The MFC is responsible for receiving and processing documents. The organization has the right to receive the necessary information from federal and municipal authorities. It is convenient to use services through the MFC, there are no long queues, appointments are by appointment at a time convenient for the visitor.

    At the MFC

To register a newborn at the MFC, you must complete the following sequence of steps :

    1. Collect all documents and check them for accuracy and compliance.
    2. Contact the MFC branch with the package.
    3. Fill out the application and submit documents.
    4. Receive a receipt from an MFC employee confirming acceptance of the application.

    5. Find out the date of application for the result.

    6. Apply to receive a completed registration document within the specified period.

Thus, the procedure is slightly different depending on the choice of the method of providing papers.

However, its essence remains the same .

    Legislative obligations, periods, fines

    Legislative acts on child registration:

    • The Russian Civil Code provides for strict registration of a minor with one of the parents.
    • Art. The Code of Administrative Offenses of the Russian Federation introduces the procedure for liability for late registration of a minor. Penalties and summons to the competent authorities are possible.
    • Federal Law N 5242-1 regulates freedom of movement and choice of place of residence within the Russian Federation.

If parents change their residence, the children's registration must be changed within seven days. Fines for non-compliance with this regulation range from 2 to 4 thousand rubles.

Where can minor citizens be registered?

In accordance with Part 2 of Art. 20 of the Civil Code of the Russian Federation, the place of residence of a minor under 14 years of age must be the address where the parents or one of them reside.

This formulation is a reflection of the child’s right to live in a family (Article 54 of the RF IC).

The controversial issue is the different registration of parents. This issue is usually resolved by agreement, but the written consent of both parents is required to determine the child’s place of residence. Problems arise with determining registration if:

    • parents cannot agree among themselves which of them will have the minor registered with them;
    • they live in a rented apartment, but are registered at a different address.

In the first case, the issue is resolved based on the provisions of paragraph 2 of Art. 65 RF IC. All disagreements are resolved through the guardianship and trusteeship authority or the court, and they, in turn, establish the registration of the child based on his interests. In the second case, parents are obliged to register the child at their own place of registration.

Children whose parents are unknown, deceased or deprived of parental rights are registered at the place of residence of the person who is his legal representative.

You cannot leave a minor without registration. Violation of registration rules is an administrative offense established by Art. 19.15.1 and threatens parents with a fine. In addition, without at least temporary registration, the child will not be accepted into kindergarten or school, and difficulties will arise with providing medical care.

Who has the right to registration?

Article 20 of the Civil Code states that any parent can register a baby in their own living space. In their absence, the application is submitted by guardians or government agencies. If relatives are not guardians, they do not have the right to register the child.

The following conditions apply to the first registration:

    1. A legally married couple can register a child in their own area with the consent of the second spouse. One person can visit the center.
    2. In a civil marriage, the child is registered with the mother. Registration with the father is possible only with a document confirming paternity and with the written permission of the mother.

Will it be possible to register a newborn without the consent of his father?

It’s worth noting right away that if the father is officially identified, nothing will happen without his consent.

But in some situations, the dad’s consent is still not needed:

    • the father died or was recognized as such by a court decision,
    • father was declared missing,
    • the father is incompetent,
    • the father was deprived of his rights as a parent,
    • the father, in accordance with a court decision, may threaten the health and life of the newborn or his mother,
    • father is in prison
    • father is a conscript soldier. (And in the case of a contract service, consent will be required).

In these situations, it is necessary to prepare a document in advance indicating the presence of one of these circumstances.

Is it possible to register a newborn in a municipal apartment?

When it comes to registering a child, the form of ownership does not matter.
But we must remember that if parents are evicted for some reason, they will be expelled along with their children. In addition, you need to know that if the parents are the official owners of the residential premises, they have the right to evict them only if the neighbor’s freedoms or rules of residence are infringed. When mom and dad are not owners, other reasons are possible.

In a situation where parents live in an apartment on social security. when registering a child, they must notify the authorized institution about this - the housing inspectorate or guardianship.

Municipal apartments are allowed to be privatized. But if you do not comply with all the terms of the social contract. hiring, privatization may be refused.

    Step-by-step registration instructions

Russian law provides for mandatory registration of a newborn at the place of residence of one of the parents.

IMPORTANT. It is advisable to complete the registration documents within a month. Further penalties will be imposed.

It is necessary to carry out a number of actions to quickly register a baby at the MFC:

    • Find out the location of the institution in this region.
    • Find out the package of documents for registration from the center staff by calling the hotline.
    • Call to make an appointment.
    • When visiting, you must take a coupon from the reception. Copies of papers can be made in the center itself.

Please note: To speed up processing, the center requests a number of other documents. These include a certificate about the number of residents in a given living space. Information about rent arrears is obtained from the housing office. The MFC requests an extract from the register of own property indicating the owner. These documents are not regulated by law, and the applicant has the right to refuse to provide them.

To register the baby, an adoption document is added to the adoptive parents. Registration of guardianship over a child will allow him to be registered with guardians.

The exact conditions of registration must be clarified in advance from the center staff. In exceptional cases, conditions may change. In difficult circumstances, you will have to visit the passport office and the migration service.

Features of registering a child at the place of residence

In the case of a complete family and parents living together, both of them come to the MFC and fill out an appropriate application for registration of the child.

If a child needs to be registered at the place of stay rather than permanent residence, there will be slight differences in the procedure. In this case, you can find out how to apply for temporary registration through the MFC using this link.

Registration with only one of the parents

If a minor has only one parent (usually the mother) on the birth certificate, and there is a dash in the other column, then permission from anyone else for registration is not required. To register a child at the MFC, a standard package of documents is submitted. The law does not provide any benefits on registration deadlines for single mothers (or fathers).

If a minor does not have a dash on the certificate, but lives only with his mother (or father), then permission from the second parent will be required for registration. If he is against it, then it is necessary to establish in court with whom the minor should live, and only then, based on the court decision, register at the multifunctional center.

Registration of a child’s place of residence other than with his parents

When a minor reaches 14 years of age, he can register separately from his parents, but only with their written permission. Also, if the father and mother are deprived of parental rights, the child is registered with his guardians.

Registration upon receipt of a passport (at age 14)

A teenager over 14 years old can apply for registration himself. To do this, he should provide a passport and other set of certificates to the MFC. Upon expiration of the standard period, the minor will be issued an identity card with a registration stamp, and not a registration certificate.

Registration with accommodation in municipal housing

Registration of a newborn (as well as a child of any other age) in non-privatized housing does not require the consent of municipal authorities or the responsible tenant. After registration, the minor receives rights to use residential premises (including privatization). He retains these rights even if he is discharged from the apartment.

Features of registration in a private house

The key difference between registration in a private house and registration in an apartment is the provision of a house book to the multifunctional center. This document records all registration actions with living space.

It is possible to register a child in a private home only when the building has been put into operation. Otherwise, this is impossible (even if all the necessary communications and other living conditions are available). The building commissioned must have a cadastral number.

Is it possible to register a child in emergency housing?

Children can be registered in emergency or dilapidated housing if their parents are registered there. If the MFC refuses to register a minor in the premises, you should go to court.

Change of registration through the MFC

To change a child’s registration record, all persons who own this living space must visit the center. They are required to personally fill out registration consent forms. Extracts from the Unified State Register and the house register are added to the documents. The consent of the owner of the area and written assurances from all registered in this area are required.

In the event of a change of registration of a newborn, the presence of both parents in the institution is required. If there is a dash in the document column opposite the father, the presence of the mother alone is sufficient.

Why do you need to register children?

Registration of children involves the need for written confirmation of the family’s presence in a certain territory. Attempts to exercise your rights in the absence of a documentary basis encounter various obstacles. The reason is Moscow itself (a city of federal significance), where, due to high population density and a large number of migrants, the authorities are forced to make adjustments to state laws. Thus, the applied principles of “first priority” almost completely deprive parents of the chance to enroll their child in a kindergarten or school if it is impossible to provide a certificate of registration of the minor in the territory assigned to the institution.

    Newborns

Registration of a newborn in Moscow is an important process that allows you to receive a compulsory medical insurance policy and the necessary medical care, subsidies and benefits (including maternity capital). Registration makes a newly born person a full member of society with all the accompanying civil rights. Without registration, it will be impossible to take a newborn child abroad, pay due attention to his health and development, and ensure further placement in kindergartens and schools.

    Kindergarten

Registration of a child in Moscow is a prerequisite for enrollment in kindergartens in the capital. To the question of whether it is possible to enroll your child in kindergarten without registration, a clear negative answer is given by the current regulations and the established admission system. The small number of available places, the waiting list and quotas are all reasons why people will be accepted into the kindergarten only by registration.

In order not to be a hostage to the situation, not to hinder the development of your child, you should issue a certificate: this will solve the issue of preschool education.

    School

No one has the right to refuse admission due to lack of registration, but the mentioned system of “queuing” and territorial assignment of institutions to districts makes the child’s registration a necessary factor for the school. Formally, to the question “Is registration necessary?” you can say “no,” but in reality in Moscow, a child’s enrollment in school occurs primarily by registration.

    Clinic

To be assigned to a children's clinic, you must provide a medical insurance policy, the registration of which is impossible without information about registration at the place of residence. The absence of a certificate entails a refusal to provide routine medical care (examinations, vaccinations, etc.).

    Features of the procedure

Russian law provides for the obligation to register a newborn child within a month. For quick registration there are MFCs. The center collects and processes documents from applicants who do not visit the passport office or the migration service. It is important for the state to respect the rights and interests of the newborn baby.

If a controversial situation arises, parents should contact the Federal Migration Service. Here everything will be analyzed in detail in their presence and they will give written confirmation about the impossibility of registering the child. Registration cannot be refused due to a large number of residents in a small area.

    Timing and cost

When applying to different processing locations, the waiting period will vary slightly. When registering a child at the place of residence through State Services, the waiting period for the result is maximum . It can be 7-9 days .

    When receiving registration
through the MFC, this period will be up to 6-7 days .
    Registration registration completely free .

This procedure does not require payment of state duty or other mandatory contributions.

However, when contacting the MFC, you will have to pay for the center’s services, however, their amount may vary depending on the region.

    Reasons for refusal

The reasons for refusing to issue a birth certificate at the MFC may include the following:

    1. If there were grammatical errors when filling out the application.
    2. It is not allowed to assign a name to a child in the form of numbers, symbols, or if the name is an obscene or absurd word. This is the root cause of failure.
    3. If the applicant does not have an identification document.
    4. Lack of medical certificate confirming the birth of the child.
    5. If there is no written consent and a notarized statement from the persons acting in loco parentis.
    6. If one of the required list of documents is missing.

IMPORTANT If MFC employees refused to issue a birth certificate without specifying reasons, or the applicant does not agree with these reasons, he has the right to receive an official refusal in writing and then apply to the court for a subsequent appeal.
