Acceptable cases of residence without permanent registration

Rights granted by permanent registration:

A person living without registration is breaking the law. However, in some cases this does not entail any administrative liability. In accordance with Article 19.15.2 of the Code of Administrative Offences, the following are exempt from paying fines:

  • citizens who have a residence permit in another residential area in the same locality;
  • close relatives of the property owner: children (including adopted or under guardianship);
  • grandchildren;
  • parents;
  • grandmothers, grandfathers;
  • spouses.

Documents for registration

  • The registered citizen is only required to submit a passport, and for citizens under 14 years of age, a birth certificate.
  • The owner of the living space provides a passport and a certificate of state registration of ownership of the living space in which you want to register. If there are several owners, each of them must collect and provide this package of documents.

An extract from the house register is not required.

In accordance with Government Decree No. 713, all Russians must have permanent or temporary registration. Permanent registration at the place of residence is a registration.

After arriving for permanent residence, a person must register within 7 days. In case of refusal of registration actions (delaying them), a fine is imposed on the citizen:

  • 5 t.r. – for federal cities of Moscow and St. Petersburg;
  • 3 t.r. – for residents of other localities.

The owner of the apartment will also be fined 7 and 5 thousand rubles if the fact of illegal residence of a Russian in his living space is officially recorded. respectively. If the owner of the property is a legal entity, the fine will increase to 750 tr.

How to make temporary registration through State Services

The application is submitted by the person who registers. That is, this person must have an account with State Services. If not, it must be pre-registered. If this does not work, then remote registration will be impossible.

Procedure:

1. Log in to the State Services website using your credentials. In the search bar for services on the main page, enter the phrase “Registration of a citizen at the place of residence.” We need a section “at the place of residence”, so we go into it.

2. Information will open indicating the procedure and a list of required documents. On the right side of the page there is a blue “Get a service” button, which you need to click to start applying for temporary registration through State Services.

3. Next, the electronic application form will open, which has already been partially filled out. Since the request is submitted from an authorized account, the applicant’s full name and passport information have already been entered.

The applicant manually enters the following information in this section:

  • for whom he is applying. You can send it for yourself or for your child (including the ward);
  • country and city of birth;
  • Please note whether you are permanently registered. If yes, you need to indicate the address;
  • place of residence where you are applying for temporary registration;
  • registration period. Agree it with the owner in advance so that there are no unclear situations afterwards;
  • details of the owner of the apartment or house where the applicant is temporarily registered, his passport details;
  • degree of relationship between the applicant and the owner of the premises;
  • contact details of the owner of the premises: phone number and email address;
  • basis for temporary residence. Here the owner's statement is usually selected;
  • if the apartment has other owners, this is noted in the application. When registering, their consent will be required; other.

4. Simply fill in all required fields. You need a lot of information about the citizen being registered. The fact is that the state and the Federal Migration Service are actively fighting the flow of migrants who, with temporary registration, receive the right to work and live in Russia. And often they make a fictitious registration, which is prohibited by law.

If it turns out that the registration is imaginary, that in fact the person does not temporarily reside in the premises, the owner, according to the Criminal Code of the Russian Federation 322.2, will be punished with a fine of up to 500,000 rubles.

5. The last point of the application is the choice of the department of the Ministry of Internal Affairs, where citizens will come to submit a package of documents and to receive a temporary registration form. You need to select the city of your stay, after which a map will open, with departments of the Ministry of Internal Affairs and information on their work schedule. The applicant chooses what is convenient.

6. Finally, the applicant agrees to the processing of personal data and with the information that he is notified that the provision of false data or forged documents entails liability.

Choosing where to register - multifunctional centers

You can submit documents for registration:

  • in the migration department of the Ministry of Internal Affairs;
  • through gosuslugi.ru;
  • at the MFC office.

Since multifunctional centers effectively combine all the advantages of the website of the State Ministry of Internal Affairs, it is better to carry out the registration procedure at the place of residence through them.

You can apply for registration at an MFC not at a person’s place of residence, but it is better to contact a branch within one constituent entity of the Russian Federation, since otherwise they may refuse to accept documents. To register at a new place of residence through the MFC, you need to collect a certain set of documents.

The application has been submitted, what next?

Soon after submitting an application, an invitation will be sent to the citizen’s personal account at State Services to visit the selected branch. In addition, the information will be sent to the mobile phone specified in the application or by email.

You must have the originals of the submitted documents with you. If there are several owners, they must all come and give written consent to temporary registration.

If everything is in order with the documents, if all formalities are completed, the applicant receives a temporary registration form indicating all the data and period of registration. According to information on State Services, the operation is completed within 3 business days.

The procedure for registering at the place of residence through the MFC

Required documents

To register in an apartment or private house in 2017-2018, you must bring the necessary documents:

  • the applicant’s passport (taken from the citizen temporarily to affix a registration stamp);
  • unified application in form No. 6 ();
  • a certificate of departure at the previous registration address (if such a document is not available, sometimes a corresponding note on the identity card is sufficient);
  • title documents, if the housing is owned - (USRN extract or certificate of ownership). If the person being registered is not the owner of the property, then the personal presence of the property owner with a passport or his notary permission to carry out registration actions will be required (registration at the place of residence through the MFC without the consent of the owner of the property is not allowed);
  • documents for a municipal apartment (order, rental agreement). Also in this case, the consent of the local government may be required;
  • an extract on the number of registered people (can be independently obtained from the database by an MFC employee when accepting documents for registration);
  • receipt of payment of state duty or its electronic equivalent (in cases of registration of stateless persons and foreigners).

If a person is registered not in an apartment, but in a room in a communal apartment, then written permission from neighbors may also be required to move the tenant.

When a man of military age is registered, he may be asked to register with the military registration and enlistment office at his new place of residence. This requirement is not reflected in legislation, but is often encountered in practice.

If personal presence is not possible, it is possible to register at the MFC using a power of attorney to carry out these actions (general, one-time, etc.).

Applying for registration at the MFC step by step

You can make an appointment at the multifunctional center in advance (even 3 hours in advance) so that you can come and not have to wait in line.

The employee will check the completeness of the accepted papers, as well as the legitimacy of the applicant. If the MFC employee has no doubts, he will take the papers for processing and issue the client a receipt with the application number.

If there are no documents, the specialist can accept the application, but tell the client about the need to provide information. This does not apply to copies of a passport or certificate of ownership, since registration with the MFC (like any other action through multifunctional centers) implies free copying. A government agency employee does not have the right to refuse to accept documents at the MFC at a location other than your place of registration.

Government duty

In accordance with the legislation of the Russian Federation, for Russians there is no state fee for registration through the MFC or the migration department of the Ministry of Internal Affairs, but when registering citizens of another country or stateless persons, you will have to pay 350 rubles.

Registration deadlines

The processing time for registration in an apartment through the MFC is up to 7 working days. If a citizen has not submitted a departure slip, the registration time may be delayed.

Where to apply?

How to temporarily register a person in your apartment? The registration of documents is carried out by the Federal Migration Service . It is the employees of the territorial organizations of this state structure who issue the passport insert, which is evidence of temporary registration. What needs to be done?

You can submit documents directly to the FMS office, as well as through the State Services portal, MFC or by mail.

Required documents:

  • passport;
  • application of the registrant (Form 1);
  • statement of consent of the owner (or all owners);
  • a notarized apartment rental agreement (if it exists, the presence of the owner is not necessary);
  • arrival slip;
  • proof of ownership;
  • home Book.

When submitting documents through the MFC, State Services or mail, copies of these documents . After checking the documents at the FMS office, you will be able to receive an insert for your passport.

For temporary registration, you do not need to cancel your permanent one. Depending on the method of submitting documents, it takes from 3 to 7 days . There is no state duty charged to citizens of the Russian Federation.

What is needed for registration in non-standard cases?

Registration in a house for demolition

If the house is officially declared unsafe, and a decision has been made to demolish the building, then registration in the apartment becomes impossible, regardless of the form of ownership.

Registration of the owner of the property and third parties in it

A privatized apartment is owned by a private person, and therefore the owner has the right to carry out any actions with it within the framework of Russian legislation.

He can independently register in the apartment even if there are other co-owners of the property. If the owner decides to register through the MFC or the Ministry of Internal Affairs in shared housing for a third party, then the permission of all shareholders will be required, regardless of their place of residence.

Registration in municipal housing

If we are talking about social housing, then the tenant of an apartment can register his close relatives in this apartment and register himself a week after receiving a warrant and actual occupancy without any prohibitions, permits or checks of the premises’ compliance with established standards.

If registering a non-relative, you will need to provide:

  • consent of all registered persons (even if the person interested in registration is the responsible tenant);
  • consent of the municipality;
  • documents indicating the area of ​​the premises.

Registration under dacha amnesty

In 2011, a law on dacha amnesty was adopted, describing the possibility of registration in a dacha. It is also possible to register through a multifunctional center or a department of the Ministry of Internal Affairs. Since it is possible to contact the MFC not at the location of the object, it is better to contact the multifunctional center.

To register in a country house, the following conditions must be met:

  • SNT is located next to a populated area (within its boundaries);
  • the building is permanent and suitable for year-round use;
  • The dacha is the only place where the applicant can register at his place of residence.

In order to register through the MFC for dacha housing construction, the applicant must provide documentary evidence of the fulfillment of all these conditions.

Registration in a private house

Registration in the MFC is possible only in residential (i.e. completed and officially handed over to the state commission) houses. Moreover, a building may have all the necessary engineering components, but without proper registration of ownership, registration will be denied.

Registration in a private house is carried out by entering data about arriving residents into the house register. This document is produced in a single copy and kept by the owner. To carry out registration actions, it will be necessary to attach the house book to the known documentation set at the MFC at the location of the object.

Registration at a military unit

A serviceman can register in an apartment attached to a military unit if he has no other housing. In this case, you should submit a report to your commander. I plan to live in a hotel. Do I need to do temporary registration and when? As I understand it, I can live without registration for up to 90 days, or should I still register within 7 days?
