Power of attorney for a car for traveling abroad. Notarized power of attorney for a car

Leaving one country and entering another by car requires preliminary preparation not only in technical terms, but also in terms of studying the list of necessary documents and collecting them. The situation is further complicated by the fact that traveling by car is subject to regulation by the laws of not one, but two or more countries - depending on the chosen route.

At the same time, a lot of questions arise regarding who owns the car, whether it is rented, and who, besides the driver, is in it. In order for the trip to be successful, you need to find out what documents are needed for the car in each specific case, taking care to familiarize yourself with at least the main list of them.

Departure rules

The rules for traveling abroad by car from the Russian Federation are regulated by legislative acts adopted on its territory. The regulations for entry into another state for the purpose of temporary stay and the procedure for such stay depend on the laws of that country.

The necessary information regarding entry by car and travel on the roads of a particular foreign state can be found on the website of the Russian Foreign Ministry or the Consular Department. In particular, it contains explanations regarding movement by car, requirements for its equipment and the availability of a package of documents.

Features of preparation when entering Poland by car

A mandatory condition for crossing the border with Poland is the presence of a power of attorney, written in your own hand or drawn up with the help of a notary.

Such conditions are necessary. If an accident occurs on the territory of a foreign country, without a power of attorney, they will most likely refuse to pay for damages.

As for the technical parameters of the car, the main thing when entering Poland is its serviceability.

One of the conditions for staying in Poland is that low beam headlights are turned on 24/7.

Also at the border, a thorough inspection of the integrity of transport is carried out.

During the winter season in Poland, tires with studs and anti-radar equipment are prohibited for use.

International passport

In accordance with the Law “On the State Border of the Russian Federation” No. 4730-1 of 04/01/1993, the basis for entry through the border post is the presence of valid documents for traveling persons, transport, goods, cargo and animals.

The main document that confirms the identity of a Russian citizen when crossing the border is one of the types of passports:

  • Overseas.
  • Diplomatic.
  • Official.

Important nuances regarding this official paper are the following:

  • With a Russian passport you can only enter some of the CIS countries.
  • At the time of return from the Schengen zone, the validity period of the document cannot be less than 90 days. The exact period depends on the requirements of the specific country.
  • If there is also a child traveling in the car, who is included in the passport, it is necessary to have a photo in accordance with his age.
  • If you lose your passport abroad, you must contact the Russian diplomatic mission to obtain a certificate of return.

Documents required at customs

You and your passengers must have certain documents in hand when crossing the border. These include:

  1. Foreign passport with all necessary visas.
  2. Medical insurance for adults and children.
  3. Invitation or confirmation of hotel reservation.
  4. Confirmation of financial solvency. This can be cash or checks and statements from your bank accounts. Find out before your trip what amount must be declared. If you bring money with you in excess of this amount, you will have to go through customs along the red corridor and declare the amount being imported.
  5. If you have children in the car, take documents for them too. This is a birth certificate, the child’s passport and visa (if any), or an entry about the child in the parent’s passport. If only one of the parents is participating in the trip, then an additional notarized consent from the second parent for the trip abroad will be required.

In addition to documents for people, you must present documents for the car.

Driver's license

Driving a car with a driver's license issued in the Russian Federation is permitted in many countries. However, some countries require both Russian and international rights at the same time. This rule applies to documents received from us before 03/01/2011 that have not been translated into English. Therefore, it is easier to have them translated at a law firm within one or two days, which will cost approximately 800 rubles.

With a driver's license issued after the above date, you can go abroad without any problems. In this case, the international one will not be needed. This rule is due to the fact that the Russian Federation has updated domestic rights to the standards provided for by the Vienna Convention.

What costs are expected in Europe?

It is widely believed that European cities are too expensive for budget holidays. If you wish, you can save a lot, for example, if instead of hotel rooms you sleep right in the car. Although in this case you will have to pay for gas stations designed specifically for such purposes.

By organizing your trip this way, you are depriving yourself of comfort, so before deciding on this type of overnight stay, you should seriously think about it.

The main thing that most of the money goes on when traveling by car in European countries is fuel. Costs also increase when driving on toll roads. European parking lots are no less wasteful.

To avoid large fines, which in most cases exceed the parking fee itself, you should carefully read the local rules. Moreover, in each city the conditions for using parking spaces vary greatly.

Customs declaration

In order to be able to use a car registered in Russia on the territory of foreign countries, it is necessary to fill out a customs declaration. It must be presented to customs officials. The procedure for its registration is regulated by the provisions of the Customs Code of the Customs Union, which since 01/01/2018 has been replaced by the EAEU Customs Code.

The time for which the vehicle is exported is determined by the customs authority. The basis for this is the declaration of the declarant, which indicates the purpose of the export and the accompanying circumstances. If necessary, this period may be extended at the request of the traveling person, stated in writing.

Issued to whom and by whom?

A power of attorney can be given by individuals who are the full owners of the vehicle, legal entities, banks and rental companies. A power of attorney is usually issued:

  1. close relatives;
  2. employees of large enterprises;
  3. clients who rent a vehicle from a special company;
  4. clients of the bank where the loan client is serviced.

Entry visa

Before you travel by car to your destination country, you need to find out whether a visa is required. To do this, you need to contact the representative office or consulate of the relevant foreign state. Contact information is posted on the website of the Russian Ministry of Foreign Affairs.

A Schengen visa is requested from the office of the country that is the purpose of the trip. Typically this is determined according to the length of stay. If it is not possible to find your way right away, you need to go to the representative office of the state that you enter first.

Travel through some countries requires a transit visa. This issue should also be consulted in advance with the diplomatic authorities of the countries through which the proposed route lies. You must apply for a visa from the day on which you plan to cross the border checkpoint. Its duration is equal to the number of days of travel, taking into account the return trip to the territory of the Russian Federation.

To the border and back

The path across the border is not always connected with tourist plans. The option of going to the border to get a migration card was until recently extremely popular. The migration card for foreigners in the Russian Federation has a validity period:

  • as a general rule - 90 days;
  • if you have a visa, the period is equal to its validity period.

It was possible to cancel the period until 2014 by leaving the Russian Federation through the official border checkpoint and entering back. At the border, a foreign citizen handed over his old card, it ceased to be valid, the foreigner received a new document, the validity of which was calculated anew.

The situation changed with the adoption at the legislative level of the “90/180 rule.” According to the “90/180 rule”, a foreign citizen has the right to stay on the territory of Russia, having a migration card, for 90 days out of 180.

It turns out that if over the last 180 days the migration card has already been valid for 90 days, it will not be possible to legally use the entry-exit scheme. Simply put, according to the law, after living for 90 days on the territory of the Russian Federation, you can re-enter only after 90 days. Violation of the rule threatens not only a fine, but also a ban on subsequent entry into Russia.

The 90/180 rule does not apply:

  • for citizens who have a visa;
  • for those working under a patent;
  • for persons with a residence permit or temporary residence permit;
  • for foreign students who are studying full-time in the Russian Federation;
  • for persons who have received refugee status.

Health insurance policy

Many foreign countries allow entry into their territory only when the traveler has a health insurance policy that is valid within its borders. This number also includes Schengen countries. Without insurance, your visa may be refused.

It is possible to obtain a policy for the duration of a trip abroad from any insurance company or travel agency that prepares documentation for obtaining permission to travel. When visiting several countries within the Schengen area, insurance must be valid for each of them and for the entire duration of the trip by car.

Ecological zones

To travel abroad by car, you need to know many nuances, for example, European countries pay special attention to the environment and the negative impact of vehicles on it, so they have established environmental zones and entry by car is regulated by special rules. It is necessary to understand that each state has its own standards and rules; there is no single standard.

The purpose of such zones is to restrict the entry of vehicles whose waste content in the exhaust does not meet the standards. There is always a warning sign before the start of such a zone.

When driving through such an area, you must attach a sticker to the front window, which will indicate the environmental class of the car.

Are all services paid for?

It is advisable to first clarify the list of services that must be provided in the host country, as well as the procedure for receiving and paying for them, if the contract provides for a franchise.

In most cases, insurers refuse to pay for services if a visit to a medical institution occurs that is not included in the insurance policy, or if the incident is not insurable. For example, in case of injury sustained while intoxicated.

In such situations, you need to pay for the treatment yourself, and upon arriving home, try to get the money back by going to court. The insured amount, as a rule, is at least 30 thousand euros.

Technical condition

Each country has its own mandatory standards for the technical condition of a car, which every car owner must comply with on the country’s roads. Most of the established standards are similar and boil down to the mandatory presence of:

  • fire extinguisher,
  • jack,
  • a set of essential medicines,
  • emergency sign,
  • cable

Also, do not forget to check the absence of front tinting, since in most countries it is prohibited.

Green card - what is its essence?

In 45 countries, a system has been introduced that requires compulsory liability insurance for the owner of a vehicle, called the “Green Card”. In some Asian and African countries there are similar ones - “Brown”, “Pink”, “Orange”. This type of third party insurance is generally required for all foreign visitors traveling across the border by car.

An MTPL policy issued in the Russian Federation is not valid abroad. In fact, the “Green Card” differs from it only in the location of action, but compensation for damage occurs according to the laws of the country where the traffic accident occurred. The amount issued as insurance compensation is determined in the same way.

Insurance requirements

If in Russia there is compulsory MTPL insurance, then in the European Union its equivalent is the “green card”. It insures your civil liability to those who may be injured due to your fault in an accident.

This means that if you get into an accident and find yourself at fault, you insure yourself against financial liability to other drivers and pedestrians. You will have to solve your financial problems regarding the restoration of your car yourself. If you want to fully insure your car, take the trouble to purchase CASCO insurance, which is valid abroad.

A “Green Card” is purchased for a specific period, which limits its validity. It is important that it lasts for the entire duration of your trip. As a rule, its presence is not checked, but if you get into even a minor accident, you will have serious problems without it. In the future, this may even become a reason for visa refusal.

Services for obtaining a “green card” are provided by most insurance companies in Russia. You can also often take out this type of insurance right when crossing the border.

Tariffs for a “green card” are the same for all insurance companies and depend on the type of vehicle and the number of days for which insurance is issued. For example, to travel by car, such a card for 15 days will cost 2,830 rubles. If you apply for it for a whole year at once, it will cost you 25,570 rubles.

If you are traveling abroad with a trailer, it will need to be insured separately. For 15 days you will have to pay 850 rubles. And if you pay for a year, the tariff will be 7,700 rubles.

Expert opinion

Ardashev Vladimir

When traveling abroad by car, you can spend your time in a very interesting and exciting way. The main thing is that all documents, including the power of attorney, are in order.

Where to get a Green Card

Such a card is obtained from an insurance company on the territory of the Russian Federation or at the border. The rates used to calculate insurance premiums are the same for all insurers. They depend on the ruble/euro exchange rate and are subject to periodic adjustment. Information about them must be contained on the websites of those organizations that have the right to issue a Green Card.

It is advisable to obtain insurance from large companies that have branches in other countries or cooperate with foreign insurers. Their list can be found on the website of the Union of Insurers of the Russian Federation. If necessary, its employees provide consultations by telephone to those persons who have been involved in an accident in another country and have a Green Card.

Documents to be received

The card is issued for a period from 15 days to 1 year.

To do this you will need the following documentation:

  • Power of attorney for a car, copy (in case of driving someone else’s vehicle).
  • Driver's license, copy.
  • Certificate of registration of the vehicle.
  • Information about the travel route and its timing.
  • Information about the territory in which the insurance policy is valid.

The amount of car insurance when traveling abroad is determined in accordance with:

  • with the type of vehicle;
  • with the period during which the contract is valid;
  • with the host country.

Basics of passing border posts

It is enough to cross the border once in your car to fully understand this issue. Prepare the necessary documents and familiarize yourself with the procedure for crossing the border. At border posts, all vehicles are divided into three streams:

  • Passenger transport,
  • Freight transport,
  • Buses.

For each of these types of transport there is its own separate queue. When approaching the border, follow the convoy of cars corresponding to your vehicle.

When communicating with a border guard, it is wise to behave calmly, not stand out in any way, and adequately answer all questions asked. All of them will in one way or another relate to the purposes of your trip abroad. All customs officers have a specific professional deformation, so take it easy on the fact that you may be suspected of transporting prohibited items.

This is their job. Your task is to behave calmly and make it clear that you are not violating any laws or rules for transporting things.

It is enough to prepare incorrect documents, or not have the required papers with you, for you to be turned away at the border. This happens very rarely, but it does happen. Therefore, it is important to understand all the issues before leaving home.

Follow the rules and don't stand out from the crowd. The main thing is that the documents are in order. If you cross the border in someone else's car, you must have a power of attorney drawn up in accordance with international rules. This document will receive close attention, both from our side of the border and from the border guards of a foreign state.

If you have things that need to be declared when crossing the border, after checking the car you will need to go through customs through the red corridor. It happens that customs officers send people into the red corridor who do not have things to declare. It’s not scary, just silently obey and the procedure will go calmly and without conflict.

Power of attorney for a car for traveling abroad

When the owner of the car is not in it when crossing the border, a power of attorney is required. To have the right to temporarily export a vehicle outside the Russian Federation, you need to have the document certified by a notary. If the requirements of a foreign state regarding permission to drive a vehicle on its territory are unknown, it is necessary to clarify their availability.

This can be done when applying for a Green Card or at the consulate. After all, local laws may provide for verification (verification, confirmation) of a power of attorney and other documents received in the Russian Federation.

When notarizing a power of attorney, the owner of the vehicle is required to provide a number of documents:

  • Technical passport of the vehicle.
  • Vehicle registration certificate.
  • Russian passports of the parties.

In addition, when registering documents at customs for the temporary export of a car, we will also require a vehicle title and a certificate of registration on our part.

Nuances associated with certain countries

When preparing to cross the border by car, just in case, study the rules of the countries you plan to travel through. It is unlikely that you will want to pay high fines in foreign currency and deal with foreign police. For example, in many European countries the use of radar detectors, which are often used by drivers in Russia, is prohibited in order to avoid receiving fines for speeding.

One of the most popular European borders among motorists is the Russia-Estonia border. This is one of the most convenient ways to enter the Schengen area.

The border with Estonia is crossed by a large number of vehicles. If you go to this border, you will see a large line of trucks. Don't join this line, just move on. There you will see a separate queue for passenger cars.

There are speed limits in Estonia. So in populated areas, the speed limit is set at 50 kilometers per hour. Outside populated areas, the permitted speed is 90 kilometers per hour. On some sections of the road you can drive at a speed of 110 kilometers per hour.

Separately, it is worth paying attention to the tires. In winter, the car must be equipped with winter tires. This is monitored and the tire markings and tread depth are carefully checked.

In addition, please note that you cannot import goods into Estonia and other EU countries according to the rules for importing goods. Different countries have different restrictions. The transport of alcoholic beverages and cigarettes will always be controlled. They can be kept, but in a strictly specified quantity. In addition, pay attention to age.

If there are cigarettes in your car, you can only divide the amount among adult passengers. When crossing the border with alcohol, pay attention to the percentage of alcohol content. This determines the number of drinks that can be transported across the border.

As a rule, meat and dairy products cannot be imported. There are restrictions on the transport of medicines. You can take with you no more than five packages, from those that cannot be freely purchased in the European Union.

Before crossing the border, be sure to read the traffic rules and the table of fines. This is important, because even such a violation as illegal parking will eat at least 40 euros from your budget. And in most cases the fines exceed 200 euros.

Some nuances of issuing a power of attorney for a car for traveling abroad

  • The person who is entrusted with driving the car may not be present when the power of attorney is executed, but the principal must provide his passport details.
  • A power of attorney for a car for traveling abroad must contain the phrase: “With the right to travel abroad” or “With the right to export abroad.” Otherwise, it will be impossible to get abroad.
  • A notarized power of attorney for a car is valid for three years. When no period is specified, it is valid for only one year.
  • The document must be translated into the language of the country where you plan to travel. A translation is considered valid only when it is printed and certified by a notary.
  • If the car is a company car and belongs to an organization, in this case it is also necessary to issue a power of attorney from a notary. It is issued on behalf of the company. The power of attorney for the car indicates the legal address of the enterprise and the details of the manager.

To certify a power of attorney for a rented vehicle, you need to prepare a package of documents:

  • Car rental agreement.
  • PTS.
  • Power of attorney from an authorized person.

Thus, when traveling abroad by car, you will need to collect a package of documentation, without which the trip will be impossible. All details and nuances regarding this process can be found on the websites of diplomatic missions and consular offices of the Russian Federation and destination countries. And also on the websites of insurance companies.
