Check debt with bailiffs by last name

More than half of the requests to the bailiffs department are due to a lack of information. This gap was partially eliminated by a special service of the Federal Bailiff Service on the Gosuslugi portal. It allows citizens to access information on enforcement proceedings opened in their name. It serves as a copy of electronic production, and has a number of small restrictions within the framework of the law. We will tell you how to find out information on the enforcement proceedings of the FSSP, to whom it is available, and what is required to obtain the data.

Where to find out about debt: common government Internet resources

You can find out for free whether you have a legal debt online:

  1. Through the State Services portal (mobile application), after authorization (registration) and submission of an electronic application.
  2. Through the website of the Federal Bailiff Service of the Russian Federation, using the “Data Bank of Enforcement Proceedings” service (mobile application, VKontakte, Odnoklassniki networks), using a one-line or extended search option (by initials, region).

Note! Both services provide information about individuals and legal entities.

This way you can get information about the following debts:

  • taxes: in the taxpayer’s personal account or on the State Services portal;
  • administrative fines for traffic violations: on the traffic police website or through your personal account on State Services.

Information about debts for housing and communal services payments, taxes, insurance premiums, and traffic police fines can be obtained on the official website of the Moscow Mayor.

We find out about the receipt of payment through the bailiff

If the information in the database does not change and you are still on the list of debtors, it means that the debt repayment order has still been issued by the bailiff. The law does not establish how long the bailiff must issue it. In this case, you can clarify the receipt of payment directly from the bailiff responsible for conducting enforcement proceedings in the territorial office.

To find out about the receipt of payment from the bailiff you need to:

  1. Make an appointment through State Services, the FSSP website or by phone;
  2. Present your passport and provide the necessary information.

Note: Please be aware that if you are more than five minutes late for an appointment at your organization, your appointment will be cancelled.

How to check for debts in the electronic database of bailiffs

The FSSP forms and maintains an electronic database on enforcement proceedings until their completion and termination, fulfilling the requirements of clause 1 of Art. 6.1 Federal Law of the Russian Federation No. 229 dated October 2, 2007 (actual edition dated December 22, 2020). At the same time, on its own website, the bailiff service places part of the database, accessible to all users, without requirements from the enforcement documentation. To search for their debt in this database, citizens just need to indicate:

  • section “individuals”;
  • region of registration (own residence or location of property);
  • surname, first name.

The FSSP recommends searching not only by last name and first name, but by all available personal data. This will allow you to get an accurate result and eliminate the provision of namesake data. All personal information entered into the form is not saved or transmitted to anyone.

Note! If there is a number of enforcement proceedings or a case, then you can check the debts using other filters by selecting the section: “Search by IP number” or “Search by ID number”. The desired section should be marked before starting the search.

Find out IL number by last name

The amount of information that can be extracted from publicly available databases is substantial. Federal Law No. 229 regulates aspects of production, and the citizen involved in it can view comprehensive information, knowing one of the details. Due to the fact that the databases are interconnected, and the court decision, which is the basis for issuing the IL, contains information about the parties. After transferring the sheet to the bailiffs, the movement of the document is reflected in the database of this service, making it possible to establish the performer, the stage of production, the motives for performing certain actions by the bailiff and the amount of satisfied claims.


The number of the writ of execution can also be found on the writ itself.

The main source of information is the FSSP website: fssprus.ru; for convenience, you can use the website of the regional department of the service. The address will be distinguished by a prefix corresponding to the region code. For example, for the Tyumen region the official website of the FSSP management will be: https://r72.fssprus.ru/, and for Vladivostok https://r25.fssprus.ru/

What information does the electronic bailiff database provide?

The result of checking by initials and region contains only publicly available information. The list of information that it covers is determined by Art. 6.1 Federal Law of the Russian Federation 229. These include:

  • date of the judicial (other) act;
  • ID details: type, number, issued by;
  • demand from the ID (except for a document issued under a judicial act not published on the Internet);
  • IP details (date, number);
  • personal data of the debtor - an individual: full name, date of birth;
  • amount of debt;
  • information about the search for the debtor (property, child);
  • details of the bailiff unit;
  • a document confirming the return of the enforcement case to the claimant.

To find out detailed information about detected debts, including the reasons for their collection, you should contact the government agency that is the collector. That is, for tax debts - to the Federal Tax Service, traffic police fines - to the State Traffic Inspectorate, etc. Regarding the application of coercive measures such as a ban on traveling outside the Russian Federation, you must contact the bailiff service.

In what cases is it necessary to search for a performance sheet?

You should look for a writ of execution when such cases arise.

  • In cases of shortcomings in the work of the bailiff.
  • In cases where the debtor was not notified of the debt.
  • In cases where the bailiff does not know the place of registration of the debtor.

It is important to know the contents of the writ of execution for persons who:

  1. They are planning to leave the country. A person who has debts cannot leave Russia.
  2. They don’t want to miss the deadline for paying the fine.
  3. Who want to check debts.

Changing information in the electronic database of debtors after repayment of debts

When checking the debt through the FSSP service, you can fully or partially pay the debt on the State Services portal. A receipt for payment is also generated here for printing. Making a payment through the USPU requires authorization.

The money contributed by the debtor towards the debt is transferred to the bailiffs, and then to the collector. This takes from 3 to 7 days. Therefore, the entry in the electronic database about the debt will not be deleted or changed immediately, but only after the money reaches the addressee and the debt is repaid.

Checking the writ of execution

On the site page you need to enter information about the person you need. When the search is successful, some data should appear on the page. The contents include the name of the judicial authority; the date when the verdict was passed, the amount of debt; debt repayment terms, information about the owner’s appeal to the court.

It is not necessary to search for performance sheets by number. The database also has an advanced search in which you can specify all known information. You can search without a sheet number. In the search bar, you can enter the debtor’s passport details, place of registration, number of the writ of execution, date of issue of the decision, name of the judicial organization.

You need to enter a lot of information in the search bar so that the system can find accurate data. If the fields are partially filled in, several results or an incorrect result may be returned.

Pre-registration

Pre-registration must be completed as follows:

  • on the website in the “Registration” section you must enter your first name, last name, phone number and email address and click on the “Register” button;
  • A new “Phone number verification” window will open on the screen. At the same time, a message will be sent to your phone or e-mail containing the code;
  • enter the code in the empty field and click the “Continue” button;
  • A new window “Create a password” will open in front of you. Come up with it, enter it twice in both free fields and click the “Done” button.

Consequences of being in the register of debtors

Entering a citizen into the register of debtors is associated with a number of possible consequences.

What are the consequences of unpaid debts?

The presence of unpaid debts by a citizen may cause bailiffs to seize his property, as well as funds stored in his bank accounts and deposits.

It is also possible to face criminal liability (up to 3 years in prison) for the following violations:

  • failure to pay child support for minor children or disabled parents;
  • malicious evasion of payment of loan obligations;
  • carrying out illegal actions in relation to property to which measures for compulsory collection have been applied (inventory, arrest) or which is subject to confiscation;
  • failure to comply with court requirements.

Seizure of accounts

The presence of open enforcement proceedings entails the seizure of the debtor's accounts and the forced debiting of funds from them in favor of the creditor. Movable and immovable property may also be subject to seizure and confiscation. The exception is the debtor's only housing, his personal belongings, pets, food for them and some other property, the list of which is determined by law.

For what debts can travel abroad be restricted?

Travel abroad may be limited if an individual has the following debts under a writ of execution:

  • outstanding obligations for alimony payments, compensation for damage to human health or harm in connection with the death of the breadwinner, as well as moral damage caused as a result of criminal acts, if the amount of debt exceeds 10 thousand rubles;
  • unfulfilled non-property obligations;
  • other obligations in the amount of 30 thousand rubles or debts in the amount of 10 thousand rubles, if the payment is overdue for 2 months.

Deprivation of the right to drive a vehicle

Deprivation of the right to drive a car is possible if you have the following debts in the amount of 10 thousand rubles:

  • for alimony payments;
  • for compensation for damage to human health;
  • for compensation for damage in connection with the death of the breadwinner;
  • for compensation for damage caused as a result of criminal acts;
  • to pay off penalties for evading compliance with non-property requirements for raising children;
  • to pay off penalties for traffic violations.

The following situations are exceptions:

  • the restriction deprives the debtor of his only source of income;
  • the use of a car is necessary for the debtor and his family members to ensure their own livelihoods, given the limited transport accessibility of their permanent place of residence;
  • the debtor or his relative uses the vehicle for transportation purposes due to a disability;
  • the debtor was granted an installment plan or deferment to fulfill the requirements specified in the writ of execution.

Where to see the number of the writ of execution

With rare exceptions, a writ of execution is issued to the debtor and he then decides which method: on his own or through the bailiffs, it will be better and faster to collect the debt. However, there are several situations in which the courts send the IL directly to the FSSP without handing it over. In such a situation, when the court hearing is held in absentia, without the participation of the defendant, and the debtor is confronted with the fact of the existence of the debt post factum. Such a person is also interested in finding out the IL number and the amount of debt assigned by a court decision, as well as the restrictive measures imposed by the bailiff.

How to get a writ of execution

There is more than one option for the development of events. In the first option, the plaintiff sends the writ of execution to the bailiff, or takes it himself and sends it to the bailiff. Judicial organizations do not forward the decision quickly, the defendant may get lost from sight, the account may be canceled, the money may be transferred to another account, and much more. To receive a sentence you need to write a statement. Forms and samples are issued by the judicial organization itself. You need to study this information. If the document contains a large number of errors, then collection will be impossible. Before handing over the original sheet to the bailiffs, it is better to obtain a copy of it. If you have a copy, you can ask about the progress of the case.

If the debtor has lost the sheet

If you lose a document, you need to get a duplicate. You can get a duplicate in another proceeding. The appeal must be submitted to the same court that issued the sentence. There are two parties present at the meeting. If the defendant does not appear in court, he will not be issued a duplicate.

Why do you need a certificate?

A certificate from the bailiffs regarding non-payment of alimony is required in the following cases:

  • To collect a debt through court.
  • To determine the total income of a family applying for government benefits or subsidies.
  • To obtain certain benefits due to non-payment of alimony.
  • To resolve the issue of depriving a citizen of parental rights due to failure to provide financial assistance in maintaining children.
  • Challenging the amount of debt by the debtor himself in case of disagreement with the bailiff's decision.

In addition to these cases, such a certificate is required by some banks when issuing a loan.

Features of executive documents

A writ of execution can be issued by the court in two forms:

  1. Court order - based on a simplified consideration of a person’s application, performs the function of a court order;
  2. A writ of execution is issued on the basis of a court decision after a full-fledged lawsuit.

Also, executive documents include:

  1. An agreement between persons on the payment of alimony, provided that it is certified by a notary;
  2. Certificate issued by the labor dispute commission;
  3. Acts of regulatory authorities indicating the collection of money, in the presence of documents with banking (or other financial organizations) notes on partial or complete failure to fulfill obligations by the debtor;
  4. Acts on administrative violations issued by the court or other authorities;
  5. Other documents, including direct decisions of the FSSP.

To find out the debt under the writ of execution, you need to dial the document number in online services. The documents are different, their details differ significantly from each other. Even issued by the court, they contain the following information:

  1. The name of the judicial authority that issued the document indicating the judge;
  2. Number and name of the case, other materials on the basis of which the sheet was issued;
  3. Date of decision, issue of order, etc.;
  4. The date when the court decision or other act came into force;
  5. Information about the plaintiff and defendant;
  6. Responsibilities assigned to the defendant-debtor;
  7. The date of the writ of execution itself.

As such, there is no unified number that would be accepted for all types of writs of execution. You can view it on the form itself on which such documents are printed. As a rule, they are located downwards, have a series and number.
