Most modern people associate a dormitory with their student years or their time working at a state enterprise. Young professionals often live in dormitories: teachers, doctors, officers, etc. Registration in a dormitory is not an easy procedure and raises a lot of questions.

Let's figure out together whether there are differences in registration in a hostel and a regular apartment, and what documents you will need to register in a designated room.

Residential status

Residential premises according to their status are divided into three types: private, municipal and managed by a legal entity. This principle applies to apartments and households. The hostel is no exception here.

Premises to which a person has ownership rights are considered private. It is confirmed by a certificate, a purchase and sale agreement or an extract from the Unified Register of Real Estate. The law does not prohibit the acquisition of ownership rights to residential premises in a dormitory.

A municipal area is considered to be an area under the jurisdiction of budgetary structures, that is, local authorities.

Examples of housing owned by a legal entity are apartments or rooms owned by businesses or educational institutions.

The order of its provision to the interested person depends on the status of the premises.

Providing accommodation in a hostel

Living in premises of this kind is due to various personal reasons. There are often cases when this happens because a person does not have his own real estate. However, most often this is associated with admission to an educational institution or employment.

While studying

Admission to an educational institution can become the reason for moving not only to another locality, but also to a subject of the Russian Federation. In the latter case, if a person is a full-time student, it will be difficult to return daily to his place of permanent registration. In such situations, it is necessary to register in a constituent entity of the Russian Federation. For a student, the best way is to get a room in a dormitory.

In this case, registration in the hostel will be limited not only to a certain period, but also to the occurrence of certain circumstances. For example, a person will be registered only for the duration of his studies. However, if he is expelled before graduation, he will have to vacate the occupied space. The reasons may be different, for example, poor academic performance or personal desire. Regardless of the circumstances, the person will be evicted. This is due to the fact that the hostel is provided to the student precisely for the time he is a student. Eviction on these grounds cannot be a reason for filing a lawsuit in court, since the parties initially agree on such a condition, and this rule does not contradict the requirements of the law.

A student can also be deprived of the right to a dormitory in case of violation of current sanitary standards.

During work (service)

You can also move into the hostel during work or service.

A person does not always have a place to live at the location of the organization in which he works. This may also be related to the performance of public service duties. In such cases, a legal entity can provide a person with a room in a dormitory. Many organizations have similar funds at their disposal.

Accommodation in a hostel in such cases is limited only by the occurrence of certain circumstances, namely the fact of working in an organization or serving in a government structure. As in the case of studies, such a condition is agreed upon by the parties initially, and eviction cannot be a reason for filing a lawsuit in court.

At the same time, it is not only the end of a job that can cause loss of housing. Even if they conscientiously perform their official duties, a person can be evicted from the hostel. This may be due to violation of sanitary standards, use of the premises for other purposes, or violation of the rights of other residents.

Teaching migrant children at school

According to the law, there should be no difference between the education of children of migrants and children from Russia. Any foreign parents can apply to admit their child to school. Regardless of whether they are in Russia with a Temporary Residence Permit or Residence Permit, or whether they work under a patent or without a patent under an employment contract. The main thing is that both the child and the parents are in Russia legally.

Only the lack of free places at school can be a reason for refusing to admit a child. You can register a foreign child to study at school through:

  • MFC;
  • Public services;
  • for residents of Moscow - through the website mos.ru (in order to get to a school in the capital, a child will definitely need registration or migration registration in Moscow).

The rules by which a child is admitted to an educational institution are stated in the Procedure for the admission of citizens to study in educational programs of primary general, basic general and secondary general education (the document was approved by order of the Ministry of Education and Science of the Russian Federation dated January 22, 2014 No. 32).

Documents for admission to school

To admit a foreign student to a Russian educational institution, the following documents are required:

  1. The parent needs to prepare an application - it is worth considering that, in addition to basic information about the last name, first name, patronymic, and date of birth, data from the birth certificate and registration document are needed.
  2. The parent will need to present their passport .
  3. The child's birth certificate will be required . The document will need to be shown in original.
  4. Registration or migration registration in the territory to which the school is assigned.
  5. A document confirming relationship with the student.
  6. You will also need a document that confirms that the parent and child are in Russia legally (for example, a migration card, temporary residence permit, residence permit)
  7. For admission to grades 10 and 11, a certificate for grade 9 .

The document does not say, but schools also usually require you to provide a medical insurance policy for the child.

Certificates written in a foreign language must be translated. The translation is certified by a notary.

As for the education of migrant children who are transferred from a foreign school to a Russian one, the child is enrolled in the class that corresponds to the level of education received in a foreign country. In this case, the materials of the child’s personal file and the grades he received at his previous school are taken into account.

In some cases, the school may organize a mid-term assessment, during which it will be decided which grade the child should be enrolled in.

In Moscow, only 75% of children from foreign families go to school. Many of them are a couple of years behind their peers. Most often this is caused by poor knowledge of the Russian language.

Types of registration

Registration varies in duration. It can be temporary or permanent. It all depends on the intentions of the person himself and the conditions of settlement.

Constant

According to general rules, it occurs in cases where a person changes his residential address for an indefinite period, for example, when selling his own real estate. In such cases, it is necessary to register at the new location within the period established by law. It is seven actual days and is calculated from the moment of arrival.

In practice, registration of this type in a hostel is quite rare. This is due to the fact that residence in this premises is limited to certain periods or the occurrence of specific circumstances. That is, a person will be able to use a dorm room while he works or studies. Permanent registration will be possible if the premises are privatized with the permission of the owner, that is, when the legal entity has given consent and the resident has received ownership of the occupied space, he will be able not only to register himself on a permanent basis, but also to register his other relatives or family members .

Temporary

Temporary registration has slightly different registration deadlines. If a person intends to live at a certain address for more than ninety actual days, then before their expiration he must contact the territorial body of the Ministry of Internal Affairs. This type of registration is typical for registration in a hostel. In this case, the person will live in the premises as a tenant. That is, he will have the opportunity to stay in the hostel and use not only the room, but also the common areas and the provided utilities.

In this case, the resident is not given the right of ownership, and he will not be able to register other persons in the room only at his own discretion. He will need the owner's consent.

Is it possible to register in a hostel?

There are two types of registration in the hostel: permanent and temporary. Permanent registration means that you will live in an apartment building for a long time.

Temporary registration is required to notify the relevant authorities of your actual stay. There is no need to change your place of permanent residence.

Please note that giving false information about your actual place of residence is punishable by law and entails administrative penalties.

Registration procedure

For moving into the hostel, the rules are applied determined by the Decree of the Government of the Russian Federation of July 17, 1995 No. 713 “On approval of the rules for registration and deregistration of citizens of the Russian Federation at the place of stay and at the place of residence within the Russian Federation and the list of persons responsible for reception and transfer to the registration authorities of documents for registration and deregistration of citizens of the Russian Federation at the place of stay and place of residence within the Russian Federation" and Order of the Ministry of Internal Affairs of Russia dated December 31, 2021 No. 984.

First of all, you need to collect the necessary documents. These include the initiator’s passport, application for registration, and a document giving the right to move in.

If the room does not belong to the person, then the appeal should be transferred to the owner of the room. Ownership of the room allows the initiator to submit an application to the registration authority independently. The application itself is drawn up in form 1, 1PR or 6, approved by Order of the Ministry of Internal Affairs of Russia dated December 31, 2021 No. 984.

Documents confirming the right to move in include a lease agreement, a certificate of ownership, and an extract from the real estate register.

A registration mark is added to the initiator’s passport if he will reside permanently. In case of temporary registration, the person will receive only a certificate.

Temporary student registration

Each student must register at the place of actual residence. This issue is mainly dealt with by the educational institution. But if there is no employee responsible for registration, then you need to take care of it yourself.

You will need the following documents:

  • a statement written in your own hand;
  • identification document (passport, birth certificate for persons under 14 years old)
  • health certificate;
  • compulsory health insurance policy;
  • three photos (3*4)
  • certificate from the educational organization;
  • permission to move in;
  • arrival and departure sheet.

Owner's consent

In accordance with the requirements of current legislation, a person must obtain the consent of the owner to register in a residential premises. The situation with a dorm room has its own characteristics. It depends on who owns the premises. If the room belongs to a municipality or legal entity, then the consent of these authorities will be required. When the question concerns privatized housing, a positive answer from the owner is required.

The procedure for obtaining consent itself is not defined by current legislation. An issue of this nature is resolved through negotiations. Upon completion, a consent is drawn up.

The text of the document must indicate the following:

  1. Name of the registration authority.
  2. Information about the owner - name or full name and date of birth, contact phone number, location address, passport details or document confirming authority.
  3. Location of the hostel.
  4. Last name, first name, patronymic, date of birth and passport details of the person registering.
  5. Length of stay.
  6. Date of consent.

The document must be signed by the owner. If consent is given by a legal entity, then it can be issued on the organization’s letterhead. In this case, it is signed by the manager and certified with a seal.

Why do teachers need temporary registration?

According to the law, you can live without registration for no more than 90 days; in other cases, you must go through the registration procedure.

Temporary registration solves a large number of problems in such situations, since it does not provide for the mandatory deregistration of you at your permanent place of residence. That is, you can have two registrations at once, so that there are no problems with migration authorities when living in a foreign city.

If you work as a teacher and you have to move to another city to work in another school, then you must definitely apply for a temporary registration, keeping the one that was originally at your place of residence.

In this case, you will be able to apply for this registration option upon obtaining the consent of a certain circle of persons:

  • if your place of registration belongs to housing stock apartments, then you must obtain the consent of its tenant so that he gives the go-ahead for your registration. In addition, if someone else lives there, and these persons are over 18 years old, then their consent will also be required;
  • consent of the owner of the property with whom you intend to register;
  • if the housing is owned by an organization, then you will need its consent;
  • if the apartment belongs to a housing cooperative, then the consent of its members.

Confirmation of consent must be documented by you at the Migration Service, which is responsible for obtaining temporary registration.

If you violate the 90-day period and do not register, this will be followed by a fine, which currently ranges from 1,500 to 2,000 rubles.

There are no other penalties for living without registration, that is, illegally living at a specific address.

Is it possible to register without the right of residence?

Registration initially gives a person the right to be in a certain premises. That is, in case of registration, a person acquires the right to use housing. At the same time, the legislation does not disclose such a concept as registration without the right of residence. In fact, in practice, some owners draw up agreements of this nature. However, in this case you may encounter a certain problem. Registration of this nature may be regarded by specialists of the Ministry of Internal Affairs as a fictitious registration. In this case, the person will be removed from the register.

How to place a migrant child in kindergarten

The right of foreigners to send their children to kindergartens and schools is stated in Article 78 of Federal Law No. 273 “On Education in the Russian Federation”.

How to queue for kindergarten

  1. Upon arrival in Russia, the child needs to do migration registration or registration.
  2. In Russia you will need to undergo a medical examination (pass results obtained in foreign countries are not accepted). It is worth considering that if a child does not have a temporary residence permit or residence permit, then he will have to pay for all medical services.

According to the Order of the Ministry of Education, the only reason why a child can be refused admission to kindergarten is the lack of free places in it.

Separately, it is worth mentioning about registration. Children of foreign citizens are accepted into kindergartens if they have migration registration in Russia or registration at their place of residence.

  • vaccination card;
  • medical record from the clinic;
  • migration registration or registration at the place of residence;
  • parent's passport.

All documents executed in a foreign language must be translated into Russian and certified by a notary.
