Noisy work in Moscow has been subject to various laws in recent years. At first there was a law on silence in Moscow No. 42 of July 12, 2002, which, unfortunately, did not regulate the time of repair work in any way. Therefore, a new decree of the Moscow Government No. 73 of 02/08/2005 appeared, which established that noisy repair work in a residential building in Moscow should be carried out from 9.00 to 19.00. After the recognition of the new resolution on the redevelopment of apartments No. 508 on October 25, 2011, the previous resolution No. 73 was canceled, and with it the issue of noise work in Moscow hung again, since there were no laws left that would regulate this issue.

As a result, after numerous complaints, it was decided to amend the already existing Moscow city law on silence No. 42, which has not ceased to be in force. Several edits were made. The last one was December 14, 2016. As a result, we established the following:

  1. The term night time was introduced from 23.00 to 7.00.
  2. Defined in paragraph 1 of Art. 2 which actions are considered noisy.

    It should be noted that “ordinary” noisy activities (clause 1 of Article 2) and noisy work during redevelopment or repairs (clause 1.1 of Article 2) are separated separately. “Normal” noisy activities include using televisions, tape recorders, playing musical instruments, etc.

  3. It was established that noise redevelopment work in Moscow is prohibited on Sundays and holidays.
  4. The time for noisy repair work was left from 9.00 to 19.00 on weekdays and Saturdays. They planned to do it until 20.00, but residents on the active citizen portal voted to limit the allowable repair time to seven o'clock in the evening.
  5. The quiet time in Moscow for noisy work during redevelopment during the day is set from 13.00 to 15.00. Thus, they installed a daylight window into which repairs cannot be made.
  6. “Ordinary” noisy events are prohibited from 23.00 to 7.00.
  7. An exception was made for noisy renovation work in new buildings. The established time frames for noise repair work do not apply for one and a half years from the date of delivery of the house. That is, in new buildings, repairs can be done any day from 7-00 to 23-00.

Traditional methods

Some citizens come up with their own ways to combat noise, trying to repay their neighbors in kind. This can be done using the following methods, but we do not recommend resorting to them:

  1. Turn on the speakers with music audio recording at full power. The owners, whose apartment is constantly stomping and making noise, can go for a walk. And let the residents above enjoy themselves.
  2. Get revenge with a frying pan. You need to fill it with water to the brim, then place it high on the furniture so that it is completely in contact with the ceiling. Put headphones on the device and connect to the music center. This is the most effective vibrating speaker.
  3. Use a mop. As soon as the neighbors are ready to rest for the night, start hitting the ceiling with a mop and making noise.
  4. Near the entrance of the neighbor’s apartment write: “Caution! Violators of peace and quiet."
  5. Record strong screams, noise and stomping of neighbors on video and post it on the Internet.

The Moscow region has its own Law on ensuring peace and quiet in the territory of the Moscow region N 16/2014-OZ dated March 7, 2014, as last amended as of July 18, 2018.

According to it, noisy work can be divided into three categories:

  1. Noise from sound reinforcement devices;
  2. Singing, shouting, construction work, unloading and loading, etc.
  3. Noisy events and noisy work during redevelopment or repairs.

Noisy events of the 1st type can be carried out from 8.00 to 21.00 on weekdays, and from 10.00 to 20.00 on weekends and holidays. They also have a daily break from 13:00 to 15:00 on any day.

For noisy work of the second type, the same intervals are established as for the first type. Only the lunch break is cancelled.

Noisy work of the third type for apartments within 6 months after registering the house for repairs and redevelopment can be carried out from 8.00 to 21.00 on weekdays, from 10.00 to 22.00 on weekends. On any day of the week, apartments are given a break for noisy repair and redevelopment work from 13.00 to 15.00. After 6 months, no loud repairs can be made from 19:00 to 9:00 on weekdays, from 19:00 to 10:00 on Saturdays and around the clock on Sundays. In addition, there is a non-working break from 13:00 to 15:00. As you can see, in the Moscow region less time is allocated for “ordinary” noisy events than in Moscow. What is the danger of noise that exceeds permissible standards?

Whatever the reason for exceeding permissible standards, it interferes with rest, study and work.

The human body reacts negatively to noise. Prolonged repair work or other actions that disturb the silence lead to a decrease in reaction, absent-mindedness, irritability, nervousness and hinder intelligence.

The citizen's productivity decreases. Exposure to sounds exceeding 70 decibels increases the risk of accidents and causes hearing loss. This especially affects pensioners, young children, disabled people and women.

What to do if neighbors violate the law on silence in Moscow?

Unfortunately, residents of the capital are often faced with noisy work being carried out at inappropriate hours and even on holidays. What to do in this case?

  1. Violation of the law on silence in Moscow is considered an administrative violation according to the Code of Administrative Offenses of Moscow. You can call the local police officer or the police, who will draw up a report on the administrative offense. Violators will be fined: individuals 1,000-2,000 rubles, officials - 4,000-8,000 rubles, legal entities - 40-80,000 rubles. The fines are not very large, but, nevertheless, they can change the opinion of repairmen.
  2. If the noise is loud, it means that most likely the owner of the apartment has started redevelopment, which occurs in 80% of cases. Redevelopment requires obtaining permission, which not everyone does. Therefore, we advise you to contact the Housing Inspectorate of your district in order to check your noisy neighbor for any uncoordinated redevelopment. Upon your application, an inspector will come to the site and check the redevelopment for compliance with building codes. The owner of the apartment will face an administrative fine of 2,000 rubles, as well as an order to approve the redevelopment if it does not violate anything, which is extremely rare, and an order to return the repair to its original position in terms of violated standards.

Fines for breaking silence

According to the latest amendments to the law, people who exceed the permissible volume at a certain time will be punished financially.

Monetary fines will have to be paid not only by ordinary residents, but also by organizations that do not monitor the noise level in the building where they are located.

For the first violation, law enforcement agencies usually limit themselves to a warning, but for a repeated violation, they issue a fine. Today the following sanctions have been established:

  • primary recovery from 1 to 3 thousand rubles. (determined based on complaints from neighbors and excessive volume levels);
  • the second violation will cost 4 thousand rubles;
  • for the third time, law enforcement agencies will issue a fine of 5 thousand rubles.

These amounts apply to residents of apartment buildings. But legal entities cannot get by with such small fines. They will have to pay several tens of thousands of rubles for breaking the silence. The maximum amount of recovery is 150 thousand rubles.

Where to complain about violators

If neighbors do not respond to requests to turn down the music volume or stop repair work, you need to act decisively. First of all, you will need to stock up on evidence. This may be an audio recording, but it is best to provide a video recording to confirm that the volume was exceeded in a particular apartment.

You will need the video when you call the local police officer, since by the time he arrives the neighbors may have stopped making noise. A law enforcement official must submit a written complaint. After the investigation, the violator will be fined.

You can also contact Rospotrebnadzor, the police and even the court. If there are witnesses and video footage confirming the violation, you have every chance to punish the neighbor who constantly harasses you with noise at night, and even recover money from him for the moral damage suffered.

Follow the rules established by law so you don't suddenly see a notice of an upcoming trial in your mailbox. Not all neighbors are ready to decisively fight troublemakers, but if the volume level is constantly exceeded, the number of people willing to write a complaint will increase.

  1. Fine for citizens - 3-5 thousand rubles.
  2. For officials - 25-50 thousand rubles.
  3. For organizations - 250-500 thousand rubles.

For noisy night construction, private individuals are fined 5,000 rubles, responsible persons - 25,000 - 50,000, and legal entities - 500,000 - 1,000,000 rubles.

Where to complain about violators

What to do if the established quiet regime is constantly violated nearby? Come to terms with it or start fighting for silence. Moreover, the issue can be resolved peacefully without the involvement of law enforcement agencies, but in some cases the matter comes to court.

Possible directions for filing a complaint are given below:

  1. Neighbours. First of all, contact the violators themselves with a request to maintain silence. It is quite possible that the neighbors understand the illegality of their actions, but due to insurmountable circumstances they are temporarily unable to behave within the law. And they will ask you to be patient for 1-2 days. In 90% of cases, it is possible to come to an agreement with the neighbors.
  2. Police. If the conversation has no effect, contact law enforcement. To record a violation, you will need a police squad. After the call, the police will draw up a report, which will be handed over to the local police officer. Further, he himself will carry out the work of maintaining order. The duties of the district police officer include visiting violators and conducting a preventive conversation. Often this measure is quite enough to restore silence.
  3. Management Company. In cases where previous measures do not bring results, write a complaint to the management organization. Attach to it a copy of the offense report drawn up by the police and a certificate issued by the local police officer confirming the work done. Such treatment does not bode well for violators - the Criminal Code has the right to file a lawsuit and, after a hearing, carry out an eviction.
  4. Rospotrebnadzor . This method is suitable for collective applications. If several apartments regularly suffer from noise emitted by one tenant, they can count on a full-fledged examination from Rospotrebnadzor, following a collective complaint.

Employees of the organization are required to conduct an examination by arriving at the hours specified by the applicants with special instruments. They take measurements, inspect the premises and draw up a report. During court hearings, it will be 100% proof of the offender’s guilt.

Judicial appeal against unlawful actions of a neighbor

You can go to court if all the evidence has been collected. To consider a case, a judge needs properly collected evidence so that it is admissible and can be relied upon when making a lawful decision.

First you need to try to peacefully resolve the conflict. Then interview other neighbors and record their testimony in writing; you can collectively write a complaint and collect signatures. Next, contact the police or the local police officer and the Law and Order and Security Committee. If it doesn’t work, then you can go to court and attach all the statements that were sent to all these authorities.

Most likely, the court will make a positive decision, oblige the violators to pay a fine and collect legal costs and compensation for moral damage.
