All actions related to the redevelopment of residential premises are regulated by the Housing Code of the Russian Federation (Chapter 4) and regional regulations. Where to start designing

The owner of the premises can use it at his own discretion and dispose of it in any way without violating the rights of others. You can do it yourself:

  • install built-in furniture and household appliances (gas and electric ovens, stoves, climate control equipment);
  • change flooring, doors and window frames, glaze the balcony;
  • Replacement of utilities, central heating systems and plumbing is allowed, provided that they are in the same place and will not affect the functioning of neighboring apartments.

It is forbidden to combine a kitchen with gas equipment and a living space, or to lead unintended ducts into the ventilation shaft. It is unacceptable to engage in redevelopment that will lead to a deterioration in the performance of the premises or will pose a threat to the remaining owners (in an apartment building). Redevelopment of premises that are on the list of dilapidated housing and subject to demolition is not permitted (based on the Rules for assessing the physical deterioration of residential buildings).

When carrying out work that affects load-bearing structures, the availability of design documentation is mandatory, as is approval from a government agency (for example, when combining a bathroom and toilet room, when combining a living room with a hallway). In accordance with paragraph 1 of Art. 26 of the Housing Code of the Russian Federation, redevelopment is carried out on the basis of a decision made by the authorized bodies. The owner is obliged to take care of proper documentation before remodeling the premises.

The procedure for approving the redevelopment of an apartment is as follows:

  • a package of documents is prepared (on the ownership of real estate, project, etc.);
  • everything is handed over to the MFC;
  • after permission is received, redevelopment is carried out;
  • the acceptance committee is called;
  • Based on the results of the inspection, new documents for the property are drawn up or any violations are eliminated.

Where to contact

When applying to the MFC for permission to redevelop, the apartment owner must prepare the following:

  • passport or other identity document;
  • technical passport for the apartment;
  • documents of title (deed of gift, purchase and sale agreement, privatization certificate, inheritance certificate, etc.);
  • a project providing for a new housing layout (made in an organization that has membership in the SRO of designers with permission to carry out such work);
  • technical conclusion on the possibility of redevelopment (if the load-bearing structures are rebuilt);
  • a completed application in the form provided on the website or at the information stand at the MFC;
  • notarized power of attorney in the event that the applicant acts on behalf of the owner of the apartment.

When residential premises are used under social rental conditions (not privatized and owned by the municipality or government agencies), it is necessary to provide a certificate of family composition and written consent of all tenants registered at this address.

After completing the repairs, you should contact the acceptance committee, which will evaluate the amount of work done and compare it with the plan provided for in the project (Article 28 of the Housing Code of the Russian Federation). At the end of the inspection, an acceptance committee report is drawn up, which indicates compliance with the prescribed construction and installation standards.

In a situation where certain violations or undeclared redevelopment are discovered, an act will be drawn up to identify illegal actions. Usually the commission includes one inspector, but if the redevelopment affects the common property of the homeowners, then representatives of the Management Company may participate.

The acceptance committee report contains the following information:

  • information about the persons who checked the actions for redevelopment of the home;
  • list of work performed and completion dates;
  • compliance with project documentation;
  • results of inspection and verification.

After receiving the acceptance committee’s act, the owner must contact Rosreestr (you can also use the MFC) to issue new documents for the property, taking into account the work performed. In a month, everything will be ready, and this will help get rid of unnecessary problems when re-registering housing or conducting purchase and sale transactions.

Actions after receiving permission

The permission received from the MFC is the start of construction work. After completing the final work, you must:

  • The owner of the apartment fills out the work log with his own hand. It is issued along with permission for redevelopment. All types of construction work carried out must be entered into the journal;
  • the apartment owner fills out the “Hidden Work Act”, which indicates the work listed in the log;
  • the actual volume of work performed is signed by an employee of the construction organization that carried out the redevelopment;
  • The commission will issue an acceptance certificate for the completed redevelopment. The certificate will be issued if the work is completed in accordance with the project. If changes were made during the repair, the act will not be signed and all innovations must be agreed upon again;

  • An application for amendments to cadastral registration is submitted to the MFC. The waiting period is 5 days.

How to obtain a certificate of completed work?

After completion of the work, you need to apply for the acceptance committee to issue a certificate of completed reconstruction and (or) redevelopment of the premises. An application for registration of the act must be submitted before the decision to approve the redevelopment expires.

An application for drawing up an act of completed reconstruction and redevelopment can be submitted by the owner of the premises or the person occupying it under a social tenancy agreement. The interests of the applicant may be represented by his legal representative or a representative by proxy from a notary.

To submit a request you will need:

  • an application for the acceptance committee to issue a certificate of completed reconstruction and (or) redevelopment of the premises;
  • identification document of the applicant;
  • identification document of the applicant’s representative, if the application will be submitted by a representative;
  • a document confirming the authority of the applicant’s representative if the application will be submitted by a representative (notarized power of attorney);
  • if, as part of the redevelopment, work was carried out that required prior approval:
  • a work production log, drawn up in accordance with all the requirements for maintaining a work production log, issuing acts for hidden work and carrying out designer supervision;
  • certificates of inspection of hidden work, signed by the design organization that prepared the redevelopment project;
  • If during the redevelopment there was no work requiring prior approval, you will need:
  • title documents for the premises in which the redevelopment will be carried out, if the right to it is not registered in the Unified State Register of Real Estate (USRN);
  • accounting and technical documentation for the premises: residential or non-residential - needed if the information is not in the base register; if this information is available in the base register, you can submit documents on your own initiative;
  • floor plan and explanation of the floor plan after the reconstruction and (or) redevelopment;
  • written consent of all family members of the tenant (if the premises are on social rent) or the owner (if the premises are owned); the exception is non-residential premises owned by the city of Moscow.

With the prepared package of documents, you can submit an application for execution of the act:

  • anywhere, regardless of your place of registration and location of the premises;
  • online at mos.ru. In this case, all documents are attached as scanned copies.

After your request is registered with the Moscow Housing Inspectorate, the process of verifying information and interdepartmental interaction will begin. If it turns out that any information cannot be obtained through interdepartmental cooperation, you will be asked to provide it yourself.

Then the day and time for the commission inspection will be agreed upon with you.

How to extend the validity period of a redevelopment permit?

The validity period of the decision to approve redevelopment is 1 year from the date of its signing. During this time, you need to have time not only to carry out all the work, but also to submit an application for a certificate of completed work.

If necessary, you can extend the validity period of the decision. This can be done once and for no more than 6 months.

How long to wait for the result

After the application is filled out and all the necessary documents are attached, the MFC employee issues a receipt with a registration number, by which you can track the status of the application. If the decision is negative, references must be made to regulations that limit the possibility of redevelopment. If the result is positive, they begin repairing and remodeling the apartment in accordance with the proposed project.

The validity period of the permit is limited - lasts for 1 year. If necessary, the owner has the right to contact the MFC again to obtain a new permit.

If the homeowner disagrees with the refusal to issue permission for redevelopment or with the acceptance committee’s act, he has the right to apply to the courts to protect his interests. To do this, in addition to your own arguments, you will have to involve the opinions of experts and specialists in the field of housing construction.

The statement of claim is submitted at the place of residence with the necessary documents attached (specified in the list when applying to the MFC and an expert opinion).

In addition, you may need a written opinion from organizations such as water utilities, fire inspectors, electrical networks, and sanitary and epidemiological stations. In practice, such cases are considered for at least six months from the date of filing the claim.

How to apply for redevelopment through the State Services portal

In order to submit documents for redevelopment through the State Services portal, you need to perform several actions:

  • register or log in to this site, go to your personal account;
  • select the appropriate section and place scanned documents;
  • after permission for redevelopment, carry out the necessary work;
  • call the acceptance committee to draw up a report on the results of the repair;
  • reissue documents (technical passport).

If the planning was carried out without prior permission, then a similar procedure is carried out with the preparation of documents and the drawing up of an act by the acceptance committee, which issues a fine. After this, all documents, along with a receipt for payment of the fine, are submitted to the MFC to legitimize the redevelopment.

When controversial issues arise between neighbors regarding the work carried out, citizens can express their disagreement by contacting the housing inspectorate or a specialized committee in local government.

The cheapest way to register a small redevelopment is through the BTI. This will cost 5,000 rubles or even less. If neither you nor the bureau have a technical passport, you will need to create one. It will cost 2,000 rubles and will take 10 days.

Serious redevelopment requires the creation of an individual project. It usually costs from 10,000 rubles and above.

If the apartment was changed without the appropriate permits and approvals, then you will have to spend 25,000 rubles on legalization in court.
