Marriage registration is not only a romantic act, but also a legal procedure, the observance of which ensures that the couple becomes a family at the official level. Not only Russians, but also foreign citizens and even stateless persons can register their marriage in Russia. This procedure is performed if there is mutual consent on the part of the bride and groom, as well as if they have reached marriageable age. In Russia, this age starts at 16 years old, but if foreigners want to get married, the age will be determined according to the legislation of their state. For some countries it is 18 years. The main thing is that entering into a relationship does not contradict compliance with the terms of the Family Code.
Rules for registering marriage
Previously, it was necessary to draw up documents 30-60 days before marriage, now future spouses can independently choose a convenient date.
Just 7 years ago, marriage was registered only at the place of registration or registration; now this rule does not apply. What to do then?
If registry office employees refuse to accept an application in another district or city, write a complaint addressed to the boss or go to court. Request that the refusal be made in writing, indicating the reason. The complaint is considered in 5-10 days, but the trial will drag on for 2 months.
Another important point.
Some couples apply to two or three registry offices at once because they do not know where they will live on their wedding day. This is permitted by law, but you will have to pay a state fee for each application submitted. Through public services you can submit an application only to 1 registry office.

Reasons for refusal

Types of ceremonies

What do the registry office give when submitting an application?

What documents need to be submitted to the registry office along with the application?

State duty
In 2021, the state fee for registering a relationship is 350 rubles. If you submit documents via the Internet or government services, then pay 245 rubles (with a 30% discount).

Which surname should I choose?
The marriage certificate contains information about the last name of each spouse. In the event that a woman has changed her last name, she will have to replace her internal civil passport and foreign passport.
Note!
If there are other documents containing the premarital surname (diplomas, title documents for property), there is no need to replace them. It is enough to present a marriage certificate.
The parties must indicate their choice in the application, however, in the process of family relations, surnames may be changed several times.
There is a restriction for choosing a double family name - if at least one of the citizens had a double surname, they are deprived of the right to make such a choice.
Documentation
In addition to the application, you will be required to provide the following documents:
- The identification document is a passport, although in some cases a sailor's passport or military ID will do.
- A document authorizing persons to marry is provided if one of the future spouses has not reached the age of marriage of 18 years.
- A document confirming that the previous marriage has been dissolved - it is provided by citizens who were previously in a marital relationship. In most cases, a divorce certificate or death certificate of the previous spouse will suffice.
- If there is a foreigner in the couple , a foreign passport and translation of all documents will be required.
And one more important detail.
If you submit an application to the same registry office where your previous marriage was dissolved, then you do not need to present a certificate of dissolution.
Girls change their last name after marriage to their spouse’s last name in 60% of cases. But you can take a double surname, for example, Ivanova-Pankratova.

On what days are applications accepted?
Since registry offices are government agencies, they are required to obey labor laws. Many people think that Saturday is a reception day, since weddings most often take place on Saturday.
But this is not true, most registry offices will register your application only from Monday to Friday, and Saturday and Sunday will be days off.

Usually there is no need to send an application to another city, because the bride and groom have the right to choose any registry office they like, located nearby. But you must keep in mind that you will have to use postal services if you need a duplicate marriage certificate , for example, if lost, or archival certificates to confirm a previous divorce or death of a former spouse.

Reasons for refusal
Failure to comply with the requirements for future spouses may be grounds for marriage.

Please note that currently the application does not have to be written by hand in person at the registry office. You can apply through the EPGU - a web resource that allows you to order online government services from issuing a new passport to making an appointment with a doctor.

Apply alone, without a fiancé
A common situation is that the groom cannot come to the registry office with the bride to submit documents. This happens when a man goes on a business trip, serves in military service, is in another country, or is serving a sentence in prison.
The bride can submit documents alone; to do this, the groom goes to a notary and has the application certified. It is then given or mailed to the bride. At the same time, the girl fills out a second application with her data.
After both steps are completed, go to the registry office. If the groom is seriously ill or is in the hospital, then call a notary or a civil registry office employee to see him at the hospital or at home.
If the bride or groom is a citizen of another state, then have the application certified at the consulate.
During pregnancy
If the bride is pregnant, the registry office staff will register the relationship even on the same day. You just need to bring with you a certificate from the antenatal clinic, which will confirm this fact. The document states:
- the name of the hospital where the girl was examined;
- passport information of the bride;
- gestational age in weeks;
- date of receipt of the certificate;
- information about the doctor who conducted the examination;

Conditions
Not everyone can get married. According to the law, there are certain rules:
- The future husband and wife must be adults;
- Spouses must have legal capacity;
- If one of the couple was in a previous marriage, then the registration must be cancelled. What do minors need?
According to the law, if minors who are over 16 years of age wish to legalize a relationship, then parental permission is required under federal law. This point regarding the permissible age or required papers can be adjusted at the regional level.

With a foreigner
To complete an application to enter into official relations with a foreign citizen, you need to collect the following package of important papers in advance:
- identity cards of future spouses;
- translation of a foreigner’s passport certified by a notary;
- marriage tax payment receipt;
- a document confirming the absence of a legal wife;
- certificate of divorce, if it was concluded;
- registration of a foreigner or residence permit, if the future husband is not a resident of a country that has a visa-free regime.
All of the listed documents are basic in the case of registering a marriage with a foreigner. Without them, the registry office will refuse the procedure. All documents in a foreign language must have a translation certified by a notary. Or there must be a mark indicating that the documents are recognized as legal in Russia.
With a prisoner
To marry a person who is in prison, you need to prepare the following documents:
- ID cards;
- certificate of divorce from a previous marriage (if there was one);
- marriage license for minors.
You must first go to the registry office and take an application form. After this, you need to go to the place where the prisoner is staying. He must participate in filling out the application in the presence of a notary. The marriage will take place in a place where it will be convenient for the staff of the registry office, as well as the prison. This is usually a separate meeting room.
Remember the main thing:
- Agree on the wedding date with the bride or groom.
- The application can be submitted through government services or downloaded and filled out at home.
- Pay a state fee of 350 rubles or a discount through government services of 245 rubles.
- The date can be chosen 12 months before the wedding. If the bride is pregnant, then they can schedule the ceremony the next day.
- Both newlyweds must be at least 18 years old. If the bride is pregnant, you can get a marriage license at 16 years old.
- Come to register your marriage on the appointed day and time, take your passports with you.
Deadlines for submitting an application to the registry office
Based on the innovations that came into force in October 2021, it is permissible to submit an application twelve months before the intended wedding.
Along with this, the marriage will not be registered earlier than thirty days later. Exceptions when the union is formalized earlier include:
- birth of a child;
- pregnancy;
- serious illness of one of the future spouses.

If you want to formalize the relationship as soon as possible, that is, not set a wedding day in a year, but get married in a month, then it is better to come in the morning.
