Necessity

Do you need registration in another city?

The question of whether registration is needed in another place can be answered in two ways.

On the one hand, if you come for a short period of time as a business traveler, for treatment or an excursion , it makes no sense to apply for a residence permit.

But if the period of your stay outside the place of registration exceeds ninety days , then you need to think about officially registering your stay; this procedure is established by Federal Law No. 5242-1 of June 25, 1993 in Article 5.

If you intend to fully use your place of residence, then you should not delay this procedure for long.

Missing the ninety-day deadline threatens those who are late with registration with a fine of one thousand rubles.

How to register? What is needed for this?

Fines for non-compliance

It would seem, what difference does it make where you are registered and live permanently? Especially if you often change your place of residence. But everything is not so simple - the state obliges everyone to register their place of residence

to receive up-to-date information about the location of each person in real time.

How will they check that you do not live at your registration address? This is a secondary issue. But if, nevertheless, a discrepancy between the residential address and the actual registration is discovered, both the citizen himself and the owner of the property will have to pay a fine, if the apartment is rented.

The fine is impressive:

  1. If we are talking about a person who has violated the registration deadlines, then the fine will be from 3 to 5 thousand rubles. in Moscow or St. Petersburg, and from 2 to 3 thousand rubles. when living in any other region of the country.
  2. If we are talking about a landlord who allowed an unregistered person to live, then the fine will be 5-7 thousand rubles. in cities of federal significance and 3-5 thousand in other cities of the Russian Federation.
  3. For legal entities, the fines are even higher: 300-800 thousand in Moscow and St. Petersburg, and 50-750 thousand for other settlements of the country.

The amount of the fine will depend on the length of the overdue period and the circumstances

, due to which the actual registration was checked.

As you can see, it is better to spend a couple of hours of your own time than to pay such fines. Moreover, the procedure is quite simple and you can arrange everything yourself.

Constantly

How to register in another city? If you have finally decided to settle in another city where you do not have a permanent stamp, you should know the procedure that will allow you to completely legally change your place of residence .

Law No. 5242-1FZ of June 25, 1993 talks in detail about registration of permanent registration in article six, which is entirely devoted to this issue.

  1. You must appear at the passport office at your place of residence.
  2. There you need to write a corresponding statement on the form provided by the employee.
  3. Within three days, employees will prepare a so-called departure slip , which you will submit when completing a new registration at another passport control authority.
  4. Of course, this procedure of unlinking from the previous address could not be carried out. So, you can simply register a new registration, and employees at your place of residence will send a notification about the new status of your stay.
  5. obtain permanent registration by collecting the necessary papers and contacting the passport office at your place of stay.
  6. After submitting the papers, you will be given a certificate , on the basis of which you can pick up the documents.
  7. Registration takes three days to complete, depending on the speed with which responses to employee requests are sent and received.
  8. Your passport is marked with your new place of residence, and you are now officially registered.

Extract by power of attorney

This method is convenient if you do not have a permanent place to live in your new city where you can register.

This is the so-called statement “to nowhere”. You will have to face some difficulties. Let's consider this method in more detail.

Procedure

In the case of an extract by power of attorney, you will not have to appear in person at the Department of Internal Affairs of the Ministry of Internal Affairs of Russia, but this does not simplify the procedure.

So, you need to follow the following sequence:

  1. Call the Department of Internal Affairs of the Ministry of Internal Affairs of Russia at the place of registration and find out whether they will issue a power of attorney without your presence. Not all territorial authorities are ready to discharge a citizen without his presence, since this scheme is often used by fraudsters. In a telephone conversation, it is worth asking the employees of the Department of Internal Affairs of the Ministry of Internal Affairs of the Russian Federation about what documents are needed for such an extract.
  2. After the consent of the registration department has been received, you must contact a notary in your city and draw up an application for deregistration. The form will be provided by a notary, who will notarize it. You also need to issue a power of attorney from the notary to the person who will take your documents to the Department of Internal Affairs of the Ministry of Internal Affairs of the Russian Federation at the place of registration. To do this, ask your representative in advance to send a scan of your passport by email (this will be faster) or a photocopy of it by letter. Based on your passport and a copy of the passport of the person representing your interests, the notary will prepare and certify a power of attorney.
  3. Then you need to send all documents by registered mail or courier service to your representative.
  4. After receipt, the authorized representative will take them to the appropriate department of the Department of Internal Affairs of the Ministry of Internal Affairs of Russia and hand them over for the deregistration procedure.
  5. When the documents are ready, the representative takes them and sends them to you in any convenient way.

Required documents

So, what documents should be in the hands of a trusted person so that he can sign you out of your old home remotely?

Here is a comprehensive list:

  • notarized power of attorney to represent your interests by another person;
  • an application for deregistration at the old place of registration, certified by a notary;
  • passport (original);
  • birth certificate of the children and the original passport of the legal representative on whose behalf the power of attorney was issued, if minors are also being discharged.

All these documents must only be in the original, since the eviction stamp is placed only in the passport and precisely in the department where the procedure takes place.

Deadlines

This is probably one of the longest discharge procedures. The deregistration itself from the Department of Internal Affairs of the Ministry of Internal Affairs of Russia will not take much time. Usually, no more than 14 days pass from submitting documents to entering data into the register (more often everything is limited to two or three).

However, in the case of an extract by power of attorney, time will be required to directly prepare documents with a notary, send the passport and other papers to a representative in another city and receive them back. In general, it will take at least one month.

Price

In addition to the duration, another disadvantage of this method of deregistration is significant financial costs.

After all, you will have to pay:

  • notarial services;
  • forwarding documents to the representative;
  • return shipping of the passport.

Although the deregistration procedure itself is also free, your representative does not have to pay any state duty when applying to the Department of Internal Affairs of the Ministry of Internal Affairs of Russia.

Example. After moving from one city to another Popov V.A. I planned to immediately buy an apartment and register in it, and at the same time check out of the old one. However, his accumulated funds were not enough for an apartment and he decided to sell the apartment in which he was registered. To do this, he issued a notarized power of attorney for his brother. After buyers were found, V.A. Popov needed to be discharged from the apartment, but due to work he was unable to leave for the city where he previously lived. Then he again turned to the notary, drew up a power of attorney for his brother and an application for deregistration. He sent these documents and his passport by registered mail to his brother and a month later received a passport with a note about deregistration and a departure sheet.

Temporarily

How to obtain temporary registration in another city? Or how to register a friend in the region for a while?

Temporary registration in another city is much easier than in the case of permanent registration.

How to temporarily register in another city? To register at your place of residence, you do not have to give up your permanent registration.

  1. You must come to the passport office with a package of documents and permission from the property owner.
  2. Having accepted the package of documents, the employee will review them within one week.
  3. Upon temporary registration, a mark is not placed in the passport, but a separate certificate is issued.

Temporary registration has a certain period and cannot be issued for more than three years.

Therefore, there are significantly fewer requests required to issue such a registration, which means that the receipt time will be reduced.

Registration in another region - main points

To get a new registration, a person must collect the necessary documents. Then choose a registration method. Of course, a lot depends on what the move itself was like. A person has changed cities or countries, or maybe just purchased a home.

Important: before submitting, be sure to check all the collected documents. If a specialist finds any error in them, he may require correction. Also check the validity periods of the submitted documents. If your passport is expired, it is better to renew it in advance. Incorrect information may delay or cancel the registration procedure.

Often men are required to have their military ID. If it is lost, the citizen contacts the nearest military registration and enlistment office and writes a statement there to restore the document.

In addition to the papers, those wishing to change their registration are required to provide an explanatory statement stating the reason. You cannot leave a place where you have lived for many years without reason. It is worth remembering that this is a procedure for obtaining permanent registration, so there are so many nuances.

Making a temporary one is a little easier.

Main reasons:

  • buying an apartment or house;
  • relocation for work (for example, military personnel have to change cities and even countries if required by their superiors);
  • study (students sometimes go to study in other cities or countries);
  • marriage (often spouses then move either together or alone);
  • new last name (changing initials always requires updating documents).

The list of documents and procedure can be clarified in advance.

Without checking out

How to register in another city without registering? If you are not able to appear and deregister from your place of permanent registration , you can do this remotely.

  1. Appear at the passport office at your place of stay.
  2. Submit a package of documents for permanent registration.
  3. Express your desire to deregister at your former place of residence.

Employees will independently send the corresponding request, and you will only need to fill out the appropriate application.

Risks

When registering in another city to evaluate the pros and cons, such a step has some risks, although it has much more advantages.

When discharged to the old place of residence, the citizen automatically loses some positions. Social benefits of regional importance will be withdrawn. If a person stood in line as in need of improved living conditions, then he is removed from it. Documents will need to be submitted at the place of new residence, and you will have to go to the end of the line.

There is one more unpleasant moment. When registering in someone else's apartment, there is always a risk that at the most inopportune moment the owner may ask you to move out and check out. If you do not have housing rights, you will have to look for another place of registration.

Each person is free to choose his own place of residence. No grounds or permits are required for relocation. When changing your residence address, it is important to promptly contact the territorial department of the Ministry of Internal Affairs and register.

Where is it issued?

To register, you must go to the passport office. It is he who deals with issues of temporary and permanent stay of citizens, as well as issues of internal migration.

In addition, if you are unable to make an appointment in person , you can do so by registering on the State Services website. You will be given an exact appointment time and given a list of required documents, thereby saving your time.

Getting an account on the government services portal is quite simple; employees will contact you via SMS as soon as you select and order the registration service.

Types of registration

A citizen can register at a new address temporarily or permanently. The type of registration depends on the goals pursued by the individual. For example: to move while studying, temporary registration is sufficient.

The rights for permanent and temporary registration are the same. The only difference is its validity period. Temporary registration is limited, its maximum validity is three years. When registering permanently, a stamp is affixed to the passport. Temporary registration requires a certificate.

From a legal point of view, there is no difference between types of registration. In practice, there are quite often situations where people with temporary registration have difficulty accessing high-paying jobs or bank loans.

What documents are required?

It is necessary to present originals and photocopies of the following documents:

  • passport of a citizen of the Russian Federation;
  • military ID for men;
  • ownership documents;
  • owner's permission to register;
  • consent of other registrants to your registration;
  • leaflet - departure;
  • a document confirming your basis for changing your registration (marriage certificate, certificate of employment, written application);
  • application in the prescribed form.

However, check the department's document requirements in advance. It is quite possible that some requirements may change over time, something is included, something is removed.

After submitting your documents, you will receive a special certificate .

It contains the date of submission, the documents themselves are listed, the signature of the employee and your data are indicated. The certificate must be kept until your next visit to the authority in order to receive the papers in your hands.

Ways to check out of an apartment remotely

A citizen may need a remote statement in various situations, for example, moving to a permanent place of residence in another district or city, or buying a new apartment. There are several ways to deregister remotely:

  1. Simultaneous discharge/registration . As noted above, this method is especially convenient when moving to a new place of residence, as it provides for automatic registration when submitting documents for registration at a new address.
  2. Extract by proxy . There are cases when a citizen needs to be discharged without subsequent registration, but due to the inability to resolve this issue on his own, he can entrust the discharge procedure to his representative. The main thing when moving to another city is to draw up such a document in advance.
  3. Through State Services . The advantage of this method of discharge is that the citizen is present in person at the authorized body only once - to mark it in the passport, and therefore there is no need to hand over his passport for a long time. However, it is only suitable for discharge with simultaneous registration at another address. It’s not possible to just get discharged according to this scheme.
  4. Extract when staying in another country . To deregister, you need to contact the consulate of your country. However, a problem may arise due to the remote location of the consulate, and therefore the citizen will have to travel a long way to be discharged.

The remote deregistration procedure usually does not take much time, and a citizen can choose the most convenient method for himself based on the current circumstances.

Timing and cost

the one-week period established by Law No. 5242-1 of June 25, 1993 , but it all depends on how complete information you provided about yourself and how much additional information employees need to obtain at their previous place of registration.

The registration procedure is completely free and does not require payment of state duty. The only material aspect is a fine , which is imposed if you missed the ninety-day deadline for registration at your place of residence.

Features and nuances

Remember that if you are registering for a minor child, you should not take the permission of the property owner or the consent of the residents.

A minor child is automatically registered at the place of registration of his parents, regardless of whether the owner agrees to this, and he can only be discharged upon reaching the age of eighteen.

It is important to pay great attention to the execution of the application. If you are entering an apartment in which you are not the owner , in addition to your signature, the application must also contain the signature of the owner of the property. Only in this case will your application be accepted.

How to register?

According to the latest innovations, during the registration process at a new address, the previous registration is automatically canceled. Therefore, a citizen needs to contact the authorized migration departments

(OVM) related to the territorial divisions of the Ministry of Internal Affairs to change the current place of registration.

You can apply to change registration yourself if you are a homeowner, or use the services of third parties

if the property is rented. These may include:

  • housing department employees;
  • authorized persons of housing cooperatives, homeowners' associations, residential complexes or representatives of the management organization;
  • MFC employees;
  • home owner.

Important! Submitting documents and obtaining registration is a free service

. Hiring third parties to represent you may incur additional costs.
