New procedure for issuing and processing sick leave from December 2021

On December 1, 2021, Order of the Ministry of Health No. 925n dated September 1, 2021 came into force. There are many innovations in it: a new procedure for issuing and filling out temporary disability certificates, special rules for issuing temporary disability certificates during quarantine, changes in the rules for issuing sick leave for part-time work and child care. We tell you what has changed in the work of an accountant.

New issuance procedure

The previous procedure for issuance and registration is replaced by Order of the Ministry of Health No. 925n dated September 1, 2021. Now the rules are prescribed for electronic certificates of incapacity for work.

In order for a medical institution to issue sick leave electronically, the patient must give written consent, show a passport (or other identification document) and SNILS. For the paper version, a passport is sufficient. When applying for electronic sick leave to care for sick family members, you will need their SNILS (if any).

If the certificate of incapacity for work has a continuation, it can be obtained in paper or electronic form. It does not matter in what format the primary sheet was issued.

Only those employers who have entered into an agreement on information interaction with the regional department of social insurance and have acquired an enhanced qualified electronic signature (ECES) can accept electronic sick leave.

The list of those entitled to sick leave has become longer. They added:

  • managers who are listed as the only participants (founders, property owners) of their organization;
  • convicts who are serving imprisonment and involved in paid work.

Information has appeared about whom a certificate of incapacity for work will be issued only in paper form:

  • for the unemployed, to confirm a valid reason for failure to appear at government employment offices;
  • women dismissed due to the liquidation of an organization if they became pregnant within 12 months before they registered at the labor exchange as unemployed.

Features of issuing sick leave during quarantine

The new Order clarifies how to issue sick leave when there is a threat of the spread of diseases dangerous to others.

  1. Those who must be temporarily suspended from work or in self-isolation will be issued a certificate of incapacity for work for the entire period.
  2. A patient who received medical care using telemedicine (that is, remotely) will be issued an electronic sick leave (including for pregnancy and childbirth). To register, you do not need to go to a medical organization. The doctor who issues such a sick leave must be listed in the Federal Register of Health Workers, and the medical institution must be listed in the Uniform State Health Information System register of medical organizations.

What does a closed leaf look like?

A closed sheet is a classic strict reporting form. It looks the same as other similar forms and is in A4 format. All its fields are filled in, all unused columns (for example, the renewal column) are crossed out. It also contains the date when the patient returns to work.

A genuine sick leave certificate has a light blue tint, and the cells for letters and numbers are yellowish. There are always watermarks on the document, which are used to check its authenticity in the accounting department. The doctor's signature and 3 different seals must be present. Only if all this information is available will the sick leave be paid.

Important! Incomplete fields may not be crossed out.

Some doctors always cross out the blank space or put a dash through it, while others do not do this. Crossing out is recommended by the Ministry of Health, but if it is not there, it is not critical, the patient should not worry.

Sick leave for part-time work

An employee has the right to receive benefits for each place of work if, at the time of issuing sick leave, he works simultaneously for different employers and in the previous two calendar years he worked for them or for others.

Since the place of work is not filled out on the electronic sick leave and a part-time job is not marked, a part-time employee can be issued one electronic certificate of incapacity for work for all of his employers. The employee reports the sick leave number for each place of work in any convenient way - in person, by phone or via instant messengers.

But in order to do this, employers must have an exchange of electronic sick leave with social insurance. If there is no agreement with the fund, then the employee needs to issue paper certificates of incapacity for work for each place of work.

If an external part-time worker had other employers in the two calendar years preceding the illness, he will receive one sick leave - in electronic or paper form. It must be provided at one of the last places of employment of your choice.

Where should an employee who is sick go to get a ballot?

If signs of illness are detected, you should immediately contact a medical institution for a diagnosis, as well as to open a sick leave certificate (SL).

The rules for leaving the BC are as follows. A certificate of temporary incapacity for work can only be issued by a doctor with a special license. The doctor diagnoses the patient's disability. You can obtain sick leave from the following organizations:

  • public medical institutions (clinics, hospitals);
  • private medical and clinical organizations;
  • dental offices;
  • medical institutions of narrow specialization (psychiatric dispensaries).

The following medical personnel do not have the right to issue certificates of incapacity for work:

  • hospital emergency department doctors;
  • ambulance workers and blood transfusion stations;
  • employees of medical examination centers (what is examination of temporary disability?);
  • emergency room staff;
  • doctors of sanatoriums and mud baths.

Since sick leave can be obtained both in a private clinic and in a public one, the patient has the right to independently choose the institution to contact in case of illness. Private medical centers must have a license with the right to issue certificates of incapacity for work.

Sick leave while caring for a child

Sick leave for caring for children aged 7 to 15 years is no longer limited to 15 days. Previously, it could only be extended by the conclusion of a medical commission. There are no such restrictions in the new rules. But the benefit can be received for a maximum of 15 calendar days for each case of treatment and for no more than 45 calendar days per year. The fact is that the conditions and duration of payments for such sick leave are established by another document - Law No. 255-FZ (clause 2, clause 5, article 6), and they have not changed.

The restrictions on sick leave for caring for a child over 15 years of age have been removed: up to three days for outpatient treatment. Now a certificate of incapacity for work will be issued for a period of up to 7 days for each case of illness without the decision of a medical commission.

We added a clause stating that if two or more children fall ill at once, one electronic sick leave will be issued.

How to open a BL in a clinic or at home?

You can open a sick leave certificate in the following ways:

  1. If you notice symptoms of the disease, contact the clinic at your place of residence (another clinic, for example, if you are in another city) or another medical institution (private medical center). The doctor will open a sick leave on the day of treatment (the sick leave certificate will not be opened retroactively), and the duration of the sick leave itself will depend on the diagnosis and the patient’s condition.
  2. If your health does not allow you to independently get an appointment with a doctor at the clinic, then you should call a local doctor at home or emergency care. The local doctor will open a certificate of incapacity for work from the date of the visit to the patient, prescribe treatment and determine the date of the visit to the clinic for examination and prescribing further treatment or closing sick leave (read about what a sick leave certificate looks like and what is the procedure for filling it out here).
  3. If the illness overtakes an employee at the workplace , then you should initially go to the medical center at the enterprise, where the patient will be given a referral to the clinic for examination. In this case, the employee can go to the medical facility the next day, but the date of opening the certificate of incapacity for work will be the day the employee goes to the medical center.

How does a certificate of incapacity for work open in a clinic? To register a newsletter you will need:

  1. Issue a ticket for an appointment with a therapist, who, if necessary, will give a referral to a highly specialized specialist, and come to the appointment. You must have a passport and medical insurance with you. The patient can also go to the emergency room at the clinic.
  2. At an appointment with a doctor, undergo an examination, during which a diagnosis will be made and, if necessary, a sick leave certificate will be issued. At the patient’s first visit, the doctor fills out a sick leave form and sets the date of onset of the illness. The form can remain in the clinic or be handed to the patient, but it will be valid only after the doctor closes it and the medical institution’s seals are affixed to it.
  3. After treatment, the patient will need to come for a follow-up appointment on the day prescribed by the doctor. Depending on the patient’s health condition, they may be discharged or further examination may be prescribed and the notice may be extended. The terms for extending the certificate of incapacity for work are established by Order of the Ministry of Health and Social Development of the Russian Federation dated June 29, 2011 No. 624n. The patient provides a closed sick leave certificate to the employer within the time limits established by law (Article 12 No. 255-FZ).

What has changed in sick leave for pregnancy and childbirth

The new procedure clarified the duration of the certificate of incapacity for multiple pregnancies, if the birth occurred at 22 - 30 weeks. In this case, sick leave will be issued for 194 calendar days.

Women living or working in populated areas exposed to radioactive contamination are entitled to sick leave for 176 calendar days during childbirth in the 22nd to 27th week of pregnancy. If the pregnancy is multiple - for 200 days.

They clarified that sick leave will be issued for the entire period of incapacity, but not less than 3 days:

  • when terminating a pregnancy up to 21 full weeks;
  • at the birth of a dead fetus;
  • at the birth of a live fetus that did not survive the first 6 full days (168 hours).

If a child was born at a gestational age of less than 22 weeks and survived the first 6 full days, sick leave will be issued for 156 calendar days. At the birth of two or more children, a certificate of incapacity for work will be issued for 194 days.

New in filling out certificates of incapacity for work

New details have been added to the section on filling out sick leave.

  1. If social insurance pays temporary disability benefits directly to the employee, you only need to fill out the line “At the expense of the employer.” The lines “At the expense of the Social Insurance Fund” and “Total accrued” are left empty.
  2. The information that the employer fills out in the electronic sick leave must be certified by two signatures - the chief accountant and the manager. If the duties of the chief accountant are assumed by the manager, one of his signatures is sufficient.
  3. Calculations of sick leave benefits must be stored electronically or in paper form. They must be signed electronically or with handwritten signatures of the chief accountant and manager. If the position of chief accountant is not provided, only the manager signs the calculations.

Deadlines for submission to the employer and where should it be sent?


Closed sick leave must be taken to the accounting department of the enterprise where the patient works. There is no need to give it to your boss. This document is used to receive sickness benefits, and payments, as you know, are handled by the accounting department.

What is the deadline for submitting the work sheet? This deserves special attention. The maximum period when you can take sick leave is 6 months from the date of closure. There are no clearer deadlines. But it is recommended to submit the document immediately after closing. The benefit is issued along with the first salary, so the sooner the slip is submitted, the faster the benefit will be paid.

What else has changed in sick leave?

It was clarified that a duplicate sick leave can be obtained if benefits have not yet been paid for it. Moreover, if you have lost or damaged a paper form, you can duplicate it electronically. By agreement with the patient or his legal representative, medical institutions that specialize in oncology, psychiatry-narcology, dermatovenereology, HIV infection, tuberculosis, and mental disorders may indicate other positions of doctors, for example, “attending physician,” “paramedic.”

If the employer made a mistake when filling out his section of the electronic sick leave, he must enter the correct information and indicate the reasons for the corrections. When sending again, the signatures of the chief accountant and the manager are also affixed.

What if quarantine was announced in kindergarten?

In this case, one of the parents (legal representatives) of the child has the right to sick leave benefits. In that situation, the employee must:

  1. Get a certificate from an epidemiologist at the children's clinic to which the kindergarten is attached, or at the SES. You can find out where to obtain the certificate from the head of the kindergarten.
  2. Apply for a certificate of incapacity for work from your local pediatrician.

In the event of quarantine in a kindergarten, cash payments are calculated according to the same rules as if the employee himself was sick.

For your information! In the column “Cause of incapacity for work” on the sick leave, the code “03” will be indicated - this is quarantine.
