State duty receipt for divorce in 2021

It is necessary to find out how to pay the state fee for a divorce before the divorce process begins. Without presenting a receipt for the transfer of this obligatory payment, the divorce application will not be accepted. It does not matter how the divorce is formalized - through the registry office or by court decision. The cost of the government service, in addition to registering a divorce, includes the issuance of a divorce certificate.

The price of divorce

Over the past year, prices for government services for the Russian population have increased significantly, and divorce was no exception. In view of this, the question of the cost of the state fee for divorce is of concern to those who have decided to begin such a procedure. It is noted that its size is influenced by several factors, namely:

  • In which body does the divorce take place: the registry office or the judicial body.
  • Is there a requirement in the application for division of property?
  • Do spouses living together have financial savings and assets?

Let's take a closer look at each point.

Divorce at the registry office

Divorce proceedings through the registry office are the simplest and least expensive option. Therefore, if you want to start this procedure, you must follow a number of rules:

  • no joint children under 18 years of age;
  • spouses have no claims against each other.

Note that before the age of 15, it was possible to get a divorce for 400 rubles, but from the beginning of 16 to this day, this amount ranges from 600 rubles. for each spouse.

Also, the updated law on payment of state duty has been amended, thanks to which a number of citizens can pay a state fee of 350 rubles. These include the following cases:

  • the husband or wife is incapacitated;
  • a court decision came into force declaring one of them missing;
  • one of the spouses is in places not so remote for a period of 3 years or more.

Please note that the state fee for divorce in 2021 includes obtaining the original document indicating the breakdown of the marriage. Also, no other costs are expected.

Deferment, installment plan and exemption from payment of state fees to the court

Deferment of payment assumes that the state duty will be paid later, with the occurrence of some event.

Installment is the right to pay state duty in several payments at a certain frequency.

Exemption from payment or reduction of the state duty means that the court, taking into account certain circumstances, changes the amount of the state duty.

The court provides all of the above methods of payment to the plaintiff only upon a written application, which is submitted simultaneously with the claim, with the attachment of all documents confirming the impossibility of a one-time payment of the state fee. The court takes into account the difficult financial situation of the applicant, as well as, when deferring payment, the fact that after a certain period of time, with the occurrence of some event, the applicant will be able to pay the state fee. The following certificates can be used as confirmation of property status:

  • about the amount of wages;
  • about the amount of benefits;
  • pensions;
  • for non-workers - a copy of the work record book.

The applicant’s dependents are also taken into account; then birth certificates, certificates of family composition, and certificates of income of other family members are attached.

Based on the results of resolving such an application, the court issues a ruling that either satisfies the requirements or refuses to satisfy them. If you disagree with the court's conclusions, you can file a private complaint with a higher authority.

Divorce is a quick way out of a marital situation.

Through the judiciary

Divorce proceedings carried out through the judiciary are only possible in the following cases:

  • spouses have children under 18 years of age, both natural and adopted;
  • one of the parties does not want to sign the application;
  • one of the spouses does not appear at the registry office.

The state fee for divorce in court, if the issue does not concern the division of joint property and financial assets, is 850 rubles and includes a statement of claim.

However, when making a court decision, you must pay the same amount when applying to the registry office for supporting documents.

As a result, the total cost of the divorce will be 2,250 rubles. If you use the services of lawyers, this price increases several times.

How to pay via terminal

Payment through the terminal allows you to receive a receipt immediately. It can be brought to the registry office or court and enclosed with a package of divorce documentation. You can pay interest-free only in Sberbank devices; other banks charge a commission of two percent.

Step by step guide:

  • insert the Sberbank card into the ATM;
  • enter password;
  • go to the “Payments in your region” tab;
  • select the “State fees” option;
  • enter the name of the institution (usually it is displayed automatically in the list);
  • enter the required data;
  • add a destination for sending money;
  • wait for funds to be debited;
  • get a receipt.

Paying the state fee through the terminal takes a few minutes.

Division of joint property and assets

When a conflict arises between spouses regarding common material assets acquired during marriage, the resolution of the dispute is transferred to the court. Therefore, it is necessary to draw up an appropriate claim, indicating the requirements for a divorce and division of movable and immovable property, incl. savings and assets.

For the state fee for divorce in this situation, you will need to describe the property, give an assessment and, only then, make payment.

Additional nuances of divorce

After filing a claim for divorce through the court, the proceedings in this case will begin no earlier than in a month, a summons about which will be sent to each spouse at the specified address.

There are also other situations that may affect the resolution of this issue through the court:

  1. The spouses did not appear at the court hearing on the specified date. In this case, the case will be closed.
  2. Absence of one of the spouses at the meeting. The reasons why this happened will be clarified and the meeting will be rescheduled for another period. If justifiable reasons are provided, the time limits will be modified depending on the circumstances of the case. If there are no valid factors, the decision will be made in absentia.
  3. If both parties appear, the decision is made at the initial meeting. However, this is possible provided that the rights of children under 18 years of age are not violated, and there is no conflict about the division of property.

Important: When a marriage is dissolved through court, the fee for this is paid by the plaintiff. The applicant also has the right to make payment for the second party or indicate that the second part of the amount is paid by the respondent. The judge will accept this request.

By the way, there is a category of persons who are exempt from paying a receipt for the state fee for divorce. These include: people with disabilities, veterans and heroes of the Soviet Union and Russia.

State duty for division of property

It is rare for a divorce to proceed in court without resolving the issue of property division. The state duty for it is paid separately from the state duty for divorce. Its size depends on the value of the property that the divorcing spouses will divide.

According to Article 333.19 of the Tax Code of the Russian Federation, the state duty when filing a property claim subject to assessment will be charged in the following amounts:

  • when dividing the common property of spouses worth up to twenty thousand rubles - 4% of its value, but not less than 400 rubles;
  • when dividing the common property of spouses worth from twenty thousand one ruble to one hundred thousand rubles - 800 rubles + 3% of the amount exceeding 20,000 rubles;
  • when dividing the common property of spouses worth from one hundred thousand one ruble to two hundred thousand rubles - 3,200 rubles + 2% of the amount over 100,000 rubles;
  • when dividing the common property of spouses worth from two hundred thousand one ruble to one million rubles - 5,200 rubles + 1% of the amount over 200,000 rubles;
  • when dividing common property in an amount exceeding one million rubles - 13,200 rubles + 0.5% of the amount exceeding 1,000,000 rubles, but not more than 60,000 rubles. State duty when filing a lawsuit for the division of common property that is not subject to assessment, or to establish the place of residence for a common child will be 300 rubles, in case of a claim for alimony - 150 rubles. For comparison, the amount of the state fee for notarization of an agreement on the payment of alimony, determining the place of residence of a child of divorcing parents or the division of common property is 250 rubles.

Interesting fact

It once again confirms how concerned our state is about preserving the value of family relationships and further demographic growth. The state fee for registering a marriage, which in 2021 is 350 rubles, is almost two times less than the state fee for divorce.
