Often, conflicts with neighbors give rise to questions about the boundaries of the property and misunderstanding about whose fence is installed between the plots. The construction of a fence entails considerable financial expenses, including subsequent repairs. Often land owners do not know how to resolve issues with neighbors, which leads to litigation. The owners of the land decide among themselves who should erect a fence between neighbors, for example, in a private house or on a summer cottage, but the law cannot force the owner of a particular plot to erect a fence.

Determining who should install the fence
The main problem that owners of land plots face is determining the responsibility and ownership of the fencing of the site. The fence must be made to draw boundaries and security on the territory.

But just the desire to build a fence is not enough. You need to know the law, sanitary and fire regulations.
You also need to understand the construction process itself, which will help you plan everything correctly and in advance.
Despite the fact that there is no mandatory requirement in the law to erect a fence between neighbors, as a rule, the owners themselves strive to mark the boundaries of their land, preventing random passers-by and strangers from entering it. When the owner does not want to have fences between his and his neighbors’ plots, no one can force him to do so.
In addition, if the seller of the plot has built a fence from neighbors, then after transferring the land to the next owner, he has the right to do with it at his own discretion, up to dismantling and complete destruction.
It is necessary to stipulate in advance the fate of the common fence when selling land, and, preferably, add it as an additional condition to the subject of the transaction. This step will eliminate further conflicts with neighbors about who is the owner of the fence and who has the right to dispose of it.
