Legislative framework of the issue

The migration procedure for removing and registering citizens at their place of residence on a permanent and temporary basis is regulated by the following legislative acts:

  • Federal Law No. 5242-1-FZ of June 25, 1993 “On the right of citizens to freedom of movement” is the main regulatory document indicating the basic rules for the registration procedure, as well as the deadlines for its registration;
  • The procedure for deregistration and registration is set out in the relevant Decree of the Government of the Russian Federation No. 713 of July 17, 1995;
  • Sanctions for violating the deadlines requiring completion of registration are described in Art. 19.15 of the Code of Administrative Offenses, while the Criminal Code of the Russian Federation provides for more serious forms of punishment for offenders engaged in fictitious registration.

Common Mistakes

Mistake #1. If you do not register on time, there will be nothing for it.

Indeed, in Moscow many people work without registration, but this imposes many restrictions. In addition, during a raid, a local police officer may notice a violation, and then a fine cannot be avoided.

Mistake #2. You can register in any room.

The timing of deregistration of a person at his former place of residence directly depends on the method of performing the procedure.

The fastest option is immediate registration in another housing.

By filing this request with the Federal Migration Service, the applicant has the opportunity to be deregistered at the previous address automatically.

Discharging a person to nowhere, for example, if the owner has sold an apartment, obliges him to go through a full procedure of contacting the Federal Migration Service at his place of residence and writing a corresponding application.

In this case, the waiting period for the return of a passport with an extract stamp should not exceed 3 days from the date of acceptance of the request.

It will take about 3 days to issue an extract through the State Services service. After processing the request, the citizen is invited to the migration services office to verify documents and confirm the procedure.

How and where to register a newborn

Registration of a newborn child is a prerequisite for access to social benefits prescribed by law.

The process of registering children usually takes several days. After the procedure, a stamp is placed on the child’s birth certificate, which confirms that he is registered.

The operation is performed free of charge, but it should be taken into account that only one of the parents can register the child at the place of residence.

The registration period is 7 days after receiving the birth certificate. The certificate is received within 1 month from the date of birth. The maximum registration period is 1 month and 7 days.

Parents have the right to register their child not only at their permanent place of residence. Registration can also be carried out at the address of residential property, which is their property, but not their permanent place of residence. In case of insufficient living space, which is provided for by the standards, registration of the child is also possible.

A child can be discharged from a house or apartment only upon subsequent registration, which must be completed within 7 days.

Registration at the place of residence: how long will it take?

By submitting all the necessary documents (passport, departure sheet, title document for housing or written consent of the owner) to the passport office of the FMS authorities (or MFC) at the location of the new residence address, and writing an application (Form No. 6), citizens can expect consideration and, directly, registration of a new registration from 3 to 8 days.

It must be said that this period can last up to 30 days for a number of reasons:

  • clarification of the applicant’s status in relation to the housing property;
  • verification of the location of a new apartment (house);
  • determination of membership in the number of citizens registered with the military registration and enlistment office.

How to do it?

The registration procedure at the place of residence consists of several stages.

  1. First you need to choose a place to stay.
  2. Afterwards, obtain the consent of the owner, the tenant in municipal housing and other residents (whether it is possible to obtain temporary registration in municipal housing and how to do this is described here). It must be in writing.
  3. After this, you should prepare the necessary documents, the list of which is established by the rules of Order of the Ministry of Internal Affairs of Russia dated December 31, 2017 No. 984. Both originals and certified copies of documents can be submitted to the registration authority.
    The collected documents are sent to the registration authority. You can do this:
    • personally;
    • through a proxy;

  4. by mail;
  5. through the MFC or the State Services portal.
  6. The option for sending information is determined by the registrant himself. There is no need to pay a state fee, since the service is provided free of charge. This rule applies to both citizens of the Russian Federation and foreigners.

    Costs may only be associated with the preparation of documents, their notarization and forwarding. The deadlines for the implementation of the procedure are established for each method of transferring papers.

  7. Upon completion of the procedure, the person will receive a certificate of registration at the place of residence in Form 3, approved by Order of the Ministry of Internal Affairs of Russia dated December 31, 2021 No. 984.

Deadline for registration at place of residence after discharge


7 days is the legally established period for citizens to register a new permanent registration from the moment of discharge and arrival at the facility - a new place of residence.

If the period of residence in another city exceeds 90 days, the person is required to obtain temporary registration, limited to a specific period.

At the same time, there is no need to deregister at your permanent place of registration.

Why is it impossible to live without permanent or temporary registration in Moscow?

The term registration fell into oblivion 20 years ago with the adoption of the Law “On the Right of Citizens to Freedom of Movement...” in 1993. Official documents began to refer to this procedure as registration at the place of residence and stay. You can now live wherever you want, move wherever you want, you just have to notify the FMS authorities of your location. But it is the responsibility of citizens to inform them about this.

Length of stay without a stamp in the passport

Only the owner of the apartment, or those living in it under a social tenancy agreement, can receive a stamp in their passport indicating their place of residence. If you do not have a property document or contract, it is impossible to obtain permanent registration.

At the same time, you have the right to live without her for only 7 days. It is during this period that you must register upon arrival at your new place of residence. If this deadline is violated, the citizen will be fined up to 3 thousand.

The period can be increased, but for a valid reason, which is treatment in a hospital. Business trip or home sale. Of course, any action must be confirmed by official documents (certificate from a medical institution, sick leave, document on the sale of an apartment, travel documents).

In principle, it is possible to live without registration, but with some restrictions on social rights. The law requires obtaining a temporary registration document when residing outside your permanent place of residence for more than 90 days. Of course, there are ways to prove to the authorities that you have just arrived in the capital and are leaving soon. Also, according to the law, you do not have to obtain temporary registration when staying with close relatives. That is, you can say that you are visiting your grandmother, aunt, uncle, sister and are going home soon, then no one has the right to fine you. Of course, your relatives must confirm your relationship and the fact of your temporary residence in their own apartment.

But all these measures are temporary, and while in the capital, you will constantly worry about how not to get caught by regulatory authorities and prove the legality of your own presence in this or that living space. What does temporary registration in Moscow provide?

Official registration in Moscow for citizens of the Russian Federation makes it possible to avoid many troubles and at the same time obtain the necessary social status. You do not have temporary registration in Moscow

Lack of temporary registration in the capital when living in it for more than 90 days is an administrative violation. By law, it is punishable by a fine of five to seven thousand.

The law does not prohibit living a full social life without temporary registration in Moscow, having a permanent residence permit in another city. You can even protect yourself from employees of the Ministry of Internal Affairs by proving that you allegedly arrived in Moscow recently and are soon planning to return to your hometown. But there are moments in life when you simply cannot do without temporary registration. You cannot do without temporary registration in the following situations:

- When applying for a job. According to labor law, the employer does not have the right not to hire you due to lack of temporary registration. But in practice, it is the lack of registration in Moscow that becomes an obstacle to getting a job.

— When applying for a loan from a bank. Many financial organizations are more willing to provide loans and credits to residents of Moscow and the Moscow region. But it is almost impossible for residents registered in an area remote from the capital and who do not even have temporary registration in Moscow to get the go-ahead from the security service.

— When placing a child in an educational institution. Of course, they cannot refuse to admit your child to a school or kindergarten, but children living in the area where the institution is located have priority right of admission. So, without temporary registration in Moscow, your child will be forced to attend the educational institution that has places.
