Cadastral passport: obtaining procedure, validity period, details

A cadastral passport for an apartment is one of the most important documents confirming ownership and allowing you to dispose of real estate as you please.

A lot of apartments have been owned by citizens since perestroika and they have not undergone any cadastral registration. If such an apartment is not sold, donated or bequeathed, but simply lived in, then registration of the apartment for cadastral (technical) registration will not be required.

However, any owner wants to have full ownership of his property, but life situations may arise when the apartment needs to be urgently sold, exchanged, etc. Then there will be no time to obtain a cadastral passport. Confirmation of the registration of an apartment on the cadastre is a cadastral passport.

Why do you need a cadastral passport?

  • to register ownership of secondary housing with Rosreesrtra (if it has not previously been registered);
  • when registering ownership of a new building;
  • at the request of the bank (when issuing a mortgage), the buyer of the apartment (to check the legal cleanliness of the apartment) and other persons;
  • in order to legitimize the redevelopment of the apartment;
  • In case of legal disputes (for example, forced eviction of a person), a cadastral passport must be provided to the court.

There are three types of apartments for which passports are issued:

  • the apartment has been owned for a long time without cadastral (technical) registration (the owner is responsible for registration of registration);
  • inherited apartment (the heir is in charge of the passport);
  • new building.

In the first and second cases, the algorithm of actions is the same, but in the case of a new building there are small distinctive nuances.

A cadastral passport can be obtained for the first time - when registering an apartment for technical registration, and also for a second time, when the apartment is in the cadastre, and the previously issued passport was lost, damaged, required by the buyer, bank, redevelopment, etc.

Where to begin?

Where to start designing? First of all, you need to go to the developer’s company and find out whether the house has been transferred to a management company or from another organization under trust management .

If the transfer has taken place, subsequent actions can be taken. If not, wait for the fact of transfer.

Next, you need to do all the documentation for ownership . As soon as you have the certificate in your hands, you can proceed to the next step.

Choose for yourself one of the ways in which you can get it. There are several methods in total.

The first is to contact the cadastral chamber or Rosreestr. The second is to contact the multifunctional center. And the third is the opportunity to register through the Rosreestr website.

Instructions for obtaining a cadastral passport for an apartment

First, let's figure out what a cadastral passport looks like. This is an extract from the state cadastre, which contains the following information:

  • apartment address;
  • year of construction of the apartment building;
  • number of floors;
  • main characteristics of the apartment;
  • material of floors, walls, etc.;
  • cadastral value;
  • apartment area;
  • the presence of balconies, loggias;
  • graphic representation of the layout;
  • other information contained in the cadastre.

Who can receive a cadastral passport:

  • if the property is already registered in the cadastral register, then anyone can receive a cadastral passport when applying to the Rossreestr for any apartment
  • if the property is not yet registered in the cadastral register, then the applicant can also be any citizen, both the owner of the apartment and an outsider, but first you must contact the cadastral chamber with an application to register the apartment, and then it is possible to receive a CP
  • if, for example, redevelopment is being carried out, then in order to obtain an up-to-date cadastral passport, you must first make changes to the cadastre, and then receive a passport; this can only be done by the owner of the apartment

Where can I get a cadastral passport?

To obtain a passport, you must contact the local cadastral chamber (Rosreestr) or the territorial department of the MFC. You can also order a passport through the official website of Rosreestr online.

What documents must be submitted to obtain an apartment passport?

Option number 1 . If the apartment is registered in the cadastral register, then:

  • owner's passport (copy);
  • application for cadastral registration (samples are available at the cadastral chamber, assistance in filling out is provided by a cadastre employee);
  • technical plan (obtained from BTI);
  • documents confirming ownership of the apartment (purchase and sale agreement, certificate of inheritance, court decision, etc.);
  • receipt of payment of state duty (for individuals – 200 rubles, for legal entities – 600 rubles).

Often this procedure can be carried out by a BTI employee, who is called to provide a technical description of the apartment and prepare a technical plan. An agreement is concluded with the BTI and, on the basis of it, it registers the apartment in the cadastral register on your behalf and receives a cadastral passport.

In a new building, cadastral registration and obtaining a cadastral passport are usually handled by the developer, who registers the apartment building and each apartment in it simultaneously with the cadastral register. The share participant only appears at Rosreestr to register his ownership of the apartment. However, the owner of the apartment can independently register the apartment without the participation of the developer. This may become necessary when the developer delays the deadline for cadastral registration for various reasons (no funds, permitting documentation is not in order, etc.)

Option #2. If the apartment is registered, then:

  • application for provision of a cadastral passport;
  • applicant's passport (copy);
  • receipt of state duty (individual – 200 rubles, legal entity – 600 rubles).

The cadastre employee issues a receipt regarding the acceptance of the application and documents. By the appointed date, you must appear at the cadastral chamber or MFC (if the documents were submitted there) and receive a cadastral passport.

Production time

If the property is registered, the cadastral passport will be ready within 5 working days. When submitting documents to the MFC, the period increases by 2-4 days. If the apartment is registered in the cadastral register, this period will be increased to 20 days.

Necessity of the document

Do I need a cadastral passport for living space in a new house?

The joy of moving should not be overshadowed by any problems .

And they will certainly arise if you do not attempt to complete the necessary documentation.

The most important of them, of course, is a document proving your rights to real estate . But the cadastral passport is no less important. What kind of document is this?

Previously, it was necessary only when it came to a plot of land or a private house. Now it is also necessary in a situation where we are talking about an apartment. It reflects the technical condition of housing , its features, and provides an assessment of this type of property (read about cadastral value).

A cadastral passport is another reason to recognize you as the owner . But such a technical document is not issued along with documentation of ownership. This means that you can only obtain this paper yourself and on your own initiative.

Why is it needed? Of course, it is foolish to assume that one fine day an authorized person will appear on the threshold of your house and ask to see all the documents for the occupied space.

No, this will not happen, and many citizens actually live in apartments that still do not have such a passport. This document is needed in a slightly different situation. Namely, when it comes to transactions with property .

Yes, after all, all the technical condition must be reflected somewhere and for this a technical passport is created. If any redevelopment was carried out inconsistently, then the discrepancy will immediately be visible with the original document.

And people who want to purchase this housing should know what kind of property they are purchasing if the transaction is carried out (read about obtaining a registration certificate for selling an apartment).

Thus, this passport is simply necessary, because without it, not only buyers will refuse to register a transaction, but also Rosreestr itself, the body without which not a single real estate transaction can be considered completed.

What is the price of a cadastral passport

  • If the apartment is already on the cadastre, then the cost of the passport will be only the state fee (200 rubles) .
  • In the event that a cadastral passport is obtained as a result of registering real estate with the cadastral register (for any cadastral registration, or changes in the cadastre, the applicant is issued a cadastral passport as confirmation of the fact of cadastral registration), then the price is set based on the amount of the contract with the BTI employee, plus state duty for registration on the cadastre (making changes). This amount varies from 3,000 to 10,000 rubles , depending on the complexity of the work.

Certificates from the BTI and floor plan of the apartment

When privatizing an apartment and other transactions, in addition to your passport, you must have the following certificates from the BTI: a floor plan of the apartment and an explication. It is issued at the request of the interested person at the territorial BTI for the location of the apartment.

It differs from the cadastral plan in the detailed depiction of the apartment . Compliance with scale and detailed descriptive part - explication.

The floor plan of the apartment is prepared within a month. An obligatory stage is for technical specialists to go to apartments for measuring work. The final plan shows all the rooms in the apartment with inventory numbers and area. Explication visually in digital format helps to analyze dilapidation.

You can often come across the question: what area of the apartment is indicated in the cadastral passport of the apartment? In the cadastral passport, the area of the apartment is indicated without taking into account the area of unheated premises.

The plan is requested only after the property is registered in the cadastral register. The application for issuance is accompanied by: a copy of the passport, a copy of the cadastral plan.

Validity period of the cadastral passport

In fact, the cadastral passport has no validity period . The legislator has not established clear deadlines. You can get a passport once, and it will be valid (if the apartment has not been redesigned or there have been other changes).

But it should be borne in mind that once every 5 years the state carries out a cadastral valuation and the cadastral value of apartments changes, therefore, in terms of cadastral value, the passport will most likely not be reliable. In order not to order a new passport, you can separately order a certificate of the cadastral value of the apartment. Ordering a certificate is simple and it is free.

Each type of cadastral work involves different activities. As stated earlier, the main stages include:

  • agreeing on essential terms and signing a contract with a cadastral engineer or company;
  • transfer of basic title, technical and operational documents for real estate;
  • travel of a specialist to the place of work, performing examinations, measurements, calculations;
  • filling out documents based on survey results;
  • issuing the result to the customer or sending the document to Rosreestr.

In addition, the list of stages depends on the type of work. If the contract provides for land surveying, cadastral work may include the removal of boundary markers on the ground. The engineer will install such signs at boundary points according to the boundary plan data.

  4. A list of regions (regions, territories, republics) will appear. Select the desired region.
  5. In the next paragraph, select the district or city in the same way:
      When selecting a city, the next two fields are not needed.
  6. But if a region is selected, in the “Settlement” field we select a specific name. The choice is given: city, rural settlement, village.
  7. Street type. We choose the appropriate option: street, alley, avenue and others.
  8. The next item asks us to enter the name of the street in the text field. Using the keyboard, enter the name as it is.

  11. Just below, click on the “Generate request” button.

Let us summarize the result obtained on the above page. The tabular form will reflect the address we are interested in and the cadastral number assigned to it in the next column.

There may be several of them - this indicates that cadastral work was carried out several times by the relevant engineer. And the first entry was made by the BTI at a time when residential premises were registered with the state and were not privatized. The second entry in the cadastre speaks of redevelopment . If it is not there, then the apartment was not registered in the cadastral register and the information is stored in the BTI.
