What steps does a foreigner need to take to obtain a residence permit in Russia? For how long is this document issued?

The procedure for obtaining a residence permit in Russia is regulated by the Federal Law “On the Legal Status of Foreign Citizens in the Russian Federation” dated July 25, 2002 No. 115-FZ (hereinafter referred to as Law No. 115-FZ), as well as the Administrative Regulations approved by the Order of the Ministry of Internal Affairs of Russia dated November 9, 2017 No. 846 (hereinafter referred to as the Regulations).

A few words about what a residence permit is (hereinafter referred to as residence permit) and why you need to obtain it.

A residence permit is a document issued to a foreign citizen or stateless person in confirmation of their rights to permanent residence in the Russian Federation, as well as their right to free exit and entry into the Russian Federation. A residence permit issued to a stateless person is also a document proving his identity (Article 2 of Law No. 115-FZ).

How to get a residence permit in Russia in 2021

In order to legally work and live in Russia, citizens of other countries must correctly obtain a residence permit. To do this, a residence permit is issued in the following order:

  1. Residence in the Russian Federation for more than one year with a temporary residence permit patent, without violating the law.
  2. Preparation of a package of documents.
  3. Filling out an application, providing a package of documents to employees of the Main Migration Department of the Ministry of Internal Affairs.

To obtain a patent on a general basis, you must have a valid temporary residence permit.

Sequence of obtaining a residence permit:

  1. Filling out the application from the Main Directorate of Migration Affairs of the Ministry of Internal Affairs strictly according to the provided sample.
  2. Take a Russian language test. Citizens of Belarus, children, pensioners, and foreigners with a diploma from a Russian university pass without an exam.
  3. Provide a medical certificate with a fresh stamp.
  4. Provide a certificate of income 2 personal income tax, which is issued by the head or specialist of the financial institution.
  5. Provide a document confirming ownership of housing or a lease agreement.

As stated above, the processing time for the application is about six months. But for certain categories of persons this term is abbreviated:

  1. Participants in state programs – up to 2 months.
  2. Qualified specialists – up to 3 months.
  3. Citizens of Belarus – up to 3 months
  4. Refugees – up to 15 days.

Obtaining Russian citizenship after obtaining a residence permit

Many migrants receive a residence permit with the goal of subsequently obtaining Russian citizenship. Having acquired a new status, a foreigner can submit an application, but not immediately. If he is not included in one of the preferential categories, he can apply for citizenship no earlier than five years of permanent residence in the country.

Important! The permissible time spent outside the country is a maximum of three months during the year.

The decision to grant the status of a citizen of the Russian Federation is made within a year. If a negative decision is made, the migrant can continue to reside in the country under a residence permit.

Remember that a residence permit is not only rights, but also obligations to the state that a citizen must fulfill.

The presence of a permit gives pensioners and citizens of foreign countries the right to receive the following types of pensions: insurance, funded, and state pensions. When submitting an application six months after receiving a temporary residence permit, a pension certificate is attached.

When filling out an application a year after receiving the temporary residence permit, you need to collect a complete package of documents and contact the FMS again at your address of residence. It is worth noting that the income certificate is provided by the person who is dependent on the foreign person. What to do if you can’t complete your registration on time?

A foreign citizen who does not have time to register at his place of residence in a timely manner may register for migration at his place of residence. And when the opportunity arises, register. The whole point is that the law does not clearly indicate that with a residence permit you can either register or register for migration. What documents are needed for a residence permit in Russia in 2021

To obtain the appropriate permit, a foreign applicant needs to prepare a complete package of documents. It includes:

  • application in two copies, filled out according to the standard form;
  • original passport;
  • a valid temporary residence permit;
  • four photographs measuring 35x45 mm;
  • medical report;
  • certificate of completion of courses in the discipline “Russian language”;
  • original and copies of the work book, 2NDFL certificate, bank statement;
  • registration document;
  • receipt for payment of state duty.

In some cases, the case may require the following additional documents:

  • marriage certificate with a citizen of the Russian Federation;
  • document on ownership of real estate in Russia;
  • a document certifying family ties with a citizen of the Russian Federation.

If one of the above documents is provided in a foreign language, you will need a notarized translation.

Does a foreign citizen need registration at his place of residence?

The choice of registration depends on the period that the foreigner plans to spend in the country and the availability of housing within Russian borders. One way or another, registration is always issued - violation of the law threatens the migrant with a fine or deportation from the country.

Obtaining a permanent residence permit will allow a foreigner to:

  • get a job in any field;
  • freely sell and buy real estate;
  • open your own business, which will not be subject to additional taxes;
  • receive free medical care.

Important! Any foreign citizen who enters the territory of the Russian Federation is required to report to the migration service about his arrival. If he arrived for a short period of time and stayed at a holiday hotel or boarding house for treatment, the information to the inspector is provided by the administration of the institution.

Where to apply for registration

Temporary registration in Moscow with a residence permit

Temporary registration is required for everyone. After arriving in the capital, only 7 working days are allotted for processing the document. If the deadlines are missed, the foreigner may be deported to his homeland without the right to return to the Russian Federation.

For some categories of citizens, only 24 hours are allotted for processing the document. This:

  • temporary guests of the capital who live in a hotel, holiday home or sanatorium;
  • those who came on duty for work;
  • persons imprisoned in special institutions;
  • persons without a fixed place of residence living in a shelter.

These citizens must be registered on the day of arrival, but if it falls on a weekend, then the issue must be resolved on the first working day.

Possible restrictions

Temporary registration at the place of residence is limited to three years, after which the citizen must extend the period of stay in the country. To do this, you need to contact the FMS office at your place of residence with an application and additional papers. Permanent registration, unlike temporary registration, is issued for an unlimited period - until the citizen is registered in another place or until his death. The process of obtaining permanent registration has several features:

  1. A foreigner can apply for it only if he has a temporary residence permit (find out the specifics of registering after receiving a temporary residence permit here) or a residence permit.
  2. A migrant must submit an application for permanent registration within a week after receiving one of the documents reflected in the previous paragraph. There are no exceptions.
  3. Registration must take place at the address of the residential premises (apartment or own house).
  4. A foreigner can register only at the MFC branch or passport office. The post office does not perform such functions.
  5. The migrant will have to collect an impressive package of documents for registration, which includes the consent of all owners of the residential premises for the foreigner to live there.

Note! After a citizen receives a long-term registration, the housing and communal services will increase the amount of monthly payments.

This is justified by the fact that with temporary registration (stay), the migrant does not stay in the apartment for long, but with permanent registration he will live in a residential building, and, accordingly, spend more electricity and water.

How is the residence of a migrant in Russia regulated?

When studying the issue, a migrant can refer to the following legislative acts:

  1. The Constitution of the Russian Federation, reflecting the norms of behavior and residence in the country not only for Russians, but also for visiting citizens.
  2. Government Decree No. 9 of January 15, 2007, which sets out the basic registration rules for migrants.
  3. Federal Law No. 109 of July 18, 2006, covering in more detail the migration registration of foreigners. Article 16 of the law is devoted to the peculiarities of registering visitors.
  4. Regulation No. 364, in force in the Federal Migration Service. Established by order of the Federal Migration Service on August 29, 2013. It was created for service employees who are involved in registering citizens, but will also be useful for migrants in studying the features of registration.

There are also numerous international treaties, according to which the legal periods of stay of foreigners in Russia are established. They establish the features of entry: visa or visa-free, and also reflect the rights and responsibilities of migrants.

How to apply for Moscow registration on the basis of a residence permit?

A foreigner may notify the relevant authorities of his arrival in person. You can also submit your application by mail. The main thing is to correctly collect the entire package of documents. It is important to write the application on the organization’s letterhead and draft it correctly. Also, the application must be accompanied by the consent of the owner of the property in which the foreigner intends to register. The package of documents also needs to include a copy of your passport and a copy of your residence permit. If a person does not have a passport, then only a residence permit can be provided. You will also need a copy of the receiving Russian citizen. If this is not the first visit to the Russian Federation, and the foreigner was previously registered at a different address, a detachable part of the arrival notice will also be required.

The second method of registration is through the receiving party. This mainly applies to those living in hotels, sanatoriums, arriving in the country for work, etc. In this case, the foreigner gives the national passport to the receiving person, as well as the detachable part of the arrival notice. The Arrival Notice must be completed correctly and accurately. No crossing outs or corrections should be allowed. Only one person can be entered on one form, even if he fills out information about the entire family. The form can be filled out by hand or printed.

You can contact the Ministry of Internal Affairs, the local MFC, the post office or the State Services website. The issue can be resolved through mail or the MFC only if the foreigner has two copies of the notifications. In all situations, it is necessary to provide documents not only of the foreigner himself, but also of the receiving party. Both a citizen of the Russian Federation and a company can act as a host.

Temporary registration for a residence permit is issued for the period specified in the notification. Ultimately, the foreigner will have in his hands a tear-off part of the notification form, on which the corresponding mark will be affixed.

Grounds for permanent registration

The legislation establishes the grounds upon which a citizen has the right to apply to the FMS to obtain permanent registration:

  • marriage with a citizen of the Russian Federation and the birth of a common child;
  • long-term work (more than 3 years) under a contract in the country with contract extension;
  • purchase of real estate ownership.

A foreigner who arrived on the territory of the Russian Federation with a visa (when migrating from a country with which visa entry has been maintained) applies for a temporary residence permit. If at least one of the conditions for permanent registration is met, the citizen is obliged to notify the FMS of his intentions until the visa expires (usually 90 or 180 days).

If visa-free entry occurred, the citizen must notify the FMS authorities of his intentions to register for registration at his place of residence within seven days.

Note! Registration of official registration is not recognized as a basis for extending the period of stay in the country. If a migrant crosses the border on a visa, he has the right to obtain registration only for the duration of the visa.
