The Russian Ministry of Internal Affairs has canceled the fine for an expired passport until 2021

Every Russian citizen over 14 years of age must receive a passport. This is a document proving a person's identity. It is called internal because it is used only in Russia. The Regulations on the Passport of a Citizen of the Russian Federation states that this document is subject to mandatory replacement when its owner reaches 20 and 45 years of age. In addition, other circumstances have been established that oblige the owner of the document to replace it.

Failure to promptly replace a document is punishable by an administrative fine, the amount of which depends on the severity of the violation and the region of residence of the citizen.

Grounds for fine

Administrative punishment for untimely replacement of a passport of a Russian citizen is imposed on persons whose passport is invalid. The basis for prosecution is the residence of a citizen without an identification document.

Legislative acts

Punishment for overstaying a civil passport on the territory of Russia is regulated by several regulatory legal acts (LLA):

All of the listed regulations indicate the grounds for imposing an administrative penalty, circumstances that reduce the guilt of the offender and the reasons for exemption from punishment.

Delay after name change

In case of a change of surname due to marriage or other circumstances, the citizen must change his passport. To replace the document, 30 days are allotted, during which it is necessary to submit a corresponding application to the authorized body.
Important: the old passport becomes invalid immediately after the last name is changed.

There is a delay of 20 for pasting photos.

Upon reaching the age of 20, a citizen must replace his identity document. This must be done within 30 days after your 20th birthday.

Young men who are serving in the army at the age of twenty receive a deferment to replace their passport. The deadline for receiving a new document is frozen until the end of its service life. The 30-day period begins after demobilization.

Delay in inserting photos is 45

When you reach the age of 45, you need to change your ID card again. This is the last mandatory passport replacement. You are also given 30 days to complete the procedure.

A valid reason for missing the deadline may be serious health problems or the citizen being treated in a hospital. Despite the presence of good reasons, the citizen will not be completely exempt from the fine, but may “get off” with a minimum amount of the penalty.

Procedure and deadlines for passport replacement

Mitigating and aggravating circumstances when assigning punishment

If my passport is expired, what should I do? It is recommended to take actions that mitigate guilt.

Mitigating circumstances include the following:

  • the person voluntarily admitted to the offense and eliminated it in a timely manner;
  • the citizen provided assistance in identifying the circumstances under which the offense was committed;
  • the person independently corrected the violation before the authorized bodies issued a decision on punishment;
  • the person is late in contacting the authorized bodies due to financial, personal, family or other circumstances;
  • a woman missed the deadline for changing her document due to pregnancy or the presence of a small child.

If the above reasons are identified, the fine may be reduced. In some cases, the violator may get off with a warning.

Circumstances that aggravate the guilt of the offender are also highlighted:

  • the person continues to carry an expired passport with him, although the deadline for its replacement has already expired;
  • the person received a warning, but did not replace the document within the time limits established by law;
  • the offense was detected at a time when the citizen was under the influence of alcohol/drugs and committed another culpable offense.

When establishing these circumstances, other reasons that are not defined by law may be taken into account. But additional reasons should be cited if there are documents confirming this fact.

Which passport is expired?

According to the Regulations on the Passport of the Russian Federation, this document is subject to mandatory replacement upon reaching 20 and 45 years of age. This must be done in order to change the photograph in the document, since with age a citizen’s appearance can change significantly, which will make it difficult to identify his personality using the previous document.

It is not only a passport that had to be changed upon reaching a certain age that is considered expired. The following factors are also grounds for replacing the document:

  1. Change of personal data (last name, first name or patronymic) of the owner of the document.
  2. Making changes to the date and/or place of birth of a citizen of the Russian Federation.

Late penalty amount

According to Art. 19.35 of the Code of Administrative Offenses of Russia, the penalty for failure to comply with the deadline for replacing a passport may be:

  • 3000-5000 rubles for residents of Moscow and St. Petersburg;
  • 2000-3000 rubles for residents of other settlements in Russia.

The final amount of the fine is determined by an authorized inspector of the Main Directorate for Migration and Migration. The amount of the penalty directly depends on the duration of the passport delay.

Consequences of late passport replacement

Missing the replacement deadline is regarded as an administrative offense. A citizen convicted of this offense is subject to a fine of up to 1,500 rubles. The amount of the fine is determined by the authorized person.

In the future, the citizen can start collecting papers to replace his passport, and a note indicating payment of penalties will be placed on the application.

For living on the territory of the Russian Federation without an identity card, an amount of up to 5,000 rubles is charged. The size of the fine depends on the area where the offender lives.

Penalties and administrative penalties

Procedure for replacing a passport

To replace a passport that has lost its relevance, you must contact the department of the Main Directorate for Migration of the Russian Federation. If you do this before the expiration of the 30-day period, the inspector does not have the right to impose a fine for overstaying your passport.

To replace a document, you will need to provide the following set of documents:

Renewal of a passport, which is a mandatory document abroad, is required when traveling is planned in the near future. An expired document does not entail monetary payments, that is, no penalty is provided. If the trip is not expected, then an expedited extension is not required.

However, before a vacation, in case of inattention and forgetfulness, discovering the invalidity of a document is especially unpleasant if the trip has already been fully planned. It is best to take care of re-registration in advance, otherwise you will simply not be allowed to go abroad with an expired passport.

The process of replacing a document, both the old type and the one with a built-in chip, is practically no different from the initial issue. The document is not taken to the GUVM, but if the validity period has not expired, but the passport needs to be replaced, then the service employees are required to confiscate it.

If the question arises about how to change a document with an expired validity period, it is important to find out about the replacement deadlines. The waiting time for production is also similar to the initial issue of the document - 1 month excluding weekends and official holidays. The time indicator may be affected by the season in which the procedure is performed. For example, in the summer, there is a possibility that many people are dealing with the same problem, since the holiday season is approaching, so the process may be delayed.

How long does it take to pay the fine?

After a penalty has been imposed, a citizen has the right to appeal it in court.
10 days are allotted for this from the date of the relevant decision of the authorized inspector. If no complaint is received from the violator during the specified time, then after 10 days the decision to impose a penalty takes on legal significance. The fine for an expired passport must be paid within 60 days from the date it comes into force. Ignoring the requirement to pay the collection may result in increased penalties.

Information: if a citizen does not change his passport for more than 3 months after the expiration of the designated period, he may be subject to criminal liability.

Contacting the MFC

MFC (Multifunctional Centers) is a network of government agencies operating in a single window mode, where any citizen of Russia can apply to receive or issue almost any document from a variety of government agencies. MFC is an excellent intermediary between citizens and any authorities. In addition, using his services frequently is much more pleasant and comfortable than contacting officials directly. Liability for failure to pay a fine

If the violator does not pay the resulting debt in a timely manner, additional sanctions may be applied to him, regulated by Art. 20.25 Code of Administrative Offenses of the Russian Federation. These include:

  1. Arrest for up to 15 days.
  2. Increase in the amount of the fine.
  3. Correctional labor for up to 50 hours.

2 years are allotted for the execution of additional penalties. Until it is fulfilled, the violator is prohibited from leaving the territory of Russia. In addition, bailiffs can block the violator’s accounts.

Mitigation and tightening of responsibility

A detailed list of circumstances conducive to mitigation of punishment is indicated in 4.2 of the Code of Administrative Offenses of the Russian Federation. The penalty may be reduced in the following situations:

  1. Repentance and elimination of the violation by a citizen who has committed a delay.
  2. Elimination of consequences and compensation for harm caused due to the violation.
  3. Missing a deadline due to military service, being in a hospital, or for reasons beyond the control of the offender.
  4. The violation was committed by a pregnant woman or mother of an infant.

Practice shows that in order to reduce the amount of the fine, a citizen only needs to come to the office of the Main Directorate for Migration Affairs of the Russian Federation with all the necessary documents. If the deadline is violated due to serious illness or pregnancy, the amount of the penalty may be significantly reduced. Also, if there is evidence of the seriousness of the reasons why the deadline was missed, the fine can be completely canceled.

Note: according to Art. 2.9 of the Code of Administrative Offenses of Russia, an official may release the offender from liability. Most often, this is possible when minor violations are committed (for example: being late by 1-2 days or missing a deadline due to force majeure).

In 2021, there is only one circumstance conducive to tougher punishment. This is a deliberate evasion of legal requirements. The longer a citizen ignores the requirement to replace his passport, the greater the likelihood that he will be given the maximum possible fine and additional penalties will be applied.

What to pay attention to

There can be many reasons for re-issuing a document, in addition to its expiration. According to the laws of the country, it is necessary to contact the GUVM in the following cases:

  • there are no more blank pages in the passport;
  • if the document is missing or stolen;
  • if personal data has been changed, including first name, gender, last name;
  • in case of mechanical damage to the pages or cover.

If the passport allows you to travel abroad, that is, its validity has not expired, but it needs to be replaced for another reason, then the old version is canceled, and the applicant is issued a new copy. If the validity period has expired, the document remains with its owner.

The procedure for accepting a document after its expiration date does not raise any questions on the part of GUVM employees or certain difficulties. The same applies to situations where there is less than six months left before the end of the relevance period. If the period exceeds 6 months, then the GUVM may be reluctant to re-issue a document required, for example, for a long trip for business purposes.

The applicant will have to explain, verbally or in writing, the reason for wanting to replace the passport well before its expiration date. It is possible to contact the head of the unit on this issue. In this case, you need to familiarize yourself in advance with the existing restrictions for replacement before the deadline stated in the passport.

How to avoid a fine for an expired passport

The only way to avoid punishment for overstaying your passport is to contact the Main Migration Department of the Ministry of Internal Affairs of Russia in time to replace the document. Also, the possibility of cancellation of a monetary penalty appears if the citizen did not allow a long delay and independently appeared at the authorized body after 1-2 days of delay.

In case of failure to comply with the deadlines established for replacing the passport of a Russian citizen, the owner of the document will be subject to an administrative penalty. According to current legislation, an official has the right not to apply this penalty if a minor violation has been committed (delaying the deadline for 1-2 days, force majeure, etc.).
