How to remove restrictions on a car

There are two ways to cancel the registry ban:

  1. Eliminate the cause of the restrictions

For example, if the bailiffs have imposed restrictions due to debts on fines, you need to pay off the debt. It is better to bring payment receipts to the bailiff.

  1. Appeal the imposed restriction

This method is suitable for those who bought a car, and then restrictions were imposed on it.

The new owner can appeal the ban only if it was imposed after purchasing the vehicle. Therefore, when buying a car, you must always check for restrictions.

Sequence of actions for appeal:

  1. Make a complaint and send it to the FSSP unit that imposed the ban. This can be done either during a personal visit or online on the FSSP website in the “Internet reception” section. The complaint is drawn up in any form.
  2. Wait for the complaint to be reviewed. This should happen within 10 days.
  3. If the complaint is upheld, you need to take a copy of the decision to lift the ban to the traffic police.
  4. If the bailiffs refuse, you need to appeal the arrest in court. In your claim, duplicate the arguments from the complaint. Attach:
  • a copy of the purchase and sale agreement,
  • PTS,
  • if available, a receipt confirming payment,
  • agreement,
  • response from the traffic police about refusal to carry out registry actions.

Additionally, indicate that the bailiffs did not respond to the complaint and refused to lift the ban.

Practice shows that the courts often accommodate the plaintiff halfway - both individuals (Decision No. 2-709/2019, Decision No. 2-271/2019) and organizations.

For example, an organization from Kalmykia bought a car on May 6, and on the 14th, due to the debts of the previous owner, it was banned. The bailiffs refused to lift the ban, pointing out that the organization did not try to register the car within the period established by law.

The Supreme Court of the Republic of Kalmykia did not agree with this decision. The court noted that if the property at the time of the ban did not belong to the debtor, but to another owner, the ban must be lifted (Appeal ruling dated March 19, 2021 in case No. 33-275/2020).
