The birth of a child requires official confirmation. Registration of the birth of a child is mandatory - in Russia this procedure is controlled by the state. Is permanent registration required for a newborn and why?

The legislation of our country provides for two types of registration: permanent and temporary. Temporary registration is carried out for a maximum of 5 years. Permanent registration is when a person is registered at his/her residential address permanently, i.e. indefinitely. Previously, this was called “registration”, but now this term is not used in legislation, although it is actively used in ordinary conversation.

The child’s parents register the child at their place of residence ; failure to comply with this obligation is subject to administrative liability (Article 19.15.1 of the Administrative Code). At the same time, the law makes it possible to register a child temporarily (the main thing is that the temporary registration is where one of the parents of the newborn is registered).

This must be done so that he has access to all the services and benefits that are provided for him by the state. This:

  • and medical services under the compulsory health insurance policy;
  • and child care services provided by child care institutions;
  • and issuing various benefits and subsidies for the child to his parents or legal representatives.

None of the listed services that the state guarantees to every person located on its territory can be provided without confirmation that the person is on this territory. For example, to issue a compulsory medical insurance policy, the insurance company will require information about the registration of the baby; to receive benefits for the child, social protection authorities will also request information about the place of registration, etc.

Obtaining a certificate through State Services

A child’s birth certificate can be obtained not only after a personal visit to the registry office, but also if you have an account on the State Services website. Registration on the portal in question opens up a lot of opportunities, which is why most residents of Russia have an account on the site.

If the child’s registration takes place through State Services, the procedure can be significantly simplified. There are several steps you need to take:

  • register on the platform (if you don’t already have an account);
  • enter personal data as requested by the platform;
  • go to the registry office services section and select registration of the child’s birth certificate;
  • fill out the application form that opens and complete it according to the sample provided on the website;
  • scan the requested documents and attach files to the application (the required papers will be listed on the website - you just need to check the list);
  • after sending everything requested, the system will show you when and where to go to pick up the finished document.

The system is directly connected with the registry office, and it is there that the submitted documents will be reviewed, and then the registry office employees will issue a completed birth certificate. On government services you can see not only the date, but also the time when the document will be ready. To pick up your birth certificate, you need to come to the registry office and bring your passport. This is important because without an identity document you cannot obtain a certificate.

What to do if the birth of a child took place under unusual circumstances

The legislation of the Russian Federation defines two types of registration:

  • Temporary registration carried out at the place of temporary residence of persons. The amount of the fine for late registration of a newborn under Art. 19.15.1 of the Code of Administrative Offenses of Russia is from 2 to 3 thousand rubles.

Responsibility

If parents violate the deadlines allotted to them by law for registering a newborn, they face a fine. This penalty is prescribed in Article 19.15 of the Administrative Code.

Where and when do you need to fill out the first documents for a newborn?

~ Maternity exchange card

~ Birth certificate. A document confirming that the child was born by you. With this certificate, you need to appear at the registry office within a month and register a new person. WITHIN A MONTH AFTER THE BIRTH OF A CHILD, you need to contact the registry office at the place of registration of one of the parents or at the place of birth of the child.

What is needed from you:

~ certificate of birth of a child from the maternity hospital (if you gave birth at home and there is no certificate, all testimony will be recorded from your words) or a birth document issued by a private practitioner during childbirth outside a medical organization;

~ statement of a person present at the time of the birth of the child (witness), If the newborn was born outside a medical organization and without the participation of doctors;

~ parents’ passport (if the family is single-parent, then one of the parents);

~ marriage certificate (if available);

~ application for registration of the birth of a child (you can fill out the sample directly at the registry office);

~ notarized power of attorney, if grandparents go to get the certificate.

*If the parents are married, the presence of one of the parents is sufficient to obtain a certificate. If the marriage is not registered, the physical presence of both the father and mother of the newborn is required. Information about the child's father in this case is entered on the basis of the record of the act of establishing paternity. If paternity has not been established, information about the child’s father is recorded on the birth certificate according to the mother’s words or, at her request, not indicated at all. In this case, the newborn receives the mother’s surname, and the patronymic is written down from her words.

~ an extract from the house register about the composition of the family registered at this address (taken here, in a separate window);

~ a certificate from the place of residence of the second spouse stating that the child is not registered with him (only if more than a month has passed since the birth of the child), if the child is registered at the address of one of the parents;

~ a statement that one of the parents does not object to the child being registered at the address of the other parent (if the child is registered at the address of the father and not the mother);

applications have been collected, the presence of one of the parents will be sufficient. There is no need to pay any transfers or fees for registering a newborn - it is done free of charge. If registration takes place at the place of residence of one of the parents, and the other is not registered there, the physical presence and consent of the parent is required for registration with the other parent.

Why does a newborn need a registration?

The need for temporary registration is usually associated with housing instability of the child’s parents. For example, they have to rent housing, but they are registered with one of their relatives.

When should the birth of a baby be recorded?

The statutory period for registering a child after birth is 30 calendar days. If, after one year, the parents have not announced his appearance, then the procedure at the registry office will be slightly changed. These documents regulate all issues related to registration (both permanent and temporary); in particular, they provide for the registration of children at the place of residence of one of the parents. The child’s place of residence, according to Article 20 of the Civil Code of the Russian Federation, is considered to be the place of residence of the parents (or one of them, if family members are registered in different places).

Some parents are thinking about the question: is it necessary to register a child at all, since an additional registered person affects the calculation of standards for the consumption of utility services and other indicators? Legislative answer: yes, it is necessary. Firstly, there are penalties for a child’s lack of registration; secondly, without formal registration it is impossible to register at a clinic, enroll in a kindergarten or school, apply for benefits and required material payments, etc.
