Temporary registration in an apartment: what is it and how is it dangerous for the owner?

Find out on our website how temporary registration differs from permanent registration, whether it is possible to register temporarily without permanent registration, and what the consequences are for late registration at your place of stay.

The essence of the process

What is temporary registration in an apartment? Registration at the place of residence is the procedure for registering at the address where a person lives for a certain period.

If you come to work or study in another locality and stay there for more than three months , you must inform the FMS authorities about this.

Failure to register temporarily is considered an administrative violation and is subject to a fine .

Moreover, penalties threaten not only a person who does not live at his place of permanent registration for more than 90 days, but also the owner of the premises in which he lives.

Temporary registration is valid simultaneously with permanent registration . In this case, the stamp in the passport remains with the permanent residence address, and an additional certificate insert is issued with the residential address written on it.

Such registration in an apartment is issued for a certain period - from 6 months to 5 years and is canceled automatically after this period.

It gives a person the right to live at a given address for the period specified in the insert.

You can register in any premises intended for residence :

  • apartment (own, municipal, service);
  • private house;
  • hostel;
  • hotel;
  • boarding house, shelter;
  • sanatoriums, hospitals.

If the period of residence in a given territory is less than three months, it is not necessary to register your presence in it. To protect yourself from law enforcement agencies, you can present a travel document, sanatorium card, etc.

How to register: step-by-step instructions

The same registration rules apply throughout the Russian Federation. The procedure for registering in your locality or another city is absolutely identical. The only question that a person who has moved will have to decide is where to register. When you buy your own home, the problem is automatically removed. In other situations, care should be taken in selecting options.

If you imagine the procedure step by step, it will look like this:

  1. The owner of the property, together with the new tenant, is sent to the territorial department of the Ministry of Internal Affairs.
  2. Both parties submit the documents necessary for registration.
  3. Fill out the application form for registration.
  4. After a set time, you will need to re-visit the department to receive a stamp.

Despite its apparent simplicity, registration has a number of nuances that should be taken into account.

What should you do first?

Before you apply for a new registration, you need to think about what to do with the old one. By law, a registrant can take two different paths:

  1. Submit an application for deregistration at your previous place of residence. He is given a departure slip, which he must provide when registering in another city.
  2. Go to the passport office at the place of registration without prior registration.

The second option is preferable. On the one hand, the procedure is simplified by half, because the extract is performed automatically. On the other hand, this will allow the citizen to calmly resolve all issues that arise with the move and not adhere to strict registration deadlines.

When deregistered, a person must register at another address within 7 days, otherwise he will be held administratively liable.

Where to contact?

Registration is carried out by departments of the Ministry of Internal Affairs. You can register at the department of the Ministry of Internal Affairs that oversees the territory where the living space is located.

There are other ways to apply, for example through the MFC or the State Services website . You can submit an application at the MFC and pick up a stamped passport, although you will have to spend a little more time on the whole procedure. State services only allow you to simplify the application process, but personal visits are not canceled (how to register through State Services is discussed here).

What additional papers may be required?

Registration is carried out on the basis of documents submitted to the Ministry of Internal Affairs. The most important of them is the consent of the homeowner.

The standard package of documents may be supplemented with other forms depending on the situation:

  • When registering as municipal property, you must obtain the consent of all persons registered there. It is compiled in any order in writing.
  • When registering a child, a birth certificate is required. And in some cases it is impossible to do without the consent of the guardianship and trusteeship authorities.
  • When registering your spouse, you must attach a marriage certificate.

For foreign citizens, you cannot do without permission from the migration service.

Registration deadlines

Article 6 of the Law of the Russian Federation No. 5242-1 of June 25, 1993 establishes that a person is obliged to register within 7 days after deregistration. If a preliminary discharge at the place of residence was not carried out, then you should report to the Ministry of Internal Affairs within seven days after arriving in the locality.

The timing of registration at a new place of residence is described in this article.

Possible expenses

Registration on the territory of the Russian Federation is free of charge . You will not have to pay a state fee for submitting documents. But registration costs may arise if the registered person enters into a paid rental agreement with the owner of the property.

Why is it needed?

Temporary registration in an apartment is necessary for the exercise of social rights and interaction with government agencies.

A citizen can perform the following actions:

  • receive medical care;
  • register the child in an educational institution;
  • apply for a job;
  • take a loan;
  • apply for benefits.

Using the certificate, you can also register the purchased car. Registration of a car will also be temporary, for the duration of the document.

Is it possible to obtain permanent registration in other localities, regions, regions?

In case of a radical change of place of residence, such as moving to another city or even region, a person must also change his registration.

This measure may not seem obvious to everyone, but it should be taken into account that many social processes are based solely on registration.

Having registered at a new address, the registered person will be able to get a job without any problems, enroll their children in kindergartens and schools, receive regional benefits, draw up any documents on the spot, and much more.

The basis for registration in another city may be:

  1. Ownership of housing or shares in it (how to register in shared housing?).
  2. A lease agreement concluded with an individual.
  3. Social tenancy agreement.

If you have close relatives, you can register with them. The basis for registration may be marriage. The spouse may, if desired, register his wife or husband with him.

Is it permissible to obtain registration in an apartment remotely?

Let's consider whether it is possible to remotely apply for registration in another locality. Since the technologies operating today make it possible to facilitate the registration process, it is possible to start the registration process remotely, but it will not be possible to completely exclude your own presence at the place of registration and register it without going to the place of registration.

In a standard situation, for registration, the registrant and the owner of the property must appear in person at the territorial department of the Ministry of Internal Affairs, which is located at the place of registration. If the living space belongs to the person who is registering, then he comes alone (is it possible to register without personal presence?).

You will need to appear at the department again after the allotted time to receive a registration stamp. By using the State Services website, you can avoid the first visit, but you will still have to appear at the Territorial Office of the Ministry of Internal Affairs with the original documents and the owner of the property to confirm your intentions.

Basic legal provisions

To control the movement of citizens of the Russian Federation, registration at the place of temporary or permanent residence is mandatory

Migration legislation of the Russian Federation is the main source of migration law on the territory of our country.

It is this, represented by numerous Federal laws, that determines the migration process and the procedure for registering Russian citizens or foreigners at their new place of residence.

As for the need for registration in a new city when moving, this practice was introduced in order to control the tax and other obligations of residents of the Russian Federation.

Depending on how long a person plans to live in another city, he can apply for two types of registration:

  • permanent (indefinite);
  • temporary (up to 3 years).

It is necessary to register at a new place of residence only if a citizen wants to stay in a city outside the boundaries of permanent registration for more than 3 months. In accordance with the law, permanent registration can only be obtained if one of the following circumstances exists:

  • purchase or other type of acquisition of your own home;
  • the consent of the owner of a certain residential premises to register a specific citizen.

Risks and consequences

What are the consequences of temporary registration for the owner of an apartment? After its registration, the following unpleasant moments may arise for the owner of the living space:

  1. Increase in payment amounts for housing and communal services. If payment is made not according to meters, but according to the number of residents, you will need to pay for everyone registered (more details in our article).
  2. Problems with tax authorities.
  3. Registration in the apartment of minor citizens. If a child is born to a temporarily registered person, he will be registered at the same address, and without the consent of the owner. It will be possible to discharge a child only by court, and even then only if the parents have their own housing.
  4. Financial difficulties. All fines, summonses, and notices from credit institutions will be sent to the temporary registration address.

How can an owner avoid problems? In any case, the law will always be on the side of the owner, and temporary registration can be canceled at any time . Therefore, rumors about the dangers of this procedure are somewhat exaggerated.

Even with temporary registration, an unwanted tenant is evicted at the request of the owner of the living space. To avoid possible problems, it is better to issue it for a short period of time and extend it if necessary.

To protect yourself from the registration of minor citizens in your apartment, before registration, check for a permanent registration stamp. If it is not there, it is better not to register such a tenant in your apartment.

Features and nuances

Remember that if you are registering for a minor child, you should not take the permission of the property owner or the consent of the residents.

A minor child is automatically registered at the place of registration of his parents, regardless of whether the owner agrees to this, and he can only be discharged upon reaching the age of eighteen.

It is important to pay great attention to the execution of the application. If you are entering an apartment in which you are not the owner , in addition to your signature, the application must also contain the signature of the owner of the property. Only in this case will your application be accepted.

Termination

Temporary registration ends after the expiration of the period for which it was issued. There is no need to perform any additional actions. Simply put, the insert becomes invalid as soon as the date indicated in it as the registration period has passed.

In addition, the owner can contact the Federal Migration Service with a request to terminate the registration earlier than the specified period .

Since a temporarily registered person does not have any rights to housing, only the owner decides whether he will be registered or not.

You can lose your registration the very next day after registration if the owner of the property suddenly changes his mind. In this case, no evidence or justification is required from him .

If a person registered in a certain territory no longer needs this registration, he can write an application to the FMS office with a request to cancel it ahead of schedule.

But you don’t have to do this; you can simply move out of this address and not use the insert anymore .

Types of registration

A citizen can register at a new address temporarily or permanently. The type of registration depends on the goals pursued by the individual. For example: to move while studying, temporary registration is sufficient.

The rights for permanent and temporary registration are the same. The only difference is its validity period. Temporary registration is limited, its maximum validity is three years. When registering permanently, a stamp is affixed to the passport. Temporary registration requires a certificate.

From a legal point of view, there is no difference between types of registration. In practice, there are quite often situations where people with temporary registration have difficulty accessing high-paying jobs or bank loans.

Re-registration at the initiative of the owner

Is it possible for the owner to re-register someone registered temporarily? As already noted, the owner of the apartment can revoke the temporary registration of a citizen at any time . Can I register a face myself?

You can register at any address only by personal application. The owner cannot independently register another person, even by personal application.

The action can only be performed on the basis of a notarized power of attorney.

Timing and cost

the one-week period established by Law No. 5242-1 of June 25, 1993 , but it all depends on how complete information you provided about yourself and how much additional information employees need to obtain at their previous place of registration.

The registration procedure is completely free and does not require payment of state duty. The only material aspect is a fine , which is imposed if you missed the ninety-day deadline for registration at your place of residence.

What additional papers may be required?

When registering at a new place of residence, migration service employees have the right, if necessary, to request additional documents. Such documents include:

  • When registering a minor together with his parents or guardians, a birth certificate of the child is additionally provided;
  • To register a legal spouse, a marriage certificate is provided;
  • To register in state or municipal housing, you must first collect documents confirming the consent to registration of all citizens permanently residing in a given residential area;
  • For citizens who do not have a Russian passport, in order to obtain registration on the territory of Russia, it is necessary to draw up a document with the migration service stating that there are no obstacles to their residence in the country.

Legislative basis

The legislation of the Russian Federation and by-laws establish the procedure, deadlines for registration rules, as well as the responsibilities of both Russian citizens and foreign ones. List of acts regulating registration:

  • Federal Law “On the right... to freedom of movement... in... the Russian Federation”.
  • "Registration rules.."
  • "Administrative regulations..."
  • Code of Administrative Offenses of the Russian Federation.
  • Government Resolution No. 809 (August 15, 2014).

REFERENCE! Citizens of foreign countries can register at their place of residence only after they have received a residence permit or visa.

Where to go to obtain temporary registration

Documents for temporary registration can be submitted in three ways:

  • in person to the department - to the Ministry of Internal Affairs (department for migration issues) or any office of the MFC (My Documents) by appointment or on a first-come, first-served basis;
  • passport offices at management companies and homeowners' associations also accept documents for temporary registration;
  • online through State Services, having previously prepared scans of documents;
  • by mail - but this method is unpopular due to delays in the delivery of written correspondence, as well as the high cost, because all documents will have to be certified by a notary.

Regardless of the method of submission, the application is ultimately considered by the department of the Ministry of Internal Affairs for Migration Issues, serving the desired address. This is where you will need to come to receive a certificate of temporary registration.

Registration procedure

You can change your place of residence on the basis of , but you will have to inform the migration authorities about your location. To register in a residential building, as well as to register in another city for citizens of the Russian Federation, you must contact the registration authorities.

      If an adult is registered, then we obtain the consent of all residents (for municipal housing), for privatized housing - the consent of the owner.
  2. If your representative will do the registration instead of you, we will issue a power of attorney for him.
  3. A child can be registered only after receiving permission from the guardianship authorities of this region.
  4. Choosing a registration method

Advantages and disadvantages

There are both pros and cons to changing your registration from city to regional. Let's start with the advantages. In regional settlements it is lower and cheaper:

  • public utilities;
  • taxation, for example, transport tax;
  • Food;
  • the cost of housing under construction.

In addition, less time is spent on completing various official papers.

We have indicated the main advantages of the region from the capital centers. Now briefly about the shortcomings.

Regional residents, unlike both capitals, are limited in receiving social benefits such as education, culture, and healthcare. In the region, there are usually lower subsidies, wages, and the like. Although, frankly speaking, life in regional settlements is much calmer than in the capitals.

How to obtain permanent registration?

If a citizen has decided to change his permanent place of residence, he must know how this procedure can be carried out according to the law.

According to the law (Federal Law No. 5242-1), the following steps must be taken:

  1. You need to come to the passport office and fill out an application there. This must be done according to the sample provided by the employees.
  2. You need to wait three days. During this time, the passport office employees will issue a departure slip. This document must be provided when going through the new registration procedure at the passport office.
  3. The procedure for releasing a previous registration is not mandatory. It is permissible to issue only a new registration, and the passport office employees will notify the citizen about the new place of residence.
  4. In order to obtain permanent residence, you must prepare a certain list of documents and appear at the passport office.
  5. Registration must be completed approximately three days in advance. The specific number of days depends on the speed of requests and responses from the passport office staff.
  6. The identity card must have a mark indicating the citizen’s new place of residence. From this moment on, it will be considered officially registered.

Registration for a specific period

The procedure for temporary registration is more simplified than registration of permanent registration.

How can you register temporarily in a foreign city? To complete the registration process, it is not recommended to give up your permanent registration.

For temporary residence you will need:

  1. Prepare the necessary papers and contact the passport officer. You must also have approval from the owner of the living space.
  2. Wait seven days for the passport office employee to review the submitted documents.
  3. There is no note in the passport that the citizen has temporary registration, but he is required to provide evidence of this.

Temporary residence is issued for a certain period of time. A citizen can be temporarily registered for no more than three years. For this reason, there are not many such requests in the passport office, which means that the entire procedure will take much less time.

You can read about all the details of registering temporary residence in Article 5 of Federal Law No. 5242-1.

How to apply for temporary registration in an apartment step by step

Regardless of which apartment requires temporary registration - privatized or non-privatized - the sequence of actions will be the same.

Step one. Collection of documents

Collect documents from the list. At a minimum, you will need a passport of the tenant and owner of the apartment, documents on housing ownership. As a maximum, first conclude a sublease agreement with the administration/department. There is no need to fill out consent and application in advance; this is done at the reception of documents.

If the owner or residents registered in a non-privatized apartment cannot appear in person for registration, their written consent must be obtained in advance from a notary.

Step two. Submitting documents for registration

You can submit documents in person, by mail or through State Services. The safest way is to do this in person through the nearest MFC office (My Documents) or directly at the Ministry of Internal Affairs (police) department dealing with migration issues during reception hours. You need to bring originals and copies of all necessary documents with you and bring people whose consent is required to obtain temporary registration.

The most convenient and fastest way is to submit documents electronically through State Services. Those who have a verified account can take advantage of the opportunity. Not all regions have implemented this opportunity, but in large cities and administrative centers of the country’s constituent entities everything is already working. Documents are submitted in the form of scans or their details are indicated for verification. The application goes directly to the department of the Ministry of Internal Affairs.

Step three. Obtaining a certificate of temporary registration

After the established period – 3 working days – a ready certificate of temporary registration is issued. The period may increase if you submit an application through the MFC or by mail. Sometimes the deadlines are extended if the Ministry of Internal Affairs is forced to make an interdepartmental request for documents, for example, if the sublease agreement referred to by the applicant is not provided.

The certificate can also be received by mail. This is indicated in the application for temporary registration.

Nuances of registration at the place of residence and stay

Citizens often ask whether temporary registration is needed if you live in another city. It is stipulated that Russians must be registered at their place of residence, no matter where they live.

You should be aware of these features:

  • It is necessary to apply for registration while in another city if the citizen plans to stay in a new place for a long time (more than 3 months);
  • if a person stays in another region for no more than 90 days, then it is not necessary to register;
  • the period of temporary registration is determined by mutual agreement with the tenant and the owner of the property;
  • Their minor children are registered with their parents.

Deciding whether it is necessary to register in order to register in another city depends on the type of registration. When registering temporarily, you don’t have to register; if you register permanently, you must do so.

If a citizen of the Russian Federation lives in a hotel or is being treated in a medical institution, then the administration of the institution is responsible for registration. Information is provided on the basis of an identity card within 24 hours.

For those who doubt whether it is possible to live in another city without registration, it is worth remembering that the Code of Administrative Offenses of the Russian Federation dated December 30, 2001 N 195-FZ (Article 19.15.2) provides for punishment for violating registration rules - a fine of 2 to 3 thousand . rubles.

If the violators live in Moscow or St. Petersburg, then a monetary penalty is imposed in the amount of 3 to 5 thousand rubles.

Changing permanent to temporary

There is no such special procedure for recording the movement of citizens , but it is possible to switch from permanent registration to temporary registration, if necessary.

to make an extract from your place of residence , the result of which will be deregistration at the old permanent address with a stamp in the passport of the corresponding content.

Then you can live quite peacefully at your place of stay for 2 months and 23 days , and then contact the FMS department, MFC, to register for a while (agreed with the one who gives your shelter), just be sure to take a departure slip.
