How to obtain a housing certificate for a large family

Updated: January 5, 2021, at 09:42

The main reason for the reluctance of citizens to have children is the lack of housing. Renting is expensive, living with parents and other relatives is difficult. Many people have been trying for years to take out a mortgage, save money, or borrow from someone in order to buy at least a room. Housing certificate (HC) for large families is a program developed by the state that provides material support. Thanks to it, you can purchase your own home by investing subsidized funds. To whom it is intended , the conditions under which this document is issued, the required papers for registration - it is worth understanding in detail.

What is this

JS is a type of bond, inside of which a certain amount is pledged.
A personal document, which only the person whose details are indicated there has the right to dispose of. While the program is valid until the end of 2021, we are waiting to see if it will be extended.

He receives money, can spend it on purchasing housing and live there permanently.

It resembles maternity capital, but has a number of specific differences:

· issued voluntarily;

· has a specific purpose - the state subsidizes only the purchase of housing by a citizen/improvement of existing housing conditions;

· you can partially/fully (if possible) cover the cost of real estate/individual housing construction process;

· used once;

· the payment is free of charge , there is no need to return the money to the state;

· terms of use are limited.

Important! The countdown always starts from the moment the owner receives the certificate. He will have six months to find the right housing, conclude a deal and complete paperwork.

The legislative framework

The state provides support to families with many children, takes measures, does not leave things to chance, although it acts far from ideally. A “large family” is considered to be a family with 3 or more children.

Adopted children have the same rights as their parents. If the guardians have completed documents becoming their adoptive parents.

Main legislative acts that reflect the process of issuing certificates, their use and other processes:

1. Article 40 of the Constitution of the Russian Federation reflects the right of the poor to receive free housing.

2. Government Resolution No. 1711 (adopted recently - December 30, 2017) - “On approval of the Rules for the provision of subsidies from the federal budget.”

3. Federal Law 102 (adopted long ago on July 16, 1998) “On mortgages.”

4. Government Resolution No. 1050 (recently adopted on December 17, 2010) – provision of housing.

5. The procedure for issuing, subsequent sale of certificates and other nuances are reflected in the Rules previously established by the Government - Resolution 153, adopted on March 21, 2006.

6. Presidential Decree No. 431 (adopted on 05/05/1992, later edited on 02/25/2003).

Funds for state support are taken from the federal/local/regional budget, as well as money from the constituent entities of the Russian Federation.

What does the certificate look like?

This is a standard document, which is printed on stamp paper, has several levels of security, and contains the following information:

  1. Name;
  2. series and number;
  3. name of the authority that issued the document;
  4. date and place of issue;
  5. passport details of the certificate holder;
  6. the size of the living area for which the certificate was issued. According to this area, the amount will be determined, based on the cost per square meter in the region;
  7. name of the authority that made the decision to issue the certificate;
  8. date of issue of the resolution;
  9. seal of the responsible body and the person who signed the resolution;
  10. accountant's signature.

The large family

A couple of officially married citizens - parents raising 3 or more minor children. Older children will be taken into account if they are full-time university students who have not yet reached 23 years of age .

The status of “large family” is assigned by the local social protection authority, as a result of which the parents receive the appropriate certificates. This allows them to enjoy various benefits provided by the authorities.

How to get ZhS:

· register as a low-income person;

· in fact, the size of the housing they occupy does not meet accepted standards (where everyone needs 15 sq.m. of space).

To register on such a register and confirm your status as a needy person, you need to identify one of the following factors:

· housing occupied by citizens is recognized as unsafe ;

· a family occupies an apartment in accordance with a social tenancy agreement, the size of the living space does not meet accepted standards for square footage, or a seriously ill person lives there with them;

· does not own any real estate;

· the available living space does not in any way comply with accepted sanitary and epidemiological standards .

The size and condition of the premises are assessed by an invited commission. They draw up an act reflecting the results of the research. You need to attach it to the collected documents in the application to receive a certificate.

What other benefits are available to families with many children is in a separate article.

Is there an apartment for 3 children?

Every person who has three or more children can now count on receiving housing instead of a plot of land.
A special law was approved by the president in 2014. According to the approved document, each municipal authority can itself decide to provide a large family not with land, but with a simple apartment.

But this decision can only be made in certain situations, which include: at the time of submitting the application, these people are already registered as needing housing. These persons have every reason to be registered appropriately and provided with an apartment.

Based on this, it can be understood that all regions were given an excellent opportunity to make an independent choice of different approaches to solving the established issue of restoring the living conditions of a large family.

How much money is in a housing certificate

The amount of the subsidy is always calculated individually , using the data at the time citizens submitted their initial application. Subsequently, the amount remains unchanged. If there is money left over after purchasing a home, you must return it.

In practice, it is impossible to cover 100% of the costs of purchasing real estate with subsidized money. The amount is enough for 30-50% of the market value of the apartment, and in economy class. According to the law, citizens have the right to choose housing that is more expensive than the subsidy amount, otherwise, according to the current realities of the real estate market, it will not be possible to purchase an apartment.

They have the right to cover the rest:

· With your own savings or borrow from friends/colleagues/relatives;

· By taking out a regular mortgage loan (some banks are ready to provide preferential mortgages, where the percentage is lower);

· By writing a statement, expressing a desire to use unspent maternity capital.

Housing certificates are given to several categories of people (military, veterans, employees of the Ministry of Internal Affairs, FSIN services), but large families have their own advantage.

The state provides them with other material assistance - maternity capital. And you can invest it, covering the remaining 50-70% of the cost of the purchased housing.

Features of registration of a housing certificate

After the expiration of the established period, during which the commission makes a decision regarding a large family, the question of the possibility of receiving subsidies is revealed. It is worth noting that not every family has complete information about the rights and benefits it is entitled to due to the fact that it has many children. This suggests that you should periodically review information about exactly what programs the state currently has and under what conditions they are provided. An opportunity like this doesn’t come around often, and it should be taken full advantage of.

If a positive or negative decision is made on the written application for a certificate for the purchase of an apartment, a corresponding notification is sent by post. It is this that will serve as the basis for receiving subsequent subsidies, which are very important for a large family.

Registration procedure

It is established by law, citizens need to perform the following actions:

1. Visit a branch of the social protection authority (SSZN). Employees will study the situation and at the same time advise what to do next. They will give you a list of required papers.

2. Collecting documents – interested parties should do this faster. The main thing is that targeted certificates issued by various authorities have expiration dates . If you miss it, you will have to update the papers.

3. Submitting an application . Having completed the formation of the package of documents, you must supplement it with a handwritten statement and take it to the branch of the social security authority.

4. Waiting for a decision . Employees will accept the papers and give you a receipt in return. They will have 30 days to study the documents and make a decision. The applicant will receive a response in the form of a written notification.

5. Receipt. Will happen if the answer is yes. The paper is drawn up with the data of the parent who wrote the earlier application. He will be considered the owner of the subsidized funds.

6. Search for housing . Keeping in mind the limited period, the citizen searches for the desired option and negotiates personally with the seller. When the formalities are settled, he writes a new application, which reflects his intentions to spend the subsidy. Supplements it with relevant documents. For example, a purchase and sale agreement or an estimate for individual housing construction.

7. Waiting for transfer . The home seller, construction company or bank - the citizen's creditor will receive a non-cash transfer to the specified account, carried out by the social security authority. Thus, mutual settlements between the parties will be completed.

8. Submitting a calculation . Having become the new owner of the apartment, the citizen submits a special report, enclosing checks/a copy of the signed agreement/mortgage agreement and other papers. This confirms the purpose where the funds were spent and the amount of expenses.

Important! Have a special certificate confirming your family status. Similar documents are issued separately to both parents.

How to get an apartment for a third child?

The answer to the question about getting an apartment depends on the region where a particular family lives. It is the local district administration that checks the relevant laws. Therefore, initially you need to come to the administration for advice.

The most important questions to think about in advance:

  • family conditions;
  • where to contact;
  • what documents are needed;

There are certain conditions for a family to join an organized queue. Now they may vary slightly in different regions. But in general they are similar.

Family conditions

The requirements for citizens who want to obtain housing coincide with the demands made for people hoping to own land.

The family must have at least three children who are not yet eighteen years old. At the same time, children must live with their guardians. The fact whether these children are natural or adopted does not play any role.

The family must be registered in the region of its application for at least the last 5 years. Guardians of many children must be in an official union.

There is also some limitation associated with parents who raise their children alone. An apartment is issued only if any family member does not own official housing.

In addition, there are various situations when a family will not be able to get an apartment; this can happen in the following cases established by law:

  • if minors do not live with their parents, but in the care of employees of various children's organizations. That is, if these children live fully supported by state power;
  • if parents are deprived of parental rights or have warnings regarding their rights;
  • There are adopted babies for whom the adoption procedure was completely closed.

Where to contact?

Young families with 3-4 minor children living at once can count on a significant improvement in their current living conditions.
To carry out such a manipulation, you need the following: come to your local authority, which deals specifically with social protection of the population, to acquire and register your status as a large family. To do this, you need to fill out a special application of an official form, in addition, you need to bring to the institution all documents on the birth of children who are not yet 18 years old.

Then you need to come to other authorities to obtain the status of low-income people, in other words, those in need of certain social assistance. In order for you to be issued this conclusion, you also need to take with you a certificate from your workplace about your wages and income.

These certificates must be brought by all family members who work. You will need to contact your local municipality with the entire list of documents to put yourself on the waiting list for an apartment.

The issue of providing an apartment should be resolved within 2-3 months.

What documents are needed?

In order to go to the queue for housing, you need to take the entire list of special documents:

  • marriage or divorce documents;
  • birth certificates of all your children;
  • a certificate confirming the composition of the family;
  • photocopies of passport data of Russian citizens of spouses;
  • certificates for an apartment already owned;
  • documents proving income; data on average earnings for the last six months is needed.

For example, in the Moscow region, people have the right to provide other documents that give them the right to purchase certain subsidies and benefits.

Regional Program Differences

Russia is huge and some of its regions have adopted their own local regulations that affect the conditions of subsidy programs. For example, the generally accepted condition by which a family is classified as having many children is the presence of 3 (minimum) children.

Some regional programs impose different conditions. It depends on the actual birth rate there. It turns out that only families with 4-5-6 or 7 offspring can be recognized as having many children. Moreover, only minors will be taken into account.

In Chechnya, 5 children is a common occurrence and a family lives in the same conditions as other people. No subsidies, certificates.

For example : at the heart of the state program in Chekhov Island, a subprogram was created where: “Improving the living conditions of families with more than 7 children.” Thus, certificates are issued only to people with 8 (minimum) minor children.

When not issued

The commission reviewing citizens’ applications may refuse them for the following reasons:

· the applicant’s children are fully provided for by the state;

· parents are officially deprived of their rights;

· less than 3 children , whose age is 18-23 years and they are not full-time students at a university/secondary school;

· the citizen previously participated in similar programs and received a plot of land/housing/subsidy through them;

· applicants have used a similar housing system before;

· not all of the documents provided have been collected;

· the citizen provided inaccurate/incomplete/false information.

Among them, only the lack of papers can be corrected. The rest are considered the final reason to refuse the applicant.

Common Mistakes

Situation No. 1

The family has collected the necessary documents and plans to indicate in the application that they need a subsidy. He believes they have enough money to buy themselves a two-room apartment. Moreover, there are 5 people in the family: parents (mother and father), two sons and the youngest daughter. The children are of different sexes, so they are entitled to only a three-room apartment.

Situation No. 2

Citizens are sure that the certificate is a bond and should be kept as a security. In reality, it is a letter of guarantee provided by the state. The owner's documented right to receive the funds indicated there.

Situation No. 3

The holder is sure that it is worth saving a little and they will spend the rest of the subsidized funds on their other purposes. According to the law, the subsidy has a strictly targeted purpose. And you need to spend it on purchasing/improving existing housing. If there is money left (which is unlikely) , it should be returned back and all receipts and statements should be provided to the commission.

Question answer

A mother of many children who does not have a legal spouse (single) has the right to take a certificate?

Can the certificate received this year be sold later, when the citizen decides on the region (city) of residence?

No, the funds can be used for a limited period. The law defines 6 months, later it is impossible.

Is it possible to spend the subsidy and at the same time invest maternity capital if there is any left?

In accordance with Part 1 of Article 2 of the Law of the Nizhny Novgorod Region of April 2, 2021 No. 26-Z “On measures of social support for large families in exchange for providing them with a land plot in the territory of the Nizhny Novgorod Region and on amendments to certain laws of the Nizhny Novgorod Region”, the right to social support measures have: large families registered as large families entitled to free provision of land plots for individual housing construction, large families entitled to free ownership of land plots for the purposes of individual housing construction in the territory of the Nizhny Novgorod region in accordance with the law of the Nizhny Novgorod region dated December 1, 2011 No. 168-Z “On the provision of land plots to large families for free ownership in the territory of the Nizhny Novgorod region” (that is, they meet the criteria of the specified law No. 168-Z, are recognized as in need of improved housing conditions and have not previously exercised their right to receive land plot).

If our family is in line for a plot for personal farming, can we get a certificate?

If a large family is not registered for the purpose of obtaining a land plot for individual housing construction, then in order to register such a family, members of a large family must be registered as citizens in need of residential premises provided under social tenancy agreements (Part 11 of Article 2 of the Nizhny Novgorod Law region dated December 1, 2011 No. 168-Z “On the provision of free land plots to large families in the territory of the Nizhny Novgorod region”). If, after registering for the purpose of free provision of a land plot for personal subsidiary farming, a large family is recognized as in need of improved housing conditions, such a family can submit an application and the established set of documents to receive a certificate for improving housing conditions. If a large family is not recognized as in need of improved housing conditions, then the provision of a certificate in this case is not provided.

Where to apply to obtain a certificate?

The Ministry of Property and Land Relations of the Nizhny Novgorod Region keeps records of large families wishing to receive a certificate for improving their living conditions in exchange for the provision of a land plot for individual housing construction. If a large family is registered with the Ministry of Property and Land Relations of the Nizhny Novgorod Region, then the large family sends an application for a certificate to improve housing conditions in exchange for the provision of a land plot for individual housing construction to the Ministry of Property and Land Relations of the Nizhny Novgorod Region.
