If a temporary residence permit is issued once and only for three years, then a residence permit allows you to spend five years on Russian territory. And after this period, the residence permit in the Russian Federation can be extended. Moreover, this can be done more than once; the law does not provide for any restrictions on the number of renewals of a residence permit.

The period for consideration of the possibility of extending a residence permit is considered as a general rule within two months. This must be taken into account when calculating the application deadline. As with obtaining a residence permit for the first time, renewal of a residence permit requires documents that are attached to the application. Fewer of them are required, but failure to provide at least one of them leads to a refusal to accept them by the FMS employee.

Why is it necessary to renew a residence permit?

Documents confirming the right of a migrant to temporarily reside in the country issued before 2021 do not lose validity for the period for which they were issued. After the expiration of the period, it is necessary to renew the residence permit, or simply put, it’s time to change it to a new document.

If a person does not want to make a replacement (does not renew), the residence permit becomes invalid, and the migrant acquires the status of illegally staying on the territory of the Russian Federation, which leads to a fine and even deportation.

Knowledge of Russian language

This requirement appeared in 2015. Knowledge of the language, history and basic legislation of the Russian Federation is necessary in order to better integrate into society. Supporting documents are submitted only once and will not be required at the next renewal.

Documents on Russian or Soviet (before 1991) education are suitable for this purpose. Both a school certificate and a diploma of secondary specialized or higher education are considered. If there is nothing like this, you will have to take a special exam. After successful completion, a certificate is issued, which is attached to the application.

Not everyone needs this confirmation. Pensioners, highly qualified specialists (and members of their families), as well as participants in other special programs are exempt from it.

Established deadlines for renewal of residence permit

Extension of a residence permit is allowed within the legislative framework (Law No. 257-F3, Article 1, paragraph No. 3, August 2, 2019) and only if the following rules are observed:

  • no later than 30 days from the occurrence of the event, after which the document cannot be used in the future;
  • upon citizens reaching 14, 20 or 45 years of age;
  • in case of detection of errors and inaccuracies made during filling out the document;
  • if a foreigner changes his full name, other data, gender, the replacement is carried out within ten days from the date of issuance of documentary evidence of the fact.

Replacing a residence permit in Russia with a permanent certificate is possible at any convenient time, as long as it is valid.

Where to go to renew your residence permit?


You can replace your residence permit at the MFC.
If the document was received a long time ago, most likely it was received at the FMS (Federal Migration Service), but for some time now this body has been abolished. Now its functions are performed by a separate structure under the Ministry of Internal Affairs. You need to contact the Municipal Department of Internal Affairs at the place of registration or the MFC (multifunctional center).

Note! In a multifunctional application for renewal of a residence permit, it takes longer to process.

Procedure

  • Have a temporary residence permit or other grounds for obtaining a residence permit.
  • Live in the Russian Federation on the basis of a temporary residence permit for at least 1 year.
  • Prepare the required documents. Prepare and submit documents no earlier than 8 months after receiving the temporary residence permit and no later than 4 months before its expiration date.
  • Get a residence permit.
  • Within 7 working days, register at your place of residence.
  • Notify annually of residence in the Russian Federation and period of stay outside the country.

What documents are needed to renew a residence permit?

To renew a residence permit, a minimum list of documents is required; it takes little time. The applicant provides the responsible person of the migration department with the following:

  • civil (foreign) passport;
  • certificate of residence permit to be replaced;
  • most often you do not need to present it, but we advise you to have a receipt for payment of the state duty with you;
  • if the documents were prepared before March 2015, you must attach a certificate of passing the tests (Russian language, history, legislation);
  • foreigners who have reached the age of 14 must present a certificate of no criminal record;
  • medical certificates (absence of infectious diseases, AIDS, narcologist, COVID-19);
  • photo 35x45 4 pieces.

All these documents are submitted prior to the application. Previously, it was written arbitrarily, but after the adoption of Order No. 417 of the Ministry of Internal Affairs of the Russian Federation dated June 11, 2020 (it came into force on July 18, 2020), the form of the document was officially established - in Appendix No. 3 to this order.

You can fill out the application using a computer or manually. In the latter case, use a pen with black or blue ink, fill in all the fields without errors, blots or corrections. The applicant puts the date and signature in the presence of the inspector when submitting the documents.

Required documents

According to the requirements of the migration legislation of the Russian Federation, a residence permit is extended upon expiration of:

  • 5 years calculated from the date of issue - for a document received on a general basis;
  • 5 years (or another period determined depending on the specific basis) - for a document received under a simplified procedure.

Thus, the list of documents required for renewal includes:

  1. Originals and copies of residence permit and resident identity card;
  2. Corresponding statement.

In addition, in some situations, authorized employees of the Ministry of Internal Affairs may additionally request:

  • Photos of the applicant (if it is necessary to issue a new copy of the document because the old one is lost, damaged, or has run out of free pages);
  • A document confirming the possibility of the resident’s sociocultural integration into Russian society (if this confirmation was not provided by the migrant during the initial registration);
  • Other documents (certificates of income and/or availability of permanent housing in the Russian Federation, results of a medical examination, etc.).

Copy of residence permit

The copy of the residence permit submitted by the migrant for renewal must be completed with a notarized copy. In order to certify a document, you should contact a notary office that has a license to provide such services. For individuals, the cost of certification of one page ranges on average from 50 to 100 rubles. The turnaround time for a certified copy rarely exceeds 1 day.

The submitted copy (like the original) of the document must contain a note about the foreigner’s status as registered at the current place of residence (or temporary stay) in Russia.

In this case, an identity card means a national passport (or another document similar from a legal point of view) of a resident. Unlike a residence permit, the submitted certificate must be completed not only with a notarized copy, but also with a notarized translation, which can also be done in almost every organization of a similar profile.

Other necessary documents can be obtained (as appropriate):

How long does it take to renew a residence permit?

The deadlines for considering applications for replacement/extension of residence permits were finally settled only in July of this year. Paragraph 23.5 of Order No. 417 of the Ministry of Internal Affairs of the Russian Federation (06/11/2020) clearly states that the issuance of a new type of certificate must be carried out within seven working days.

Important! There is no need to worry that you will be left without a residence permit for some time. The certificate issued by the inspector upon acceptance of the application has the same functions. A migrant can move freely within the country and leave it.

Exchange is made on a paid basis. When renewing (exchanging) a residence permit, a state fee is charged. The average cost is 5 thousand rubles. The receipt is issued by an employee of the MFC or at the department of the Municipal Department of Internal Affairs; you can pay at any bank branch.

In what case can a residence permit extension be refused?


Convicted migrants will be denied a replacement residence permit.
There are a number of restrictions, in the presence of which the renewal of a residence permit may be refused. This includes the following violations:

  • reporting false information about yourself;
  • fake documents;
  • During a medical examination, dangerous infectious diseases and drug addiction were identified;
  • there is no confirmation of the possibility of providing financial support for oneself and family members (minimum subsistence level);
  • there is no certificate of passing exams on knowledge of the Russian language;
  • if the migrant has been subject to readmission or deportation for five years;
  • when convicted of serious (especially grave) crimes, as well as illegal actions related to drug trafficking;
  • there is an outstanding criminal record in Russia or another country;
  • if a foreigner supports terrorist activities, creating a security threat to the state and other citizens.

Extension of a residence permit or replacement of an old sample with an unlimited document does not relieve one from the obligation to annually send a notification regarding a residence permit. Many, despite the warning and familiarization with the rules, ignore this responsibility. This can lead to a fairly impressive fine (from 7,000 rubles), without payment of which it is impossible to renew the residence permit, and a repeated violation leads to deportation from the country.

A residence permit gives many rights to foreign citizens, but it is important not to forget about the obligations assumed.

HOW TO REPLACE A RESIDENCE PERMIT WITH A NEW, PERMANENT TERM/

Which foreigners do not need to confirm their knowledge of Russian, knowledge of history and laws?

As stated in paragraph 5 of Art. 15.1 of the Federal Law of the Russian Federation No. 115, a separate category of foreigners is not required to confirm the presence of the specified knowledge. Moreover, neither when registering a temporary residence permit, nor when obtaining or extending a residence permit. The list of persons who are exempt from this obligation is quite extensive. So, among them are:

  • highly qualified specialists from foreign countries;
  • Belarusians (citizens of the Union State);
  • foreigners - native speakers of Russian;
  • foreign students studying full-time at Russian universities, employed in accordance with the norms of Art. 13.4 Federal Law of the Russian Federation No. 115;
  • foreigners who apply for a residence permit and who have blood relatives (parents, children) in the Russian Federation, etc.

Accordingly, citizens who are classified in this preferential category, when renewing a residence permit, submit the above documents without a certificate.
