A passport is the main document identifying a person. According to Russian laws, it should be changed at least twice during life - upon reaching 20, 45 years of age and additionally under appropriate circumstances. To ensure that citizens comply with the law, the state has provided a control system - administrative penalties for violating the rules. Deadline for re-issuing the main document of a citizen of the Russian Federation

A passport is automatically considered expired when certain circumstances arise that require its replacement. Such a moment is the onset of 20 and 45 years. Upon reaching these ages, the identity card becomes invalid immediately after the birthday.

To replace a Russian passport within the period established by law, you must:

  1. visit the Federal Migration Service at the place of registration or place of residence;
  2. hand over the necessary package of documents to responsible employees;
  3. get a new ID card.

The Russian passport must be reissued within 30 calendar days from the date of 20 and 45 years. An expired document cannot be used for transactions since it is officially invalid.

Consequences of delaying passport replacement

It is impossible to carry out some legally significant actions with an expired passport. The passport simply becomes invalid. An internal document of a citizen of the Russian Federation is needed for:

  • marriage registration;
  • conclusion of contracts;
  • free movement throughout the country;
  • employment;
  • preparation of other legal documents;
  • admission to educational institutions;
  • opening a bank account, obtaining a loan;
  • voting at different levels;
  • home purchases;
  • receiving medical care.

The citizen is obliged to ensure the safety of the document, its validity, bears administrative responsibility for the absence, damage to the passport, or failure to issue it within the specified time frame in accordance with the law. He must also replace it in a timely manner.

What documents are required to re-issue a Russian passport?

Before directly visiting the Federal Migration Service to replace a Russian passport, a Russian citizen must collect the following documentation:

  • old Russian passport;
  • 3 new passport photos;
  • an application filled out according to the sample on a special form;
  • arrival and departure sheets;
  • check for payment of state duty;
  • original document confirming marriage registration;
  • an extract from the house register;
  • military ID (if available).

In addition to these papers, FMS employees may require a certificate proving the birth of children. Therefore, despite the fact that this document is not included in the list of mandatory ones, it is best to bring it with you so that your passport can be replaced on time.

When is it necessary to change your passport?

Many citizens are taken by surprise by the situation when their Russian passport has expired, and not everyone knows what to do about it. The need to replace an identity document arises in accordance with Government Decree No. 828 of July 8, 1997, which establishes the following validity periods:

  • 14-20 years old. The first change is required at the age of 20;
  • 20-45. The second time you will have to replace the document when you reach 45 years of age;
  • 45-indefinitely. After the second shift, the identity document remains with the owner for life.

What is the fine for an expired passport?

How to exchange a passport based on age and can it be replaced with an electronic one?

The procedure for replacing a passport at 45 years of age is practically no different from that which must be completed when receiving the first document.

List of documents

In order to exchange a passport based on age, a citizen will not need to collect a large package of documents. Before visiting a department of the Ministry of Internal Affairs or a multifunctional center, you will have to prepare:

  • application for the issuance (replacement) of an identity card, form No. 1-P;
  • passport to be replaced;
  • 2 photographs measuring 3.5 x 4.5 cm;
  • receipt for payment of state duty.

The required package of documents will have to be supplemented with papers, on the basis of which the necessary marks are entered into the identity card. For this you will need:

  • birth certificates of children under 14 years of age;
  • military ID (for citizens liable for military service);
  • marriage certificate (if available);
  • certificate of divorce (if divorce took place).

Exchange of internal ID by age is a procedure that requires the provision of photographs. The applicant must present two photographs. One will be pasted directly into the passport, and the second is needed for the application form.

Photos used for identification purposes are subject to strict requirements. The citizen needs to clarify in advance not only the question of how many photographs are needed, but also what they should be. Photos must be:

  • clear;
  • color or black and white;
  • on a white background;
  • have a size of 3.5x4.5 cm.

Employees of a department of the Ministry of Internal Affairs or a multifunctional center will not accept photos that do not have the red-eye effect removed or that have glare and shadows in the photos. For identification, only photographs in which the citizen is depicted from the front are used.

Persons who have vision problems and constantly wear glasses must be photographed wearing glasses. But it is important that the glasses of the accessory are transparent and that the frame does not hide the eyes.

Citizens who wear hats due to religious beliefs are allowed to be photographed wearing them. This is the only exception to the rules, since in all other cases, the photographs that must be presented when you need to renew your passport at the age of 45 must not contain hats, caps or any other headwear that could distort the real appearance of the citizen.

What to do to avoid a fine?

Today, there are many reasons why some people postpone the procedure for replacing their identity cards within the time limits established by law. However, in fact, according to Article 4.2 of the Code of Administrative Offenses of the Russian Federation, only the circumstances listed below can relieve a citizen of responsibility in the event of untimely replacement of a Russian passport:

  1. The period of pregnancy and childbirth.
  2. Difficult life situation requiring hospital treatment.
  3. Voluntary consent to fulfill all requirements provided for by law.
  4. Awareness and remorse for committing an offense.
  5. Providing assistance to law enforcement officers.

The timing of replacement and the penalty for late payment in other circumstances may be regulated in court.

Mitigation and tightening of responsibility

Code of Administrative Offenses 4.2 provides a list of situations leading to a mitigation of punishment:

  • Active repentance and cessation of violations by the person who committed the delay;
  • Voluntary reporting to the responsible authority, as well as providing assistance to resolve the problem;
  • Prevention of consequences, as well as compensation for possible harm;
  • A state of passion or due to a coincidence of insurmountable circumstances;
  • The age of the offender is a minor;
  • Also, mitigation will be made for a pregnant woman or mother with a child.

In practice, this means that for a minimum fine it is enough to come to the GUVM office yourself, with all the necessary documents. In the case of an application by a young mother or a person who could not properly replace the document due to being in the hospital, the penalty may be significantly reduced or canceled.

Important! Article 2.9 of the Code of Administrative Offenses allows an official to release a person who has expired his passport from administrative liability. Most often this happens in case of minor violations, such as a delay of one or two days or force majeure that occurred through no fault of the violator.

The basis for increasing the guilt is only one point - continued violation of the law after notification. The longer a citizen continues to delay registration, the higher the likelihood of receiving the maximum fine with additional punishment.

How can you completely get rid of the fine?

According to Article 2.9 of the Code of Administrative Offenses of the Russian Federation, an official has the right to limit himself to an oral reprimand against a citizen who has committed a minor offense.

Another circumstance that can completely remove all responsibility from a person is indicated in Article 4.5 of the Code of Administrative Offenses of the Russian Federation. It clearly states that if the specialists of the Federal Migration Service department accepted documents from a citizen of the Russian Federation for re-issuance of a passport, without noticing that they were submitted in violation of the deadlines, then they have no right to impose a fine for late payment after 2 months. By this time, the period for bringing to justice will be considered expired.

Also, complete exemption from sanctions imposed for late replacement of a passport can be obtained under the following circumstances:

  • the offense was recorded by persons who do not have the authority to do so;
  • the fine was imposed six months later, while the maximum period for imposing it should not exceed 2 months;
  • for the decision, invalid passport data was received from the offender;
  • the citizen was forced to pay a fine in cash.

Permanent residence or temporary stay of a citizen in a region of the Russian Federation other than registration should not prevent the timely replacement of a passport. Every Russian has the right to contact any branch of the Federal Migration Service and make a request for the issuance of a new document. Only in this case the time frame for producing an identity card will be increased.

Deadlines for obtaining a civil passport and cost of the service

When planning to exchange your domestic ID, you should consult in advance about how long it takes to change your passport. To do this, it is not necessary to attend legal consultations. Employees of the departments of the Ministry of Internal Affairs and multifunctional centers are always ready to answer any question of interest. Those who contact the appropriate organization at their place of residence will have to wait only 10 days. The remaining citizens will wait a month for the updated document.

Many people worry and try to find out how to quickly re-issue a passport, just because they don’t want to be left without an identity card. Don't worry. If necessary, you can obtain a temporary identity card for this period, which we will discuss in one of the following sections.

If there is a delay in replacing your identification document, and you do not have circumstances that could save you from a fine, then sanctions cannot be avoided. In this case, the fine will have to be paid according to the issued order. You can do this in several ways:

  • through the bank cash desk, according to the details specified in the protocol;
  • through a terminal at a bank branch;
  • by transferring funds from an electronic wallet account;
  • via Internet banking.

Once the passport holder realizes that the document is expired, a number of other pressing questions arise:
