Law

The main law determining the calculation of length of service for pensions is the Federal Law “On Labor Pensions in the Russian Federation”.

This law, number 173, was adopted in 2001.
The text of the law contains a list of those periods that are included in the total length of service for a pension. Another legislative act is Federal Law No. 400 “ On Insurance Payments ,” which deals with what is included in the insurance period.
According to the provisions of these legislative acts, the insurance period required for calculating a pension includes those periods of time when insurance contributions were transferred from the citizen’s income to the account of the Pension Fund.

  • What does “ special work experience ” mean? This concept refers to the time when a citizen worked under special conditions. Also, special length of service is calculated for those who work in a certain profession and have a legal right to early retirement.

For a long time, when calculating pensions, a term such as “continuous work experience” was used, but now it has been abolished and has no meaning.

Main types of accumulated experience

The standards of modern legislation of the Russian Federation have established the following categories of experience:

  • Insurance;
  • General labor;
  • Labor special.

The total length of service is the periods of work of a person when he carried out the required labor activity as an officially employed employee. The time when he was engaged in activities useful to society is taken into account.

The accumulated insurance experience is life time when a person was engaged in labor or other type of employment. We are talking about employment, during which the statutory contributions to the Pension Fund were calculated for him in the Pension Fund.

Special accumulated experience is a period when a person was officially employed or served in military service in unfavorable geographical regions, in difficult conditions. This also includes professional activities for which a pension is legally assigned much earlier than the usual period.

Previously, when calculating benefits for temporary disability and during maternity leave, continuous work experience was used. Currently, such benefits are calculated solely on the basis of total length of service. At the same time, the concept of continuous accumulated experience, which is familiar to many, is practically not used.

So, is the period of registration of an unemployed person on the stock exchange taken into account as an element of work experience? If we consider the accumulated insurance experience, it directly correlates with the continuous hours worked.

Here you need to remember that if the official insurance period is less than the standard labor period, the accrual of the required benefits will be made on the basis of continuous accumulated years.

The need for accounting

A pensioner who has lost his job due to downsizing or liquidation of an enterprise can count on receiving payments if he registers as unemployed no later than 14 days from the date of dismissal. Exceptions apply to military pensioners. Persons receiving a military pension can register with the employment center in order to find new employment or retraining. Registration at pre-retirement age

When staffing is reduced, employees of different ages may be laid off, including those who have only a few years left until retirement. What should an unemployed person do in this case? You need to register with the labor exchange (employment center) within two weeks. A territorial branch of such a service is selected.

To register, you will need to present several documents to the center employee:

  • Civil passport or other identification document.
  • A certificate indicating the average earnings at your previous place of work.
  • Diploma of education.
