What is a technical passport of an apartment?

A registration certificate for an apartment is a document that contains all the information about the building in which the apartment is located, as well as about the apartment itself. It has no legal force and is a primary document with information about the results of the inventory. The technical passport contains:

  • house address, inventory number;
  • situational plan - the house is marked with an outline on the map;
  • floor plan of the apartment - your layout relative to neighboring apartments is shown;
  • explication - listing all the rooms in your apartment, including loggias and balconies, closets and dressing rooms;
  • detailed description of the apartment - total area and area of ​​individual rooms, ceiling height, description of the loggia or balcony;
  • information about the building - year of construction, type of heating, etc.;
  • date of the last technical inspection of the apartment.

By law, it is not necessary to regularly update the data in it. But if the apartment has been remodeled or communications have been moved, a window or opening has moved, the floor plan has changed (for example, old pipes have been replaced with new ones), then updating the technical data is necessary.

Today, it is not necessary to have a paper registration certificate on hand to approve repairs. The main thing is that the apartment is registered with the BTI. The Moscow Housing Inspectorate itself will request a technical passport when it begins to consider your application for redevelopment, check that the BTI plan coincides with the data of the redevelopment project, and issue its decision.

What is needed to obtain a land passport?

The list is standard for most real estate documents:

  • Citizen's passport;
  • Title documents for the target plot of land;
  • Payment of state duty in a certain amount (rates are indicated on the Rosreestr website for each type of passport separately);
  • Completed application form for obtaining a CP.

Documents are handed over to an employee of Rosreestr or MFC against signature. Check its completeness and accuracy, and also accept seized papers based on it carefully. The production time for a CP usually does not exceed 5 days, however, the state registrar may require additional information. There is also a mechanism for refusing to issue a cadastral passport, for example, in the event of an application from an inappropriate person. The list of reasons for refusal is described in Federal Law No. 221. Even in case of refusal to issue a cadastral passport, the applicant can appeal the registrar’s decision by filing a lawsuit against Rosreestr. Trial is also often required in cases of:

  • Delays in issuing CP;
  • Loss of documents issued for obtaining a passport;
  • If the registrar requires additional documents not provided for by the regulations and legal procedure.

Sometimes disputes can end with an appeal to the head of the authorized body, in a pre-trial manner.

Registration passport - what kind of document is it?

It is an A3 booklet and consists of drawings, tables, as well as data in the form of text about the condition of the room.

It contains information about:

  • home owner;
  • location of the premises;
  • common living space and individual rooms;
  • inventory value of housing;
  • major repairs carried out;
  • redevelopment;
  • material of walls and ceilings, as well as their finishing;
  • engineering communications;
  • explications;
  • how old it was built, etc.

At the end of it, the date of issue, signature and information about the person who issued the document must be indicated.

It is issued for an indefinite period, but requires updating and reconciliation every 5 years. If this deadline is missed, no sanctions are imposed on the owner, but, for example, it will not be possible to sell an apartment with an “outdated” registration certificate. You will have to update the document quickly, and this is already a problem if you need to urgently sell your home.

That is, difficulties due to omission may begin after the fact, when this document has to be used officially somewhere.

Also, changes must be made to the technical passport if the layout of the apartment has changed. The responsibility for re-issuing documents in this case falls on the owner - it is he who must contact the relevant authority to reflect the changes made in the registration certificate.

Differences between a technical passport and other documents

You can confuse a technical passport for an apartment with a technical plan or cadastral passport. These are three different documents:

  1. The technical plan includes technical information about the object, reference to the building and area, and contains a satellite photograph with the location of the object.
  2. The cadastral passport contains information displayed in the address register, as well as the object number in the unified building registration system.
  3. The BTI technical passport is a plan indicating the length of each wall in the apartment, listing absolutely all rooms, and the location of utilities.

What is the difference

It is worth understanding that these are completely different information and reference documentation. The technical data sheet contains more information. It includes the material from which the floors are made, the year of commissioning, and the inventory value of the housing. This is what is used to evaluate an apartment.

The cadastral extract is mainly used in conjunction with Form 7, since it records the missing information.

Such documentation may be required not only for real estate transactions, but also for obtaining a mortgage. Most banks request both a plan and a statement at the same time to check the purity of the transaction.

Registration certificate for an apartment in a new building

Obtaining a technical passport for an apartment in a new building is the responsibility of the owner. The developer himself rarely registers the house with the BTI; he only registers the new building with the cadastral register.

To carry out an initial inventory and obtain a technical passport for an apartment you need:

  • obtain from the developer an architectural plan according to which the house was built;
  • pay the state fee and call a BTI technician to take measurements and compare your apartment with the architectural plan data;
  • get a BTI plan.

The first difficulty is that when visiting the apartment, the technician may not find some walls that are in the document from the developer. This threatens the appearance of “red lines” in terms of BTI. You will have to erect walls that the developer had in the project, and legalize redevelopment that you did not even do. This is the only way you can get a BTI plan in black lines.

If the current condition of the apartment corresponds to the developer’s architectural plan, you will receive a plan in black lines, and you can begin redevelopment.

The second problem is the errors of the BTI itself. Measurements may be carried out incorrectly, and this causes difficulties in coordinating redevelopment. Errors may “pop up” at a late stage of legalization, and then you will first have to correct the BTI plan, and then start the approval almost all over again.
