Decree of the Moscow government of December 16, 2021 No. 2260-PP “On establishing the amounts of individual social and other payments for 2021”

In order to maintain the level of social support and social stability and in accordance with the powers of the Moscow Government established by legal acts of the city of Moscow in the field of social protection of the population, the Moscow Government decides:

1. Establish the amounts of individual social and other payments for 2021 (Appendix 1).

2. Confirm the list of one-time social payments for 2021, the amounts of which are established by separate legal acts of the Moscow Government (Appendix 2).

3. Establish the value of the city social standard in order to determine the size of the regional social supplement to the pension in accordance with the Decree of the Moscow Government dated November 17, 2009 No. 1268-PP “On the regional social supplement to the pension” and appointments in accordance with the Decree of the Moscow Government dated 27 November 2007 No. 1005-PP “On approval of the Regulations on the appointment and payment of monthly compensation payments (additional payments) to pensions and one-time payments made at the expense of the budget of the city of Moscow” monthly compensation payments to pensions of certain categories of working pensioners specified in paragraph 6 annex to the resolution of the Moscow Government of November 27, 2007 No. 1005-PP “On approval of the Regulations on the appointment and payment of monthly compensation payments (additional payments) to pensions and one-time payments made from the budget of the city of Moscow” in the amount of 20,222 rubles.

4. This resolution comes into force on January 1, 2021.

5. Control over the implementation of this resolution shall be entrusted to the Deputy Mayor of Moscow in the Moscow Government for Social Development A.V. Rakova.

Laws: federal and regional

The law that considers all issues relating to veterans is Federal Law No. 5-FZ dated January 12, 1995.
There is a difference in what benefits a federal and regional labor veteran enjoys, and it is significant. The federal certificate remains valid throughout Russia, and the citizen receives benefits in any subject of the Russian Federation, even if he has changed his place of residence. For example, if a federal benefit recipient moved from St. Petersburg to Novgorod, he is subject to the privileges of this region in relation to this category of citizens. The regional veteran title is valid only in the territory of the region where it was awarded. When moving, the title and associated privileges are lost.

Here are some of the laws regulating the provision of benefits to labor veterans of all categories at the level of regional legislation:

• Law of Moscow dated November 3, 2004 No. 70;
• Law of the city of St. Petersburg dated November 22, 2011 No. 728-132;
• Law of the Krasnodar Territory dated December 15, 2004 No. 808-KZ;
• Law of the Khanty-Mansiysk Autonomous Okrug dated November 7, 2006 No. 115-OZ;
• Law of the Murmansk region dated December 23, 2004 No. 550-01-ZMO.

What are the allowances?

All labor veterans are paid pension supplements. The amount of additional payments depends on the cost of living. Taking into account inflation, the amount of subsidies is regularly increased. They also pay extra separately for each order, medal or gratitude from the president.

Additional payments and benefits apply only to the place of residence. When moving, you will have to re-register documents for benefits and subsidies at the local social security authority.

Those who have not yet retired receive the status of labor veteran only when working in the following positions:

• astronauts;
• those who served as test pilots;
• military;
• civil servants;
• employees of the Ministry of Internal Affairs.

Assistance to labor veterans from the state is provided to create motivation among citizens to take a responsible approach to work and their duties.

Types of pension

Indexation of pension supplements occurs annually in January or according to another scheme, if a corresponding government decree is issued for this. That is, the amount of payment in 2021 and 2019 will differ by the amount of inflation approved by the state. The legislation provides for 3 types of pension payments:

Labor veterans are guaranteed to receive an insurance pension. To receive payments and bonuses, it is enough to confirm your veteran status with a certificate.

Pension amount

The veteran's pension is not a fixed payment. For each citizen the amount is calculated individually. The formation of the payment amount is influenced by 3 factors:

1. Points. The citizen recruits them during his work.
2. The cost of one coefficient at the time when the veteran is paid subsidies.
3. The fixed bonus amount is RUB 4,805. 11 kopecks

A veteran may refuse benefits. For example, discounts on housing and communal services or free travel on public transport. Instead, the state will pay a proportionate amount of compensation.

Who claims privileges

Among those who have the right to receive labor veteran benefits are citizens who have:

• orders, medals, honorary titles of the Russian Federation and the USSR;
• certificates and gratitude from the President;
• departmental insignia for labor or service merit (including for work of at least 15 years in a certain industry), provided that the length of service is at least 25 years (men) and 20 years (women). In some regions, the length of service requirements are different.

Departmental insignia that are taken into account when assigning a rank are various badges and medals that are issued on behalf of the federal government, ministries and departments, including the USSR. Rewards of a lower rank will not help you get a rank. Although a subject of the Federation has the right to create its own list of achievements for obtaining the title and add regional awards to it.

In addition, the title Veteran of Labor is given to those who began working as children during the Great Patriotic War and worked for a total of at least 40 years (men) and 35 years (women).

Examples of awards and titles that give the right to the title “Veteran of Labor”

The absence of any titles and awards in the lists given in the letters of the Ministry of Labor and Social Protection of the Russian Federation cannot be the only reason for refusing to award the title “Veteran of Labor”. Titles that determine qualifications are not taken into account when assigning the title “Veteran of Labor” (for example, “Senior Teacher”, “Master of Animal Husbandry”, etc.) Honorary titles include the following:

• "USSR State Prize Laureate";
• “Winner of the Prize of the Council of Ministers of the USSR”;
• "Excellence in the Russian Chemical Industry";
• "Honorary Polar Explorer";
• "Honorary Energy Engineer";
• other titles.

Badges and badges include:

• "Veteran of the Automotive Industry";
• “Veteran of Sports of the USSR”;
• "Volgo-Balt 1964";
• “For active work in trade unions”;
• “For traffic safety”;
• "Honorary Railwayman";
• other signs and badges for excellent work and hard work.

Certificates and diplomas include:

• Certificate of the Executive Committee of the Union of Red Cross and Red Crescent Societies of the USSR “For active participation in the activities of organizations of Red Cross societies of the RSFSR”;
• “Certificate of the Board of the Russian State Insurance of the Main Directorate of the Northern Sea Route under the Council of People's Commissars of the USSR;
• Certificate of Commendation from the Ministry of Installation and Special Construction Works of the USSR “For the development and assistance in introducing inventions and rationalization proposals into production”;
• other diplomas and certificates.

In accordance with the Decree of the President of the Russian Federation, the title “Veteran of Labor” can be received by various honored workers, as well as folk artists and performers, holders of the listed awards and medals of the Russian Federation.

Where and how to get the title

The title is awarded exclusively at the regional level. Where to go and how to get benefits for a labor veteran in federal cities - Moscow, St. Petersburg, Sevastopol? Everything there is formalized at the city district level.

An application for receiving a government service called “Awarding the title Veteran of Labor” should be submitted to the regional (territorial) department of social protection or MFC. The service is free. The decision is made within a month. Refusal is possible if not all documents have been submitted or if the information turns out to be unreliable.

The list of required documents is small:

• statement;
• passport;
• pensioner's ID;
• award documents;
• employment history.

You will also need a 3x4 cm photograph.

If a citizen worked during the war, they check whether the work book contains entries made during the war. If not, you will have to collect archival information.

After issuing the certificate, they submit an application for benefits (also at the social security department). You will be asked for copies and originals of almost the same documents, plus the ID you received, and also, possibly, a certificate of family composition.

What benefits are provided by law?

The general list is given in Federal Law No. 5:

• additional leave at your own expense at any time of the year (maximum period - 35 days);
• tax relief;
• monthly cash payment in the amount determined by the constituent entity of the Russian Federation;
• reduced fares for certain types of transport;
• compensation for housing and communal services;
• other types of social support established in a specific region.

Financial compensation

A cash benefit is a monthly payment of funds, part of which is an additional payment to pension payments, and part is provided in kind - in the form of a set of social services. At the federal level, it is not stipulated that additional payment to pensions is mandatory. Regional authorities independently decide what social support measures to provide to preferential categories of citizens. In those regions where there is a financial measure of social support in the form of benefits, the authorized authority is the Administration of the Pension Fund of the Russian Federation.

One of the most widespread benefits in many regions of the country is a fifty percent discount on housing and communal services.

In many regions, an additional benefit has been introduced for honorary workers: exemption from paying contributions for major repairs.

Compensation for home telephone payments and discounts on public transport are also determined at the regional level.

Legislation

The main law for labor veterans is 5-FZ

, which reveals the features of the status. Thus, the procedure for obtaining the status of a labor veteran, the list of persons entitled to this, as well as the reasons for a possible refusal to grant the title are stipulated.

This law also stipulates the list of support for this category and the main types of support (additional payments, allowances, subsidies). In addition, it is immediately indicated that regional authorities can also take part in supporting labor veterans by developing and implementing new benefits, or additionally financing payments from their own budgets in order to improve the quality of life of former workers.

There is also the concept of monetization, which provides for the possibility of a person receiving government additional payments to refuse natural payments, replacing them with bonuses to monthly payments.

This right is specified in Law 122-FZ, while the list of services, instead of which the recipient can receive a cash increase, is specified in the wording of Law 178-FZ of December 2015.

Monetization of benefits under Federal Law 122

The service for monetization of benefits is regulated by the law on labor veterans, Federal Law of the Russian Federation No. 122 of August 22, 2004, and is provided at the federal and regional levels. Money received in return:

• treatment and rehabilitation in sanatoriums;
• provision of medicines;
• transport services.

If a pensioner does not need a certain type of social benefits, he has the right to write an application to renounce them and receive monetary compensation.

Mandatory documents

• a certificate from the pension fund confirming non-receipt of cash payments for other reasons.

Tax benefits

According to the law, labor veterans are entitled to benefits for the following taxes:

• property tax (if a citizen has real estate: an apartment, room, house, outbuilding, garage, then he is exempt from tax on one of the buildings of his choice);
• Personal income tax (applies to pensions and benefits, financial assistance - no more than 4,000 per year); in addition, a deduction is available for the costs of spa treatment;
• land tax and transport tax are established by the constituent entity of the Russian Federation independently. Accordingly, preferential tax regimes for various categories of citizens are regulated by the regulatory legal acts of the subject.

Impact of indexation in 2021 on veterans' benefits

Federal legislation provides for the indexation of social payments annually from February 1. In 2021, a new Decree of the Government of the Russian Federation No. 61 dated January 29, 2021 was adopted on approval of the indexation coefficient of 1.03.

On its basis, material preferences were increased for certain categories of citizens of the capital (Moscow Government Decree No. 1753-PP dated December 17, 2019).

The numbers turned out to be as follows:

• monthly city payment - 1,056 rubles;
• reimbursement for travel within the city every month - 400 rubles;
• compensation for travel on commuter trains - 199 rubles;
• monetization of free provision of medical drugs - 1,171 rubles;
• monthly refund for a landline phone - 264 rubles.

It is quite convenient to have a Muscovite social card in your hands. You can use it to receive a pension and all required compensation. The additional functions of plastic are very rational: making an appointment with a doctor through terminals in clinics and paying for utilities without a commission.

Moscow

Benefits for capital labor veterans in terms of social support are established by law No. 70 dated November 3, 2004. Among them:

• the possibility of free travel on any passenger transport (except taxis and minibuses) in Moscow or a monthly monetary compensation in the amount of 378 rubles;
• free travel by commuter rail or monthly cash compensation in the amount of 188 rubles;
• 50% discount on payment for housing and utilities - provided on the basis of an application to the organization that charges payments for these services;
• monthly monetary compensation for city telephone services in the amount of 250 rubles;
• free production and repair of dentures (except for the costs of paying for the cost of precious metals and metal-ceramics);
• for non-working citizens with medical indications - free vouchers to sanatoriums and compensation for round-trip railway travel using vouchers received through social security authorities;
• monthly cash payment in the amount of 1056 rubles.

Important information: benefits for labor veterans in 2021 in Moscow are provided only if they receive an insurance pension, pension or lifelong maintenance on other grounds and upon reaching the age to receive an old-age insurance pension.

Procedure for registration and receipt of additional payment

A citizen should apply for preferential payments from the regional or regional budget at the place of residence to the social support service for citizens with the following documents:

• Confirming the right to the status of a labor veteran (with all ranks and regalia);
• Identification documents of the applicant;
• Certificates of income of a labor veteran;
• Payment documents confirming the costs incurred (for housing and communal services, medical);
• Social card (if available);
• Employment history;
• Recipient details.

All requests are reviewed within 10 days. The pensioner draws up an application in the prescribed form with a request to assign a monthly additional payment, or to provide material compensation for benefits for housing and communal services, travel and other reasons. Cash payments are assigned from the 1st day of the month, which occurs after the month of filing the application. The veteran has the right to receive the required compensation for the 6 months preceding the month of application. A similar service can be obtained at the MFC at the veteran’s place of residence.

Saint Petersburg

Social support measures or benefits for labor veterans in St. Petersburg in 2021 are established by clause 1 of Art. 62 of Law No. 728-132 of November 22, 2011 (Social Code). These include:

• monthly cash payment in the amount of 947 rubles;
• payment for housing in the amount of 50% of the living space;
• payment of utilities in the amount of 50%;
• payment of contributions for major repairs - 50%;
• free travel on city passenger transport (except minibuses and taxis);
• free year-round travel on suburban railway transport.

Monthly payment

In Art. 10 of the law of the capital separately specifies such a measure of social support as a monthly payment. In Art. 11 also indicates its size for labor veterans - 200 rubles. The same norm establishes that the indexation procedure can be determined both by annual city laws and by resolutions of the capital Government.

From January 1, 2020, the amount of monthly city payments to labor veterans was established at 1,056 rubles, compensation for telephone payments in the amount of 264 rubles.
