Powers of the Department of Education

Structure of educational authorities in Russia

Departments (or ministries) of education are government structures at various levels. Federal authorities

When reforming the system of executive authorities in 2018, an important change took place for the education system: the Ministry of Education and Science was divided into two separate government bodies: the Ministry of Higher Education and Science and the Ministry of Education.

Rosobrnadzor

The Federal Service for Supervision in Education and Science (Rosobrnadzor) is designed to monitor the quality of educational services. The subject of the complaint may be:

  • inconsistency of educational programs with state standards;
  • violation of the procedure for licensing educational institutions;
  • non-compliance with the qualification requirements of teachers and professors;
  • violations during the Unified State Examination or the Unified State Examination;
  • insufficient provision of schools with textbooks and other school equipment, etc.

Before contacting Rosobrnadzor itself, you should file a complaint with the regional government body performing the duties of Rosobrnadzor. Territorial authorities

Contacting the federal ministry is already a last resort. You need to start complaining with the head of the educational institution, and then move on to control bodies at various levels. At the same time, the complaint will not be accepted by a higher authority without first contacting a lower authority. Therefore, you need to complain in the following order.

For preschool, school and secondary vocational education:

  • head of an educational institution;
  • municipal department of education;
  • regional education department;
  • Rosobrnadzor or Ministry of Education.

For universities:

  • university rector;
  • Rosobrnadzor or Ministry of Education and Science.

In exceptional cases, when the actions of employees of an educational institution contain signs of a crime, it makes sense to immediately contact the Investigative Committee of the Russian Federation, bypassing the above authorities.

Municipal Department of Education

The municipal department (department) of education is closest to the direct work of educational institutions:

  • leads queues to kindergartens and schools, issues vouchers;
  • resolves issues regarding transfers to other educational institutions;
  • monitors the organization of educational activities, children's recreation during the holidays, as well as children's sports;
  • ensures the proper quality of living conditions for children in educational institutions.

If there is an organizational problem that could not be resolved at the level of the educational institution: conflicts with teachers, problems with enrollment in kindergartens and schools, insufficient equipment of the educational institution, you can contact the education department of your locality. Regional Department of Education

The Department (Ministry) of Education of the region is vested with the following powers:

  • licensing and accreditation of educational institutions;
  • control over the activities of educational institutions;

Reasons

The protection of the rights and interests of their children by parents or their legal representatives is prescribed . There are also many regulations that ensure that you and your child have the right to receive quality services in the manner prescribed by them.

In what cases can a complaint be filed with the Ministry of Education?

All educational institutions in the region, including kindergartens, schools and universities, are under the competence of the relevant branches of the Ministry of Education. If a minor conflict occurs in an educational institution, the territorial education unit can resolve it. Unfortunately, the reality looks different. In most cases, management does not pay attention to disputes and problems, which actually forces citizens to file a complaint with higher authorities.

The following violations may be grounds for filing a claim:

Rights of citizens when their appeals are considered by the Ministry of Education of the Russian Federation

The period for consideration of an appeal lasts, according to Federal Law of the Russian Federation No. 59, no more than 30 days. Its extension is possible, as an exception, for another 30 days. How to complain to the Ministry of Education? There are several ways to submit an appeal. Any government agency provides for the reception of citizens . How to correctly fill out a sample complaint to the Ministry of Education?

A sample claim can be sent to the Department of Education in several ways:

Where should the complaint be filed?

The complaint is filed by the legal representative of the child whose rights or interests are violated in the educational organization. If the problem concerns a group of students or an entire class, then it is advisable to write a collective complaint to the department.

Grounds for refusal to consider a complaint

The complaint will not be considered in the following situations:

  • if the personal data or contact information of the applicant is not indicated;
  • the statement contains abuse and threats to the life and health of a teacher, supervisor, or other person;
  • the text of the document is impossible to read;
  • the requirements for filing a claim electronically are not met;
  • if the response to the appeal involves the disclosure of state secrets.

A complaint may be left unanswered if the applicant repeatedly contacts the department with a problem that has already been considered.

The exception is situations when new circumstances or evidence of violations have appeared in the case. The complaint to the Department of Education must not contain an objection to the court decision. Otherwise, it is returned to the applicant indicating the method of appeal.

Based on the results of consideration of the appeal by the Department of Education to the teacher or administration of the school or kindergarten, the following measures may be applied:

  • administrative responsibility;
  • disciplinary action;
  • compensation for material damage.

Bringing to responsibility a teaching worker is carried out on the basis of the Administrative and Civil Code of the Russian Federation on a general basis.

If a teacher systematically violates a child’s rights, parents can write a statement to the school principal demanding that action be taken and him held accountable. When the administration of an educational institution fails to act, the complaint is sent to the regional office of the Ministry of Education. The appeal can be sent via an electronic form on the official website of the department, by registered mail, or in person to the office.

How to submit a complaint to the Ministry of Education?

Grounds for complaint

Reasons for contacting the Department of Education may include:

  • illegal fees in an educational institution;
  • humiliation of the honor and dignity of students;
  • psychological or physical violence towards a child from peers, teachers, administrative workers;
  • improper care and supervision of pupils, as a result of which harm was caused to the health of a minor;
  • incompetence of teaching staff;
  • problems with the child's entry into 1st grade.

Reference! If violations are associated with damage to the mental or physical health of a minor, then criminal liability may be provided for them. In this case, the complaint must be sent to the police or prosecutor's office.

Feeding algorithm

Filing a complaint directly to the Ministry of Education and Science is the most effective lever of pressure on employees of educational institutions. Violators of children's rights and freedoms will not be able to do anything about the sudden inspection, and even officials in district departments will be forced to reconsider the case. However, before contacting the main department, you are required by law to go through the path of “peaceful resolution” of the conflict. Typically it looks like this:

  • Something happens in an educational institution - your child’s rights were violated once or were violated systematically;
  • You contact directly the teacher who was caught in violation, or the school principal (with a written complaint);
  • The school management reviews the complaint, but does not change anything (or ignores it);
  • You notify the school (in writing) that the complaint has been sent to a higher authority - the local department of education;
  • The department office receives the complaint and considers it;
  • Upon review, due to the human factor (everyone is very supportive of each other), you receive a refusal to satisfy your requirements;
  • Having received a refusal, you can begin to file a complaint with the main department of the Ministry.

Usually, especially when it comes to physical or moral humiliation, a complaint can be filed with several authorities at once - necessarily to the director of the institution, to the education department of your region and to the prosecutor's office. Submitting an appeal directly to the Ministry of Education must have a good reason - for example, local authorities are “covering up” for the school and its sins, or they send you replies about the measures taken, although no measures were taken.

If you decide not to “bother” and send a complaint directly to the Ministry, know that within 7 days it will be sent to the territorial department for on-site consideration . Only after the department refuses to consider your appeal can you send the complaint again to the Ministry itself.

The results of your appeal may result in the formation of a special commission at the Ministry that will begin an investigation into the actions or inactions of authorized persons or teachers. Based on the results of such an inspection, an administrative offense may be issued or a decision to transfer the case to the prosecutor's office.

Application procedure

To resolve a controversial issue, you should first try to contact the Administration of the relevant educational institution. Voice your complaints. Perhaps management is not aware of the violation, and they will make attempts to correct the situation. If these actions did not lead to the desired result, then you can go to the next structure.

All requests regarding the work of institutions located on the territory of the municipality are sent directly to the department. Therefore, first of all, the claim should be submitted there.

And only if the reaction to it does not satisfy you, you can contact the ministry . In this case, it will be a higher authority in which you can appeal the department’s decision.

Moreover, if you bypass the first step and go straight to the regional authority, then your application will still be sent down first. But the period for its consideration will increase by 7 days, since this is the time period provided for forwarding the application to the appropriate authority.

Wherever the complaint is filed, remember that it will be considered by government officials, so you should not use profanity or threats against them. In addition to the fact that such statements will not be considered, you may be held liable.

Methods

There are several standard ways to file a complaint with the Ministry of Education:

  • By registered mail with notification;

This method is used when you do not have the opportunity to submit an appeal in person or online - for example, the volume of evidence and “evidence” against the school is so large that electronic services cannot process it. Also, this is the most reliable method of submission, since you involve a third party (Russian Post) as a guarantor for sending the letter. It is necessary to keep receipts indicating that you sent a complaint, since otherwise it will not be possible to prove the fact that the complaint was filed.

  • Complain only according to your profile - the complaint must be within the competence of the Ministry;
  • Stick to facts and evidence - slander may entail counterclaims;
  • You cannot come in a state of intoxication - they simply won’t let you in;

  • Contact first - if your complaint has already been considered and a decision has been made, there is no need to bother the minister a second time.

If your application requires additional checks, the ministry will indicate to you the timing of these checks . The answer will be sent to you in one of the ways available to you - by mail, e-mail, or delivered in person. Most often, responses to complaints come by mail. However, if your evidence is sufficient for the minister or deputies to make a clear decision about the problem, they will give you an answer immediately.

  • Electronic appeal

The most convenient way to register your complaint if there is no extensive evidence. On the official website www.mon.gov.ru there is a citizen appeal section where you can either file a complaint or simply report an offense (corruption) or send a simple letter asking for help in understanding the problem (information request). In any case, your complaint will reach the Ministry and will be processed within three days after submission.

In order to file a complaint, you need to digitize all the evidence you have , whether it be recordings of conversations (with prior warning to the persons on the recording about the recording) or refusals from education departments. The electronic form allows you to submit only 1 file without using archiving programs, so if you have more information, you will have to use a different method of submission.

However, if there is only a video or audio recording of the offense, or refusals, electronic filing is the most convenient.

The form must be filled out carefully, without missing the selection of topics or your data. Please remember that by law a complaint cannot be anonymous.

Consideration of such an appeal is carried out within 30 days , as when applying by other means.

Procedure for submitting a written appeal

According to Federal Law No. 59 of May 2, 2006, when submitting a written request, the sender must indicate the following information:

  1. The name of the authority is the Ministry of Education of the Russian Federation. You can also write the name of the official to whom the complaint is intended, or his position.
  2. Full name of the applicant.
  3. Citizen's postal address to which a response to the appeal should be received.
  4. The essence of the complaint . It is necessary to briefly and succinctly describe the reason for the complaint and refer to the laws that were violated. You should write to the point, without abusing emotions, but describing exclusively facts.
  5. Put forward requirements . The sender must indicate what action he is asking to take. You can write that you need to understand the situation and take the necessary measures.

The complaint will not be considered if:

  • it is anonymous , that is, the sender’s last name is not indicated;
  • there is no indication of a return postal address to which a response can be sent;
  • contains profanity or offensive language , as well as threats against the official to whom it is intended;
  • the text is not readable.

The sender will be informed that it is impossible to consider his request in the following cases:

  • the response to the complaint implies the disclosure of state secrets or other secrets that are protected by federal laws;
  • complaints have already been received describing the same conflict situation , they were answered, but this appeal does not contain new information;
  • Issues that are not within the competence of the Ministry of Education of the Russian Federation are submitted for consideration.

Filing a complaint in person

The head of the capital's Department of Education holds a personal reception of citizens, including you can get an appointment with the first deputy and deputy heads. According to the law, complaints must be registered within three days and considered within 30 days. In exceptional cases, this period may be extended, but such extension cannot be more than 30 days. Anonymous complaint

When sending a complaint through the electronic reception, e-mail or registered mail, it must indicate personal data, including the applicant’s full name and contacts.

An anonymous complaint may be left unanswered. Consideration of a complaint where the details of the applicant are not indicated does not comply with the requirements of the law.

An anonymous complaint against a teacher can be sent to any authority. But government employees are not obliged to review it and take measures to eliminate the violations specified in it.

Terms of consideration

The complaint is registered within 3 days of receipt and sent to the structural unit that is responsible for considering this issue.

Department employees review the complaint and make a decision on taking measures to eliminate violations within a month after registration of the application.

If the problem is within the competence of other government agencies or executive authorities, then the application is redirected within 7 days.

Attention! When the circumstances of the case are unclear or additional information is required, the period for consideration of the complaint can be up to 2 months after the application is accepted.

The applicant is notified of the results of the consideration of the claim in writing at the specified postal address or by e-mail. The citizen is also informed about which department the complaint was forwarded to.

When considering applications, the information they contain, including those relating to the private life of the applicant or minor, is not disclosed without his consent. All personal data is stored and processed in accordance with Law No. 152-FZ of July 27, 2006.

Procedure for consideration

After the office of the authority receives your application, it is registered within 3 days . This is the period for which it must be written to the contractor, and he must accept and familiarize himself with it.

If it is decided that the complaint was filed out of competence, it will be sent to the appropriate structure within seven days . The applicant receives notification of this.

The total period for consideration of a complaint is 30 days . If it is not possible to solve the problem or give a substantive answer due to additional checks and the request for necessary materials, then the period for reviewing the paper is extended, but not more than a month. If a decision has been made to extend the time interval, a notification about this fact is sent to the applicant.

While the verification is underway, the applicant can provide additional evidence, missing documents, give explanations, and get acquainted with the case materials, if they do not constitute a state secret.

If, as a result of the proceedings, the perpetrators were not brought to justice, or the punishment does not seem so serious to you, then you can complain.
