Required documents
When applying for a job, you must present a number of documents. In addition to standard documents, the driver must also present additional documents. Below is the entire list of required documents:
- hoarding passports;
- work book, if any;
- pension insurance certificate;
- diploma, certificate;
- driver's license;
- medical certificate of health.
Important : when hiring, you must take into account the type of car that will be attached to the driver. If it is a truck or bus, then the driver must have a certain category of license: without them he cannot drive these vehicles.
What should the contract contain?
In general, an employment contract with a driver is a standard type of contract, which must contain the following information:
- data of the parties;
- date and place of conclusion of the agreement;
- position and department in which the employee will work;
- salary amount;
- rights and obligations of the parties;
- working hours;
- term of the contract;
- responsibility of the parties.
An employment contract with a driver can be concluded either for an indefinite period or with an indication of a certain period of its validity.
Important: If the contract is concluded for a certain period of time, then it can be concluded for no more than 5 years.
You can also indicate in the contract that the employee is undergoing a probationary period.
Some features
Taking into account the specifics of the work performed by the driver, the employment contract concluded with him has a number of features. In particular, when concluding an employment contract, it is necessary to take into account that the driver is constantly on the move, and therefore it is impossible to indicate his place of work.
Important : the contract can indicate the routes that the driver must take, but they can change frequently, and because of this, it will be necessary to introduce corresponding changes in the text of the contract. That is why it is recommended not to indicate the location of the work.
When drawing up the text of the contract, it is necessary to take into account all the features of the driver’s working regime: a variable schedule, the need to provide rest during working hours, irregular days, driving at night, etc.
Important : special attention should be paid to the responsibilities of the parties. It is recommended to conclude an agreement with the driver on full financial responsibility.
When concluding an agreement on full financial liability, it is necessary to indicate all cases in which the driver is liable. As such, we can indicate damage caused to the vehicle due to the fault of the driver, damage caused to the property or health of third parties, etc.
If the driver will transport goods, then in addition to the concluded employment contract, it is also necessary to provide him with the appropriate power of attorney indicating all the necessary rights.
When concluding an employment contract with a driver, it is necessary to resolve issues related to insurance.
Please note : in accordance with current legislation, the driver must have a compulsory motor liability insurance policy, which is usually purchased by the employer.
Work and rest schedule
The internal regulations of enterprises regarding the work and rest regime of drivers are regulated by departmental orders of the Ministry of Transport of the Russian Federation and recommendations of the Ministry of Health.
The specific nature of a driver’s work obliges employers to establish special working regimes for them, including the duration of continuous work behind the wheel and the frequency of rest.
