A land plot for individual housing construction is a land plot on which the construction of a separate residential building, no more than 3 floors high, owned by one family, is legally permitted.

What is the maximum plot size?

The presence of maximum and minimum indicators indicates that domestic legislation establishes area restrictions for plots that can be purchased or leased from local authorities.

The maximum size of land plots is determined by legislative acts. They include the following parameters:

  • minimum setbacks from the boundaries of plots to determine places where buildings, structures and other objects can be constructed, and beyond which construction is prohibited;
  • maximum building height or maximum permitted number of floors;
  • percentage of development relative to the remaining area of ​​the site;
  • places where there are no restrictions on permissible sizes.

The maximum size of a land plot largely depends on the purpose for which it is allocated: housing construction, farming, etc. In each specific case, regulations, land use rules and other regulations are taken into account.

After the above-mentioned changes came into force in 2015, regions lost the right to independently determine the maximum size of land, so there are few such restrictions left.

Land plots located in populated areas and allocated for individual housing construction (IHC) make it possible to erect a separate building for non-commercial (personal) use. The maximum height of buildings is limited to 3 floors, and their purpose is only for 1 family who lives in it permanently or temporarily. This type of household can be assigned a postal address at which registration or temporary registration can be obtained.

The status (purpose) of individual housing construction within the framework of the current legislation of the Russian Federation is assigned exclusively to territories with the category “settled areas” and is stated in the property certificate. Agricultural land can be allocated for the following types of use:

  • Garden non-profit partnerships (SNT) - have restrictions on area; they most often house small houses without a postal address and cadastral number. It is not possible to register for accommodation;
  • Dacha non-profit partnerships (DNT) are small plots with modern, fairly large buildings. The legality of such structures is a controversial issue. Currently, only in the Moscow region, dacha villages of this type have a developed infrastructure, which is most often created at the expense of cottage owners;
  • Farms are territories larger than 1 hectare, up to 10% of the area of ​​which can be developed;
  • Agricultural land – used for agricultural purposes, without residential buildings.

For the construction of houses, cottages, country chalets and other real estate, it is advisable to choose territories with the category of individual housing construction. Despite the constant changes in land codes, capital development of other lands is contrary to legal norms.

Please note that changing the category of land is, in principle, a solvable task. But doing this on your own will be quite difficult and will require a lot of money and time.

There are cases when a site is first developed and then its status is changed. At the same time, large specialized companies and local governments periodically carry out similar activities. The maximum sizes of land plots are adopted in accordance with the Land Use and Development Rules (LRU), approved by local authorities. These indicators are mandatory for all participants in land legal relations and are applied when:

  • allocation of plots from state or municipal lands;
  • provision of land for rent;
  • making a decision on the division of territory;
  • determining the possibility of making additions to plots;
  • formation of a new agricultural plot;
  • allocation of agricultural land, which is in common ownership;
  • allocation of unclaimed territory;
  • allocation of lands from artificially irrigated or drained lands.

Maximum and minimum plot size in the absence of regulations

If the region does not have a PZZ and has not established town planning regulations, to resolve issues regarding the formation of sites, it is worth focusing on the legislative acts of the constituent entities of the Russian Federation. This applies to cases where the limits are determined by local authorities.

One of these regulations is, for example, Law of the Leningrad Region dated October 29, 2003 No. 83-oz. It sets the maximum size of plots that are provided from lands owned by the state or municipally. The same document determines the maximum indicators of the total area of ​​land that can be simultaneously owned and/or otherwise owned by persons engaged in personal subsidiary plots.

The area of ​​land can be determined in three main ways:

  1. analytical;
  2. graphic;
  3. mechanical.

Analytical

It consists in determining the area of ​​the site based on the coordinates of the characteristic points of its boundaries. This method uses analytical geometry formulas.

In accordance with them, the area of ​​the polygon S is determined by the formula :

  • Xi and Yi are the coordinates of the i-th characteristic point of the area, which has the form of a polygon.
  • i is the serial number of the characteristic point. This parameter varies from 1 to n, and n is the number of characteristic points.

If the plot has the shape of a quadrangle, then the area calculation is calculated using the above formula with n=4.

If the area has the shape of a trapezoid, then its area is found using the formula:

  • a and b are the bases of the figure;
  • h – height of the trapezoid.

When calculating an irregularly shaped quadrilateral, you first need to determine the value of the semi-perimeter p:

p=0.5(a+B+c+d) , where: a,b,c,d are the dimensions of the sides.

Then Su will be equal to:

To calculate the area using this method, a plot of land with a complex shape shown on the plan is divided into simple sections (rectangles, triangles, trapezoids), then the areas of these figures are calculated and added together. The accuracy of the graphical method is determined by the accuracy of the graphical measurement on the plan . This method is convenient to use if the number of characteristic points is small.

If the area has a curved shape, special palettes are used.

Mechanical

Used for a large area with complex boundaries . To do this, use a planimeter, which is a device that allows you to determine the area of ​​a flat figure by tracing its outline.

The accuracy of this method depends on the size of the site and the properties of the plan.

Attention! The area of ​​a plot placed in the real estate cadastre can be determined using an online service called “Public Cadastral Map” by address or cadastral number.

Limitation of the area of ​​plots for individual housing construction

To know what the minimum area of ​​land for individual housing construction is established, you should:

  • familiarize yourself with the provisions of local town planning regulations. Due to the fact that this issue is not regulated by law, the rules are set exclusively by the local administration;
  • look at the zoning map and determine the exact location of the object;
  • study the basic conditions and requirements for development in this area;
  • contact a geodetic company to draw up a demarcation plan and draw up an act indicating the exact boundaries of the plot.

The size of the land plot for the construction of a residential building depends on the following factors:

  1. The level of demand for land in a given area.
  2. Population density.
  3. The area of ​​land owned by a person or municipality that can be transferred to individual housing construction.
  4. Level of economic development of the region.

Methods for calculating the dimensions of the land along the perimeter

Another question deserves our attention: “one hundred square meters of land is how many meters around the perimeter,” and what methods are used to measure the site. The lengths of the sides can be whatever you want. It all depends on the form of land tenure. In practice, there are several simple ways to calculate them along the perimeter. Moreover, you can find out the size of the land on your own, or by using the services of a specialist from a geodetic organization. In the second case, a surveyor, using professional equipment, will determine the exact boundaries of your land plot or, as they say, will carry out land surveying.

Self-measurement methods:

  • the simplest of them is to calculate the lengths of all sides by measuring them in steps at right angles. It is easy to imagine a distance of one meter. It is approximately equal to a very long stride of an adult. This means that by measuring a little more than 10 steps in one direction and the opposite, we get 1 hundred square meters. This method, of course, does not give an accurate result. When building a house, it is better to turn to professionals;

When obtaining land for private household plots, the following conditions are taken into account:

  • individual residential buildings must have no more than three floors and an area of ​​up to 1500 m2;
  • on 12 acres it is allowed to build only one residential building;
  • the distance of the object from neighboring buildings must be at least 3 m, for outbuildings - from 1 m;
  • the distance between objects is determined taking into account the building material.

Allowable area of ​​garden plots

In different regions of the country, the minimum size of land for gardening may differ, for example:

  • in the Moscow region this figure is 6 acres;
  • in Leningradskaya - 5;
  • in Sverdlovsk - 11 acres.

At the federal level, the minimum size ranges between 6 (for garden farming from 4) and 15 acres. In addition, the area of ​​the gardening plot must be at least 400 m2, and its width cannot exceed 8 m.

Limitations on the area of ​​plots in the Leningrad region

The following maximum land sizes are established in the Leningrad Region:

  • for gardening – 0.12 ha;
  • for country house construction – 0.20 hectares;
  • for gardening - 0.10 ha;
  • for a peasant (farm) farm – 50 hectares.

The minimum size of a land plot in the Leningrad region is:

  • for gardening – 0.05 ha;
  • for summer cottage construction – 0.05 hectares;
  • for gardening - 0.01 ha;
  • for a peasant (farm) farm – 1 hectare.

Restrictions on residential construction also depend on whether it is in a rural or urban area.

How to get benefits?

Categories of citizens entitled to benefits and discounts receive land plots:

  • on a free basis, in order of priority (by prior registration, registration and provision of a package of relevant documents);
  • according to a previously issued certificate in any of the districts, within the characteristics of the document;
  • plots designated in advance (prescribed by decisions of the settlement administration) and prepared by municipalities with mandatory approval of the design of the capital structure and its placement.

Sometimes not only the size, but also the ratio of the length and width of the allocated land plots is regulated. For example, in the Krasnodar Territory the minimum width is 6 m.
