Can a school refuse a transfer based on registration?

Article 44 of the Federal Law “On Education in the Russian Federation” No. 273-FZ provides for the right of parents to choose an educational institution for their children. At the same time, the legislation does not provide for any restrictions due to the lack of registration at the place of residence in the territory of a particular municipal entity or according to other criteria of the student.

A refusal to admit a child living and registered in the area where an educational institution is located to school can be regarded as a violation of a citizen’s right to receive an education, as prescribed in the Constitution of the Russian Federation.

For violation of the admission rules, the organization itself, as well as its employees, may be brought to administrative responsibility in accordance with paragraph 5 of Article 19.30 of the Code of Administrative Offenses of the Russian Federation.
