Migration registration of foreigners

Every migrant arriving in Russia is required to register at the place of stay. This is stated in Federal Law No. 109 of July 18, 2006 (see link at the end of the article). Migration registration is completed by the receiving party after receiving the required documents from the guest: a passport with a border crossing mark and a migration card with a stamp of the Russian Border Service.

According to the law on migration registration, the receiving party is the citizen or organization where the foreign citizen lives or works. The receiving party is:

Registration certificate

  • A citizen of the Russian Federation with permanent registration and/or owning residential premises (a foreigner is registered at this address).
  • Legal entity (company in which a foreign citizen works: Russian or a representative office of a foreign company).
  • International organization.

  • A foreigner who owns housing in Russia registers for himself.
  • A foreigner with HQS status who owns housing in the Russian Federation has the right to register for himself and his family members.
  • Hotel or similar organization - notification of the arrival of a foreign citizen is submitted on the first day after arrival (on the first working day after the weekend).

A representative of the receiving party contacts the migration service with a set of documents. By law, this is done within 7 days after crossing the Russian border.

Documents for registration

To register at your place of residence, you must provide:

  1. Completed arrival notification form. and sample filling in PDF. Fill out the form by hand in block letters or on a computer. Abbreviations and abbreviations may not be corrected or used. The form is signed by the receiving party, and the legal entity puts a stamp.
  2. A copy of the foreigner's passport (pages with photo, name, nationality, date and place of birth, series and number). In addition, you need a copy of the page with the visa (for visa countries) and a stamp confirming border crossing (if one is affixed).
  3. A copy of the migration card with a border service stamp.
  4. Passport, certificate of ownership of residential premises or constituent documents (for a legal entity) of the receiving party.

The papers are provided directly to the migration service department or sent by mail. You can also issue a notification of arrival through multifunctional centers. There is no state fee for issuing a notification. If registration takes place through the post office, then the cost of postal services is approximately 250 rubles.

The detachable part of the notification form with the stamp of the migration service is handed over to the foreigner. He keeps this paper throughout his stay in the Russian Federation and presents it along with his passport where required.

Registration at the place of stay is issued for the duration of the visa, and for citizens of visa-free countries - for 90 days. When this period expires, a citizen of a foreign state is obliged to leave Russia.

Patent registration renewal: all the subtleties and nuances

The validity period of a patent is the same as the personal income tax. It is issued at the MFC. When a foreign citizen (from Moldova, Ukraine, Uzbekistan, Tajikistan or other CIS countries) pays personal income tax for six months, he has the right to extend the patent for this period. Then this operation is repeated or the registration is terminated.

The Russian state provides the opportunity to draw up a renewal for a foreigner on a patent at certain addresses: apartment (place of residence), work premises (place of employment). The responsible person submits a written application together with the foreigner. For example, a homeowner or employer. A sufficient reason for renewal of a patent is employment in accordance with the legislation of the Russian Federation, payment of taxes.

It is useful to know that the certificate of authenticity of temporary registration is available online on the official website of the GUVM of the Ministry of Internal Affairs and when visiting the institution of the GUVM of the Ministry of Internal Affairs.

When a migrant has extended registration using a patent for a calendar year and left the territory of the Russian Federation before the end of the paid time, then upon return it is necessary to register again, although it is already available on receipts for a full 365 days.

The duration of the documentation operation when purchasing a patent is 3 days.

Legal grounds for refusal

The established rules must be followed in order to renew business papers without refusal.

List of reasons for rejection:

  • if there are no sufficient grounds;
  • no evidence;
  • registration is expired;
  • illegal residence in Russia;
  • false information in the application;
  • repeated violation of laws.

The refusal must be appealed in court no later than 10 days from the date of drawing up the decision, which is recorded in writing. If the trial ends with a victory, the registration is extended.

The Russian state provides sanctions for violators. Expired registration is a serious violation; legislation classifies it as an administrative violation, for which a fine of 2,000 rubles – 5,000 rubles is provided. You must pay before leaving for the borders of your native country. The bad news is that a subsequent entry ban is possible.

IMPORTANT! Immediately upon completion of the registration period, you must leave the Russian Federation. You must pay a fine for violating documentation deadlines. Often the delay is insignificant; in this case, after a period of 90 days, you are allowed to come to Russia again.

It is first recommended to make sure that you are not included in the list of those who break the law. However, it will not be possible to cross the Russian border again in the near future. You should find out about this in advance.

The purpose of registering migrants in the Russian Federation is to vest foreigners with rights and freedoms in the Russian state and to assign the necessary responsibilities.

In this way, security in the country is controlled. Statistics are also kept, forecasts are made, and plans are developed in the migration field. The Constitution, the fundamental law of the state, is protected. This includes systematizing information on the movement of foreign citizens.

From a legal point of view, renewal of registration is a new document to replace the previous one. It is required upon entry and stay in Russia. Issued for visa-free foreigners; for others, a visa extension is required.

Fines for late registration

Usually the fine is 2-7 thousand rubles. Its amount is significantly influenced by circumstances. If registration in a new place is not renewed due to a valid reason, the person may not be held accountable. In case of repeated violation of migration laws, a person may be deported from the country and banned from entering for a certain period.

An expired document no longer has legal force and is therefore invalid. Article 19.15.1 of the Code of Administrative Offenses of the Russian Federation is applied to its owner. It provides for a fine for the violator himself and for the owner of the home in which he lives.

A fine is also issued in cases where a citizen was already registered, but did not renew the document in a timely manner. Since the Federal Migration Service takes up to 7 working days to process your application, you should submit your application in advance.

If a citizen has already expired his application, but wants to stay in the country, he must still contact the FMS and explain why he did not renew his registration in a timely manner. If the person has not committed any other violations, there will still be a fine, but he will avoid deportation.

In each situation, the final decision is made only by the inspector after carefully checking all the circumstances. He has the right to decide what to do with the citizen - limit himself to punishment in the form of a fine or oblige him to leave. Usually, in the case of the first violation, the person is met halfway.

It is important to remember that the loss of this document is also punishable. If this happens, you should immediately contact the migration service, this will help prevent a fine.

Punishment is also provided for legal entities. In large cities, the fine for them is 50-750 thousand rubles.
