How to obtain a cadastral passport of a land plot, documents, validity period, how much it costs

A cadastral passport (hereinafter also referred to as passport, KP, KPZU) is a special extract from the state cadastre. Unlike regular CP extracts:

  • contains a predetermined set of information in a smaller volume than a full statement;
  • the cost of obtaining it is less than a regular extract;
  • the most common official document that will be needed at the place of demand to resolve real estate issues.

The passport contains the following information and data:

  • General information about the land plot: cadastral number (including previous numbers (inventory or conditional) and the date of entry of the object into the cadastre;
  • site address;
  • land category;
  • type of permitted use;
  • square;
  • cadastre price;
  • information about the owner (full name or name of the organization) and what type of ownership (sole, joint or shared);
  • other information (data about natural objects, land plots that were allocated, merged or otherwise transformed with the participation of the land of interest, information about engineers who performed cadastre work);
  • Plan (drawing) of the entire site and, if available, its parts, indicating the scale;
  • Encumbrances and restrictions (mortgage, lease, easement).
  • The CP is a technical and legal document and confirms that the object is registered in the cadastre. KPZU is made on several sheets in the form of text information (descriptions and characteristics of the site) and graphic images (plans, diagrams, drawings). Each sheet is signed by the head of the territorial division of the cadastral authority and sealed with the seal of the institution.

    The cadastral passport of a land plot has practically no differences in form from the cadastral passport of an apartment or other premises. The differences relate to the content side - the descriptive part of real estate objects.

    How do you order?

    There are three options for contacting the cadastral authority (MFC) to obtain a passport:

    • Personal appeal from a citizen (organization) to the MFC. The applicant can arrive to submit an application for a CP without a prior appointment on a first-come, first-served basis, or by appointment (the exact date and time of appointment agreed upon with the applicant are reserved). Make an appointment with a cadastre worker. You can use the service by phone, via the Internet, or come in person to get a ticket.
    • Postal delivery of documents. The documents required to obtain the KPZU must be sent exclusively to the territorial department of the cadastral authority where the land plot for which the passport is being ordered is located;
    • Submit an application for the Civil Code on the Internet on the official website of the Rosreestr, or through the “State Services” resource

    What is it for?

    KP is an extract from the real estate register. It includes information about the owner and the site. It should be obtained if basic information has changed or you have purchased a new plot. The passport must be kept with other property documents. Without it, it is impossible to make legal transactions with land or independently calculate the correctness of the accrued tax.

    The following information is entered into the State Land Cadastre:

    A passport is needed to make almost any transaction with the site. It must be provided in the following situations:

    • when selling land;
    • upon receipt of a building permit on your own site;
    • when using property as a mortgage or for inheritance;
    • during legal proceedings with neighbors regarding the determination of territory boundaries;
    • when renting land;
    • when using the site as the authorized capital of the resulting legal entity.

    Not all owners understand why a control panel is needed. It contains information about the price, features and size of the territory. It includes information about the owner. If you are planning to sell land, the first thing a potential buyer will ask for is documents. Therefore, they must not only be available, but also in order.


    Comparative analysis of market and cadastral prices of land plots

    The cadastral and market value of a land plot are different. Usually the cadastral price is slightly lower. It should not significantly exceed the market value, since it is from this that the tax is calculated. If there is a discrepancy, you must resort to expert assessment. Otherwise, you will have to pay high taxes.

    Completing an application via the Internet is extremely simple, all the details are clear and unambiguous, it’s difficult to get confused.

    When drawing up an application, you must be careful when specifying the method of obtaining a personal passport:

    • in person at the cadastral office;
    • by mail;
    • through the Internet.

    The applicant himself determines what is more convenient for him. The method of submitting documents for ordering KPZU does not predetermine the method of receiving it in finished form.

    Please note: the application includes such a column as an email address and telephone number. Such details must be filled in with reliable data, since if problems arise, the cadastre employee will be required to solve them. the institution needs to communicate with the applicant. This saves time and simplifies the process of manufacturing the gearbox.

    Otherwise, there are no nuances in drawing up the application.

    Receipt, check or other payment document confirming payment for the CP

    How much does a cadastral passport for a land plot cost:

    • 390 rub. for citizens, if the KPZU is in paper form, if received through the MFC - 460 rubles;
    • 290 rub. for individuals, if in electronic form, if through the MFC - 360 rubles;
    • 600 rub. for legal entities (on paper);
    • 300 rub. for organizations (electronic version).

    The receipt is provided in the original when appearing at the MFC simultaneously with other documents. Payment details can be found on the official website of Rosreestr or at the MFC. By the way, there are terminals where you can also make payments.

    If payment has not been made, then the payment must be made within a month and the payment confirmation must be submitted to the MFC. If payment is made through settlement organizations, then these organizations themselves notify the cadastre. organ. From the moment the payment document (check, etc.) is provided, the period for issuing a passport begins to count.

    If a person applies for a CP on behalf of an organization, the powers of the director are also presented (minutes, decision, order to appoint a director).

    The official receiving the documents is provided with the original documents. The MFC employee independently makes copies of documents. Upon their acceptance, the applicant is given a corresponding receipt (stating the date of application, the applicant’s data, the composition of the submitted documents, etc.) and the original documents (with the exception of the application) are returned.

    Based on one application, it is possible to order a KPZU for only one land plot. Cadastral passports for several plots are produced upon requests and payments in accordance with the number of real estate objects. For example, passports are required for three land plots, which means that you need to submit three separate applications and pay 600 (200x3) rubles. various payments. All applications can be submitted at the same time.

    Is it possible to obtain a land passport or an extract from the Unified State Register of Real Estate?


    On January 1, 2017, the Federal Law of the Russian Federation “On State Registration of Real Estate” came into force.
    As part of this legislative act, a new procedure was established for obtaining information about land plots and real estate. Thus, according to the new rules, the familiar extract from the Unified State Register of Real Estate and the cadastral passport were replaced by one document - an extract from the Unified State Register of Real Estate (USRN). The new format paper contains information about a specific housing property and the rights and encumbrances registered on it (we discussed in a separate article whether it is possible to clarify the presence of arrest and encumbrances on a property, knowing only its cadastral number).

    Thus, at present, the production of cadastral passports and certificates from the Unified State Register is not done ; they are not issued unless necessary. If necessary, citizens can order an extract from the Unified State Register.

    How to order online

    This method is the fastest, since everything is done online by filling out special electronic forms.

    So, in order to order KPZU via the Internet, you should do the following:

    • Go to the official website of Rosreestr for cadastral registration.
    • On the right, choose to submit an application for registration. accounting, select your items.
    • Click the “Go to applicant information” button. In the form presented, select the positions: individual (type of applicant) or other (category of applicant). Please provide your full name, passport, phone number and email address. If you chose the method of receiving by mail, you must also indicate your residential address. Check the box “I agree to the transfer of personal data to RosReestr” and click the “Proceed to data verification” button.
    • If you have already paid the fee charged and have a payment in hand, then you need to click on the “Sign and send request” button. An electronic signature is used to sign the request and certify the payment.
    • But it’s easier to make payments through settlement organizations proposed by RosReestr (including Sberbank, Qiwi wallet and other banks and credit organizations, a list will be offered). Then you do not need to put an electronic signature, you just need to go through the payment procedure proposed on the site. So, click the “Send request” button.
    • Your application is registered and assigned a registration number (remember it). It will be visible in the open window. There will also be a link “Check request status”. You should follow this link.
    • In the appropriate column, enter the application number (step 6) and click the “Check” button.
    • A new window will appear, in the text of which there will be a link “Indicate the payment code”, you should follow this link. A “payment code” column will appear, enter it. The code itself will be in a letter that will be sent to your email from the Rosreestr service. Next, click the “Proceed to Payment” button.
    • A list of payment organizations and payment methods will appear at the bottom of the electronic form. Choose a method convenient for you and make a transfer. Be careful, sometimes the site mistakenly indicates incorrect payment amounts. In this case, do not be guided by these data, pay the amount required by law (for citizens: 200, 150 rubles, for organizations: 600, 300 rubles).

    This is the whole procedure. After this, you can count down the required five days and receive a cadastral passport. You can also check the status of the application on the website and if so, you can receive a passport without waiting 5 days.

    When do you need to change the gearbox?

    At the time of transfer of ownership, the information on paper must be current - it is recommended to change the real estate passport every five years. This rule will be introduced in 2021, because... The cadastral value will be updated during the specified period. As for purchase and sale, donation and other options for transferring owner rights: the validity of the document does not exceed thirty days.

    Situations when obtaining a new document is necessary:

    • There has been a change of owner (or a change of the owner's surname).
    • By decision of the state commission, the permitted type of use has changed.
    • After repeated measurements, the coordinates became different.
    • The boundaries of the allotment have been moved.

    The old document in these cases will be invalid.

    Where and how to get KPZU?

    Depending on the issuance method chosen and specified in the application, the provision of CP may be as follows:

    • the citizen (his representative) takes it to the cadastre. authority (MFC). To do this, the cadastre employee responsible for issuing the passport is presented with a receipt (on the acceptance of documents) and the citizen’s passport (if he is a representative, then also a power of attorney);
    • the passport is sent by mail to the address specified in the application (information about sending the letter is sent by email if the applicant indicated its address in his application);
    • is provided in electronic form as a link to the Rosreestr website, where the electronic CP will be located. Information about the link is sent to the applicant’s email.

    Sections

    The extract, replacing the outdated cadastral passport, consists of 4 sections:

    • B1 - includes 18 columns containing: cadastral number;
    • inventory value;
    • determination of the category and type of permitted use of land;
    • data on location, area, configuration, types and restrictions of use;
    • address, information about the owner;
    • information necessary for state registration;
    • data on previously completed transactions.
  • B2 - diagram (done only after land surveying, so the sheet may be empty);
  • B3 – data on restrictions on use, encumbrances (the sheet may be empty);
  • B4 – data on parts (the sheet is empty if the section is “solid”).
  • Grounds for refusal to manufacture and issue

    There may be cases when the KPZU is not provided to the interested person:

    • The application and its attachment are not accepted. This is possible if 1) the application does not comply with the established form, 2) it contains incorrect data, 3) payment has not been made (within 1 month from the date of issue of the code to pay for the service). The applicant is notified of this fact orally in person or by email if the passport is ordered by mail or via the Internet. The person receiving the application is explained the essence of the violation and how to eliminate it. If the deficiencies are not eliminated, the application is considered not submitted and is not considered by the cadastral authority.
    • Refusal to provide CP. Such a refusal is possible if the provision of information reflected in the cadastre is limited and the applicant does not have individual access to it. The refusal is provided in writing.
    • Notification of the absence of information in the cadastre about the object in respect of which the cadastre is ordered.

    The following actions of the cadastral institution can be appealed (if they are unlawful):

    • to a higher division of the Rosreestr (for example, a complaint about the actions of an employee of a city department can be filed with the head of this department or with a regional division);
    • judicially.

    Validity

    Law No. 221-FZ does not define a validity or expiration date. Therefore, it will not be possible to determine exactly how long the statement is valid, since it is theoretically unlimited and is not valid for any limited amount of time.

    In fact, this is true only until the moment when something changes on the site or the need arises to register rights or a transaction.

    Every 5 years a state inventory of all plots is carried out, the value of some of them changes.

    When making any transaction, the data must be up to date . If the statement is received before the next assessment, the information in it is considered unreliable.

    Is it possible to make changes?


    Changes are not only possible, but also must be made:

    • after each state inventory,
    • correct errors if necessary,
    • changes in area, configuration or boundaries.

    This makes it possible to combine the content of documents certifying property rights with the content of the cadastral extract.

    • When dividing,
    • consolidation of plots,
    • adding additional space

    a new cadastral passport is required (preferably with preliminary land surveying).

    To take into account the changes, you need to contact the office with an application, passport, boundary plan and a document certifying the category of the site. The modified version can be received after 20 days.

    Is it necessary to register a non-residential country house?

    This concept arose with the adoption of Federal Law No. 93-FZ of June 30, 2006 “On amendments to certain legislative acts of the Russian Federation on the issue of registration in a simplified manner of citizens’ rights to certain real estate objects.” However, it is necessary to take into account that in this case, in addition to the benefit - property tax will not be charged for an unregistered house - there are restrictions.

    In the absence of registration of the right to an erected building, a citizen does not have the opportunity to dispose of it, including selling, donating, bequeathing, etc. Difficulties may also arise in protecting rights associated with an unregistered building.

    Therefore, if the ownership of your building has not yet been formalized, then all activities to improve the house can be assessed as a continuation of the construction of the building, which does not require obtaining a building permit and drawing up design documentation. If the ownership of the building is registered, then, in accordance with the law, obtaining permission for reconstruction is not required.

    After completion of the reconstruction, you will have the opportunity to register the changes made in a simplified manner. Since the land plot is jointly owned, it makes sense to register joint ownership of the garden house.
