Every year the number of Belarusians living permanently in Russia is constantly growing, and 2021 in this sense was no exception. The Republic of Belarus is part of a state allied with Russia. The requirements for the presence and residence of its citizens on the territory of our country are significantly simplified when compared to citizens of most other states.

Preferential conditions are provided for all actions related to temporary registration or permanent residence in Russia, as well as obtaining a residence permit (RP) or Russian citizenship for Belarusians.

Border crossing rules

When entering the territory of the Russian Federation, Belarusians do not need to fill out a migration card.
To register with the territorial body of the Main Directorate for Migration Issues of the Ministry of Internal Affairs of the Russian Federation (GUVM MIA of the Russian Federation), you will need a travel document (ticket) confirming crossing the country's border. For this reason, in order to avoid unnecessary difficulties, it is advisable for citizens of the Republic of Belarus to keep these documents throughout their stay in the Russian Federation.

Most foreign citizens are given a period of 7 working days after arrival in the Russian Federation to register for migration with the territorial body of the Main Migration Directorate of the Ministry of Internal Affairs of the Russian Federation.

Belarusians do not need to obtain temporary registration at their place of stay if they stay on the territory of the Russian Federation for less than 90 days (Article 3 of the “Agreement between the Russian Federation and the Republic of Belarus on ensuring equal rights of citizens of the Russian Federation and the Republic of Belarus to freedom of movement, choice of place of stay and residence in the territories of states - participants of the Union State” dated January 24, 2006).

List of required documents

In order for registration in Moscow for citizens of the Republic of Belarus to be successful, you should prepare in advance the documents that will be required during registration. According to the rules, all papers must be transferred not by the Belarusian himself, but by the receiving party:

  • passport of a citizen of the Russian Federation;
  • passport of a citizen of the Republic of Belarus or international passport;
  • ticket confirming entry into Russia;
  • fee payment receipt;
  • notification filled out in a standard form.

Do Belarusians need temporary registration?

Temporary registration at the place of stay is the registration of foreign citizens in the Russian Federation for migration purposes.

The receiving party is required to carry out this procedure if a citizen of the Republic of Belarus plans to stay in the country for more than 90 days. The receiving party can be a person who is the owner of the residential premises (or the tenant) in which the Belarusian actually resides in the Russian Federation.

A citizen of the Republic of Belarus, if he owns residential premises in the Russian Federation, can be a host for himself, as well as for other foreign citizens. In accordance with Federal Law No. 182-FZ of June 08, 2020, which came into force, the status of a residence permit is no longer required for this.

If a citizen of the Republic of Belarus enters the Russian Federation for the purpose of employment, then the obligation to complete migration registration falls on the employer, but only if the Belarusian actually stays at the address of the organization in which he carries out labor activities, or in the premises of the specified organization that does not have address data (building, structure), including temporary.

But in the case of a Belarusian staying in a hotel, all necessary procedures related to migration registration are carried out by the administrative staff of this institution.

How much will the paperwork procedure cost?

The cost of the registration procedure for a Belarusian will cost 3 thousand rubles if he plans to stay on Russian territory for no more than 90 days. If you plan to work in Russia for up to a year, then in order to register you will have to pay 5 thousand rubles.

Many foreigners seek help from specialized legal organizations to obtain permanent registration. In this case, it will be necessary to pay an additional certain amount for the services of an intermediary.

How to obtain and what documents are needed

For timely registration of migration registration of a Belarusian, the receiving party (individual or employer) must provide the following documents (and their copies) to the territorial body of the Main Migration Department of the Ministry of Internal Affairs of the Russian Federation at the place of stay within 90 days from the date of crossing the border of the Russian Federation:

  • passport of a citizen of the Russian Federation;
  • passport of a citizen of the Republic of Belarus;
  • a document confirming entry into the territory of the Russian Federation;
  • completed notification form;
  • a document confirming ownership (or other legal basis) of residential premises.

After filling out the notification form, all documents are submitted to the inspector for verification. Registration does not take much time and is done almost immediately. After the inspection, the inspector must return the detachable part of the notification form with a mark already affixed and an indication of the permitted period of stay of the Belarusian in the Russian Federation.

You should always have this document with you, since it will be the official confirmation of the legal presence of a citizen of the Republic of Belarus on the territory of the Russian Federation.

Mandatory location (stay) of a citizen of the Republic of Belarus

The place of registration for an arriving Belarusian can be either the residential premises of an individual in which he stays, or the residential premises of the organization in which he carries out work activities and is actually located.

A Belarusian is required to stay at the temporary registration address. If it turns out during the check that the foreigner is at a different address, he may be subject to administrative liability.

Such situations often occur, for example, when citizens of such a country who have entered the Russian Federation are in a completely different place, different from the address of migration registration.

Permitted periods of stay of a citizen of the Republic of Belarus on the territory of the Russian Federation

The permitted period of official stay in Russia for citizens of the Republic of Belarus is no more than 90 days in each half-year from the date the person entered the country. However, if there are sufficient grounds, the permitted period of stay on the territory of the Russian Federation may be extended.

Such grounds are concluding an employment contract or obtaining a residence permit in the Russian Federation. It should be remembered that all documents must be completed in advance, that is, before the end of the current legal grounds for staying in the Russian Federation.

Citizens of the Republic of Belarus can stay on the territory of Russia for no more than 90 days in a six-month period.

Temporary registration for a period of no more than 90 days can be issued during a visit of the receiving party to the territorial unit of the Main Directorate of Migration Affairs of the Ministry of Internal Affairs of the Russian Federation at the place of residence, at the MFC, in electronic form, or by sending a notification by post. If there are legal grounds to extend migration registration, it is possible, but you will need to visit the authorized body.

Important! Citizens of the Republic of Belarus, if desired, have the opportunity to begin the procedure for obtaining a residence permit at any time after completing migration registration in Russia.

And in this case, the amount of time they managed to stay in our country at the time of filing the application is absolutely unimportant. In addition, these applications will be considered by the authorized body as soon as possible. Thus, unlike citizens of other CIS countries, Belarusians have 3 months to issue a residence permit (clause 23.2 of Order of the Ministry of Internal Affairs of Russia No. 417 of July 11, 2020).

Also, if a citizen of the Republic of Belarus is in Russia on the basis of a concluded employment contract with an employer, then the validity period of this contract will be the period of the Belarusian’s permitted stay in the country. In situations where the contract with the employer is indefinite, the period of stay in the Russian Federation must be extended every year.

Duration of stay in Russia after registration

The permissible time of presence in the country is different for residents of the republic. If a citizen has permanent registration in Minsk or another city in Belarus and has registered temporarily in Russia, then this person will be able to freely stay in the state for 90 days. In some cases, registration for a year is allowed.

Migrants often wonder whether Belarusians with temporary registration can work in Russia? Persons who are registered can find employment in any region of the Russian Federation. In addition, the person will be able to remain on the territory until the employment contract is terminated. After the end of the agreement, provided that the registration time has expired, the Belarusian has the right to legally reside in Russia for another 15 days. This period is necessary to find a new place of employment.

Separately, it is worth noting that today work in Russia in the north for Belarusians and employment in other constituent entities of the Russian Federation is possible without obtaining a patent. Citizens of the republic get jobs with the same rights as Russians.

During the time that a person is in the country, he can submit the necessary package of documents to obtain a residence permit. The procedure for obtaining a residence permit for citizens of Belarus is also simplified. It is better to submit documents immediately after registration. This is due to the fact that obtaining a residence permit requires a certain waiting period, which can range from 3 months to six months.

How much does it cost to register temporarily?

The state fee for registration of temporary registration is not provided for by the legislation of the Russian Federation. Agencies providing services of “this kind” set their own tariffs.

It is not recommended to apply for such a service.

Remember: temporary registration can be issued by a person who legally owns a residential premises in which a Belarusian actually resides in the Russian Federation! Therefore, in most cases, these are fictitious registrations, information about which is not available in the database of the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation.

Particular care should be taken when filling out submitted documents. Employees of the territorial bodies of the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation can be very careful about the verification, and even small inaccuracies become the reason for refusal and the need for repeated application.

It should also be borne in mind that in the event of a job loss, a Belarusian is given 15 days to conclude a new employment contract (if the established 90 days have already come to an end). Otherwise, you will have to leave the territory of the Russian Federation. Citizens of the Republic of Belarus when working in Russia are exempt from registration of patents.

Important! For exceeding the permitted period of stay in Russia, a citizen of the Republic of Belarus may be subject to an administrative fine in the amount of 2,000 to 5,000 rubles, and for Moscow, St. Petersburg and their regions from 5,000 to 7,000 rubles (Article 18.8 of the Administrative Code), and sanctions may also be applied. in the form of restrictions on subsequent entry into the Russian Federation.

When a citizen of the Republic of Belarus leaves the Russian Federation, his receiving party sends a notice of departure to the territorial unit of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of the Russian Federation, thereby removing the foreign citizen from the migration register.

Required papers and certificates

In order to carry out a standard registration of a resident of Belarus in the migration department, a person must transfer his own national passport to the receiving party. At the same time, it is important to provide the migration department with:

  • Special Arrival Notice;
  • A paper confirming the official ownership of housing, if a representative of the country lives in an apartment or house;
  • If other people live in the premises, you must obtain their consent. It must be recorded in writing.

Important! A receipt for payment of state duty is not required. There is no charge for this operation.

It is not necessary to bring the listed papers in person. They are allowed to be sent by mail. This organization has special notification forms for registering the arrival of a foreign citizen. You can get them completely free. And you will have to pay 300 rubles to send it to the registration department of foreigners. There is another option to save effort and time. Documents can be submitted through special municipal service centers.

GUVM employees receive the submitted papers, register them, and make the appropriate decision. If everything is fine with the documents, the Belarusian receives a tear-off spine. It serves as official confirmation that the foreigner has been registered.

If the request and papers are submitted by the receiving party, then the migrant takes the resulting decision independently. It is also possible to involve an official representative. You can invite him in the following situations:

  1. Serious illness of the host.
  2. Busyness, which is typical for owners of hotels and boarding houses.
  3. Finding a host on a long-term business trip.
  4. Other valid reasons that do not allow the owner of the premises to approach the migration department and even organize a postal shipment.

The listed circumstances must be documented. The representative must also have a power of attorney.

Situations often arise when a registered foreigner experiences certain life situations that require him to urgently leave his place of temporary residence. Staying without registration and liability for violations

If a resident of Belarus intends to enter Russia as a tourist temporarily, for a short period, then he should not worry. Trips of less than a month do not require registration with the migration service.

However, failure to register with the Main Directorate for Migration Affairs of the Ministry of Internal Affairs during a longer stay on the territory of the Russian Federation is a violation of the law. If the foreigner and the receiving party were unable to provide the necessary documents within the specified time frame, then the former is equated to illegal immigrants in the state.

If such a crime is detected, punishment awaits both the foreigner himself and the citizen of the Russian Federation or employer. For a migrant, the fine can range from 2 to 5 thousand rubles. In particularly serious cases, the foreigner is also deported from the country.

If a person residing illegally was given a job, then the legal entity will bear responsibility. The size of the fines in this case will become more impressive. The most serious penalty is an amount of 500 thousand rubles for each non-resident. The statute of limitations for such an offense is 1 year. After this period, the employer will not be held liable.

How to correctly fill out a notice of arrival of a foreigner in the Russian Federation

The application form is posted on the website of the Ministry of Internal Affairs of the Russian Federation. It can be found in the subsection “State services in the field of migration” or in the Regulations, approved. Order of the Ministry of Internal Affairs of the Russian Federation No. 514. It is a two-page document that must be filled out manually or on a computer. The text must be legible and cannot be edited.

The notification should indicate personal data about the person who needs to be registered (full name, gender, citizenship, passport details, as well as a document certifying the right to stay (reside) in the Russian Federation, etc.).

You are also required to provide information about the receiving party. What exactly needs to be written down depends directly on who is receiving. If we are talking about an individual, then indicate his data: full name, house. address, details of his passport and title document, which certifies the right of ownership of the residential premises provided for the actual residence of the foreigner.

If the receiving party is a legal entity (organization), then the notification, among other things, records the personal data of the authorized responsible person acting on behalf of this legal entity (full name, details of his identification document, home address). As for the organization itself, you need to indicate the following information about it: name, TIN, address. It is also required to mention a document that confirms the right of ownership of the housing that she provided to a foreigner (Belarusian) for temporary residence.

The receiving party must sign the back of the form, thereby expressing consent to the temporary residence of the foreigner (Belarusian) with her. If an organization (legal entity) accepts it, then it must certify the affixed signature with its seal.

Registration in Moscow for citizens of the Republic of Belarus

For citizens of Belarus located in Russia, there are 2 registration periods:

  • 3 months;
  • 12 months.

Registration for Belarusians in Moscow is carried out within a maximum of 30 days from the moment of crossing the border of the Russian Federation. Moreover, if the arrival of a Belarusian is conditioned by an invitation (working relationship or personal invitation), the procedure for registering a guest of the country is handled by the receiving (and, accordingly, inviting) party.

In this case, by the time the citizen of Belarus arrives, all official formalities will be resolved, and he will not have to worry about resolving this issue. All Belarusian citizens located in Russia have benefits and are equal in rights to the indigenous residents of the Russian Federation.

No other time periods are taken into account. If the arrival of a Belarusian is due to a working relationship and involves a stay in the country for more than 3 months, then registration is issued only to the employing company.

To do this, a bilateral labor agreement is required and an application from the company is required. Without this, any labor activity on the territory of Russia is not legal and a Belarusian, a priori, becomes a guest worker.

Otherwise (if the period of stay is more than 3 months), documents are submitted at the district office of the Federal Migration Service. The registration procedure takes place quickly (no more than 3 working days) and involves avoiding difficulties and delays in completing all necessary papers.

Registration of Belarusian citizens for up to 90 days will cost about 2,000 Russian rubles. When registering for a period of 1 year, the amount will be approximately 4,000 Russian rubles. If you plan to stay in Russia for more than 1 year, then it is worth addressing this issue in advance and registering for a long period of stay.

The registration procedure begins with the filling out of the arrival form by the party receiving the Belarusian citizen. A tear-off document is issued, giving the Belarusian the right to stay in Russia for up to 90 days.

If there is a valid reason for the absence of the host party during registration, a citizen of Belarus can independently go through this procedure. However, documentary evidence of a valid reason for absence will be required.

Registration of Belarusian citizens in Moscow through the Office of the Federal MS provides for a small list of documents:

  • copy of passport or other identification document (pages with photo and Russian translation required)4

Error 1.

Registration at the place of temporary stay is also provided for foreign students. They are no exception in this sense. The placement is carried out at the address where the student actually lives. If this is, for example, a rented apartment, it means at the address of this apartment. In this case, the receiving party is the individual who rents out the apartment (provides it for living). It is he who must submit information for registering a student who has arrived to study.

The situation is somewhat different when a student is provided with a place in a dormitory for the actual period of study. The receiving party in this situation is the educational organization that owns this hostel.

Error 2.

For your information, a foreigner cannot use a document as a substitute for a passport if its validity is less than 6 months. Documents issued in connection with professional (official) activities are also not considered. The listed documents are not presented instead of a passport.
