure for owners and third parties, with the only exception that a notarized power of attorney is required.

What is

This document confirms the owner's right to own the land. If for some reason it is missing from the documentation, then this gap must be filled without fail. Otherwise, no manipulations with real estate will be possible. It is necessary when drawing up a purchase and sale agreement, for transferring land by inheritance, when planning construction work, when leasing and taking out insurance. The form is an extract from the Unified State Register of Real Estate and includes all important information about land ownership:

  • exact address, unique cadastral number and cost, total area, type of permitted use, survey boundaries and date of entering the number in the State Cadastre;
  • diagram;
  • information about the encumbrance, if any;
  • a description of the land holding, taking into account all its boundaries, with an exact indication of the size and angles.

Validity period of the cadastral passport for the apartment

In fact, the Law does not clearly indicate the validity period of the document. BTI bodies regularly carry out forced inventories of real estate (once every 5 years). If, after such a check, discrepancies between the actual layout and the information from the cadastral passport are identified, this may entail fines. Make all changes to the cadastral passport on time and do not carry out uncoordinated redevelopment. The Star-Service Cadastre and Registration Center will help speed up the receipt of a cadastral passport, and will also provide legal support for real estate transactions of any complexity.

What to do if information about the land plot is not in the cadastre?

If there is no information about the plot in the cadastre, then you need to come to the MFC at the location of the plot and submit documents:

  • Passport
  • Documents confirming ownership of the land.
  • A notarized power of attorney in the case when documents are submitted by a representative.

After information about the land plot and the legal owner is entered into the database, it will be useful to make a land survey so that it can be entered into the cadastre. To do this, create a boundary plan in advance, which includes:

  • A copy of the passport (data on all pages, including registration and citizenship);
  • Proof of ownership or use
  • General plan and other information documents
  • Linking the earth to coordinates and how the measurements were taken
  • Acts of coordination of site boundaries with neighbors
  • Conclusion of a cadastral engineer

How to read it?

Not everyone is able to understand all the information contained in the passport. To do this, you need to carefully read the document and its main sections.

The document must contain the following information:

ItemsCharacteristic
Cadastral valueIt is used to calculate land tax. To determine it, averaged parameters are taken into account. If it is significantly higher than the market value, you have the right to conduct an independent examination and appeal to the district court.
LocationThe full address is indicated here. If it is impossible to indicate it in full, guidelines are included in the document. In some cases, employees of the Cadastral Organization draw up a detailed description of the route to the site.
Owner informationThey must exactly match the passport data from your civil passport. There should be no errors in them.
Description of boundariesIt is carried out in accordance with the boundary plan. If land surveying has not been carried out, boundaries will not be established. To obtain this document, you will have to call a cadastral engineer who will take the appropriate measurements.
Cadastral numberIt allows you to identify the area. If the CP is lost, it can be easily restored using this number.

From January 2021, changes to the Federal Law “On the State Real Estate Cadastre” regarding mandatory land surveying will come into force. Now any owner is obliged to carry out land surveying. If you do not do this, you cannot donate the land, sell it, or prove your case regarding the boundaries of your own territory in court.

Study all sections of the document. There should be no errors in your passport data and information about the site. If they are found, you need to submit a request to Rosreestr to make corrections. If there is disagreement with the amount of tax, the cadastral value of the land plot is assessed. Its results allow you to make corrections to the information.

What is this document and why is it needed?

When studying the data on why a cadastral passport is needed, it is worth understanding what lies behind this name.
The fact is that, out of habit, this is the name given to an extract received in the Unified Register, which contains the complete data necessary for carrying out any real estate transactions. The completeness of information and the list of characteristics that will be reflected in the passport depend on the type of real estate it describes. It is logical that the characteristics of a private estate will differ significantly from the parameters of an apartment. Looking through the information that is now available instead of a cadastral passport, it is worth considering that the extract can be of several types, depending on the purpose:

  • for land plots;
  • non-residential, residential premises;
  • garages and parking spaces;
  • apartments;
  • unfinished buildings.

Any real estate must be registered in the State Cadastre

, it will be assigned a unique number. The code will tell the specialist what type of real estate the property belongs to and in what location it is located.

This approach to real estate accounting allows you to avoid all kinds of discrepancies and eliminate the possibility of errors during operations. When clarifying what the cadastral passport contains, it is worth noting that the table of contents of the document will allow you to quickly find the necessary data.

Where can I get an extract from the Unified State Register of Real Estate and can it be done for free?

EGRN extracts are not issued free of charge. You can obtain an extract online through the Rosreestr website or by personally contacting the MFC.

The deadline for issuing the document is 24 hours if online through Rosreestr. If you need a physical document, then up to 7 working days.

The electronic format of the document will not have the signature and stamp of the issuing institution. Therefore, if you need an extract not for review, but for submission to some authority or for a transaction, you need to order a paper document.

How to find out if it is in stock

Many owners don't know if they have a CP. If it is not available, you can make a request at the Cadastral Office. In the application for this, the exact address is indicated in order to identify the location. If it is not there, indicate the approximate location and parameters of the site. You can also find it using the owner’s passport details.

A passport will be provided if the relevant data is in the database. In this case, a unique number is indicated in the register. The owner of the participant will only have to request a copy of the CP. To do this, you need to submit a package of documents with the appropriate request.

The CP is the most important document that must be protected. If you cannot find it in your documents, contact the appropriate authority.
