There are a number of regulations that, to one degree or another, regulate the types and legal significance of both identity documents and their codes.

Temporary document when replacing a passport - legislative framework

Legislation on the loss of a citizen’s passport

To understand what a temporary certificate of a citizen of the Russian Federation is, you should refer to the legislative acts.

Information about such a certificate can be obtained on the basis of:

  • Presidential Decree No. 232 (03.13.97);
  • Government Regulations No. 828 (07/08/97) as amended on 07/07/16;
  • FMS Order No. 391 (11/30/12);
  • Government Regulations No. 1214 (11/18/16);
  • Code of Administrative Offences.

The obligation to have a passport begins when you reach 14 years of age. During the absence of a passport, due to its replacement, a temporary document is issued - an identity card.

Non-identity documents

Any documents issued in connection with the professional or other activities of a citizen are not considered identification documents, for example:

  • student cards and grade books;
  • pension certificates, certificates of disability, certificates of a veteran, disabled person, honorary donor;
  • work books;
  • international passports;
  • marriage and divorce certificates;
  • professional certificates, for example, certificates of a lawyer, FSB employee, police officer, civil servant or member of the Russian Academy of Sciences.

The following also cannot serve as identification:

  • copies of passports, including those certified by a notary;
  • certificates of release. The limit of their validity is submission to the passport office to obtain the main document.

What is a temporary identity card for a citizen of the Russian Federation?

VUL is a certificate in form 2P, presented in Order of the Federal Migration Service of Russia No. 391.

The document is issued by the Russian Ministry of Internal Affairs. By Decree No. 1214, the authority to issue VULs was granted to multifunctional centers.

Since February 2021, they have served as intermediaries between the Ministry of Internal Affairs and citizens in accepting documents for a replacement passport and handing over the prepared certificate.

To become the owner of a temporary document, you must apply for it. This must be done simultaneously with submitting documents for passport restoration. The places where this procedure can be performed are established by law.

These include:

  • bodies of the Ministry of Internal Affairs related to the territory where the applicant lives;
  • bodies of the Ministry of Internal Affairs located in the territory where the applicant is staying temporarily;
  • accredited multifunctional centers;
  • State Services portal.

What can you do in Russia with a foreign passport?

Buy a train ticket

Buy cigarettes and alcohol

Although a foreign passport is not an identification document within the country, it makes it possible to unambiguously determine the age of the owner. So the international passport appears in both lists of documents that can be used by the Order of the Ministry of Health of the Russian Federation of May 12, 2014 N 215n; Order of the Ministry of Industry and Trade of the Russian Federation dated May 31, 2021 No. 1728 to sell tobacco products and alcohol.

Validity

What does a temporary identity card for a Russian citizen look like?

The temporary ID card has a limited validity period. It's valid for a month.

This period is established due to the fact that during this period the citizen has time to obtain a new passport and the need for a temporary document becomes invalid.

There are situations in which the deadline for issuing a passport may be delayed, for example, if it is necessary to establish the identity of a citizen. In this case, the temporary document can be extended for another month.

Is it possible not to take an internal Russian passport abroad?

An internal passport is not included in the list of documents that must be collected to travel abroad. However, when traveling, sometimes there are situations when a foreign passport does not help:

  1. The citizen required medical assistance, which is provided subject to the provision of a compulsory medical insurance policy, before passing through passport control at the airport.
  2. A person goes to the airport by transport, and upon boarding it is required to provide a national passport.
  3. Receiving visas or documents from a travel agency directly at the airport.
  4. When applying to a diplomatic institution outside of Russia in case of loss of a foreign passport necessary for personal identification.

The above list is incomplete. Therefore, in order to avoid such situations, it is recommended that in addition to your international passport, you take with you an all-Russian passport when traveling.

In what cases is it issued?

After submitting an application for a passport, the document is not immediately issued. It will take time for the Ministry of Internal Affairs to prepare it. Typically this period takes at least 10 days. It is during this time that you can receive the described certificate.

Issue may be required if the passport is changed:

  • by loss;
  • upon loss of a document due to its damage or wear;
  • in connection with theft;
  • in connection with a change in passport data (erroneously entered or deliberately changed full name);
  • when changing gender.

You can also receive this certificate when you first apply for a passport.

Important: to receive a temporary document when replacing a passport is the right of every citizen and they have no right to refuse this.

Is a driver's license an identity document?

Purely legally, a driver's license is only a document confirming the right of its holder to drive a vehicle.

However, in accordance with the Decree of the State Committee for Personal Injury 06-1016 of the Armed Forces of the Russian Federation, a driver’s license has a dual function, namely:

  • confirmation of the right to drive a vehicle;
  • Confirmation of the identity of the driver's license holder.

However, there are a number of departmental restrictions on the civil circulation of a driver’s license.

For example, in accordance with the Regulations of the Central Bank of the Russian Federation, acts of the Ministry of Foreign Affairs and the Ministry of Internal Affairs of the Russian Federation, any banking transactions using a driver’s license are excluded.

Restrictions associated with the use of a temporary ID

What rights is a citizen deprived of with a temporary certificate instead of a passport?

Restrictions associated with the use of VUL include:

  • the impossibility of international travel (this applies even to those countries with which Russia has an agreement on the recognition of internal passports);
  • inability to initiate the procedure for obtaining a passport;
  • inability to change registration;
  • inability to register at the place of residence or stay.

When using a non-permanent ID, you may encounter other difficulties.

So, if police officers need to confirm the identity of a citizen, they may require this procedure to be carried out at the police station.

You will have to spend additional time, since a temporary document is not as protected from forgery as a passport and confirmation of its authenticity is required. To avoid inconvenience, presenting an additional document with a photo, such as a driver's license or student ID, will help.

In some cases, there is a refusal to provide services for the sale of air and railway tickets. Transport company employees can refer to internal documents and instructions. You should be aware that these actions are not legal.

Problems arise when preparing documents for a loan or when applying for a job. This is also illegal.

It is especially important to note that a temporary certificate is not confirmation of where a person is registered, since this information cannot be certified with a seal.

In order to certify this data, you must obtain a separate document.

Documents of foreigners

Foreign citizens staying or entering the territory of the Russian Federation must have one of the following documents:

  • an international passport of your country. For citizens of states that have a simplified border crossing regime with the Russian Federation, an internal passport is sufficient;
  • an international diplomatic passport, if the activities of a foreign citizen are related to a diplomatic or consular mission;
  • a passport of a citizen of the USSR if the foreigner is a citizen of one of the republics of the former USSR and legally resides in the territory of the Russian Federation;
  • temporary residence permit on the territory of the Russian Federation;
  • residence permit in the Russian Federation;
  • a certificate confirming refugee status or granting asylum on the territory of the Russian Federation.

Nuances

The difficulties and limitations that arise when using a VUL are due to the fact that the official form does not reflect the details of the passport taken as a replacement.

Despite numerous appeals from citizens, the uniform remains unchanged. However, now the specialist issuing the certificate has the right to enter the citizen’s passport data into it. To do this, use the “Reasons for issuance” column.

Important: your temporary ID should be stored as carefully as your passport. When receiving a new passport, the ID must be returned.

Can I use a foreign passport instead of a regular one?

There may be some cases when a person can use a foreign passport, but most often these are cases that do not require an official identification document, but only the correct spelling of the last name, first name and patronymic. In what cases can you use a foreign passport instead of a passport in Russia :

  • purchasing a train ticket;
  • when ordering air tickets for domestic flights;
  • when exchanging currency, etc.

Please note that when presenting tickets at a train station or airport, you may be required to have an internal passport, so the information in both documents must match in such cases.

A unique case for Russia is a trip to the Kaliningrad region . A foreign passport is not required if a person goes there by air or water transport, however, to get to this city by land transport it is necessary to cross the Belarusian and Lithuanian border. Which persons does the Law apply to?

Such persons include:

  • persons released from prison who have an outstanding or unexpunged conviction for committing a crime;
  • persons in respect of whom a decision has been made on the undesirability of staying or living on the territory of Russia, but it is not possible to deport them outside of Russia due to their lack of citizenship of a foreign state;
  • persons who were citizens of the USSR as of September 5, 1991, who arrived in Russia to live after November 1, 2002, who did not acquire Russian citizenship in the prescribed manner and do not have another citizenship, or whose passport as a citizen of the Russian Federation was confiscated, as well as their children ;
  • persons in respect of whom a decision was made to cancel the decision on recognition as a citizen of Russia or on admission to citizenship of the Russian Federation, who do not have a place of residence in Russia;
  • persons in respect of whom a decision has been made that it is undesirable to stay or live in Russia, or a court has issued a decision imposing an administrative penalty in the form of deportation from Russia, or the Ministry of Internal Affairs of Russia or its territorial body has made a decision on deportation outside of Russia, or a decision has been made to transfer a stateless person to a foreign state in accordance with the international treaty of the Russian Federation on readmission, but there is no state ready to accept such a person.

And it turns out to be a vicious circle - such illegal citizens cannot be deported outside of Russia, because they do not have citizenship of another country. That is, these persons are “outside the law.”

For example, some citizens arrived in Russia from troubled regions - from Donbass and Nagorno-Karabakh, South Ossetia.

Such citizens can live in Russia for a long time, but they cannot legally get a job without documents. And a full life without documents is hardly possible: it is impossible to get a loan, insurance, etc.

Currently, there is a special procedure for establishing the identity of a foreigner or stateless person who does not have a valid document. But, at the same time, our migration legislation does not provide for an identification document of a stateless person in the Russian Federation, issued after his identity has been established.

Clarifications from the Ministry of Internal Affairs on the legal status of foreign citizens after October 1, 2021.

The website of the Ministry of Internal Affairs of the Kabardino-Balkarian Republic published detailed explanations of the effect of temporary measures to regulate the legal status of foreign citizens after October 1, 2021. Here is the text of the publication in full:

In accordance with paragraph 2 of Decree of the President of the Russian Federation of June 15, 2021 No. 364 “On temporary measures to regulate the legal status of foreign citizens and stateless persons in the Russian Federation during the period of overcoming the consequences of the spread of the new coronavirus infection (COVID-19)”, foreign citizens and stateless persons who arrived in the Russian Federation before March 15, 2021 and who, as of June 16, 2021, do not have legal grounds for stay (residence) in the Russian Federation, have the right to apply to the territorial bodies of the Ministry of Internal Affairs until September 30, 2021 inclusive Russia with a free-form application to resolve their legal situation, or travel outside the Russian Federation.

Foreign citizens who do not take advantage of this opportunity, from October 1, 2021, will be considered illegally staying on the territory of the Russian Federation and are subject to liability in accordance with current legislation.

From October 1, 2021, the ban on making decisions regarding administrative expulsion from the Russian Federation, deportation, readmission, undesirability of stay (residence), not allowing entry and shortening the period of temporary stay with respect to foreign citizens will completely cease to apply.

During the period of validity of the remaining provisions of the Decree, work with foreign citizens is carried out taking into account the following features.

1. Foreign citizens who have regulated their legal status in the Russian Federation before September 30, 2021 are fully subject to the Decree, including suspension until the expiration of 90 days from the date of lifting of temporary restrictions on transport communications with a foreign state introduced by the Russian Federation the duration of the temporary stay of foreign citizens, the terms of registration at the place of stay without the need to take actions to extend them.

The list of foreign states in respect of which the temporary restrictions on transport communications introduced by the Russian Federation have been lifted (indicating the date of lifting of these restrictions) has not yet been approved by the Government of the Russian Federation. In this regard, the provisions of the Decree, until the approval of the corresponding list, apply to citizens of all foreign countries without exception.

During the period specified by the Decree, foreign citizens who have regulated their legal status have the right to apply for the issuance of permits to reside in the Russian Federation. At the same time, in order to leave the Russian Federation for the specified category of foreign citizens who arrived in the Russian Federation in a manner requiring a visa, transit visas should be issued upon their application.

Permits for residence and registration at the place of residence of foreign citizens located in the Russian Federation, the validity of which expires before December 31, 2021, are considered valid until July 18, 2022 inclusive.

The periods of temporary or permanent residence in the Russian Federation of foreign citizens located in the Russian Federation, registration at the place of residence, as well as the validity periods of refugee certificates and certificates of temporary asylum on the territory of the Russian Federation, which expire after December 31, 2021, are renewed from 1 January 2022 and is considered extended for 199 days from the end date.

2. If a foreign citizen was brought to administrative responsibility for violating the regime of stay (residence) in the Russian Federation when submitting an application to regulate his legal situation, such prosecution should not be considered as a basis for making a decision on not allowing entry into the Russian Federation.

3. Regarding the procedure for obtaining permits for foreign citizens to carry out labor activities in the Russian Federation, as well as their employment, we draw attention to the following.

Until the end of 2021, foreign citizens who arrived in the Russian Federation on a visa-free basis will not lose the right to apply for the issuance (re-registration) of a patent without taking into account the requirements for the deadline for submitting documents for its registration and the stated purpose of the visit to the Russian Federation.

Foreign citizens who are citizens of member states of the Eurasian Economic Union will retain the right to conclude employment contracts or civil contracts for the performance of work (provision of services) with employers or customers of work (services), regardless of the stated purpose of the visit to the Russian Federation.

Employers or customers of work (services) who have permission to attract and use foreign workers will also be able to apply for the issuance (extension) of work permits to foreign citizens without taking into account the requirements for the stated purpose of the visit to the Russian Federation.

In addition, the labor activity of foreign citizens who have formalized labor (civil law) relations in accordance with the established procedure is recognized as legal after December 31, 2021.

Thus, for all foreign citizens who have regulated their legal status, it remains possible to obtain, before the end of the current year, the necessary permits and legally carry out labor activities in the Russian Federation for the entire period of validity of such documents or labor (civil) contracts, respectively.
