What is a certificate of ownership

Real estate transactions that involve the transfer of rights from one person to another are subject to mandatory state registration. Information about the transfer of ownership and the current owner of the property is contained in the Unified State Register of Real Estate. This is necessary for many purposes: control and accounting of citizens’ real estate, resolving issues about the legality of transactions, certification of property rights, and so on.

A certificate of ownership of real estate is an extract from the Unified State Register of Real Estate on the rights of an individual to the real estate he or she owns. This is a document containing information about the presence/absence of real estate owned by a citizen.

The provision of extracts to citizens is regulated by Federal Law FZ-218 of July 13, 2015.
Data is provided by Rosreestr (Federal Service for State Registration, Cadastre and Cartography) at the citizen’s own request.

In the fall of 2021, the transition to the FSIS Unified State Register of Real Estate (USRN) was completed in Russia - all 85 regions switched to the new digital system. A special service has been operating in many regions since 2021 and will now allow residents throughout Russia to quickly obtain information about the characteristics of real estate, check the owners or clarify the presence of encumbrances before a real estate transaction.

Such a certificate may be needed when applying for a mortgage, privatizing an apartment, receiving subsidies from the state, or resolving legal disputes.

Thanks to the FSIS EGRN, the provision of government services in the field of real estate turnover will be simplified, and the time for registering property and conducting cadastral registration will be reduced from three days to 30 seconds. Receipt of government services will not depend on the actual location of the property. For example, a resident of St. Petersburg will be able to obtain rights to an apartment located in Yalta without leaving his region.

In total, FSIS USR is more than 10 petabytes of real estate data. For comparison, the size of the results of experiments conducted over the course of a year at the Large Hadron Collider reaches 4 petabytes. The system already processes about seven requests per second 24/7. Every day, the system receives about 100 thousand requests for state registration of rights and cadastral registration, as well as more than 500 thousand requests for information from the Unified State Register of Real Estate.

The procedure for obtaining an extract from the Unified State Register of Real Estate

You can obtain a certificate of non-ownership of real estate in several ways: through or on the official website of Rosreestr. You cannot come directly to the department and order an extract. Also, by the end of the year, a special service for issuing extracts from the Unified State Register will be launched in all regions of Russia.

Through government centers

Step 1. You need to contact any government services center with a passport (or other identification document) and fill out an application for an extract from the Unified State Register of Real Estate (provided at the “My Documents” office). It is also necessary to inform the employee about the form in which the extract is required - through multifunctional centers it can be obtained both in paper and electronic form.

Step 2. After receiving a payment document from an employee of the public services center, pay a fee for providing information from the Unified State Register of Real Estate, attaching a payment document to the application. Then wait for the certificate. The delivery period is five working days.

You can obtain this extract from the Unified State Register of Real Estate in electronic form through the Rosreestr website. But in this case, the applicant must have an enhanced qualified electronic signature (ECES). An enhanced qualified electronic signature (ECES) differs from an unqualified one in that for its formation, cryptographic information protection tools certified by the FSB of the Russian Federation are used. Only a certification center accredited by the Russian Ministry of Telecom and Mass Communications can issue such a signature.

Step 1. To obtain a certificate through Rosreestr, you need to go to the official website of the department in the section “Obtaining information from the Unified State Register of Real Estate” and select the type of extract “On the rights of an individual to the real estate he or she has.” Bring your passport (or other identification document) and SNILS (if available).

Fill out the request form, indicating a specific region or noting that the information is required “throughout Russia.” It is also necessary to note the types of objects that need to be checked: for example, only apartments. Here you need to select the date for which you are checking the information in the register, or a specific period. Next, you need to pay for the service and wait for the certificate. The deadline for submission is three working days.

Using a special online service

In September 2021, the Federal Cadastral Chamber launched in pilot mode an online service for issuing information from the Unified State Register of Real Estate. By the end of 2020, it will work in all 85 regions. This became possible thanks to the implementation of the FSIS USRN throughout the country.

Using the service online, you will be able to obtain an extract from the Unified State Register of Real Estate. Now, according to the law, it takes three days to obtain information about real estate (through the Rosreestr website and the MFC - the previous two options). But the service made it possible to reduce the time for issuing information about real estate to several minutes. To use its services, you must log in through the Unified Identification and Authentication System. You can search for objects by address or cadastral number.

“The service looks like a regular online store, which is familiar and convenient for people. You don’t need to enter a lot of data - the service is synchronized with the government services website. You just need to log in to government services. Extracts are as legally significant as those drawn up on paper,” the press service of the Federal Cadastral Chamber clarified. The cost of services for issuing a certificate depends on the number of entities that will be checked and the form of the certificate - paper or electronic. For example, for one subject, when receiving a certificate in paper form, you need to pay 750 rubles, in electronic form - 470 rubles. If you need information throughout Russia, the cost of the paper version will be 2,080 rubles, and the electronic version will cost 870 rubles.

Previously, Rosreestr explained its position on the ban on the resale of USRN information. We are talking about a government bill that prohibits the resale of extracts from the Unified State Register of Real Estate. The document provides for a ban for government agencies, organizations and citizens on the resale of USRN information to third parties. A sample certificate can be seen on the official website of Rosreestr. It contains the following information:

  1. Personal data of the citizen (full name, passport details, date of birth, place of residence and place of stay).

A certificate of the presence/absence of real estate ownership is requested based on the citizen’s personal data and can only be requested by the citizen himself. Where can I get a certificate of ownership?

There is no single algorithm for obtaining a certificate. It can be obtained either using electronic services or through a personal visit to a special authority. The three most common options for obtaining :

  1. Visit the MFC (multifunctional) and receive a paper version of the certificate there.
  2. Visit the BTI (Bureau of Technical Inventory) and obtain a certificate from this body. However, the BTI can only obtain information up to 1998; only Rosreestr has more recent information.
  3. A certificate of lack of housing ownership is also issued through State Services (it is possible to order a certificate in both paper and electronic versions).

Standard documents for obtaining a certificate of ownership of real estate are a passport of a citizen of the Russian Federation, SNILS (if registration with the Pension Fund of Russia was made after April 1, 2021, a document confirming registration in the individual accounting system), a receipt or check for payment of the state fee for this service.   • lack of information in Rosreestr;
  • unpaid state duty;
  • if the request is sent from an outsider. Only the person in whose name the property is registered can receive the certificate.

Important! If the authorities refuse to issue certificates, this action of the state authorities can only be appealed in court. Obtaining a refusal in this case is possible only in rare cases.

How to obtain a certificate of absence of real estate ownership

A certificate confirming the absence of real estate ownership is drawn up in the same way as a document confirming the availability of real estate . In fact, these are the same extract; they differ only in the information contained. If a citizen has rights to real estate, a certificate of real estate ownership is issued, listing the objects and their main characteristics. In the absence - respectively, a certificate from the BTI about the absence of property or an extract from Rosreestr about the absence of real estate in ownership.

Form and content of the certificate

This document is drawn up on a form classified as strict reporting documents. The completed form must be certified by the registrar’s signature and the organization’s seal. The help contains the following information:

  2. For 28 subjects, the maximum is 1,250 rubles for paper, 500 for electronic.

The validity period of the certificate is up to five years. But, if today the applicant took a certificate and tomorrow bought an apartment, then, of course, the document will no longer be valid.
