Who is entitled to a preferential pension and what is the procedure for applying for it?


Who will retire early?

Early pension payments can be made in the following cases:

  1. Those senior citizens who were fired due to the liquidation of an enterprise or due to layoffs at the employment center are offered early retirement two years before the due date, taking into account the transition period. After dismissal or layoff, they must remain unemployed until they reach the legally established age. But to obtain early pensioner status, one more condition must be met - an insurance period of at least 25 years for men and 20 years for women.
  2. The citizen has already accumulated a long experience. Long-term work experience is considered to be 37 years for women and 42 years for men. To calculate this period, only work activity and sick leave time are taken into account. If these conditions are met, you can retire 2 years earlier than expected.
  3. If a woman has many children. When there are three children in a family, a woman can retire 3 years earlier; when there are four children, 4 years earlier. But at the same time you need to complete a minimum insurance period of 15 years.
  4. If the work activity was carried out under special work experience. For example, such experience includes production according to List No. 1. These include harmful, difficult working conditions, working underground or in hot workshops.

On these grounds, senior citizens can apply for early retirement.

if the name of the institution has changed over time?

To understand this, you need to use identical names that are approved by the following regulatory documents:

a) Resolution of the Ministry of Labor of the Russian Federation dated July 25, 2003 No. 57. It is established that the name “children’s art school, including by type(s) of art” provided for in the List is identical to the name “experimental children's art school”;

b) orders of the Ministry of Health and Social Development:

  • dated April 15, 2005 No. 278 – the name “lyceum” provided for in the List is identical to the name “school-lyceum”, “gymnasium” = “school-gymnasium”;
  • dated 11.09.2007 No. 585 – name “orphanage-Internet for mentally retarded children” = “children’s psychoneurological boarding home”;
  • dated September 15, 2009 No. 747n – “special (correctional) boarding school for children with developmental disabilities” = “special (correctional) boarding school for orphans and children without parental care with disabilities”; “special (correctional) orphanage for children with developmental disabilities” = “special (correctional) orphanage for orphans and children without parental care with disabilities”;
  • dated July 20, 2010 No. 527n – “primary school (school) – kindergarten” = “complex “kindergarten – primary school (school)”.

From the above regulatory documents it follows that teaching staff, when changing the name of the institution, have the right to receive an early pedagogical pension if these names are identical to the names provided for in the List. This is confirmed by judicial practice: see Appeal ruling of the Novosibirsk Regional Court dated June 10, 2014 No. 33-4736/2014.

Where to go when registering

In order for an elderly citizen to receive pension payments ahead of schedule, all details must be clarified at the branch of the Pension Fund of the Russian Federation. Pre-retirees contact the fund in advance so that they have time to search for data and check their work history. You must also have proof of employment with you. They are needed to confirm work experience or the availability of benefits.

All necessary documents can be presented in person or sent by mail. When submitting documents via mail, the date of submission is considered to be the date the envelope was sent.

If not all documents have been collected, the missing certificates can be submitted within another 3 months. But it’s better not to miss this deadline, because then pension payments will be assigned later.

The package of documents is reviewed within 10 days. After this, Pension Fund employees make a decision: to refuse early retirement or to approve it. Notification of refusal will be sent within 5 days from the date of the decision. The refusal can be appealed if it is unfounded.

How to apply

If a citizen has accumulated the required length of service and collected points, then he needs to independently engage in the process of processing the payment. For this purpose, a complete package of documents is prepared and an application is drawn up and submitted to the competent authorities.

Documents and application deadlines

You can apply for a pension through PF or MFC branches, and you can also submit applications and other documentation through electronic services.

Documentation is prepared for this:

  • passport;
  • employment history;
  • SNILS.

Pension Fund employees have basic information about places of employment. If for various reasons data is lost, then the citizen will have to prepare employment agreements, extracts from orders or other certificates confirming official periods of work. The documentation is reviewed within 10 working days, after which the citizen is notified of the decision made. The pension is assigned from the moment the application is submitted.

Payment calculation

To determine the amount of early pension, the standard formula is used:

Fixed payment + IPC * price of one point.

For each citizen, these indicators are individual, so the calculation is carried out for each future pensioner. If a person applies for a long-service pension, then earnings for periods of work are additionally taken into account.

Features of early retirement

One of the reasons for refusal to issue an early pension will be that the pre-retirement employee was employed after being dismissed due to liquidation or reduction. And the Pension Fund employees will find out. The amount of pension payments in case of early assignment depends on the following factors:

  1. Before January 1, 2002 - depending on length of service and average monthly income.
  2. After January 1, 2002 - on the amount of contributions from the employer to the Pension Fund.

Also, the size of the pension is determined depending on such non-insurance periods as caring for a child under 1.5 years old, caring for a disabled child, or military service.

Northern experience

Another category of citizens who can retire early are those who work according to northern seniority. At the same time, they take into account the periods when a citizen works constantly for a full working day. Full-time work is understood as performing work in such working conditions under which the right to early retirement appears, at least 80% of the working time.

In simple words, if an employee has been assigned part-time work during certain periods of his working life, but the duration of work remains within 80%, then the citizen can qualify for early retirement.

An employer can set a part-time pay for an employee when performing work on a part-time basis or on a full-time basis when working part-time. If a pre-retirement employee cannot provide documents confirming a suitable work schedule, then the period of employment on a part-time schedule will not be taken into account when calculating the northern length of service.

For example, in 2021, an employee worked at the company for 6 hours 24 minutes a day, which is 80% for a 40-hour 5-day work week. Then all days will fall into the “northern” period. But if he works 7 hours 3 days a week and 4 hours on two more days in the same week, then only three days with a seven-hour schedule will count towards his seniority.

Preferential professions

The list of preferential specialties is an approved list of professions that are entitled to certain preferences.
The basis for their compilation is the level of exposure to the body of harmful factors that arise during the production process.

There are List No. 1 and List No. 2. They were approved in 1991 by resolution of the USSR Cabinet of Ministers No. 10 to determine the professions of people who have the right to retire early. The procedure for applying the Lists at the present stage is established by Decree of the Government of the Russian Federation No. 665 of July 16, 2014, in accordance with the provisions of Article 30 of Federal Law No. 400-FZ “On Insurance Pensions”.

According to the Labor Code, citizens whose work activities are carried out in hazardous conditions (according to the SOUT) have the right to additional leave, reduced working hours and other privileges.

More grandchildren means earlier retirement?

LDPR party deputies initiated a bill on early retirement for those elderly people who have three or more grandchildren. The purpose of the innovation is to improve the demographic situation in the Russian Federation by stimulating the birth rate not only in the first, but also in the second generation of Russians.

Modern youth are in no hurry to start families and have children. Their main goal is to achieve a stable financial and social situation. If a second or third child is born in a family, the woman can no longer work. All her time is spent on caring, being at home and raising children.

In this regard, an initiative arose to provide early retirement to elderly men and women who have three or more grandchildren. If there are three grandchildren, grandparents will be able to retire 2 years earlier, that is, for women the age is reduced to 58 years, and for men - to 63 years.

At the birth of grandchildren, the retirement age for one of the elderly will be reduced by 6 months. The maximum period by which retirement can be reduced is 6.5 years. To achieve the maximum reduction, grandparents must have at least 12 grandchildren.

Despite the fact that the bill should make life easier for young families, there are many Russian citizens who are skeptical about such an innovation. Citizens are interested in the following questions:

  1. How will two grandfathers and two grandmothers share early retirement?
  2. Why do those elderly people who refuse to help raise their grandchildren need early retirement?
  3. Who will help young mothers before grandma turns 58?

Citizens also propose returning to the previous retirement age so that no new conditions have to be introduced for an earlier pension.

Other innovations

Starting from 2021, they plan to introduce another condition for the appointment of early pension payments. This will be available to one of the able-bodied children to care for parents who are recognized as group 1 disabled, and this status has been in effect for at least 8 years. Not only the natural children of older people, but also stepsons or stepdaughters can apply for early retirement.

An additional condition for receiving benefits is 20 years of insurance experience for men and 15 years for women. They will be able to retire at 55 and 50 years old. This rule was introduced due to the fact that older people, due to their disability, were unable to work and gain experience in order to receive an insurance pension. This way the state will be able to provide support to low-income families with bedridden parents and able-bodied children.

What to do for part-timers

When calculating a pension, the insurance period takes into account the periods of work during which employers paid contributions for their employees. If a citizen works two jobs at the same time, then both employers pay contributions for him. But only one experience is taken into account. Citizens consider this state of affairs unfair.

Initiative citizens suggest adding experience from additional work to the main one. Some workers may work 30 years in two jobs, but they will retire at the same age as those who worked the same 30 years in one job. The health status of those who worked two jobs will be clearly worse. Therefore, it would be fair to give the right to early retirement to those who make more contributions to the Pension Fund. But this issue has not yet gone further than discussions on the Internet.
