How to get a deferment from the army

Are you a future defender of the Fatherland or a caring parent whose child has received a conscription certificate? Let us explain in what cases the state will grant a citizen the right to defer conscription into the Armed Forces.

Who will be called up for military service?

Men aged 18 to 27 years who are fit for military service due to health and physical development are called up for compulsory military service. In this case, origin, social and property status, race and nationality, education, language, religion, type and nature of occupation, political and other beliefs do not matter.

Foreign citizens and stateless persons living on the territory of Belarus are not subject to conscription <*>.

A citizen will be called up for compulsory military service if he <*>:

— is not in stock;

- has no right to a deferment;

- lost the grounds for deferment;

- have not been called up for compulsory military service before;

- voluntarily applied for conscription (including if there is a deferment).

Note! Representatives of the fair sex also have the right to perform military duty. To do this, they must meet established requirements and have training in the specialties that the Armed Forces need <*>.

When can conscription be deferred?

Deferment from conscription for compulsory military service or service in the reserve (deferment from conscription) is a right that, under certain circumstances, makes it possible to temporarily avoid service in the Armed Forces.

Note! Postponement is always a temporary measure.

Unlike a deferment, exemption from military service is permanent <*>. To avoid confusion, remember the reasons why citizens are exempt from conscription or simply not conscripted:

- a citizen is declared unfit for military service due to health reasons and is excluded from military registration;

- his father, mother, siblings were military personnel or served in other law enforcement agencies and were killed, died, or became disabled of group I or II as a result of injury (wounds, trauma, concussion) in the performance of official duties;

- the citizen is one of the orphans and children left without parental care;

- a citizen has 3 or more children;

- he completed military service or otherwise performed military duty in another state.

Citizens <*> are not subject to conscription:

- those who have served a sentence of imprisonment in a correctional institution;

- having a criminal record;

- in respect of whom the court applied compulsory security and treatment measures (only during their application);

- in respect of whom a criminal case has been initiated, transferred to the prosecutor for referral to court, or is being considered in court.

A deferment from conscription is granted only by draft commissions if there are grounds. The decision is announced to the conscript <*>, although he may not be called to the meeting of the draft commission <*>.

The list of grounds for deferment from conscription is exhaustive:

1) for health reasons;

2) to continue education;

3) to undergo an internship and pass a qualifying exam in the internship specialty;

4) by marital status;

5) to obtain a military-technical specialty;

6) in connection with the exercise of deputy powers;

7) on the basis of presidential decrees.

All these grounds are secured by Part 1 of Art. 32 of the Law on Military Service.

Note! Even in wartime, some citizens have the right to a deferment from conscription.

There may be situations where there are several reasons for deferment. In this case, it will be provided for the maximum permissible period <*>.

1. Postponement due to health reasons

Citizens subject to conscription are required to undergo a medical examination . It is organized by the military registration and enlistment office and conducted by the military medical commission (MMC), which includes paramedical specialists and military doctors <*>.

VHC doctors study and evaluate the state of health and physical development at the time of examination <*>. As a rule, you additionally need to submit a health certificate from the clinic at your place of residence.

If you have any health problems, you should inform the VVK doctors about it. Taking into account complaints, they can refer a citizen for medical examination or treatment <*>.

The basis for a deferment from conscription for health reasons will be the final conclusion of the doctor who supervises the work of the Military Military Commission. The deferment period is up to a year <*>.

The conclusion indicates the diagnosis and an article in the list of diseases of the Requirements for the health status of citizens <*>.

2. Deferment to continue education

This delay is regulated by <*>.

As you can see, in two cases a one-time deferment is given. This is an innovation, enshrined in Part 4 of Art. 32 of the Law on Military Service as amended. Law of July 23, 2019 N 231-Z.

According to the one-time principle, a deferment cannot be obtained twice for the same reason.

An exception to this rule applies only to those who study abroad in the direction of republican government bodies (government organizations).

Note! The deferment is provided to those who study full-time. There is no exception for correspondence students, other than exemption from all types of military and special fees for the duration of the session <*>.

Certificates are submitted to the military registration and enlistment office once when making a decision on deferment (clause 35 of the Regulations on conscription, clause 6.3 of the list of administrative procedures). Students abroad are required to independently submit documents confirming their studies by November 1 each year Otherwise - conscription on a general basis <*>.

3. Deferment for internship

Such a deferment will be provided to intern doctors for the period of internship and passing the qualifying exam <*>.

In this case, you will need a certificate of place of work, service and position, indicating the term of the employment contract <*>. The certificate is issued in accordance with clause 2.2 of the list of administrative procedures.

4. Deferment due to marital status

This deferment will be given if there is a wife and a child under 3 years of age and supporting documents (for example, a marriage certificate and a child’s birth certificate).

Note! There are cases when the issuance of documents is not provided. Then the citizen’s marital status is studied by the military commissariat together with the local executive committee (city administration). They draw up an act that is taken into account when deciding whether to grant a deferment <*>.

A deferment from conscription due to marital status is usually given to citizens who have <*>:

- disabled parents or other family members who, for health reasons, require outside constant care and who are not fully supported by the state. The health status will be confirmed by the conclusion of the medical commission (VKK, MRE). An important condition is the absence of other able-bodied persons obligated to support and care for these family members;

— pregnant wife and documents confirming pregnancy;

- wife and child under 3 years of age;

- wife - disabled person of group I or II;

— a disabled child;

- a child raised without a mother;

- two children;

- a mother or father who is not married and has no other able-bodied children, who has a child under 3 years of age, or two or more children under 18 years of age, or a disabled child under 18 years of age, or a child - a disabled person of group I or II over 18 years of age, or a mother with a pregnancy of 28 weeks or more who is not in a registered marriage and has no other able-bodied children;

- one or more siblings under the age of 18 years or over 18 years of age who are receiving general secondary, vocational, secondary specialized education or are disabled people of group I or II, - in the absence of other persons who could take them on content.

Based on marital status, a deferment from conscription is granted for the entire duration of the grounds. If there are several of them, the deferment is granted for the maximum possible period.

Every year in March - April, the military registration and enlistment office checks the marital status and, if necessary, extends the deferment from conscription <*>.

5. Deferment for obtaining a military-technical specialty

Citizens who receive a military-technical specialty in the direction of the military commissariat <*> have the right to a deferment from conscription on this basis.

A deferment from conscription is granted for the entire period of study. Information about military-technical specialties can be obtained on the official websites of the Ministry of Defense or universities, for example BSU.

6. Postponement in connection with the exercise of parliamentary powers

The status of a deputy gives the right to a deferment from conscription. The military registration and enlistment office must submit a certificate of place of work, service and position held, indicating the term of parliamentary powers <*>.

7. Postponement based on Presidential decrees

This deferment is granted by presidential decrees for the duration of their validity <*>.

For example, according to Decree No. 401, certain categories of citizens working in areas of radioactive contamination in certain areas of the Gomel and Mogilev regions received a deferment from conscription. The deferment is provided for the period of work. In this case, a mandatory condition is the presence of completed education in the specialty of the educational profile “Pedagogy”, “Pedagogy. Vocational education", "Agriculture and forestry. Garden and park construction", "Healthcare" <*>.

Birth of second, third and subsequent children

Parents with two or more children are entitled to a deferment. An important argument for this is officially registered paternity.

The military registration and enlistment office must submit:

  • Certificate of composition of seven;
  • Birth certificate for each child. The document is issued at the Civil Registry Office;
  • Certificate of adoption of each child.

If a second child is born while a serviceman is in a military unit, the man is not sent home early. He will be able to see the child only during vacation or at the end of his service.

Good reasons

Since the principles of conscription are formed on the basis of federal law No. 53-FZ, it is there that one can find grounds for granting a deferment. The formed main points of opportunities for deferment from army life are expressed as follows:

  • An unprecedented rule for conscription is a medical examination and assessment of the health status of a young man who has reached conscription age. Detected illnesses make it possible to postpone military service.
  • Choice of alternative service, lasting 18-21 months.
  • The presence of close relatives who died in the performance of military duty. In this case, you can count on receiving a military ID without military service at all.
  • The state has not ignored those who are undergoing training in order to obtain secondary specialized or higher education. For them, as well as for persons who turn 18 while studying in secondary school, a deferment system is provided.
  • For work. Provided if there is a written justification for the need for a deferment for a certain person from the management of the enterprise.
  • Benefits provided for family reasons.

That is, there is a range of possibilities that legally makes it possible to delay the moment when a young man joins the army.

Deferral rules for 2021 by law

There are currently several ways to postpone the period of stay in a soldier’s uniform. The rules for deferment from service are enshrined in the current legislation of Russia.

Deferment from the army, along with issues related to the moment of conscription and service in the ranks of the Armed Forces, is prescribed in Federal Law No. 53 of March 28, 1998 “On military duty and military service.” Here are recorded all the options for obtaining the appropriate document, which allows the young man to postpone the moment of conscription for a certain period.

This regulatory act applies to all citizens of the Russian Federation who have not yet reached the age of 27. There are often amendments to legislation that need to be made due to government policy.

Thus, one of the latest amendments was the topic concerning foreign citizens who served in their homeland. According to the new standard, all foreigners receiving Russian citizenship and under the age of 27 are required to undergo compulsory military service. The rule also applies to former citizens of the CIS: military personnel received in Kazakhstan or Ukraine are invalid in the Russian Federation.
