Responsibility for carrying a traumatic weapon without permission

Many fans of traumatic weapons are wondering whether it is possible to possess them without special permission, whether it is possible to buy traumatic weapons without a license. Will there be special sanctions for this? This article provides answers and a complete explanation to this question. So, do you need to get a license to use a traumatic pistol? Will there be any sale of traumatic weapons without a license?

Modern types of traumatic weapons are purchased for the most part for personal protection. According to modern legislation, such weapons can be legally purchased, carried, stored and used only with special permission. Every person who purchases such a weapon must understand that any pistol is a means of protection; it can only be used in certain situations, in particular, when there are certain reasons to believe that his health and life are in danger.

Legal issues

Since 2014, amendments have been made to the Government Decree on the circulation of civilian weapons, which are still in effect. According to these amendments, it became possible for citizens of the Russian Federation to carry weapons in the following cases:

  • for holding sporting events;
  • during the hunting season;
  • for training or shooting practice;
  • for self-defense purposes.

It was the last point that became the key in resolving disputes about whether it is possible to carry a traumatic weapon with you.

You need to know that according to current legislation, the legal basis for carrying weapons is a permit issued by the relevant authorities. It must be issued in accordance with the procedure established by law and indicate the specific type and model of weapon.

What weapons can you carry without a permit?

A stun gun is also considered very popular as a self-defense item. This is also a fairly compact device, only with electrodes that produce a current discharge that is not very dangerous to health. Its main value lies in the fact that, having received a discharge, especially to an open surface of the body, your opponent will not only likely fall into a short-term shock and, being partially paralyzed, will cease to understand the essence of what is happening, but will literally freeze in place. About the same way Brazil froze after the defeat of its team in the semi-finals of the 2014 World Cup football championship from Germany with a score of 1:7. In addition, the shocking device has good camouflage, because it is produced in the form of, for example, a flashlight, a mobile phone or a simple lighter. There is only one minus - the discharge does not penetrate winter clothes well.

Correct classification

The basic regulatory act in this area is the Law “On Weapons” of 1996 No. 150-FZ. It defines the types of permitted means of self-defense. These include:

  • gas weapons;
  • devices operating as electric shockers;
  • mechanical sprayers;
  • smooth-bore firearms and ammunition for them (including traumatic);
  • domestic spark gaps;
  • various aerosol preparations, inside the cavities of which the presence of irritating or tear-producing substances is allowed;
  • firearms that have limited damage, which include barrelless models, revolvers/pistols, and are only allowed to have cartridges with a traumatic, gas or flash-noise effect.

Important! In addition to the above, it is allowed to have official copies necessary for self-defense.

Service weapons are required in exceptional cases and are permitted to be worn by officials involved in similar situations requiring protection:

  • health and life of citizens;
  • property or property rights;
  • when transporting certain types of cargo or correspondence;
  • during conservation measures in the field of ecology and resources.

At the same time, in our country there is a certain ban on certain types of self-defense means that are unacceptable to carry with you and use them during defense:

  • various types of bladed weapons;
  • long-barreled firearm.

These types are only allowed to be transported or transported.

Prohibition on the purchase of weapons for violators of public order

Restrictions are imposed on citizens who have committed offenses in the field of public order. Russian President Vladimir Putin signed a law establishing the duration of the ban on the purchase of firearms for citizens who have committed repeated offenses in the field of public order. This was reported on the official website of the Kremlin. Law “On Amendments to Art. 13 of the federal law “On Weapons” was adopted by the State Duma on March 21 and approved by the Federation Council on March 26. The document was developed in pursuance of the decision of the Constitutional Court of the Russian Federation. How the law will work The ban will apply to those who have repeatedly committed within a year “an administrative offense that encroaches on public order and public safety or the established management procedure; offense related to violation of hunting rules; or an offense in the field of illegal drug trafficking,” and will last until the end of the period during which the person is considered subject to administrative punishment. A ban is introduced on the purchase of weapons for citizens who have an unexpunged or unexpunged criminal record for a crime committed intentionally, or who have an expunged or expunged criminal record for a serious or especially serious crime involving the use of weapons. The law also clarifies that the list of sports, the participation of which gives the right to purchase sports firearms with a rifled barrel, is established from the sports included in the program of the Olympic Games, and is approved by the Ministry of Sports of the Russian Federation in agreement with the Ministry of Internal Affairs of Russia. Legal permission

In order to legally use purchased self-defense means, you must obtain the appropriate document. Such a permit to carry a traumatic weapon can be purchased at specialized licensing and permitting departments under the police.

It will be issued under the following conditions:

  • provision of a package of documents;
  • obtaining a medical certificate;
  • completing training;
  • successfully passing exams after studying.

The permit to carry and store traumatic weapons is valid for 5 years. After the period has passed, everything is extended for the same period.

Conditions

In Russia, the right to bear arms is granted only to persons who have reached the age of 21. In this case, the following conditions must be met:

  • absence of mental disorder;
  • a person must be resistant to and account for his actions;
  • comply with all necessary requirements for storing weapons so that they cannot be taken by strangers or small children;
  • submit to the Department of Internal Affairs a certain package of documents to obtain a license.

Therefore, before buying this or that pistol, you need to clarify information about whether you will be able to use it or not.

To use a weapon for the purpose of self-defense, you must follow a clear procedure:

  • raise your hand up and fire a warning shot;
  • after this, the person from whom the danger comes will understand the seriousness of his opponent’s intentions;
  • You should never threaten another person without a valid reason, otherwise it can end quite badly.

It is also generally accepted that it is impossible to take a person’s life or cause serious injury with a traumatic weapon. But such cases still happen. Therefore, when answering the question of whether a permit is needed for a traumatic pistol, we can always say with certainty that it is simply necessary. Otherwise, the use of such weapons will be illegal, and its owner will be held accountable.

Citizens who are in public service in the police or are in the military are not required to take training courses before obtaining a license for a traumatic pistol. You just need to indicate the details of your service weapon.

Legislative rules

Strict rules for carrying traumatic weapons have been developed. At the same time, you need to know that this includes firearms of limited destruction, using cartridges of traumatic effect.

The current rules for carrying a traumatic pistol require the owner to have a permit. It is necessary not only during storage, but also during transportation and, especially, use.

Since the illegal carrying of a traumatic weapon implies administrative liability, it is necessary to know the conditions under which it is possible to carry it:

  • long-barreled firearms are carried uncovered;
  • firearms with a short barrel are carried in a holster;
  • it must be unloaded even with a loaded magazine or drum;
  • cannot be worn with the fuse removed;
  • It is not allowed to load cartridges into the chamber while wearing it.

Such rules are based on protecting not only the owner from unwanted injury, but also those around him.

What storage is considered illegal?

Illegal or legal handling of weapons is determined by the presence or absence of a license.
The licensed person must be legally competent and must provide a package of documents when applying for a license. At the same time, before applying for a license, it is necessary to ensure the legal storage of weapons in a specially equipped place. As a general rule, the person requesting the license must purchase and install a safe. Restriction of free access to weapons by children and third parties must be ensured.

Today, within the framework of civil circulation, private individuals who once received a license. Online stores offer to buy weapons regardless of whether you have the legal right to own them. You may find yourself “outside the law” by purchasing a pistol or shotgun without obtaining permits in advance of the purchase.

You should contact the licensing authority of the police department related to your place of residence, and first obtain:

  1. Medical certificate.
  2. Certificate of completion of courses.

The certificate must reflect the absence of major contraindications from both the nervous system and the musculoskeletal system. And to take courses, you should choose a training organization that holds a regional license from the Ministry of Education and Science.

There is also a category of citizens who will be denied a license:

  • underage;
  • not having registration at the place of residence;
  • not deregistered from the psychoneurological dispensary;
  • previously convicted of intentional crimes;
  • those with health limitations (those suffering from epileptic seizures, brain tumors and general somatic disorders);
  • who have committed more than 2 administrative offenses within one calendar year.

You must fill out an application and attach a copy of your passport and photograph. It is separately noted that for a positive decision on issuing a license, confirmation that a safe has been purchased and installed is required. That is, all conditions for further storage are provided.

Responsibility for breaking the law

Violators should be aware that there is a certain responsibility for carrying and using traumatic weapons without permission. It may imply both an administrative penalty, most often a fine, and a more serious criminal penalty.

Administrative Code in Part 4 of Art. 20.8 regulates the carrying of not only cartridges, but also weapons. The following types of punishment are provided for non-compliance with the rules:

  • administrative fine, which is differentiated according to the degree of guilt in the range of 500...2000 rubles;
  • a more stringent type - deprivation for a period of 6...12 months of the right to carry, store, or purchase weapons.

You need to know that if these rules are violated while intoxicated, the legislation will apply more strictly to these persons. Their actions will be qualified according to Article 20.8, Part 4.1 of the Administrative Code of the Russian Federation, under which the following restrictions apply:

  • the amount of the fine is selected according to the fault from the range of 2000...5000 rubles;
  • You can lose the right to carry, purchase and store weapons for a period of 12...24 months.

In addition to these sanctions, it is possible to confiscate existing ammunition and the weapons themselves. In most cases, the second penalty is often applied in a situation where the owner of the revolver/pistol resists the police and, while clearly intoxicated, refuses to undergo a medical examination. In this case, the gun and ammunition may also be legally taken away from him.

The illegal carrying of pistols or revolvers is most often due to the fact that they are not properly registered. For such actions, a more severe punishment is provided, regulated by the Criminal Code, Article 222, Part 1. They can be imprisoned for up to 4 years , be required to perform forced labor for a similar period, have their freedom limited for a period of up to 36 months, or be fined up to 80 thousand rubles.

At the same time, at the moment, the legislation of the Criminal Code of the Russian Federation does not provide for such punishment for traumatic weapons. Only ammunition and weapons themselves are subject to the regulations. Accordingly, there will be only administrative liability for injury.

Categories of weapons used in self-defense

Article 3 of Federal Law No. 150 identifies several types of civilian weapons that can be used for the purpose of self-defense, these are:

  • traumatic and gas pistols;
  • smooth-bore long-barreled firearms;
  • means of limited destruction;
  • stun guns;
  • aerosol products.

It is also worth noting that self-defense means may be of a service nature.

Citizens of Russia who have permission to store and use a traumatic pistol cannot use it:

  • in a state of intoxication;
  • when organizing events where there is a large gathering of people;
  • on areas owned by educational institutions;
  • while relaxing in places focused on leisure and entertainment.

Until 2021, wearing traumatic protective equipment was prohibited. Its use was allowed exclusively during sports competitions, hunting, as well as training and shooting practice. The innovation caused heated debate in the highest spheres of government, as well as different opinions among ordinary citizens.

Citizens over 21 years of age will be able to obtain permission to purchase, store and carry self-defense equipment in 2021. Previously, the minimum age limit was 18 years.

Education

Before obtaining permission to purchase a traumatic weapon, a person is required to attend courses in the possession and handling of traumatic weapons.

Such courses are held in specialized organizations that have been certified for this activity. After training, a person passes a full exam.

The training consists of theory; in this part, a person studies the laws and regulations about weapons. Studying the rules that govern legal relations in the field of weapon ownership, safety standards, storage rules.

Practical exercises consist of shooting, providing first aid. help, as well as lessons on how to properly maintain weapons.

Popular models

Traumatic weapons are popularly called traumatoma. The following brands are in demand in everyday use:

  1. "Wasp" PB-4-1 . This is a representative of barrelless versions of Russian traumatic weapons. Cartridges 18x45 mm. In the original models, the bullets were rubber, weighing almost 12 g, and the shot power was 120 J. Later, the power was reduced to reduce the risk of serious injury.
  2. "Thunderstorm R-04s" . This is one of the most reliable and simplest traumatic weapons to use. Revolver caliber 9 mm. When firing a shot from this weapon, the recoil is not felt as much. The shot accuracy is high.
  3. Pistol "Makarych" , which is an almost complete copy of the Makarov PM. Compact, reliable and solid.

Using weapons without a license

Unlike the article for carrying without permission, the illegal use of weapons can be charged if the general rules are not followed.
Before using the remedy you should:

  • warn;
  • shoot in the air.

In most cases, compliance with these conditions can protect you from the consequences of criminal prosecution. The Code of Administrative Offenses provides that the illegal use of a means of self-defense, associated with the lack of a license, may entail punishment under Part 1 of Article 119 of the Criminal Code of the Russian Federation.

A threat to kill or cause grievous bodily harm can only be charged if there were grounds to fear that this threat would be carried out. Thus, in the event of an unlawful threat with a traumatic pistol, a situation may arise in which criminal charges may arise against the holder of the weapon.

Features of air guns

Humanity learned to blow a cannonball through a tube at the same time as the invention of archery. Europeans came to replace gunpowder with air around the 15th century, and in the Soviet Union, the production of pneumatics began after the end of the Second World War.

In the modern era, pneumatic weapons do not compete with military weapons, but coexist peacefully. At the same time, the entertainment world of “aircraft” has grown out of the framework of shooting ranges. Although seemingly safe, the shot can cause serious damage and in some cases even be fatal.

Representatives of pneumatics are differentiated by quality, design, purpose and cost

Pneumatic classification

In appearance, it resembles “combat” colleagues in the shop. The need to obtain permission is determined by the characteristics of a particular model. Therefore, before purchasing, you should study the classification of air guns.

The main distinguishing feature according to which pneumatics is systematized is the method of initial gas compression. The most common is the spring-piston mechanism.

Table 1. Classification of air guns

  • Principle of classification
  • Peculiarities
In terms of muzzle energy.Muzzle energy weapons:
  • up to 3 J.;
  • not higher than 7.5 J;
  • more than 7.5 J.
By scope.
  • soft;
  • paintball;
  • airsoft with plastic balls;
  • hard.
According to the principle of operation.
  • spring-piston;
  • gas cylinder;
  • compression

Muzzle energy no higher than 7.5 J: most pneumatics fall into this category. Above this figure are most sporting and hunting weapons.

Given the many criteria for evaluating weapons, it can be difficult for beginners to understand the requirements for the correct purchase of pneumatics. In addition, it should be borne in mind that some copies should be stored taking into account the requirements prescribed at the legislative level.

It is believed that guns with a power of up to 7.5 J are safe for humans

Combat power of pneumatics

The availability of airborne weapons has fueled controversy regarding their use in self-defense. It makes no sense to use a pistol with a muzzle energy of up to 7.5 J for self-defense.

For pneumatic guns to be effective in an attack, the bullet must have a power of at least 47 J. An air pistol is not suitable for repelling enemy actions.

However, it is foolish to consider “air balloons” to be absolutely harmless. Any throwing weapon poses a threat to life. Therefore, when using an air gun, you must adhere to the safety precautions specified by the manufacturer.

One of the most popular pneumatic models is the Crossman C11

Names of weapons that do not require a permit

In compliance with the required parameters of caliber and muzzle energy, the following models can be purchased without permits:

UmarexThis brand from Germany is one of the leading weapons manufacturers. Among the many undeniable advantages, high cost is noted. The price of some copies exceeds 100,000 rubles. However, the model line is quite wide, so followers of this brand will be able to find a pistol according to their financial capabilities. The Umarex Walther CP99 Compact is considered a worthy representative of pneumatics. It fits comfortably in the hand, and at the moment of shooting it creates the illusion of a military weapon. 10024.58 000
GletcherA relatively young American company. Located in the middle price range. The most popular representative is Gletcher TRS 24/7. It is a successful replica of the Taurus 24/7 pistol. Designed for police and civilians. The successful combination of price and quality and positive customer reviews have brought the product to a leading position. 12034.54000
CrosmanAn American brand specializing in the production of pneumatics. The Crosman C11 model is one of the most popular and powerful pistols. Considering the low cost, it is a budget option. In appearance it does not resemble any other representative of firearms. 1503.20.043000
"Kalashnikov"For adherents of domestic pneumatics, the company has released a pneumatic copy of the Makarov pistol - Umarex Makarov. It is so similar to the firearm that it is difficult for amateurs to tell the difference at first glance. Quite an economical option. 13534.53500

Do I need a permit for a Makarov air pistol? Due to the fact that in terms of muzzle energy and caliber size this model fits into the permissible standards, registration of permits is not required.

Gas means a weapon designed to temporarily destroy a target, which can be a person or animal, by using toxic substances that have a tear-producing, irritating or other effect. To purchase and store it, you must obtain a license.

Mechanical sprayers, aerosols and other devices filled with tear and irritant substances are also classified as gas weapons, but can be purchased freely. In Russia, the circulation of any gas weapons equipped with nerve agents, poisonous or other substances that can cause harm to health is prohibited.

10. Melee weapons are:
