Legal regulation

Russian legislation considers the procedure for determining disability and benefits for persons with disabilities. Basic regulatory documents on this topic include:

  • Law No. 181-FZ “On social protection and adaptation of people with disabilities in the Russian Federation” dated November 24, 1995. This is the basic legal document on the provision of benefits to people with disabilities.
  • Law No. 122-FZ “On social services for the elderly and disabled” dated August 2, 1995. According to this document, persons with an established group of disabilities have the right to a special set of services (sanatorium treatment, etc.) or can receive a cash equivalent. Other options for benefits for people with disabilities are also being considered.
  • Decree of the Government of the Russian Federation No. 95 “On the procedure and criteria for obtaining the status of a disabled person” dated February 20, 2006. This document determines the conditions and procedure for recognizing a citizen as a person with disabilities.

According to the law, granting a person the status of a disabled person implies that he has certain indications. The determination of their compliance with the health status of a particular citizen is carried out in accordance with Order of the Ministry of Labor and Social Protection of the Russian Federation No. 1024n “On classifications and criteria used in the implementation of medical and social examination of persons by federal municipal institutions of MSE” dated September 29, 2014. To assign disability group 2, the presence of certain ( or all) of the following restrictions:

  • When moving. These are difficulties associated with independent movement, in many situations requiring assistance from others (for example, when using public transport or a special stroller).
  • When perceiving reality. This concerns, for example, the correct orientation of the individual in the area and in time, which require outside control.
  • When communicating. For example, due to defects in the speech apparatus, it is difficult for such a person to pronounce words clearly.
  • During training. Such a citizen has difficulties in remembering, comprehending and reproducing information, which leads to the impossibility of receiving a full-fledged education according to the school curriculum.

A disorder in a person's body can be caused by illness, injury or congenital defects. A complete list of indications for assigning a certain disability group is given in Order of the Ministry of Labor and Social Protection of the Russian Federation No. 1024n. Other disorders include:

  • mental disorders;
  • deterioration of hearing and vision;
  • damage to the respiratory system;
  • physical abnormalities.

Determining disability is a complex process. It includes medical, social and economic aspects. During the initial examination, a disability group is assigned for a year and requires annual re-examination (after two years, a person can be assigned an indefinite/lifelong category). After passing the ITU by a specific person, it is determined:

  • The presence/absence of this person’s disability according to the criteria of current legislation.
  • Opportunity for employment (and professional correction).
  • The medical and social protection program he needs (including a pension).

Labor activity

The length of the working week for disabled people of group II has been reduced to 35 hours. This means that the employer is obliged to pay such an employee a salary on the same basis as other employees who work 40 hours.

The employer does not have the right to charge payment in such cases based on the actual number of hours worked. According to the law, a disabled person is a person with limited physical resources, therefore, he spends much more energy to perform work that is identical in load to healthy employees. The amount of payment and the number of labor hours must be specified in the employment contract.

Employees with group 2 disabilities receive a monthly tax deduction from their salaries. Its size in 2021 is 500 rubles. In addition, this category of the population is entitled to additional leave.

If a disabled person registers as an individual entrepreneur, then he is given the opportunity to receive a special benefit. The payment is offered as initial capital when starting a business. It is important that this money is issued indefinitely and free of charge.

Housing subsidies and additional payments

The standard living space for citizens with disabilities is 36 square meters. m. If necessary, housing is additionally equipped with devices and special equipment that are required for the normal functioning of the patient. For a wheelchair user, the social protection committee, upon request, installs a ramp, etc.

Disabled people also have the right to receive housing by drawing up a social tenancy agreement. Social security is required to register single elderly citizens with disabilities staying in a nursing home with special registration. Extraordinary allocation of apartments is provided for orphans.

This category of citizens has the legal right to receive a plot of land for individual construction. For working disabled people, banks provide preferential conditions when applying for a mortgage.

Benefits for utilities (gas, water, heating, electricity) for disabled people reach 50%. Discounts are also provided on rent for other types of services provided by public utility organizations (contributions for major repairs, telephone payments, garbage collection services, etc.). Concessions on utility payments apply exclusively to the disabled person, and not to all members of his family.

How much insurance pension do disabled people receive?

Those disabled people who have worked at least a day for official employment are entitled to receive a strass pension. With this type of payment, length of service is not taken into account. The only obligatory condition is the fact that the employer has paid for the employee to the Social Insurance Fund, i.e. to the social insurance fund. The tax fee is 3% of the salary of an employee of the organization. After payment to the Social Insurance Fund, the employee is an insured person, after which he has the right to apply for and receive a disability insurance pension.

Worth knowing! First, a person must pass a commission, and the ITU must recognize him as disabled. The norm is spelled out in the law “On social protection of disabled people in the Russian Federation”, namely No. 181-FZ, which has been in force since November 24, 1195. After confirmation of disability, a person who has officially worked at least a day at the company can receive an insurance pension.

In this case, they do not take into account:

· Total work experience.

· For what reason was the disability obtained?

· When disability was registered, during work, before admission or after dismissal.

· If there is no work experience, according to Federal Law No. 166 of December 15, 2011 “On state pension provision in the Russian Federation,” a person still has the right to receive a social disability pension.

Medical benefits

Working disabled people of the 2nd group receive a 50% discount when purchasing prescription drugs. When purchasing medical aids (including orthopedic shoes), the discount varies from 50 to 70%. Such citizens have benefits for dental prosthetics, etc.

Rehabilitation procedures for illness, which is the main cause of disability, are provided to the patient free of charge. This also includes medications needed by a person during the recovery period.
