Why do you need a study leave report?

The legislator establishes the right of a military man to receive additional professional education, taking into account the interests of the service and personal choice.
Decree of the President of the Russian Federation dated September 16, 1999 No. 1237 regulates various problems related to the period of service, including the provision of study leave. Contractors are given the right to take study leave in order to prepare for and pass entrance or ongoing examinations for training in the following areas:

• military UZ;
• adjunct;
• doctoral studies;
• during the period of training in the specified military areas;
• to institutions of vocational education, higher education (without interruption from service, i.e. in absentia);
• during the period of training in the specified civilian areas.

To obtain permission from the command to leave the territory of the unit due to training needs, you need to draw up a special document - a report. We talked about how military personnel study in civilian educational institutions, and how to write a report for study leave for a military personnel.

Procedure for provision

To apply for study leave, you must:

• Receive a call certificate from the educational institution indicating the start and end time of the session;
• Write a report to the unit commander about granting study leave;
• The commander signs the order and gives the tear-off part of the certificate to the serviceman;
• At the end of the session, the specialist from the educational institution fills out the form of the certificate properly, affixes it with a signature and seal, and gives it to the soldier;
• Upon returning to the military unit, the employee submits a certificate to the financial department in order to receive monetary compensation.

For officers studying in postgraduate courses or military universities, the request is sent by the rector. Based on the notification, the unit commander signs an order to provide the adjunct or dissertation candidate with sufficient time to prepare. The order for granting leave is sent to the educational institution by mail.

When are military personnel given study leave?

Federal Law No. 76-FZ dated May 27, 1998 regulates the opportunity to get an education and, as a result, leave for different categories of employees:

• contract officers have the right to study in civilian educational institutions through part-time and part-time forms;
• contract soldiers who are not officers (with a duration of service without a break of more than 3 years) have the right to study in secondary vocational educational institutions, in institutions of higher education at the expense of the budget, part-time and part-time;
• conscripts serving on conscription do not have the right to training.

Officers and other categories of employees can receive guarantees related to payment for days of study and other compensation for travel to the place of training while receiving education:

• appropriate level for the first time;
• in the direction of a federal government agency in which there is military service.

If an officer, for example, has secondary vocational education after graduating from a military institution, he has the right to receive a higher education and, in parallel, to a social guarantee - study leave.

There is one more condition, defined by Decree of the Government of the Russian Federation dated November 3, 2014 No. 1155: a military man who is not classified as an “officer” can receive guarantees related to studying in civilian educational institutions if his period of continuous contract service is at least 3 years .

The conditions for receiving paid leave are:

• studying in a civilian specialty of the appropriate level in a civilian educational institution for the first time (all officers in the army have a higher military education; their lack of a civilian secondary or higher education is interpreted upon admission to a civilian educational institution as receiving an education of the appropriate level for the first time);
• full-time and part-time education;
• serving under a contract during the period of admission or study (the age for concluding the first contract is 18-40 years old, the maximum age for serving depends on the rank, that is, the age of study is related to the actual being on a contract).

What is needed for registration

To obtain study leave you will need a number of documents. The first of them is a referral for training. To obtain such a document, the employee must submit a report indicating in it:

• the name of the educational institution where he intends to enroll;
• the duration of continuous military service under a contract at the time of drawing up the report;
• the education he has;
• information about his receipt of a referral for training in the previous period.

A copy of educational documents must be attached to the report. The commander of the military unit will issue a referral in the form established by Government Decree No. 78 of 02/07/2006. Such a document is generated in 2 copies: one - in the hands of the applicant for signature with recording of the fact of issue in the logbook, the second - in a personal file.

If a military man is studying part-time or in the evening to receive leave, he submits a report (a sample report for study leave for a military man is given below), attaching a summons certificate in the prescribed form. It contains 2 parts - a challenge and a spine. Without a confirmation certificate, a serviceman will not be released for the session.

The document provided in preparation for admission to an adjunct or military doctoral program is a notice signed by the head of a military educational institution, allowing a military person to take part in the examination procedure. Free days will be given for postgraduate studies, military doctoral studies (in absentia) by order of the military unit commander, an extract from the administrative document will be sent to the place of study.

How and to whom the report is submitted

The report must be submitted to the commander of the military unit in writing. The text is presented freely. It must mention and decipher the reasons for providing the report.

The commander considers the appeal if there is proof of training. When contacting the command, you must have justification documents available in order to be able, if necessary, to prove why the absence of an employee for a certain period of time is necessary.

Sometimes, to confirm your studies, you need a student ID, an order of enrollment, and if you have doubts about the educational institution, you need some documents (for example, a license).

Refusal

The current laws state that a serviceman has the right to unconditionally receive leave during the session, passing exams, and preparing to write a thesis. However, the specifics of military service are such that a soldier must also undergo exercises, field training, and participate in peacekeeping and combat operations. In this case, the serviceman receives a refusal, and the head of the educational institution is notified in writing. They, in turn, must reschedule the session for the period when the soldier will be at the location of the military unit.

If the official need extends for an indefinite period, academic leave is granted until the end of the emergency situation. Refusal to grant study leave for other reasons is unlawful.

How to write a report correctly

A correctly drawn up sample report for military personnel’s study leave 2021 contains the following provisions:

1. A cap. It states the full name, rank of the commander of the military unit addressed to whom the paper was drawn up, data of the compiler, including full name. and rank.
2. Document's name.
3. Main part including:
   statement of the reason for absence;
4. the period during which the military man will be away from the unit;
5. reference to a regulatory document giving the employee the right to receive social guarantees related to studies;
6. the place to which a person is heading;
7. information from the call certificate (number, date, other information) attached to the report.
8. Date, rank, full name, signature of the applicant.

The report should mention possible applications that are sent along with it. The unit commander, for example, has the right to request various documents, for example, an administrative document on enrollment in studies, an institution’s license.

The information in the report is presented in free form; there are no special requirements for wording.

How long will they be released?

The duration of study leave to prepare for and pass exams depends on the specific educational purpose.

Leave is granted for the following period:

Military personnel studying in higher education institutions have the right to receive:

The vacation period is extended by the time necessary to travel to and from the place of study.

Military personnel entering postgraduate or doctoral studies without passing exams are not entitled to study leave.

However, a military man studying part-time in an adjunct or doctoral program has the right to receive:

• 1 day a week - for preparation (exception - weekend, holiday);
• 2 days a week. - in the 4th year of study at the request of the employee himself.

Such days are formalized by order of the unit commander.

• 30 days per year - for passing the candidate minimum and preparing a dissertation (travel time to the educational institution and back is not taken into account).

Duration

The duration depends on the form of study and year. If you have access to exams, a military man who has entered a higher educational institution is granted leave for a period of 30 days. If it is impossible to establish the beginning of the training campaign, they give 10 days off for each exam. After enrollment in a university or another educational institution, 40 days are allotted for the 1st, 2nd course session, 4, 5 - 50 days. You are given 4 months to write a thesis project, preparation for state exams takes 1 month.

When receiving secondary special education, sessions 1 and 2 are given 30 days, 4, 5 – 40 days. We are given 30 days to complete state exams, 2 months to write and submit qualifying work.

How will they pay?

Vacation payments to military personnel are established by multiplying the average daily salary by the number of calendar days of absence. Vacation pay is subject to personal income tax.

The average daily earnings are determined on the basis of Decree of the Government of the Russian Federation dated December 29, 2009 No. 1100. The formula is as follows: the allowance accrued for the previous 12 months is divided by the number of days that fall within the period for which the allowance is accrued. Non-working holidays are taken into account when counting days.

Employees may be paid for travel to and from their place of study in the manner determined for the relevant power structure.

Can they refuse?

An important issue is the right of the commander to refuse to grant study leave to a military man. What if the employee did not inform the commander about the training?

The charter of the internal service of the RF Armed Forces states: a military man is obliged to report to the commander about all actions that could affect the performance of service duties. Study definitely influences this factor, because a military man must be released from service for a significant period. This means that the commander must take measures to prevent a weakening of combat readiness.

As a result, the lack of notification about studies, regardless of the reasons, is a violation of Art. 26 Federal Law No. 76-FZ and the Charter, is a disciplinary offense for which you can be subject to disciplinary punishment.

There is also a second position: failure to report about studies is not a reason for refusing to let you go to the session. Why? Clause 10 of Rule 1155 defines possible reasons for refusal. These are exercises, ship cruises, business trips lasting more than 3 months - the general list is determined by type of troops. For the period of participation in such events, the military man is issued a certificate indicating the basis for postponing the exams.

The command has no reasons for refusal (with the exception of certain cases provided for by law) if there is a message about the training.
