Housing subsidies for combat veterans: how to get them

Veterans of military operations in Russia are not only participants in the Great Patriotic War, but also participants in any other armed conflicts in which the Soviet Union or modern Russia took part. These are Afghan wars and participants in two Chechen campaigns. The Housing Code of the Russian Federation provides for the allocation of housing on preferential terms by state authorities and local governments within the limits of their powers in cases provided for by the legislation of the Russian Federation.

However, in order to actually exercise their right and receive housing from the state, combat veterans need to know their rights, the laws in which these rights are defined and make a lot of effort to realize them. Subsidizing of various spheres of life of the population is carried out in Russia every year.
Each member of society can qualify for certain discount options. But there are also mandatory conditions that must be met. For combat veterans, benefits are provided that relate to providing them with living space. And not just a special pension for old age or length of service. In this area, the concept of subsidization is applied. You should rely on it when applying for help.

As part of this project, a citizen can register ownership of housing once. Use rights will apply to both the veteran himself and his family members.

Typically, such assistance takes the form of a certificate. Its main feature is the impossibility of misuse of funds. In any case, a citizen will need to purchase housing - finances are transferred to the account of the real estate seller.

But in the future, a person has full right to own and dispose of his property. He can donate housing or sell it.

Legal basis

In the legal field, regulation of the allocation of benefits for different categories of veterans is carried out on the basis of federal regulations. In this case, you need to look at several articles from Federal Law No. 5-FZ “On Veterans”.

Combat veterans are discussed in Article 3. It defines those citizens who can apply for this type of title. Article 13 defines a general set of social guarantees from the government that apply throughout the state.

The options for supporting citizens with the status of combat veterans are directly discussed in Article 16. The division of the general set of benefits for individual subgroups is also applied here.

At the same time, a separate article contains provisions regarding citizens who suffered from hostilities and received the status of disabled people. These may include both ordinary citizens and military personnel. Information about this is posted in article 4.

What's in practice?

The transfer of powers to provide housing for veterans to the regions determines the fate of this type of social assistance. It is always regulated by the normative act of the subject of the federation. For example, in the Rostov region this is Decree of the Government of the Rostov Region dated 06/25/2012 No. 541, and in the Krasnoyarsk Territory this is Law KK No. 10-4487 dated 03/25/2010. In the regions, local legislation does not provide for the provision of apartments in kind to BD veterans. Instead, the entities provided for the payment of housing subsidies for Afghans and veterans of combat operations in Chechnya.

Naturally, the money can only be spent on the purchase and sale of housing - the subsidy is not given in person, and it cannot be spent on other purposes. The veteran chooses his own living quarters. If it is more expensive than the amount of the subsidy, the beneficiary must pay the difference independently or through borrowed funds. These rules are typical for most Russian regions, only the size of the subsidy differs. It depends on the average market value of 1 sq. m. m of housing in the region, established by the Ministry of Construction - the veteran is paid the equivalent of the cost of 18 square meters. m. From region to region, the average cost of 1 sq. m. m different.

For example, in the Saratov region at the beginning of 2021 it is about 31 thousand rubles, in the Krasnoyarsk Territory about 54 thousand rubles, and in Sakhalin - about 68 thousand rubles. Accordingly, in the Saratov region the subsidy amount will be about 558 thousand rubles, in the Krasnoyarsk Territory - about 972 thousand rubles, and in Sakhalin - about 1.2 million.

Please note that family members of the veteran may also be included among those entitled to assistance. For example, in the same Krasnoyarsk Territory, family members of a citizen are taken into account if the provision of total living space per one family member, taking into account the standard of housing space provided to the citizen, is less than the accounting standard. When determining the amount of the subsidy, the number of family members of the veteran is taken into account, at which the accounting norm for each family member is achieved (clause 2, article 7 of Law QC No. 10-4487).

Benefits for category 1

EDV

Direct participants in the battles, sappers, soldiers of automobile battalions and pilots who supported military operations in Afghanistan, that is, citizens included in the first group of veterans (see above), must be paid a fixed amount of money every month (see paragraph 3 paragraphs. 4 Article 23.1 5-FZ RF). In 2018, the additional payment is 1,741.47 rubles.

If, on the grounds listed in other laws, the veteran is entitled to another payment, he must choose which one he will receive. An exception is made only for Chernobyl victims and participants in nuclear weapons tests. These categories of citizens can enjoy two benefits at the same time. Within the framework of the law under consideration, out of several additional payments, the largest one is automatically assigned.

To apply for additional payment, you must contact the Pension Fund. Payment is assigned from the day the application is submitted. Annual indexation of the EDV is carried out automatically.

Pension benefits

The status of a veteran of local wars provides the right to receive an increased pension (see Article 45 No. 4468-1).

The benefit is established for pension payments assigned by the state in the following cases:

  • by length of service;
  • on disability;
  • loss of a breadwinner.

Not all participants in military conflicts are entitled to this benefit. Only veterans of the first group, specified in subparagraphs 1–4 of paragraph 1 of Article 3 No. 5-FZ of the Russian Federation, receive an additional payment to their pension.

The pension provision of these citizens is increased by 32% of the calculated pension amount. From the point of view of a pensioner, an unpleasant feature of the Russian pension system is the limitation of benefits.

A citizen who has the right to simultaneously receive several pensions must choose which payment increases or additional payments will be applied to.

Payment for housing

Veterans must be compensated for utility costs (see clause 5, clause 1, article 16 5-FZ of the Russian Federation). The compensation amount is 50%. The benefit applies to the following payments:

  • for renting an apartment or room;
  • for the maintenance of the premises (including expenses for common property);
  • collection for major repairs.

The benefit applies to all family members living with the veteran. Compensation is not provided to persons from the third veteran group specified in subparagraphs 5 - 7 of paragraph 1 of Article 3 of Law No. 5-FZ of the Russian Federation.

The mechanism for implementing this benefit is established in the constituent entities of the federation. The federal budget only finances relevant activities.

Provision of prosthetics

The state provides veterans with prosthetic and orthopedic products. The procedure for providing them is established by Resolution No. 240.

The state accepts the obligation not only to issue the necessary product to the veteran, but also to pay for the following activities:

  • repair or replacement of the product;
  • travel of the veteran with an accompanying person to the manufacturer of prostheses for fitting or fitting;
  • accommodation of a veteran, if the product must be manufactured on an outpatient basis;

Instead of paying for travel, the veteran may be provided with monetary compensation. If a person independently applied for the manufacture of a medical device, the cost of expenses incurred by him is compensated according to established standards.

The scope of this assistance depends on the content of the individual rehabilitation program. A government agency does not have the right to impose a specific product model on a veteran.

If a person has decided to use a certain product from a specific manufacturer, he has the right to independently purchase it, and then exercise the right to compensation.

Out of turn

Veterans should be served out of turn at communications institutions, theaters and other cultural and educational organizations, sports clubs, and swimming pools. The sale of travel tickets should also be carried out on a priority basis.

Perhaps this preference at the moment is more of a symbolic gesture than a real benefit. With the development of computer technology, standing in queues for tickets has long become a thing of the past.

Conditions for providing UBD compensation for the purchase of housing (construction)

To receive compensation payments, you must comply with the rules for providing funds under this program. First of all, the candidate must check compliance with the scope of distribution - the program applies only to combat veterans. Registration is carried out on the basis of providing an official certificate.

It is provided that a citizen has the right to receive:

  • a certain amount for compensation;
  • social rental of housing until funds are fully transferred or housing is built.

Conditions also include specific variants of the rules. They need to be taken into account in order to correctly complete the purchase of real estate and not lose financing.

In any case, if there are no funds in the country’s budget, it will be necessary to wait for their receipt. This option involves placing the citizen in a queue. During this period, the veteran can enter into a social rental agreement for premises. This issue should be resolved in advance in order to save money and get the best opportunity for settlement.

Subsidy amount

Registration of this type of subsidy involves determining the amount of the benefit. It does not have a fixed indicator. Since for different categories and services to the homeland, different options for assistance are given.

Not only the veteran himself is taken into account, but also his family members. Therefore, if he has direct relatives, the amount of payment may be increased. There are 18 square meters per citizen.

Next, we take the average cost per square meter of housing in the region where a combat veteran lives. St. Petersburg has an indicator of 43 thousand rubles per square meter. These are the forecasts for 2021. This approach provides the opportunity to purchase housing - both a full-fledged apartment or house, and a room.

Both factors affect the payment the veteran will ultimately receive. It is necessary to understand that the number of meters of housing and its cost are directly proportional to the amount of compensation from the state. This formula is used to determine the amount of subsidy that will be accrued on the certificate for a citizen.

Rules for processing compensation

Applying for assistance under this program requires compliance with a number of rules. First of all, you need to remember the correct procedure for benefits:

Is this subsidy provided to veterans of military operations in Chechnya?

Receiving benefits in terms of subsidized housing is available to all participants in hostilities. And the military personnel who performed their duties during the Chechen military campaign are also included in this preferential category.

Initially, they obtain the status of a combat veteran, and then receive all the privileges associated with this rank. The amount of payments for them is no different in this case. And the algorithm for obtaining a subsidy remains the same.

Housing programs from the state allow different segments of the population to obtain real estate for their own use.

Combat veterans apply for subsidies for themselves, which involve both financing exclusively from the state and supplementing with their own funds; it is allowed to use maternity capital.

When calculating the amount of assistance, they include not only the veteran, but also his family - wife and children. For people with disabilities under such a program, the same conditions are assumed with a one-time opportunity for assistance.

How to get housing

Housing is allocated in the prescribed manner: registration (queue), issuance of a certificate and its implementation.

In regions, the local administration may establish additional requirements.

IMPORTANT! In the event that the recipient of the certificate is incapacitated, a guardian may act as an applicant. A disabled person can apply for a plot and construction of a private house.

Registration

The first step towards receiving preferential payments is official registration at your place of residence. An application for a housing subsidy is drawn up at the housing fund or local administration.

On average, consideration of an application takes about thirty days, after which the applicant is notified of the result in the way he indicated in the application (for example, by letter, call, etc.). After writing the application, the applicant is given a receipt. It contains the necessary list of documents that are independently requested by the department through interdepartmental communications. Accordingly, the data will be obtained without the need for the citizen to present documents.

In case of refusal to register, the reasons must be indicated with references to regulations. An unjustified refusal can be appealed in court within three years, otherwise the statute of limitations will expire.

REFERENCE: Veterans who submitted an application for the queue before 01/01/2005 were placed in a preferential queue for their category, and persons who submitted applications after this date were placed in a queue on a general basis, with all other applicants of different categories.

Required documents for queuing

When filing an application, you should have the following documents with you:

  • Combat Veteran Certificate. It must be reliable and current at the time of application. You should also provide a copy of it.
  • Passport and a copy of all its pages.
  • Extract from the house register.
  • Certificate of family composition, marriage contract (if the citizen is in an officially registered marriage). If the marriage has been dissolved, you must provide a divorce certificate.
  • Identification documents of all family members of the veteran. These could be passports or birth certificates.
  • SNILS of a veteran and his family members.
  • Certificate from Rosreestr about the availability or absence of housing.
  • A copy of the personal account.
  • If a person lives in a dilapidated or dilapidated building, it is necessary to provide an appropriate conclusion recognizing the building's unsafe condition.
  • If a veteran rents housing under a social tenancy agreement, then this should also be provided.
  • Copies of documents confirming all military ranks, merits and awards.

IMPORTANT! If the applicant is in military service, then he must send a report to the head of the military unit.

Documents are submitted personally by the applicant. If a veteran is declared incompetent, then his guardian or legal representative acts - they must have a power of attorney.

Does it matter the house in which the apartment is purchased with allocated subsidies?

The current federal legislation does not contain information about which residential real estate benefits are allocated. Therefore, veterans have the right to purchase both secondary housing and an apartment in a new building.

However, according to the law, other rules for choosing real estate purchased using housing certificate funds may be established at the regional level. For example, in Penza the municipality allocates subsidies for the purchase of apartments only in new buildings under construction or already constructed, but in the Moscow region there are no restrictions.

The housing certificate is issued by local governments of the region in which the veteran is registered, therefore all financing conditions depend on the bills adopted in the territory of this subject of the Russian Federation.

Benefits for all categories

Phone installation

The development of cellular communications has made access to telephony services simple and easy. However, installation of landline telephones still poses difficulties. Advantages of joining cooperatives

Until December 31, 2021, veterans enjoy benefits when joining various cooperatives and non-profit associations. After this date, the benefit will be changed to preferential provision of land.

The implementation of this right is not associated with the imposition of monetary obligations on the state. Preference consists only of granting the right to priority receipt of a land plot, the grounds on which it is provided and the conditions for its allocation are established by general legislation.

Annual holiday at a convenient time

According to the rules established by the Labor Code HA, annual leave is provided according to a schedule that takes into account both the interests of the employer and the wishes of the employee.

In other words, the specific vacation time is a subject of agreement.

Military veterans have the right to request leave at a time convenient for them. The employer is obliged to provide them with such an opportunity.

Funeral services

Funeral expenses for veterans are financed from the funds of the departments in which they served in military or other service.

Departments pay for:

  • preparing the body for transportation;
  • services for transporting the deceased;
  • cremation and burial services;
  • making a monument;
  • installation of a tombstone.

Funeral services are paid in an amount not exceeding 18,980.00 rubles, and in Moscow or St. Petersburg - 26,280.00 rubles.

The cost of work on the manufacture and installation of monuments should not exceed RUR 32,803.00. (see resolution No. 460). In life, the relatives of the deceased themselves bear these expenses, and subsequently apply for compensation for them.

It is very important to keep all financial documents confirming your expenses. Without them, it will be impossible to receive a refund.

Features of the benefit program

Until 2005, WBDs received municipal housing in their region. However, after the changes that took place, the benefit became federal.

By applying to improve the level of living conditions, you can receive support from the state budget. A housing certificate is guaranteed for combat veterans.

VBDs who fall into the category of privileged persons claim to receive subsidies for military veterans to purchase housing.

However, it is worth considering that it is exclusively targeted and cannot be used for other purposes.

The allocated amount cannot be spent on medicines, rest, or repairs. VBD has to temporarily rent a property for his family.

According to the law, combat veterans are entitled to compensation for housing. This privilege is regional.

Its size is set by the regional authorities. To take advantage of the provided preferential relief, you will have to contact the social protection department of the city or district yourself.

By presenting a rental agreement, the beneficiary receives the privilege. Usually 50% is compensated.

Number of square meters

Under the preferential program, you cannot build a palace or purchase a luxurious country mansion.

However, it will be possible to improve your living conditions, but you will have to adhere to the established standards.

Payments for housing to combat veterans are carried out according to the law.

For extra square meters purchased at the same time as the discounted ones, you will have to pay extra from your accumulated savings or take out a loan.

A standard for the total area has been established that is taken into account when allocating UBD housing under the preferential program:

  1. those living alone receive 33 sq. m;
  2. a family of 2 people has the right to claim 42 sq. m.;
  3. families of 3 or more residents 18 sq. m. m multiplied by the number of family members.

Separate housing benefits for combat veterans are established for military personnel who have received the rank of colonel and above.

They add 15 square meters to the norms established by law. m. The privilege extends to those who have received an academic degree.

Is secondary or primary housing included in the program?

Using the certificate, you can purchase housing in any region. Preference is given to apartments in new buildings, but their cost often exceeds the allocated target amount.

Certificate holders are allowed to purchase housing from a secondary fund. Also, the owner of the target benefit can take part in shared construction, covering the amount with certain funds.

Keys to new housing for combat veterans

In some regions, there are targeted programs for issuing preferential loans to participants and veterans of the database. However, they have nothing to do with the certificate and are not redeemed at its expense.

In turn, land plots planned for housing construction are allocated for UBD in the regions.

They cannot be exchanged for cash or received compensation. In case of inappropriate use or absence of construction work during the specified period, the land plot is taken away.

Payment amount 2021

The applicant is given a certificate for the purchase of housing. How much will it cost? It is impossible to give a definite answer . Despite the fact that the amount of assistance is fixed - 18 sq. m of area, the cost of the certificate varies . Due to the fact that the price of real estate differs in different regions, different calculation standards are provided.

When calculating, average indicators in the primary/secondary market in the region are taken.

Improving living conditions for combat veterans

Combat veterans have a number of state benefits regulated by Federal Law No. 5-FZ of January 12, 1995 “On Veterans” and the Housing Code of the Russian Federation. The support program came into force in 1995 and is being implemented to this day.

Veterans can qualify for free housing and improved living conditions.

Certain categories of them are entitled to free housing in the same locality where the combatant lives. To receive such a subsidy, there are necessary requirements: first of all, the veteran must be recognized as needy.

Which combat veterans are eligible to receive the certificate?

There are a number of combat veterans who are eligible for such a certificate. These include:

  • Veterans of the Second World War (Great Patriotic War).
  • Defenders and residents of besieged Leningrad.
  • Military personnel who participated in hostilities in the Caucasus (Chechnya).
  • The Afghan certificate is given to participants of combat operations in Afghanistan.
  • Persons who participated in demining the territory of the USSR after the victory in the Second World War.
  • Military personnel who were disabled or injured on the borders of the Russian Federation and the USSR as a result of military clashes.
  • Employees of the Federal Penitentiary Service, Ministry of Emergency Situations, Ministry of Internal Affairs and other similar government agencies who were injured or disabled while in service.

Who is included in the category of beneficiaries?


Federal law states that benefits are provided to the following categories of citizens:

  1. People who are military personnel, as well as persons after retirement or transfer to the reserve based on an order. These citizens must have been participants in an armed conflict during their service in the Russian Federation or the Soviet Union.
  2. Dismissed military personnel, or retired and reserves. To take advantage of the privileges, people had to engage in mine clearance in the territory of the Soviet Union and other lands during a certain period, namely from 05/10/1945 to 12/31/1951.
  3. Soldiers of the battalions that delivered goods to Afghanistan during the war in the country.
  4. Persons who flew from the territory of the USSR to Afghanistan may also qualify for benefits. But there is one caveat: such sorties had to be carried out during an armed conflict in the state.
  5. People who served state military units located on the territory of foreign countries during military clashes.
  6. Citizens who worked in Afghanistan from December 1979 to 1989 of the same month. One of the main conditions is that individuals must have worked for a certain period of time, or have a valid reason to leave the business trip early.
  7. Persons serving in Syria since September 30, 2015.

What additional requirements are imposed on applicants?

Combat veteran status alone is not enough. The applicant must meet other requirements:

  • Poor status. The applicant should not be able to purchase housing on his own.
  • The need for housing. The applicant must really have problems with living space. Most often, those who apply for certificates are those who either do not have their own apartment/house or their existing property is too small for relatively comfortable living.

Example : A combat veteran lives in the same apartment with his family of 3 people. Total: 4 registered persons in one apartment. The housing area is 33 sq.m. According to the standards, the minimum area for 1 person should be 18 sq.m. If there are four residents, then they are entitled to housing with an area of ​​18 * 4 = 72 sq.m. Under these conditions, the veteran is eligible to apply for the certificate if he or she meets other requirements.

  • There is a confirmed status of “combat veteran”.
  • The applicant resides in the region of application for a certain period of time. Usually this is 10 years until the date of application. In some cases (depending on the region), the period can be either 5 or 15 years.
  • More than 1 year has passed since receiving the “low-income” status. You cannot obtain this status and immediately apply for a certificate.
  • The applicant did not take any action to specifically worsen living conditions (for example, registering strangers in the apartment in order to conditionally reduce the living space by 1 person). If this fact is revealed, the applicant will be denied a certificate and banned from participating in the state program for 5 years.

“Primary” or “secondary”

Federal legislation does not directly indicate in which market housing can be purchased. At the same time, this issue is regulated separately by regional regulations in each specific area. Thus, in Moscow and the Moscow region it is allowed to purchase an apartment on the secondary market using a certificate, as well as in the Penza region and Perm region.

All issues of allocation of residential premises and funds for them are regulated by the Administration at the place of residence and its subordinate departments.

Recognition to those in need


The main condition for providing housing to combat veterans is their recognition as needy. According to the Housing Code of the Russian Federation, the following are recognized as such:

  • living in premises that do not comply with established residential standards, even if the premises are registered as property;
  • not being tenants of residential premises under social rental agreements, members of the family of the tenant of the residential premises under such an agreement, not being a member of the family of the owner of the residential premises;
  • living in the premises under a social tenancy agreement, but at the same time the space standards per family member were violated;
  • if an apartment provided under a rental agreement or owned by right of ownership is occupied by several families, if the family includes a patient suffering from a severe form of a chronic disease, in which living together with him in the same apartment is impossible. In this case, the citizen must not own another premises or rent another premises under a social tenancy agreement.

In fact, a combat veteran either should not own an apartment or house, or be the owner of such housing that does not meet the standards. For example, an apartment may be located in an apartment building intended for demolition.

Instructions for registration

The procedure for recognizing those in need of improved housing conditions

In order to become the owner of the coveted certificate, you must go through all stages of the procedure for obtaining the right to purchase an apartment. First of all, the veteran must recognize himself as needy . This is the main condition for obtaining housing.

  1. It is necessary to create a package of documents.
  2. After this, an application is drawn up. A sample can be found on the Internet.
  3. Next, you need to appear at the local government office at your place of registration.
  4. Documents are submitted for review.
  5. Within one calendar month, the papers are reviewed, and then you are notified of a positive or negative result.
  6. If the answer is yes, you can obtain the necessary papers and move on to the next step.

Step-by-step algorithm

The subsidy is issued to applicants in the standard manner. In order to issue it, you must follow the following procedure:

  1. It is necessary to prepare a package of documents following the list.
  2. The completed application is attached.
  3. You must submit documents to the municipality at your place of registration.
  4. After 30 days, you must receive a decision from the commission on the possibility (impossibility) of adding you to the queue to receive a subsidy.
  5. As soon as funds arrive, you will be notified in order of priority about the possibility of receiving a certificate.
