What to do if the insurer underestimates the amount of payments
Many motorists are dissatisfied with the amount of compensation offered by the insurer. In such a situation, the car owner has two options:
- Agree with the amount of compensation and pay extra for the repairs yourself.
- Initiate additional examination.
Having chosen the second option, the motorist must be prepared for material and time costs. To increase the amount of compensation you will have to do the following:
- Wait until the insurer conducts an examination.
- Receive the inspection report and study it.
- Contact an independent expert. The motorist must pay for the services of such a specialist himself. Subsequently, he will be able to recover this amount from the insurer through the court.
- Notify the insurer about the examination. Submit the report to the company’s employees along with a request to collect additional payment for insurance compensation. Along with the expert opinion, documents confirming the occurrence of an insured event and an agreement concluded with an independent expert should be submitted.
- Wait for the insurer's response. Typically, no more than 10 days are allotted for consideration of such requests. If the insurance company refuses to increase the amount of compensation, the client must request a written refusal.
- With the refusal and documents confirming the fact of the accident, as well as the results of an independent examination, we go to court. In a lawsuit, you can demand payment of not only material, but also moral damage.
To increase the chances of your claim being satisfied, it is advisable to involve a specialized lawyer in the case. It will help speed up the process and increase the final payment amounts.

Benefits and advantages of the study
Road traffic accidents cause many problems: stress for those involved in the accident and their families, material costs for restoring transport, in some cases, months of hospital treatment and costs for medications and rehabilitation. Those responsible for an accident will face administrative and criminal liability - from fines to real terms in correctional institutions. Automotive technical expertise can convince the court of the driver’s innocence: the cause of a collision with a suddenly run-out pedestrian or loss of control of the vehicle may be the poor quality of the road surface or non-compliance with traffic rules by other road users.
Situations often arise when a car owner, having received his car from a service station, discovers a new malfunction, and the breakdown recurs again after some time. Having contacted a service station, the driver receives a categorical refusal to fix the problem: the business owner, in rare cases, admits guilt and carries out additional repairs at his own expense. Automotive technical expertise will help determine the reasons for the failure of a part or assembly, and the time when the malfunction occurred.
Having considered several reasons why special studies of vehicles and road conditions are prescribed, we can highlight the advantages of conducting an automotive technical examination:
- avoidance of administrative and criminal liability in the absence of real guilt;
- reduction of material costs for vehicle repairs;
- proof of poor quality car repairs at a service station;
- proof of purchase of a car with hidden defects;
- proof of the guilt of the temporary owner of the vehicle in its damage;
- minimizing the risk of purchasing faulty expensive equipment.
Types of automotive technical examinations
To determine the culprit of the accident, the following studies are carried out:
- examination of the car to confirm the circumstances of the accident;
- study of road conditions to identify accident hazards;
- transport and trace research, which makes it possible to establish a number of circumstances of an accident based on traces on the car, road surface, etc.
If it is necessary to establish the presence of defects or violations during vehicle maintenance, a technical condition study is carried out. Finally, the most common service is a forensic vehicle inspection. It is this that serves to determine the value of the car, as well as the amount of damage caused.
Selection of an independent appraiser. What should you pay attention to?
Car enthusiasts often wonder: where to get an independent examination of a car after an accident? When choosing an appraiser, you should give preference to an organization that has an impeccable reputation. Most motorists who encounter this problem are guided by the recommendations of friends and acquaintances who have previously used such services. But if there are no advisers, what points do you need to pay attention to in order to ensure the quality of the work, and the expertise really turns out to be independent? There are several such criteria:
- It is better if the company specializes in this type of activity;
- The conscientiousness of the company’s employees can be evidenced by the offer to pre-calculate the amount of damage, free of charge;
- the organization must have at least one certified expert technician on staff;
- specialists must have specialized education and regularly undergo retraining, be members of an assessment SRO;
- the company should not cooperate with representatives of insurers;
- the existence of the company indicates the presence of experience and qualifications;
- the organization must be provided with modern equipment and the necessary facilities for carrying out work;
- the presence of lawyers on staff representing the interests of clients in legal proceedings;
- the presence of a permanent office and its own website, and not just an electronic mailbox;
- adequacy of the cost of services.
To finally make sure of the contractor’s reliability, you can ask to familiarize yourself with some previously performed assessments and make sure there are no errors or inaccuracies in the as-built documentation.
Some criteria can be checked online:
- expert accreditation – on the RSA website;
- make sure that the company is not on the list of enterprises that include disqualified persons, as well as conscientiousness in paying taxes on the Tax Service portal;
- the organization must be present in the unified register of taxpayers, and no other companies should be registered in its office.
These are just some of the possible checks, but their implementation will ensure the reliability of the expert company.
Ensuring quality during an independent assessment of a car after an accident requires the involvement of highly qualified performers, so it cannot be of low cost. You also need to pay attention to this.

General information about conducting auto examinations
By law, an assessment of damage and the cost of future repairs must be carried out within 5 days. This must be done by the insurance company. If the car is driving, then the initial inspection of the damage is done immediately, at the time of filing an application for insurance.
Otherwise, when the car cannot be delivered to the insurance company, the expert himself must come to its location. The need for this service will need to be stated in the insurance application. The period does not change and is the same 5 days. As an exception, it can be increased to 10 days or even more if this is specified in the insurance contract and the car is located in a very remote or inaccessible place.
Sometimes, in order to verify the occurrence of an insured event, the insurance company may require that the car of the person responsible for the accident be provided for inspection (within 10 days after receiving a statement from the victim).
After the examination, the client is provided with a report for review, which is signed by the insurer, the expert technician, and the accident victim. The car inspection is paid for by the insurance company, but it should not be confused with a regular inspection. It is done by a representative of the insurance organization, who is not always qualified as a professional appraiser.
Stages of assessing a car after an accident
Carrying out an independent examination consists of the following steps:
- When examining the scene of an incident, cameras and video cameras must be used. Using this technique, hidden damage in the vehicle is recorded. At the same time, the license plates of the vehicle are photographed.
- Then a document is drawn up with a photo report, which includes an assessment of the damage to the car after the accident. This procedure takes 3 days.
The drawn up document is certified by the signatures of all persons present.
Necessary documents for car assessment
Upon the arrival of experts, the car owner must submit the following documents:
- Personal passport.
- Documents for the right to drive a car.
- A certificate issued by the inspector, which lists all damage found during the inspection of the vehicle.
At the same time, the task of an independent assessment of the car includes clarifying the following information:
- Does the damage present correspond to those recorded in the certificate issued by the inspector?
- Whether the vehicle can be restored and how labor-intensive the repair will be.
After clarifying these issues, the actual work of the experts begins.
Who conducts it?
Both state and commercial enterprises can conduct the research , observing the legal nuances of employee qualifications. Only a specialist (expert technician) entered in the state register may be allowed to carry out the examination.
Requirements for such employees, taking into account the requirements for their professional skills, are established by Order of the Ministry of Transport of Russia dated September 22, 2016 No. 277.
Experts are responsible for providing incorrect information and if the results of an unreliable examination entail losses, the technical expert is obliged to compensate them in accordance with paragraph 5 of Article 12.1 of Federal Law No. 40.
Companies conducting an independent examination after an accident must be members of a self-regulatory organization of appraisers and have a compulsory appraiser liability insurance policy (in accordance with Article 15.1 of Federal Law No. 135 “On Appraisal Activities in the Russian Federation”). Otherwise, the result of the examination will be considered invalid.
