Legislative basis
The legislation of the Russian Federation obliges every citizen to indicate his place of residence within the country.
Federal Law No. 5242-1 of June 25, 1993 “On the right of citizens of the Russian Federation to freedom of movement, choice of place of stay and residence within the Russian Federation” contains a clearly formulated rule according to which everyone is required to have permanent or temporary registration.
Responsibility for evading it is provided for in Article 19.15.1 of the Code of Administrative Offenses of the Russian Federation. The registration procedure is also prescribed by the legislator in Government Decree No. 713 dated July 17, 1995.
Accommodation without registration - terms and grounds
The Administrative Code allows a citizen to stay away from his place of residence only for a limited time, no more than 90 days. After this time, it is necessary to notify the FMS authorities of your place of stay.
Temporary registration in a dormitory or other premises is carried out without deregistration from permanent registration.
For stays beyond the established period, according to Art. 19.15.1. Code of Administrative Offenses, the violator and the homeowner will have to pay a fine. Its size for ordinary citizens ranges from 2000 to 5000 rubles. Legal entities will have to part with an amount of 250-750 thousand.
It is worth noting that not everyone is held accountable for living without registration. If a close relative came for a while, for example, one of the parents, grandparents, children or their significant other, then the law will be quite lenient towards such a guest.
He does not face administrative penalties for exceeding the time of residence without temporary registration. All others must report their whereabouts to migration control authorities.
Registration takes three days, after which an insert is issued indicating the temporary residence address.
Registration in the hostel
To apply for permanent or temporary registration in a dormitory, you must first obtain the consent of the owner of the dormitory as a whole or of the room. An exception is the situation when a minor child is registered at the place of residence of one of the parents.
In this case, the consent of the owner or other registered persons is not required; the procedure is of a notification nature. The parent only needs to submit an application on his own behalf and attach a copy of the child’s birth certificate and confirmation of his registration.
Is it possible to register in a hostel: the main provisions of the law
Since July 1993, by legislative act number 5242-1, the institution of registration was officially abolished. However, this word is still used along with “registration”, and persons living in the territory of the Russian Federation are required to notify government authorities of their place of permanent or temporary residence if their stay at this address is more than 3 months.

Temporary registration is necessary so that the citizen does not lose the right to receive free medical services, benefits or benefits distributed according to territoriality.

Permanent registration
A citizen who is the owner of a room in a dormitory receives permanent registration in it without the mandatory consent of neighbors or other registered persons. If the room belongs to a municipality, you will have to obtain the consent of the municipality and the other tenants with whom you will be living together.
Moreover, even the presence of permanent registration is not a basis for prohibiting eviction on legal grounds.
This depends on the conditions under which the living space is provided for use. For example, if it is official, then after dismissal from a specific place of work the citizen is obliged to leave the room, despite the presence of a registration. If he does not vacate the premises and does not sign out voluntarily, the employer will force him through the court.
Remember! The only way to insure yourself is to privatize your home. But this is only possible with municipal housing. If the property is owned by the employer, this option is not possible.
Owner's consent
In accordance with the requirements of current legislation, a person must obtain the consent of the owner to register in a residential premises. The situation with a dorm room has its own characteristics. It depends on who owns the premises. If the room belongs to a municipality or legal entity, then the consent of these authorities will be required. When the question concerns privatized housing, a positive answer from the owner is required.
The procedure for obtaining consent itself is not defined by current legislation. An issue of this nature is resolved through negotiations. Upon completion, a consent is drawn up.
The text of the document must indicate the following:
- Name of the registration authority.
- Information about the owner - name or full name and date of birth, contact phone number, location address, passport details or document confirming authority.
- Location of the hostel.
- Last name, first name, patronymic, date of birth and passport details of the person registering.
- Length of stay.
- Date of consent.
The document must be signed by the owner. If consent is given by a legal entity, then it can be issued on the organization’s letterhead. In this case, it is signed by the manager and certified with a seal.

There is no legal concept of registration without right of residence. A synonym for this phrase is fictitious registration. This is an illegal fraud that is prosecuted by law.
An owner who knowingly consents to such registration may incur administrative liability and receive a fine of 2-7 thousand rubles (Article 19.15.2 of the Code of Administrative Offenses of the Russian Federation)

Procedure for registering
Decisions on the provision of residential premises for citizens based on a personal application are made by the Department of Migration Affairs. This body replaced the FMS in 2021.
The registration process itself has not undergone any significant changes. The documents are provided to the employee of the passport office of the housing department, to which the property is assigned.
