The essence of the Zemsky Doctor program
The lack of staff makes it much more difficult for residents of small municipalities to receive qualified medical care. To create attractive conditions for doctors, a specialized federal program “Zemsky Doctor” has been in place since 2012. It was created with the aim of improving the material security of specialists. The allocated funds, in particular, can be used to purchase housing. According to the current rules, assistance in the amount of 1 million rubles is provided.
The need for additional measures is due to a significant deterioration in the situation with personnel in this industry. - from 2021 – increasing the age limit for participants from 25 to 50 years, expanding the list of municipalities included in the program;

Changes 2019-2020
Despite the measures taken, the situation with personnel shortage remains tense. During a specialized conference of Russian doctors in the fall of 2021, the following data were announced:
- almost 500 settlements with a population of up to 2 thousand people are not able to provide first aid services in stationary centers;
- the shortage of doctors (junior personnel) is more than 23,000 (130,000) people, respectively;

To increase the effectiveness of the Zemsky Doctor program, in 2020 a decision was made to eliminate age restrictions. The corresponding amendments were confirmed by special Government Resolution No. 1347 of October 18, 2019. The federal budget plans to allocate additional funds (more than 237 billion rubles) for targeted financing of medicine.
The legislative framework
The rules for implementing the state program for qualified doctors in villages are determined by Federal Law No. 326 “On Compulsory Medical Insurance”. Amendments to this bill were applied in two thousand and eleven.
They fix the registration rules and criteria required for participation in the state program.
The payment of a million rubles is carried out only for certified young specialists with a document confirming a completed internship or residency.

Basic conditions
The following basic conditions have been approved for the Zemstvo Doctor program:
- amount – 1,000,000 rubles;
- formation of payments - at the expense of the federal and regional budgets;
- obligations of the participant - relocation, signing an employment contract in the specialty for a period of 5 years;
- liability – return of funds in case of early termination of the contract due to the fault of the doctor;
- the responsible institution is the territorial division of the Compulsory Health Insurance Fund (MHIF).
Requirements for participants
The essence of the Zemsky Doctor program is to attract employees with higher medical education. There is no age limit from 2021, so this criterion does not matter. The participant must document receipt of the relevant qualifications at the application review stage. Other requirements and features:
- In addition to a university diploma, you can provide information about a completed internship (residency);
- labor obligations are formalized by a contract for a period of 5 years;
- an agreement is concluded for a medical specialty with a municipal medical institution;
- a separate agreement with the Compulsory Medical Insurance Fund determines the conditions for receiving compensation, notes the obligation to return part of the money upon termination of the employment contract.
Junior medical personnel can receive assistance from the state under the special program “Zemstvo Paramedic”. The current rules provide support for paramedics and other workers of the corresponding category in the amount of 500,000 rubles. The general conditions correspond to those discussed above. - order for the enterprise on employment in the specialty;
- a certificate from the Federal Tax Service or another document confirming the TIN;

- documents confirming the presence of a higher specialized education (completion of residency, internship);
- data on permanent registration of place of residence from the Ministry of Internal Affairs;

According to the approved rules, the responsibilities of the responsible institution are performed by the territorial division of the Compulsory Medical Insurance Fund. The procedure for returning personal income tax was set out in the Letter of the Federal Tax Service of the Russian Federation dated November 14, 2019 No. BS-4-11/ [email protected] In accordance with the provisions of clause 1 of Art. 231 of the Tax Code of the Russian Federation, the amount of tax excessively withheld by the tax agent is subject to refund based on a written application from the taxpayer. In this case, the refund is carried out at the expense of personal income tax, which is subject to transfer to the budget on account of upcoming payments both for this taxpayer and for other taxpayers, from whose income the tax agent makes withholding.

If the amount of tax to be transferred by the tax agent to the budget is not enough for a refund, the tax agent, within ten days from the date of submission of the corresponding application to him, sends to the tax authority at the place of his registration an application for the refund of the amount of tax withheld in excess. The tax amount transferred to the budget is returned to the tax agent by the Federal Tax Service in the manner established by Art. 78 Tax Code of the Russian Federation.
At the same time, as noted in the Decree of the Constitutional Court of the Russian Federation dated February 17, 2015 No. 262-O, the rule according to which the excessively withheld amount of tax is returned to the taxpayer through a tax agent (clause 1 of Article 231 of the Tax Code of the Russian Federation) has priority, since the overpayment of tax arose due to the fault of the last one. In other cases, when returning tax, you should be guided by the general rules - Art. 78 and 79 of the Tax Code of the Russian Federation. Thus, the return of the amount of personal income tax excessively withheld by the tax agent from one-time compensation payments to medical workers is carried out by him (in our case, by the regional Ministry of Health) in the manner established by clause 1 of Art. 231 Tax Code of the Russian Federation.
Responsibilities of the program participant
If a doctor received a million under the Zemsky Doctor program, it is necessary to fulfill the agreed obligations. In addition to the five-year service, the need to comply with the terms of the employment contract is implied.
Consequences of failure to comply with conditions
In case of early termination of the employment contract at the initiative of the employee, the money will have to be returned in proportion to the remainder of the mandatory period (5 years). The exception is the situation when a doctor must fulfill his military duties. Two options are offered:
