After marriage, a woman, according to the legislation of the Russian Federation, can change her last name. However, she will also have to replace her own passport. Few people know, but men can also change their last name to their wife’s last name, and some do just that, justifying their choice with various reasons.

Thus, if one of the spouses decides to change their last name, he will in any case need to change his old passport to one that contains new data. The same applies to a foreign passport, if you have one. Many people are afraid of this procedure because they consider this process to be long, tedious and not the most pleasant. However, a lot has changed recently. Now it will take very little time to change your passport. For example, it was clearly established what documents are needed to carry out the replacement. It also indicates how long before the document needs to be replaced and when it will be issued.

Replacement procedure and its features

In principle, there are no differences between the usual replacement of a passport upon reaching a certain age and the replacement upon marriage. A citizen of the country will need to perform already familiar steps.

  1. Visit the department of the Ministry of Internal Affairs, MFC.
  2. Study the document acceptance schedule.
  3. Find out the list of documents that will be required for the procedure.

However, it is worth noting that the activities of the Ministry of Internal Affairs can be regulated at two levels:

  • federal;
  • regional

This is due to the fact that in different regions of the federation there may be differences in the conditions for the provision of services, although they will be insignificant. The following points also remain unchanged:

  • basis for replacement;
  • replacement timing;
  • liability for violation of obligations or deadlines;
  • the location of the authority where you can apply for services.

Deadline for replacement

When the marriage is officially registered, the citizen is faced with the obligation to provide a package of documents to the MFC branch. This requirement is regulated by paragraph 15 of State Regulation No. 828.

If the requirement is ignored, the citizen will be considered a violator. He will be held liable, which includes paying a fine.

Important ! For a young family, the fine can hardly be called small.

You can avoid this if:

  • the period of violation does not exceed a week. Here the violation can be considered minor;
  • there is a reason why a person did not have time to submit documents, and it is justified by him.

You must submit documents to replace your passport within 30 days from the date of marriage

In the first case, the assignment of administrative responsibility, as well as the imposition of a fine, depends on the decision of an employee of the Ministry of Internal Affairs. It is he, according to the law, who is able to free the offender from such consequences if he considers this possible. In the case of the second option, the citizen will need to provide evidence of a valid reason in the form of certificates or other supporting documents.

Time limits apply not only to spouses who decide to change their last names, but also to employees who are responsible for replacing the document. So, for example, it should be carried out:

  • within 10 calendar days when the necessary documents have been received and accepted, if the replacement occurs at the place of registration of the citizen;
  • within 2 months when the documents were received and accepted, if the replacement does not occur at the place of residence.

If documents for a replacement passport were submitted at the place of residence, the passport will be replaced within 10 days

Legal basis

A passport is replaced if special circumstances arise: assignment of a different full name, change of gender, appearance, theft, damage to a document, or reaching the approved age limits. One of the grounds for obtaining a new identity card is a change of surname by a spouse upon marriage (Article 32 of the RF IC).

The procedure and conditions for obtaining a passport are regulated by the legislation of the Russian Federation:

  • By Presidential Decree No. 232 of March 13, 1997;
  • Government Decree No. 828 of 07/08/97

The regulations set out in detail the general principles of registering a citizen’s data, instructions for replacing and re-registering a document. The deadline for issuing a passport and the person’s responsibilities are also indicated. Separately, information about the document is presented: features of paper, signs, distribution of seals and stamps, pages.

For untimely receipt or replacement of an identity card, or its absence, penalties are imposed on a person under Art. 19.15 Code of Administrative Offenses of the Russian Federation.

Package of documents

There is a list of papers that are required to carry out the legal procedure for replacing a passport. This list is suitable both for cases of standard replacement when a citizen reaches a certain age, and in the case of a change in surname during the registration of a marriage between two citizens.

It is worth noting that an employee of the Ministry of Internal Affairs (MFC), regardless of the location of the body, does not have the right to ask for other documents. We list the required documents.

  1. Previous passport.
  2. Written statement 1P. It does not have to be filled out by hand. It can be found in email. option, fill out in the gadget and print. As for the signature, it must be valid. In other words, it must match the already changed surname.
  3. Certificate of registration of marriage union. At the same time, it must contain two surnames - the old and the new. The employee cannot take the original document, so you must take care of a photocopy of it in advance. However, this does not mean that the certificate can be left at home. You may be required to present it, so it is better to carry this document with you.
  4. Photo size 35 by 45 mm, 2 pieces. In this case, the quality requirements should be studied in paragraph 25 of the MS regulations. For example, the image must be clear, and the citizen must not be wearing a headdress during the shooting.
  5. Receipt of payment of the duty. The state duty since 2015 is 300 rubles.

Application form 1P

Sometimes the applicant will need to provide additional documents. Let's list them.

  1. Military ID, if the application is submitted by a citizen liable for military service.
  2. Documents that can confirm marriage if the note is not made in the passport.
  3. Birth certificates of children. This applies to those who have children under 14 years of age. If a person does not want to include them in the passport, such papers do not need to be provided.

TIN

There is no need to change your TIN during your life. However, we recommend that you go and get a TIN form with your new last name. This will protect you from document confusion when interacting with the tax service, as well as employers. To obtain a new TIN form, you must take with you a new passport, an old TIN form, as well as a marriage registration certificate and come to the tax service with these documents. There you will fill out a short application and you will be given a date to receive a new TIN form.

Where to submit documents?

There are several places where you can take documents to replace your passport. All of them are stipulated in the Regulations on the Russian Federation Passport. So, for example, the procedure can go:

  • in places of residence;
  • at the place of temporary residence of the applicant;
  • at the place of application, if the current situation requires it.

Thus, a person can apply for a change of passport to any department of the Ministry of Internal Affairs (MFC) both at the place of registration and at the place where his registration is considered temporary. If for some reason a citizen does not have both permanent and temporary registration, he can go to the MFC department to undergo the appropriate procedure.

Important ! If for some reason an employee of the Ministry of Internal Affairs refused to accept documents from a citizen for issuing a new passport, these actions can be considered unlawful even when the applicant does not live in the area where the organization is located.

However, there is a small amendment that is worth mentioning. It is possible to defend the right to replace a passport at the place of application only when the citizen can document the impossibility of submitting documents at the place of residence or registration due to the lack of them. This situation arises if, for example, one of the spouses registers a marriage, after which for some reason he moves to another region other than his registration. Then you can prove the possibility of replacing your passport with the help of your spouse’s passport, where the address of your actual residence is indicated.

You can submit documents to replace your passport at a location other than your place of residence, if there are reasons for this.

When to change a passport based on age in Russia

The last page of the passport of a citizen of the Russian Federation contains accessible information about at what age it is necessary to change the passport. However, despite this, various problems and confusing situations often arise in connection with the exchange of a document.

As mentioned above, a citizen receives his first passport at the age of 14. Then the passport must be replaced twice - at 20 years old, the first replacement due to age, and at 45 - the second. After reaching 45 years of age, a passport cannot be exchanged based on age; it becomes valid for life. However, it must be remembered that there are other situations when you need to change your passport.

How can I replace my passport while a new one is being made?

The old passport is confiscated when the necessary documents are submitted. Thus, we can say that for some time (if the case requires it) the citizen will live without such a document.

Such a situation can lead to unpleasant consequences, since any check requiring confirmation of a person’s identity can make a person a criminal on the territory of the Russian Federation. In other words, if it is not possible to confirm the identity, the citizen will have to pay a fine in accordance with the administrative code of the Russian Federation.

The old passport is confiscated

In this case, there are two ways out of the situation.

  1. A citizen left without a passport can receive a certificate confirming the seizure of his documents.
  2. A citizen can receive a temporary identity card.

It is known that within 30 days a person who decides to change his last name must submit documents. If this deadline is missed, the violator will be held accountable and a fine will be imposed.

  1. From 2 to 3 thousand rubles for all regions of the country, excluding Moscow and St. Petersburg.
  2. From 3 to 5 thousand rubles for Moscow and St. Petersburg.

What other documents will need to be changed when changing your last name after registering a marriage?

Among the documents available to a citizen, the following are subject to replacement in this situation.

The spouse must replace the foreign passport by submitting an appropriate application to the required authority. It is worth noting that the deadline for submitting documents and applying for a replacement foreign passport is not officially established, so in principle this can be done at any time. The application along with the necessary documents, if required, should be submitted to the territorial body of the Ministry of Internal Affairs of Russia. You can also submit the form electronically through the Unified Portal of State Services or by personally contacting the MFC branch. Additionally, it should be noted that the issuance of new generation foreign passports must be carried out no later than 02/01/2018. After this date, all passports will switch to a new model, which citizens also need to take into account. As for the state fee, previously you had to pay 2,000 rubles for issuing an old-style international passport. Since the document began to be issued in a new version, the amount of state duty increased to 3,500 rubles. The amount of state duty is regulated by the Tax Code of the Russian Federation.
Insurance certificate of compulsory pension insurance, or SNILSIf the insured person's last name changes, the territorial body of the Pension Fund of the Russian Federation undertakes to issue him a new insurance certificate. This point is spelled out in paragraph 4 of Article 3 of Federal Law No. 27. To obtain a new certificate, you must contact the Pension Fund department at your place of residence or the department of a multifunctional center with a corresponding application to exchange the old SNILS for a new one. It is also possible to submit an application online through the State Services portal or on the Pension Fund website. If a citizen works under an employment contract or under a contract of a civil law nature, then he can apply to the employer with a request to exchange an insurance certificate. This is also stipulated in Federal Law-27, in Article 9, in paragraph 1.
Medical insurance policyIf a citizen has a medical insurance policy, he is obliged to notify the medical insurance organization that his last name has changed. The notice period is one month from the date the changes occur. To change the policy, you must submit the appropriate application, and also attach documents such as a new passport, SNILS. If you don’t want to include the originals, you can replace them with certified copies. It is recommended that you check with your medical insurance company for a complete list of documents that may be required. At the time the application is accepted, the company representative must issue a temporary policy or a certificate of issuance of a new one. Both documents are valid for one month from the date of issue. According to the law, a citizen has the right to free medical care, even if he currently owns a temporary policy or a certificate confirming the execution of a new document.
Certificate of tax registrationYou can receive a new certificate indicating the previously assigned individual tax number using a special application. It is worth noting that when submitting an application and receiving a new certificate, the previous certificate will be considered invalid. There is no statutory deadline for replacement, so you don’t have to worry too much about the fact that a fine may be charged for ignoring the requirements for replacing this document. When contacting the tax service with an application, a citizen will also need to present a passport confirming the change of surname.
Driver's licenseYou can replace this type of document at the traffic police department at the place of application. In this case, a citizen can contact a department employee with a request to replace the ID either without an appointment, or by making an appointment by phone or through the State Services portal. In this case, you will need to pay an additional state fee to obtain a new certificate. The fee is 2000 rubles. Additionally, it should be noted that if you change your last name or driving category, the old license is automatically considered invalid and must be cancelled. Despite the fact that the replacement period has not been officially established, if the surname is changed and the replacement ID is ignored when meeting with a traffic police officer, the citizen may be issued a fine or given a warning about the need to issue a new document.

In addition to the passport, you will have to replace other documents: international passport, SNILS, driver's license, etc.

Sometimes other documents also need to be replaced. Among them are a voluntary health insurance policy and a savings book. The citizen will need to present a marriage certificate and passport. Therefore, both of these documents should be carried with you for some time.

Fines

For late submission of an application, there is a fine prescribed in the Code of the Russian Federation in article 19.15. A citizen who fails to submit an application to the passport office or other institution thirty days from the date of marriage will be fined.

In the regions, the amount of the fine is up to 3,000 rubles inclusive, in cities with federal status - up to 5,000 rubles inclusive. The amount is not fixed, but does not exceed the specified amount. If a citizen has a valid reason for delay, he will have to provide evidence.

If the delay was insignificant, the corresponding state. the authority has the right not to charge a fine depending on how many days it was. But this is not his responsibility, and everything depends on the specific authority.
