How to check out of an apartment and register at a different address at the same time? Step by step order

According to current legislation, a citizen who wishes to register must apply for registration within 7 days from the date of discharge from his previous place of residence. The registration of the applicant is carried out by the Federal Migration Service of the Russian Federation. To submit documents, you must personally visit the organization’s branch. However, not all citizens who want to register can come to the office of the institution. In order to reduce the burden on the migration service and simplify obtaining registration, specialists have developed a method that allows you to apply remotely.

In this article we will analyze in detail how to register in an apartment through State Services in 2021; the opportunity is available only to registered users of the service.

The manipulation does not require specific knowledge. The site interface is intuitive. However, experts advise familiarizing yourself with the main stages of the procedure in advance. We will talk further about what papers will be required to complete the application, the specifics of applying to the FMS via the Internet and the time frame during which the registration will be affixed to the passport.

Do I need to register with a new registration?

As mentioned earlier, discharge and registration at the same time through the passport office are now possible. It is enough to collect documents and contact the Department of Internal Affairs of the Ministry of Internal Affairs, Homeowners Association or MFC to receive a stamp in your passport or a registration certificate.

If there is no new place of residence at which permanent registration can be obtained, two other methods remain:

  1. Temporary registration. It is carried out for a certain period. There is no need to sign out from your old address.
  2. Extract with subsequent registration. For example, if a person sold an apartment, but did not have time to buy a new one. He must be deregistered at his old address and registered at his new place of residence when he has one.

Note: from a legal point of view, the term “registration” has long disappeared, but it is still used in everyday life. Instead of registration, registration is now issued at the place of residence (permanent) or at the place of stay (temporary).

Rules for registration at the place of residence and deregistration of citizens of the Russian Federation

The procedure for extracting and registering in 2021 is regulated by Decree of the Government of the Russian Federation dated July 17, 1995 No. 713 “On approval of the Registration Rules...”.

What points are important to consider:

  1. Permanent registration is issued no later than 7 days from the date of arrival at the new place of residence.
  2. Temporary registration is issued no later than 90 days from the date of arrival at the residence address.
  3. The person responsible for receiving and transmitting documents to the registration authorities is the owner of the residential premises in which the citizen is registered. The tenant must submit documents for registration to him within the established time frame, then the owner submits them to the registrar no later than three days from the date of receipt.
  4. If the registration of a minor by one of the parents requires the consent of the other, if he is registered at a different address.
  5. The place of residence of children under 14 years of age is the place of residence of their parents.
  6. To register a minor under 14 years of age, the consent of the owner and other citizens living at the address is not required.
  7. The timing of discharge and registration at the place of residence depends on the method of submitting documents.
  8. If the apartment has several owners, their consent will be needed to register the non-owner.

Note! If re-registration to another apartment is made through State Services, the application is submitted by the person who needs registration, and not the owner: information about him is simply indicated. But in the future, the person registering must come together with the owner of the home to the passport office. If registration documents are submitted in person, the presence of the property owner and the person registering is required.

Advantages and disadvantages

Previously, it was necessary to stand in queues on reception days at institutions in order to register children. But today this process can be carried out using the Internet portal State Services , the undeniable advantages of which are:

  • The procedure is carried out at a time convenient for you.
  • You can register your child very quickly.
  • Ability to monitor the status of requests.
  • The ability not to leave home.
  • Simplicity of the site.

As for the shortcomings, these include rare, but still occurring errors in the operation of the site, which are quickly eliminated by support specialists.

You need to register your children at your place of residence in order to be assigned to a medical institution and get on the waiting list for kindergarten (also registered on the State Services website). An older child needs this in order to enroll in school. Applying for registration on a single portal means receiving significant benefits .

How to check out of an apartment and register in another: step-by-step instructions

What you need to fit into the apartment:

  1. Collect documents and submit them within the prescribed period to the property owner.
  2. Make an appointment at the MFC, Department of Internal Affairs of the Ministry of Internal Affairs or the HOA passport office.
  3. Submit an application with the remaining documents.
  4. Obtain a passport or registration certificate.

Let's look at each step in detail.

Step 1: collecting documents

According to clause 16 of Government Decree No. 713 of the Russian Federation, a citizen who needs permanent registration must prepare:

  • passport;
  • residential lease agreement;
  • extract from the Unified State Register of Real Estate, if the owner is registered;
  • application in the prescribed form.

Note: if the rental agreement is subject to state registration, it is not necessary to submit it. The registrar himself will request all the information from Rosreestr. The same applies to extracts from the Unified State Register of Real Estate. But in this case, the registration period will be 8 working days. It’s better to bring documents to register faster.

Step 2: make an appointment

You can make an appointment at the Department of Internal Affairs of the Ministry of Internal Affairs through State Services or on the department’s website. If documents are submitted to the MFC, you can sign up on its website.

Step 3: Submit your application

When submitting the application, the owner and the registering citizen are present. It is necessary to appear at the appointed time and submit it along with pre-prepared documents. After receiving the documents, a notification is issued; if necessary, at the applicant’s request, a certificate of receipt of a passport can be issued to mark registration.

Contents and sample application

The application is filled out according to Form No. 6, approved by Order of the Ministry of Internal Affairs of Russia dated December 31, 2017 No. 984 “On approval of the Administrative Regulations...”. It is submitted immediately for deregistration at the old address and registration at the new address.

What information is indicated in the application:

  1. Name of the registration authority.
  2. Full name, passport details, date of birth of the applicant.
  3. Full name, passport details of the person who provided the residential premises.
  4. Details of the document on the basis of which housing was provided.
  5. Address of the apartment or house where the citizen needs to be registered.

In the second application (about deregistration) the same data is indicated, but you will need the address where you want to cancel your registration.

After a few days, the registered citizen will be issued a passport with a registration mark. If he is under 14 years of age, a certificate will be issued instead.

Contents and sample of registration certificate

The certificate is filled out by the registrar according to Form No. 8, approved by Order of the Ministry of Internal Affairs of Russia No. 984.

What information does it contain:

  1. Full name, date of birth of the child.
  2. At what address was the place of residence registered?
  3. Series, number, date of issue of the birth certificate, name of the issuing authority.
  4. Signature and seal of the head of the registration department.

When is temporary registration required?

Temporary registration is not mandatory if the period of stay in another city does not exceed 3 months. It is more of a notification nature and is required for statistical data on the movement of citizens of the Russian Federation.

For arrivals exceeding 90 days outside the place of permanent registration, persons who do not have temporary registration may be issued a fine.

Lack of registration can lead to the following difficulties in obtaining the following services:

  • payment for housing and communal services;
  • obtaining a foreign passport, pension certificate;
  • employment; placement of children in preschool educational institutions and schools;
  • receiving medical care, social security, etc.

Register at a new address and receive a certificate at your place of residence for free, possibly within 3 days. The period will be extended to 8 days if there is no document providing the basis for registration.

You can apply for the service and submit an application through:

  • Main Department of Migration Affairs of the Ministry of Internal Affairs;
  • MFC;
  • Russian Post;
  • State Services portal.

The temporary registration procedure is free and takes from 3 to 8 days. The deadline depends on the place where the application is submitted. This can be done quickly and conveniently through government services. To do this, let's go to the portal, having previously logged in to it.

According to reviews from recipients of registration through the government services portal, the following advantages can be highlighted: receiving government services without leaving home; availability of instructions; the ability to complete an application in 15 minutes; no queues and registration in 3 days.

How to check out and register at the same time through State Services?

If you have a verified account, you can register at your place of residence through State Services.
How to do it:

  1. Log in.
  2. Go to the “Passports, registration, visas” section.
  3. Click on “Registration of citizens”, then – “Registration at place of residence”.
  4. Click on “Get a service”.
  5. Fill out an electronic application.
  6. Submit an application for verification.
  7. Receive an invitation to an appointment at the Department of Internal Affairs of the Ministry of Internal Affairs. The application will be reviewed within three working days.

Note! When filling out the application, personal data is indicated, as well as information about the owner of the property in which the registered citizen will live. An adult capable citizen can submit an application. Children over 14 years old can also send it, but parental consent will be required. To register incapacitated persons or children under 14 years of age, documents are submitted by parents, trustees or guardians.

List of documents for registration

To register a child, you need to collect documents. The list is given in the table.

Document A comment
Parent/legal guardian IDIntroduced by the applicant
Child's birth certificateIf the child is under 14 years old
Child's passportUpon reaching the age of 14 years
Reason for registrationA document confirming that the mother or father is registered at this address

How long does it take to check out and register?

A citizen who has moved to a new address must submit documents for registration to the owner no later than 7 calendar days. The home owner is given three calendar days to submit them to the registrar.

The period for simultaneous discharge and registration depends on how the documents are submitted:

  1. Directly to the registrar (UVM Ministry of Internal Affairs) – three working days.
  2. Through State Services – up to three working days.
  3. Through the MFC – 7 working days from the date of application.

Note! If the registrar independently requests information about the documents on the basis of which the citizen moved into the residential premises, the period for consideration of the application will be 8 working days.

How to leave your old place of residence?

If you just need to leave your place of residence without further registration, this can also be done. The owner’s opinion is not taken into account: a registered citizen has the right to deregister at his own request.

What is needed for this:

  1. Submit documents to the passport office or MFC.
  2. In a few days you will receive a stamped passport.

It is important to consider that voluntariness is important for discharge. A person can be forcibly removed from registration only through a court. To discharge a minor, parental consent will be required.

Registration without an extract from the previous place of residence

Such registration is called temporary; registration at the old place of residence is not canceled. Temporary registration at the place of stay is issued if a person lives in a living space that is not his permanent place of residence, within 90 days from the date of arrival. An exception is a vacation in a sanatorium or hotel: in this case, the administration is obliged to notify the Department of Internal Affairs of the Ministry of Internal Affairs on the day of the client’s arrival.

Note: the validity period of temporary registration is not determined by law. It can be issued for either 1 month or 5 years. But this is agreed upon with the owner in whose apartment the registered citizen lives. If the property belongs to a person who needs registration, the period remains at his discretion.

To register without leaving your previous place, you need to:

  1. Agree with the property owner about the validity period of the temporary registration and provide him with documents.
  2. Submit documents to the Department of Internal Affairs of the Ministry of Internal Affairs, MFC or through State Services. The presence of the apartment owner is required.

Finally, in a few days a certificate of registration at the place of stay will be issued.

Documentation

To obtain a temporary registration you will need:

  • passports of the owner and the registered person;
  • extract from the Unified State Register for housing;
  • statement;
  • a rental agreement or other document on the basis of which the person being registered lives in the apartment.

The main advantages of design

This method of notifying the FMS is considered relevant among young and active people who do not want to spend a lot of time visiting the branch of this institution. The State Services Portal was specially created to provide Russian citizens with the opportunity to use various government services without having to leave their home.

This includes the opportunity to submit an application and other documents for temporary registration. This process is considered fast and convenient.

The main advantages of using the portal include:

  • there is no need to come to the FMS or MFC office to transfer documents, so you only need to come to the institution for a ready-made certificate, which allows you to spend little time on this process;
  • the presence of the owner of the property where the citizen plans to live in the new city is not required;
  • The registration process itself is carried out quickly, so a lot of time is saved.

Registration of temporary registration through State Services is a simple process, but to complete it you need to first register on the portal, then log in and understand the available functions and sections.

Responsibility for violating the rules of registration at the place of residence or stay

Administrative liability is provided in several cases:

  1. Absence of any registration, or the property owner allowing unregistered citizens to live there. Fine for individuals - up to 5,000 rubles, for legal entities - up to 750,000 rubles. (Article 19.15.1 of the Code of Administrative Offenses of the Russian Federation).
  2. Failure to comply with deadlines and other registration rules. Fine for officials - up to 50,000 rubles, for citizens - up to 3,000 rubles, for owners or tenants of residential premises - up to 5,000 rubles, for organizations - up to 750,000 rubles. (Article 19.15.2 of the Code of Administrative Offenses of the Russian Federation).

Important! They will not be held accountable if the unregistered citizen lives with close relatives (parents, grandparents, children, spouse). Also, liability does not arise if a person lives in one apartment, but is registered in another, and both premises are located on the territory of the same subject of the Russian Federation.

Lawyer's answers to private questions

I want to check my child out of the apartment. Do I need permission from the guardianship authority?

No, guardianship permission is not required. It is only needed to sell the property of a minor. However, for deregistration, the consent of both parents is required.

I have been deprived of parental rights to my child. Now he lives with his father, my ex-husband, but is registered in my apartment. Can I leave there and register somewhere else?

Yes, you can register in any residential premises. In addition, after a court decision on deprivation of parental rights comes into force, you are deprived of all rights to the child, including cohabitation (Article 71 of the RF IC).

Question about discharge and registration of family members. In 2015, he privatized the apartment for himself; the rest filed waivers of privatization. Can I discharge them now without their consent?

Yes, but only through the court. And it is unlikely that the court will satisfy such a requirement if there are no grounds. Citizens who at the time of privatization had the right to participate in it, but refused, retain the right to live in privatized residential premises afterwards.

Is it possible to remove registration in a passport using a power of attorney? I cannot submit documents in person.

It is better to obtain a notarized consent for registration, because This is exactly what is required for the Department of Internal Affairs of the Ministry of Internal Affairs.

In 2021, I checked out of the apartment, moved to another city and registered there. Now I have returned to my homeland, I want to register at my old address. Housing in shared ownership, I own 1/3. Do you need the consent of the other owners?

No, to register one of the owners of the premises, the consent of the others is not required.

Child under 14 years old

A teenager without a passport cannot fully use government services. Full functions are available only to its parents. This means that the child’s profile will be automatically linked to mom or dad’s personal account. A simplified version of the service can be used up to 14 years of age, and from the moment you receive an identity card, register on the portal and become a full-fledged user with access to a full list of services.

How to add a child in State Services

You can add children to your State Services profile using information from your birth certificate. Data about the child is entered only into the parent’s profile. If mom or dad have already registered an account on the site, you will need to log in to your personal account. If registration is necessary, we go through the procedure in a matter of minutes, thanks to step-by-step instructions. Next, move to the top zone of the main page. In the right corner, click on your own last name and find yourself in your personal account, where personal data is presented.

Scroll down the windows of the thematic area: “My health”, “Transport and driving”, we reach the section “Family and children”. Click on the plus in the center of the square that says “Add a child.”

The next step is to enter information about the child in the form that opens. Full name and gender are required, and SNILS number and TIN are at the request of the parents.

It is advisable to prepare a birth certificate in advance. The following information is indicated from the document: series, number, registration number. It is convenient to select the issue date on the calendar, which will open automatically.

Fill in information about your medical insurance policy. In this section, we fill out the proposed fields without fail. This information will be required when making an appointment with the doctor and will be carefully checked. The service will place the information entered by the user in page format. To prevent errors, we check again and, if necessary, make changes. At the bottom of the page there is a line “Add a child”. If the user has several children, after each completed form it is possible to add information about other minors.

The child's profile is automatically linked to the adult's page. If a simplified profile was created separately, then you can then link it to your mom or dad’s page. In your personal account we find the “Information about children” section. It already contains information about the child, and at the bottom of the form there is an attachment code. The proposed figures should be copied.

Next, we log into the child’s account and add the data that the service requests, click the “Link” button, insert the code and save. To receive most services, linking may not be required, but it reduces the time when filling out questionnaires when making requests, because the information in the fields appears by itself.

The child can enter the password and login independently. At the same time, it is better to warn him that these sets of numbers and letters should not leave the house, because strangers can gain access to personal information.
