What papers are needed to allocate land for free?
Those groups of fellow citizens who are mentioned in Article 39.5 of the Land Code have the right to receive land territory from the state free of charge:
- citizens who have a plot of land for free use for more than 5 years;
- young families who need assistance in obtaining housing;
- large families with three or more children;
- veterans and combatants.
So, what do you need to provide to get free land:
- application for the provision of land territory;
- identification document of the applicant and his family: passport or birth certificate;
- an extract from the Unified State Register of Property or its absence;
- certificate of recognition as needing housing;
- cadastral passport.
Sometimes additional documents may be required to provide a land plot. For citizens who have an allotment for free use, it is necessary to submit a certificate of ownership of this territory to the land department.
For large families, additional information confirming their status will be required. This requirement includes a list of such papers:
- certificate of a large family;
- certificate of non-deprivation of parental rights.
For young families, an age requirement must be met - each family member should not be more than 35 years old. The marriage certificate is also transferred, and if there are children, their birth certificates.
To obtain a land plot, you need to collect all the documents necessary to provide it.
For veterans, a certificate confirming their status as a combat participant is required.

The provision of land for free use in the Moscow region, as throughout the country, is regulated by the Land Code of the Russian Federation. According to it, plots that are in state and municipal ownership, as well as lands owned by an organization with the right of permanent (perpetual) use, can be transferred to citizens free of charge.

Both individuals and legal entities, as well as individual entrepreneurs, have the right to receive a plot of land for free use.
Land is issued to the following categories of citizens and organizations:
1. Specialists
Citizens who have a certain education and work at their main place of work in the relevant specialty. The land plot is provided to specialists only for individual housing construction and private plots.
The specialist receives the land for free use for a period of up to six years.
2. Workers
There is no single list of categories of workers who are entitled to official land plots. Typically, land is provided to workers in transport, forestry, timber industry, hunting and nature reserves and national parks. Service land plots are provided to employees for free use. The period of gratuitous use of the office plot is equal to the term of the employment contract with the employee.
3. Budgetary organizations
This category includes:
- state-owned enterprises;
- centers of historical heritage of the presidents of the Russian Federation who ceased to exercise their powers;
- state authorities and local governments;
- state and municipal institutions (budgetary, government, autonomous).
Budgetary organizations can receive land for free use only for one year.
4. Non-profit organizations (NPOs)
Three groups of NPOs can receive land for free use:
- Non-profit organizations created by citizens to conduct vegetable gardening or horticulture, land is provided for a period of up to 5 years;
- NPOs created by citizens for the purpose of housing construction, the period is established by separate federal laws;
- NPOs created by constituent entities of the Russian Federation for the purpose of housing construction.
5. Religious organizations
Religious organizations can receive land for free use in two cases:
- if the land is provided for the placement of buildings and structures for religious and charitable purposes (for a period of up to 10 years);
- if there are buildings on the land that religious organizations own on the right of free use (for the period while the religious organization owns the building or structure).
6. Tenant of service housing
A citizen has the right to free use of the site on which official housing is located for the period until the lease agreement for official residential premises in the form of a residential building is terminated.

A land plot is issued for free use for the following purposes:
1. For individual housing construction, private household plots or peasant farms
Land for individual housing construction (IHC), personal subsidiary plots (LPH) and for the implementation of a peasant (farm) enterprise (peasant farm) is issued for a period of no more than 6 years. On such land, a citizen can build a house, start a personal subsidiary plot, or engage in business in the form of a peasant (farm) enterprise.
All residents of the Moscow region can obtain a plot of individual housing construction, private household plots or peasant farms.
2. For agricultural activities in forest areas
Land in forest areas is provided only for agricultural activities for one's own needs. It will not be possible to obtain land for free use for agricultural activities as a type of business on this basis. You can use land free of charge on this basis for a period of up to 5 years.
3. For hunting, forestry, agriculture and other uses
A citizen or organization can receive land for agricultural, hunting, forestry and other uses that do not involve the construction of buildings and structures on the site. For these purposes, areas allocated for defense and security needs that are temporarily unused are provided. The list of land plots that can be obtained for free use is approved by the federal authorities. It is published on the official websites of federal authorities within two weeks from the date of approval. You can get such a plot for up to 5 years.
4. In exchange for the seized land plot
If a citizen or organization owned a land plot with the right of free use and this plot was confiscated for state or municipal needs, then instead of the confiscated plot they will provide another one free of charge.

An application for obtaining a land plot can be submitted through the regional government services portal of the Russian Public State University, including through a specially organized workplace in the MFC. It can only be submitted by a citizen or organization applying for the site.
The application is processed within 15 working days. The result of the service is issued only in paper form at the MFC.
If the desired plot has not yet been formed, then the applicant must submit documents for preliminary approval of the provision of land plots, state ownership of which is not demarcated. This can also be done through the RPGU portal.

List of what needs to be provided
- Application for the provision of land.
Filled out according to a specific pattern. The header indicates where the application is being sent and the applicant’s details are entered.The text of the document contains information about the site and the essence of the request. The attached documents are also listed in the form of a register.
- An extract from the Unified State Register is ordered individually by each adult family member.
To do this, it is advisable to send a request to Rosreestr in the form of an application for the issuance of such paper. After three days, this service will provide a response in the form of a written notice. - Certificate of recognition as needing housing.
Issued by the housing policy department of the municipality. It will require a lot of papers, including a certificate of income, registration in Russia for at least 10 years, and a certificate of ownership. - Extract from the cadastral passport.
It can be obtained from the cadastral office within 3 days. You must first pay a state fee of 350 rubles. - If it is necessary to transfer the marriage certificate when considering papers for large and young families (if they were lost), they can be restored at the registry office.
To do this, you need to pay the state fee and submit an application. - Basis for obtaining the plot.
This is a document confirming the ownership of land. Such a document may be a lease agreement or an agreement to provide a site. These types of documents are drawn up by a notary, so you can get them by contacting a notary office. Also, documents can be restored to the Unified State Register.
