A claim to the Criminal Code for uncompleted work is submitted by analogy with poor-quality provision of services.

The Gosstroy decree applies to all institutions that have undertaken obligations to maintain apartment buildings. Its norms and requirements must be taken into account by providers of cleaning services, and consumers of these services - residents of houses - should also be aware of them. If the local area is poorly cleaned, you should not remain indifferent and wait for the janitors to show consciousness.

A dirty, abandoned yard is not only an aesthetic issue. Being in such territory is both unpleasant and dangerous. Children cannot play here; it is difficult to find comfortable conditions for a pleasant stay . Who can you complain to about the poor, irresponsible work of janitors in Moscow or another locality?

ATTENTION! If the management company is responsible for the maintenance of the apartment building under the contract, claims, first of all, should be addressed to its management.

There is a standard sample document for a complaint against a janitor; it can be obtained from the Criminal Code itself or on websites related to housing and communal services. The complaint must be made in writing and registered with the company. It can be on behalf of one homeowner in the house or on behalf of the entire group of residents.

If it is not possible to find a sample, you can make a claim in any form, but the document must contain basic data. This is information about the person to whom the claim is sent, information about the applicant, accurate and reliable data about the fact of poor performance of cleaning work.

It is necessary to indicate the fact of violation of the service agreement, the requirements of housing and communal services legislation. The complaint must be drawn up in two copies. One is transferred to the management of the Management Company, the other remains with the applicant. Both copies must have a mark indicating registration and receipt.

Procedure in case of non-compliance with requirements or failure to correct violations

There are not isolated cases when the Criminal Code refuses to satisfy the requirements set out in the complaint, citing far-fetched arguments, or completely omits inconvenient moments for itself, pretending that there are no shortcomings or violations. The applicant can either back down or contact other competent authorities until the case is brought to court. In the latter case, it is worth taking care of the evidence base in order to sway the court on your side.

Evidence of violation

The fact of violation must be recorded; this will be fundamental evidence in court. So, if there was no response from the Criminal Code to the received document and the response was not sent to the applicant on time, this will already be significant evidence of violations on the part of the Criminal Code.

If the problem is resolved on paper, but in fact everything remains unchanged, then the most optimal way would be to draw up an act.

The applicant leaves a violation report in his own hand, which must be certified. The certification procedure consists of signing such an act by members of the council of the apartment building or neighbors.
