Crossing a double solid line in 2021 remains one of the most serious types of traffic violations in Russia. It should be noted that there have been no changes in the conditions for bringing to justice and types of punishment for such violations. In 2021, the rules that worked in 2021 and previous years continue to apply.

Types of solid lines and their purpose

Traffic rules in Russia there are two types of continuous lanes - single and double.
In any case, such a strip is a type of road marking and separates oncoming traffic lanes from each other. At the same time, from the driver’s point of view, there is no difference between crossing a single or double continuous lane.
In each of these cases, the same liability is provided. The type and amount of punishment depends on the circumstances of the violation, as well as a number of other data provided for by the administrative code.

Not considered a violation

Force Majeure

When unwanted overtaking occurs due to an emergency situation. That is, the driver resorts to maneuver to avoid a collision, run-over, due to a car breakdown and other circumstances, then such an action is not recognized as punishable. It is believed that a traffic participant acts when absolutely necessary, avoiding more serious consequences.

Overtaking standing vehicles

It happens that you have to overtake a broken down or parked car into the oncoming lane. If the roadway is narrow and it is impossible to pass such vehicles on the right, for example, on the side of the road, then this is the case when you can cross a solid one.

But it is prohibited to overtake a bus that has stopped to drop off passengers through solid markings!

Revocation of driver's license for a continuous line

Since this violation is one of the most serious, it is punishable by deprivation of a driver’s license. However, such a sanction can only be applied in three cases:

  1. Deprivation of the right for crossing a double solid line is possible when overtaking another vehicle. In this case, the driver must move into the lane intended for oncoming traffic. In addition, it should be pointed out that punishment in the form of deprivation of the right to drive a car can occur both when crossing a single or double solid line. For this violation, the law provides for liability in the form of deprivation of rights for up to 6 months.
  2. For overtaking in the oncoming lane, even if it starts on a section of road with an intermittent strip, you can lose your license for 4 months.
  3. Another case where you can lose your driver’s license for crossing a solid line is when this violation is repeated. Moreover, the punishment in this case was increased to 1 year of deprivation of rights.

IMPORTANT!

A repeated violation is considered to be committed within one year after payment of the fine for the initial one. If this period has passed, the violation will be considered as the first. If the fine has not been paid and more than a year has passed, the driver is considered held accountable and the violation will be regarded as a repeat violation.

How to properly file a complaint

According to current regulations, drivers can appeal traffic police fines within 10 days from the date the protocol comes into force. It is also important to take into account that if the owner of the vehicle disagrees with the accusations made, he must put the appropriate mark in the text of the protocol.

The request to appeal must be sent directly to the traffic police or to the district court. During the trial, the driver is likely to be found not guilty if there is no warning dotted line on the section of the road where the offense was committed. The following will also be compelling arguments:

  • The displayed sign does not meet the requirements of GOST;
  • the driver has photo or video evidence of the absence of an offense;
  • the traffic police officer lacks significant evidence to support the accusation;
  • the motorist can confirm his innocence with the testimony of witnesses.

During the trial, the driver must provide all significant evidence of his innocence. Taken together, several factors can provide the driver with a reduction in liability.

What types of fines are provided?

Deprivation of rights is possible only in the above two cases. in all other situations, a fine is imposed. Moreover, its size directly depends on the circumstances under which the violation was committed. All such situations should be considered in more detail:

  • For an intersection involving entering the oncoming lane (overtaking), in addition to deprivation of rights, a fine in the amount of 5,000 rubles may be imposed;
  • A penalty of 1 to 1.5 thousand rubles is provided for driving around an obstacle while driving into oncoming traffic;
  • If the driver makes a turn or turns into oncoming traffic, he will be given a fine in the amount of 1 to 1.5 thousand rubles.

At the same time, violations related to driving into the oncoming lane, which were recorded by cameras, are punishable by a fine of 5,000 rubles.

For a turn through a double solid line

In the case of a turning maneuver or a turn of 1780 degrees and crossing a continuous strip, a fine of 1000 to 1500 rubles is provided. It does not matter whether the stripe is single or double, the punishment can be the same.

How to mitigate the penalty for turning across a solid line

As indicated above, the fine for this violation can range from 1 to one and a half thousand rubles. In this case, the decision on the specific amount of the penalty is made by the head of the traffic police. He is obliged to take into account the mitigating circumstances provided for by the Code of Administrative Offenses of the Russian Federation. For example, if the violation is committed for the first time.

Therefore, when drawing up a protocol on site, the presence of such circumstances should be indicated in it. There is a special place for this in the protocol. Accordingly, one should not refuse explanations.

Helpful advice

There is no need to waste time when drawing up a protocol by a traffic inspector. The motorist can use these minutes to record the details of the incident on a video camera. Perhaps even the smallest circumstances of an event can benefit the accused during the proceedings.

The owner of the vehicle must record:

  • road section;
  • traffic signs installed nearby;
  • blackened markings;
  • location of the vehicle on the road.

Also, the presence of photos and video materials will eliminate the possibility of the court suspecting evasion of responsibility on the part of the car owner.

The motorist must follow the procedure for drawing up documents at the scene of the accident. The inspector is obliged to fill out papers with unambiguous formulations and real facts, and not with subjective assessments. If the driver does not agree with the specified data, he must indicate this in the protocol.

For a turn through continuous markings

The law does not distinguish between the maneuver of turning or turning across a continuous line. This violation is provided for by the same article of the Code of Administrative Offences. In this case, a turn is considered to be a maneuver made with an exit onto another road. For example, a rotation of 90 degrees. Meanwhile, a U-turn is considered to be a change of lane to another lane made at an angle of 180 degrees.

Since the punishment is provided for by one article of the Code of Administrative Offenses of the Russian Federation, it is the same - a fine from 1 to 1.5 thousand rubles.

What trajectories can be used to make a left turn through a double solid line?

A solid line, including a double one, means that any maneuvers associated with crossing it are blocked. Consequently, drivers do not have the right to make any maneuvers regardless of the trajectory of their movement. In each of such cases, a fine will be imposed. In this case, the driver’s actions will be qualified depending on how and why he crossed the solid line.

For overtaking

Overtaking, which involves entering oncoming traffic through a solid lane, is considered the most serious violation of this type. This is due to the fact that such maneuvers create an immediate risk of an accident.

Therefore, punishment is provided in the form of a fine in the amount of 5,000 rubles or deprivation of a driver’s license for up to 6 months.

For avoiding an obstacle

Avoiding an obstacle is also a violation if such a maneuver involves crossing a continuous strip. In this case, it does not matter which obstacle the driver drove around. For example, it could be a fallen pole or tree, a damaged car, and so on.

In any case, these actions constitute an offense for which a fine of up to 1,500 rubles is established.

Leaving the courtyard area

Leaving the courtyard territory is a violation of the type in question. However, this is the least serious violation. Therefore, the fine for committing it is only 500 rubles.

Ahead of the passing lane

Driving ahead in the same lane is not considered a serious traffic violation. So, if a driver gets ahead of a car using a neighboring lane of passing traffic, he may be held liable in the form of a fine of 500 rubles. It is worth noting that, according to the law, this maneuver is not overtaking, since it does not involve entering the lane of oncoming traffic and does not pose a great public danger.

Lawyer's advice on how to prove innocence

When a violation is recorded on camera, there is no point in proving anything. The only option is to prove that the camera was unreasonably installed in the appropriate location or that it was not operating properly. To do this, you will need to go to court through administrative proceedings and request a document on the technical condition of the equipment and the validity of its installation.

When drawing up a protocol, the traffic police officer must carefully check this document. Any errors, for example, in the place, date, driver details, etc., may cause the decision to impose a fine to be canceled.

Is overtaking through a continuous road allowed according to traffic regulations?

We will see the main problems right away, trying to formulate what, exactly, is “overtaking through a continuous line”?

Overtaking across a solid line is a maneuver while vehicles are moving, during which, for one reason or another, they enter oncoming traffic or sections of the roadway that are currently restricted for movement by appropriate markings.

In the title article, dedicated to all cases of intersection of solid lines, the types of this marking are discussed in detail. In order not to repeat ourselves, here we will only briefly recall its main types:

Intersection cases:

  • Markings 1.1 and 1.3 are always violations, but the penalties for them will depend on the circumstances, which we will examine in detail below.
  • Line 1.2.1, which marks the shoulder (edge of the roadway) - crossing it is possible for parking or leaving it (if this is permitted by signs or the absence of them), but is prohibited in all other cases.
  • It is permissible to cross Line 1.11 in one direction and return within the scope of this marking.

Of course, all these cases require detailed examination, which we will do later, but first a few words about markup 1.4 (solid yellow).

Is it allowed to cross the yellow solid line?

First of all, you should distinguish between yellow and orange markings. Current standards require the use of both of these colors, with fundamentally different meanings:

  • Orange markings indicate temporary action. For example, during reconstruction, repairs and other actions of a non-permanent nature. All types of road markings can be painted in orange, and if there are orange and other stripes at the same time, it is the orange ones that have priority .
  • Special areas of permanent coverage are indicated in yellow. In particular, marking 1.4 indicates that stopping is prohibited in its coverage area (and, if there are additional signs, in the coverage area of such signs).

Is it possible to cross yellow markings (that is, cross without stopping)? There is no such ban directly, but much depends on other circumstances. For example, a sidewalk can be marked with such continuous markings, then driving onto it will become a violation of Part 2 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation (driving on sidewalks entails a fine of 2,000 rubles). There may be other similar cases. But none of them fit the definition of “overtaking”, which means they have nothing to do with the topic under consideration.

Orange markings, despite their temporary nature, are completely similar to white (permanent) ones in terms of violation. Therefore, it will be considered further in the general context, without emphasis on the color of the stripe.

Overtaking or ahead?

A few more short introductions. What, exactly, is overtaking, and how does it differ from ahead:

  • Leading is moving faster than another participant in the movement, but within the lanes of your direction .
  • Overtaking is a maneuver that involves changing the position of your vehicle relative to other road users, driving into oncoming traffic .

The degree of guilt, and therefore the level of punishment when overtaking through a continuous lane, will depend on this driving into oncoming traffic.

Ask a Question

There are a few more important points to pay attention to:

  • Everything said below fully applies to two-lane roads (having one lane in each direction).
  • Traffic on three-lane roads (one lane in each direction plus one “common” in the middle) is regulated by existing markings or signs.
  • This trial has nothing to do with roads with four or more lanes.

When driving on roads with four or more lanes, overtaking is prohibited in any case .

How to appeal a punishment for crossing a continuous line

The driver has the legal right to appeal the inspector's decision. If the issue is reviewed through the traffic police, the driver is given only 10 days to resolve this issue. In this case, it is necessary to collect all the evidence that you are right and notify the inspector of your intention to appeal his decision. The last action is optional, but according to the recommendations, this is what you should do.

This is necessary to obtain the protocol and scheme of the offense. Then it is necessary to attach to the case all available evidence that the crossing of the solid line was justified. Video and photo files can be used as evidence to explain that crossing a solid line in a particular situation was inevitable for certain reasons. If the traffic police agrees with the decision of the traffic police officer, this decision should also be appealed. This issue may be considered by the Supreme Court.

Automatic registration of an offense

Cases of offenses on roads with double solid roads are automatically recorded. The practice of using photo and video surveillance cameras began in 2008. Cameras installed permanently send data to information centers, where they are processed and, if violations of the rules are detected, letters are sent to car owners informing them of the imposition of a fine. They cannot deprive rights based on data from automatic cameras.

The technical base is constantly updated, devices have been put into operation that can monitor traffic violations even in the dark, as well as control traffic lights and barriers remotely. However, cases of false alarms or failure to clearly record the license plate number of the offender still occur to this day.

Traffic police inspectors on the roads use mobile systems, sometimes radars with video recording. In this case, a diagram of the place where the administrative offense was committed is drawn up, the marking line and the vehicle traffic pattern are indicated. This scheme is an addition to the protocol on an administrative offense. It, according to Order of the Ministry of Internal Affairs No. 664, paragraph 154, is not mandatory. If available, the diagram is submitted to the court along with the rest of the case materials.

The driver must check if there are any errors in the traffic diagram. In case of disagreement, he can draw up his own scheme and petition for its use in court. You can also take photographs of the scene and bring in witnesses.

Definition

Marking lines on roads serve to divide it into several parts and are painted with white or yellow paint. If a single line is intended to divide the vehicle traffic area into two parts, in which traffic occurs in different directions, then a double continuous line according to traffic regulations is used for similar purposes, but with some features. It is necessary to delimit oncoming traffic flows:

  • if there are 4 or more lanes on the road;
  • There are less than 4 lanes on the road, but each of them is more than 3 m 75 cm wide.

In what cases can punishment be avoided?

The fine for crossing a solid line in 2021 - 2021, established by the camera, is subject to unconditional execution. Even if it is appealed, cases of satisfaction of complaints do not exceed 15 of the number of those filed.

You can avoid punishment if you can prove that overtaking began on a broken line and was completed on a solid line. In other cases, you need to look for procedural errors made when drawing up the protocol and, on their basis, seek dismissal of the case in court.

Thus, the size of the fine depends on the driver’s subsequent actions after crossing the solid line. In any case, deprivation of rights is an exceptional measure of punishment. And to minimize the consequences, it is recommended to pay fines within 20 days after the penalty is imposed.

Controversial situations on the road when crossing a double continuous line

In addition to permitted maneuvers, crossing a double solid line can be controversial - when a double solid line is crossed, it seems justified, but still violates the rules . A fine is issued, but the person understands its injustice and goes to court. In order not to waste your time and effort, you need to understand in what situations the driver really has every chance to prove that he is right.

Most often, controversial situations arise if the road markings have not been updated for a long time and have become almost invisible. If the road is unfamiliar, the driver simply could not see what he is violating when turning or crossing, and will receive a punishment through no fault of his own. You can prove that you are right not only with the help of traffic cameras, but also with the help of your own DVR. When the lines do not meet the GOST R 51256-2011 standard, the fine may be completely removed.

Do everything to prevent falsification of documents. It is worth filming the road itself, your car and the DTS car. You need to set the time and date on the camera when the protocol is drawn up. But remember, an appeal is possible only 10 days after receiving a fine or deprivation of rights - documents will not be accepted later. By the way, do not agree to a weaker punishment, because this means you admit yourself guilty.

In any case, try not to violate the ban on crossing a double solid line. Then you won’t have to think about how to appeal the case in court, prove your innocence and get behind the wheel again.

How soon will a driver receive a fine for crossing a solid line?

At the moment, there are several ways to record an offense. This can be done by traffic police officers upon crossing a solid road, or the car can be caught on camera. Traffic police officers draw up a protocol. But the cameras operate in two modes - automatic or controlled. The automatic mode records an offense, but does not create a protocol, because There is no real employee working behind the camera. The driver receives only a decision. In a controlled mode, the violation is recorded by officials and then the official draws up an administrative protocol.
